3 I. Detailed scope of work : (For detail, please refer page No.8-11). III. PREPARATION OF BIDS Technical and financial Bids. The bids are to be submitted in two parts in separate sealed envelopes (a) Part-I (Technical Bid) (b) Part-II(Financial Bid) Technical Bid: The Technical bids should contain the following. a) EMD of `10, b) Cost of tender document fee in the prescribed form (if the tender Document down loaded from the web site) or Paid Voucher Receipt (if, the Tender Document is obtained from the office on payment) c) Document in support of the tenderer being a registered hotelier (Or) a contractor having experience in running Hotel/catering services/canteen for at least one year on or after The contractor claiming experience of running PMB canteen is also required to submit satisfactory performance certificate. d) The tenderer must sign with seal each page of the Tender document mentioning the name in capital letters at the prescribed locations and submit the tender document duly signed with seal along with the Technical bid as token of acceptance of tender terms & conditions. 6 T E N D E R N O T I C E No: PMB/Civil/Tender/212 Port Blair, dated On behalf of President of India, Chief Port Administrator, Port Management Board invites sealed tenders for Running of port canteen at Havelock jetty from registered hoteliers or contractors having experience in running a Hotel /catering services/canteen, for a period of 01 (one) year, which on satisfactory execution shall be extendable for one more year. S. Description Earnest Money Cost of Tender No. Documents 1. Running of port canteen at `10, ` Havelock jetty. 2. Tender document may be obtained from Port Management Board, Port Blair by hand on payment of `250/- per set or by registered post on payment of `250/- per. The payment for obtaining tender document can be made either by cash or by demand draft drawn in favour of Accounts officer, Port Management Board, A&N Islands. The entire Tender Document is also hosted in the official website of the A&N Administration which can be downloaded by the interested Tenderers. Payment of ` towards the cost of Tender Document should invariably be submitted in the form of Demand Draft drawn in favour of the Accounts Officer(PMB), in a separate sealed envelope superscribed as Cost towards tender document must place it in the cover containing the Part I and Part II offers, otherwise your offer submitted will be summarily rejected. Receipt of application for issue of Tender document will be closed at 1200Hrs on The sale of Tender documents will be closed at 1200Hrs on The tenders will be received up to 1530Hrs on and will be opened on the same day at 1600Hrs in the presence of intending Tenderer. 6. The Chief Port Administrator, Port Management Board, Andaman & Nicobar Islands reserves the right to accept or reject any or all the tenders without assigning any reasons thereof and also does not bind himself to accept the highest tender. Cooking/ Preparation of items is permitted inside the canteen premises. 3. Usage of electric hot case for preserving the food is permitted. 4. Usage of LPG burner stove for cooking is permitted. However, usage of kerosene/ burner stove or any other conventional type etc. is strictly prohibited. 5. The canteen staff should wear clean apron and suitable gloves while cooking and serving. 6. Clean filtered drinking water will have to be provided free of cost to the customers on demand. Page 9 of 22

10 7. The sweeping & Cleaning works are to be carried out as and when required to keep the canteen Hygienically clean at least twice a day. 8. Periodical cleaning of water storage tanks etc atleast once in a month or as and when required by the department to provide safe drinking water to the users. 9. Periodical medical examination of canteen staff for communicable diseases, obtained from Competent Authority shall be displayed in the prominent place inside the canteen. 10. The normal working hours of the canteen shall be 0500 Hrs to 1700hrs. on all week days including holidays. However, the contractor shall make the canteen facilities available beyond 1700hrs when required. 11. Only ISI/FPO approved oil preventives and colours will be permitted in cooking. 13. Water supply will be provided by the department free of charge and Electricity is required to be arranged by contractor. 14. Two Nos. Garbage bin have to be kept by the contractor, one inside the canteen and one outside the canteen and to be cleaned twice a day and disposed of in the nearby garbage disposal bin of local Municipal council, and Never Repeat Never to be dumped in the sea. 15. No contractors item will be kept outside the canteen. 16. Subletting of the canteen is not permitted. 17. The Canteen staff must behave well with the users and neatly dressed. 18. Contractor must display approved rates in a prominent place. 19. The utensils etc required for cooking & serving etc will have to be provided by the Contractor. Page 10 of 22

11 20. The contractor should follow the statutory provisions of labour laws such as implementation of labour law and obtaining license from the labour enforcement office(s)and licensing officer, Port Blair. 21. The contractor should ensure that the waste is disposed off as per norms and there is no direct discharge into sea. 22. The contractor may employ adequate number of employees at his expense for smooth and efficient running of the canteen. He is responsible for proper and polite behavior of his employees in the canteen towards staff and canteen committee members/ representatives/ guests. 23. The canteen must be kept clean and in hygienic condition. The staff of canteen must dress neatly and maintain personal cleanliness. It is the responsibility of the contractor to get the utensils cleaned and sterilized before use. Any disregard to these will attract penalty as decided by the CPA, PMB. 24. The contractor will ensure that performance of the canteen is up to the satisfaction of the customers and the service of the canteen staff is prompt and there is no undue delay. Note: - Selling of Cigarettes, Pan, Pan Parag, Gutka, & Liquor is strictly prohibited. Page 11 of 22

12 Terms & Conditions 1. The Tenderer has to Offer the MONTHLY HIGHEST BID in the Schedule of Price Offer prescribed at page No. 15 of this Tender document. The Monthly highest bid, offered by the contractor is inclusive of Water Charges and exclusive of Electricity charges, which the contractor is required to arrange. 2. Agreement shall be drawn on non judicial stamp paper with the successful contractor within 15 days, after the award of the work. If the successful contractor fails to sign the contract agreement within the stipulated period of 15 days, EMD submitted by the firm shall be forfeited and offer of the firm shall be terminated. The contractor shall quote his rates as per various terms and conditions which will form part of the agreement. 3. The contract is valid for a period of 01(one) year, which on satisfactory completion is extendable for one more year. The contract shall be cancelled any time within the contract period for non-satisfactory performance or any other reasons deemed fit by Chief Port Administrator. 4. Tender document consists of scope work and the set of terms and condition of contracts to be complied with by the tenderer can be obtained from the office of the Assistant Engineer (P&S) during office on all working days. Except Saturday, Sundays and Public Holidays. Tender documents, will be issued to the contractors from this office only on payment of Rs. 250/- (Rupees two hundred fifty only, Non refundable). 5. The tender shall be accompanied by the earnest money/bid security (unless exempted) of `10,000/- (Rupees Ten Thousand only) in the form of call deposit receipt, Account Payee Demand Draft, Fixed Deposit Receipt, Banker's Cheque or Bank Guarantee from any of the commercial banks in Page 12 of 22

13 an acceptable form drawn in favour of Accounts officer, Port Management Board. A contractor exempted from depositing earnest money in the individual cases shall attach with the tender an attested copy of the letter exempting him from depositing earnest money and shall produce the original when called upon to do so. If the Technical bid is not found in order, price offer will not be opened and offer of the firm will be considered as rejected. 6. The earnest money of successful tender or 10% of contractual cost whichever is higher will be held as security deposit till the completion of Contract period. If the contractor is unsuccessful in completion of work as per the agreement or withdraws his tender or makes any modification in the terms & conditions of the tender which is not acceptable to the department, the Government shall, without prejudice to any other right or remedy be at liberty to forfeit 100% of the said earnest money/security deposit. 7. In the financial bid the bidders must quote the rates in figures as well as in words. If there is any discrepancy between the price quoted in figures and words whichever is the higher of the two shall be taken as the bid price. 8. The contractor shall consider the employment of the persons in the canteen and paying them monthly salaries at the rate negotiated by him directly with them. No payment will be made by PMB to staff employed by the contractor. The contractor only is exclusively responsible for taking prescribed charge from staff. 9. The staff employed by the contractor shall never be treated as the staff of either permanent nature or of a daily wager appointed by or on behalf of the PMB and the PMB shall never be liable for any service conditions or any reinstatement. It will be the sole liability of the contractor. Page 13 of 22

14 10. The PMB authority will not reimburse any charges/compensation for the loss of his materials or the injuries suffered by the self and/ or the employees of the contractor. 11. Contractor has to make arrangement for the kitchen equipment and crockery. 12. No subsidy of any kind will be provided by the Department to the contractor. 13. The contract will ensure all safety measures including Fire Risk due to equipment/oven/fridge etc. being used in the Canteen premises. 14. The modern state of the art equipment should be used for running the canteen, cafeteria, kitchen, etc. maintaining hygienic conditions as per the latest methods for operating the same. 15. The Contract is responsible for obtaining all required Licenses from the Local Bodies. 16. No child labour should be employed by the contractor. 17. The contractor will be responsible for the safety and insurance of labours, machinery, equipment tools & plants and their properties deployed or employed by him. Port Management Board shall be held responsible for loss of life or property or safety of the labourers, machinery and equipment at sea and land. 18. Except writing rates and amount, the bidder should not make any changes, additions, alterations and modifications in the printed forms of tender document. 19. The contractor would be bound to replace such worker(s) whose conduct and services are not found satisfactory by the Chief Port Administrator, Port Management Board, Andaman & Nicobar Islands. 15 20. The Security Money deposited will be liable to be forfeited or appropriated in the event of unsatisfactory performance of the contract and loss or damage, if any, sustained by the department on account of failure or negligence on part of any of labour of the contractor. 21.That it is expressly understood and agreed to between the parties to this tender that the persons deployed by the contractor periodically for the above work shall be employee of the contractor for all intents and purposes and in no case, shall a relationship of employers and employee between the said persons and PMB shall accrue implicitly and explicitly. 22.The contractor shall keep Port Management Board, Andaman & Nicobar Islands indemnify against all claims whatsoever in respect of employees deployed by the contractor. In case any employee of the contractor so deployed enter into dispute of any nature whatsoever, it will be the prior responsibility of the contractor to contest the case and that, the Port Management Board, Andaman & Nicobar Islands will be reimbursed for the actual expenses incurred towards council fee and other expenses etc. which will be paid in advance by the contractor to Port Management Board on demand. Further the contractor shall ensure that no financial or any other liability is attached to the Port Management Board. 23.The Chief Port Administrator or any other officer authorized by the office shall be at liberty to carry out surprise checks on the works of the contractor in order to ensure that the work is properly carried out. 24. The antecedents of staff deployed by the contractor under this contract duly verified by the Police authorities shall be submitted to this office for record. 25. The services of workers will be required for seven days a week basis. Page 15 of 22

16 26. No employee of the contractor shall be allowed to stay in Port premises beyond the stipulated time or create any temporary shelter. 27. The workers of the contractor should not be below the age of 18 years and above the age of 60 years as on the date of contract is effective. 28. Contractor should ensure payment of his workers as per Minimum Wages Act as applicable to Andaman & Nicobar Islands. The contractor will have to ensure payment of EPF for its employees engaged during the contract period. 29. Mode of Payment:- The mode of payment shall be on monthly basis. The successful bidder must deposit the monthly rent or before 07 th of every month. The contractual cost is exclusive of service tax, the contractor is required to pay service tax at the applicable rates. Non-payment of dues, within due date is liable for payment of fine at the rate of ` per day up to maximum of 10% of the contractual cost, after attaining maximum of 10% of the contractual cost the contract is liable for termination. 30. Liquidated damages: On Damage to port infrastructures: The Contractor will be responsible for damages inflicted to the existing port Infra structural facilities, accidentally or otherwise during contract period. Any damages to the structures as a whole or a part otherwise to the Port Infra structure shall be made good by PMB through ALHW and expenses towards such repairs must be wholly borne by the Contractor. 17 On Non- Satisfactory execution of work: Non satisfactory execution of work contained in the scope of work of tender document and non compliance of works entered in the Inspection register by the contractor during the Contract period, after the stipulated period if the works remains uncompleted, the liquidated damages shall be 5% of highest accepted bid amount for each un-complied work. 31. The contractor should follow the statutory provision of labour laws such as implementation of labour law and obtaining license from the labour enforcement office(s)and licensing officer, Port Blair. 32. The competent authority on behalf of President of India does not bind himself to accept the highest or any other tender and reserves to himself the authority to reject any or all of the tenders received without the assignment of a reason. All tenders in which any of the prescribed conditions are not fulfilled or are in complete in any respect are liable to be rejected. 33. Canvassing whether directly or indirectly in connection with tenders is strictly prohibited and tenders submitted by the contractors who resort to canvassing will be liable to rejection. 34. The competent authority on behalf of President of India reserves to himself the right of accepting the whole or any part of the tender and the tenderer shall be bound to perform the same at the amounts quoted. 35. The tender for the works shall remain open for acceptance for a period of 60days(sixty days) from the date of opening of tenders. If any, tenderer withdraw his tender before the said period or makes any modifications in the terms & conditions of the tender which are not acceptable to the department, then the government shall, without prejudice to any other right Page 17 of 22

18 or remedy, be at liberty to forfeit 100% of the said earnest money as aforesaid. 36. The Contract is liable for termination/ cancellation within the contract period against non-satisfactory execution or performance of work contained in the scope of work of agreement and the security deposit held by the government will be forfeited. 37. The Chief Port Administrator, Port Management Board, Andaman & Nicobar Islands reserves to himself the right to cancel or terminate the contract within the contract period, without assigning any reasons thereof. 38. The contractor is required to obtain the Security Pass for the workers employed for running of canteen on payment of prescribed fees. 39. Notice Inviting Tender shall form a part of the contract document. The successful tenderer / contractor on acceptance of his tender by the Accepting Authority, shall within 15 days from the stipulated date of start of the work sign the contract consisting of :- 40. The Notice Inviting Tender, all the documents including additional conditions, specifications and special condition, if any, forming the tender as issued at the time of invitation of tender and acceptance thereof together with any correspondence thereto. 41. Settlement of Disputes and Arbitration: Except where otherwise provided in the Contract Agreement all questions and disputes relating to the contract and the instructions here-in before mentioned and as to the quality of workmanship or materials used on the work or as to any other questions, claim, right, matter or thing whatsoever in anyway arising out of or relating to the contract, drawing, instructions, orders, or those condition or otherwise concerning the work or the execution Page 18 of 22

19 or failure to execute the same whether arising during the progress of the work or after cancellation, termination, completion or abandonment thereof shall be dealt with as mentioned herein after : (a) Any dispute arising out of this Agreement shall at the first instance be tried to be resolved by the officers designated and authorized by both the parities. Such officers of both parties shall sit together and to resolve any dispute arising out of this agreement in equitable manner and to exercise the authority of the party to make decision by mutual agreement. (b) If the dispute cannot be settled by 30 days by mutual agreement the matter shall be referred to a Sole Arbitrator at Port Blair to be appointed by Hon ble Lt. Governor, A & N Islands in accordance with the provisions of the Arbitration and Conciliation Act, 1996, and the cost of arbitration shall be shared by the parties equally. (c) The arbitrator appointed under this clause shall pass his award with in a period of six month from the date of reference made to him. Subject as aforesaid, the provisions of the Arbitration and conciliation Act, 1996, shall apply to the Arbitration proceedings under this clause and the arbitration proceeding shall be held at Port Blair. (d) Above all, any dispute or differences shall be referred to the jurisdiction of District Court, Port Blair. 42. Commencement of the Contract This contract will come into force for a period of one year, (12 months), after signing an agreement between the two parties. 43. Termination of the contract That this contract may be terminated on any one of the following contingencies Page 19 of 22

20 (a) On the expiry of the contract. (b) By giving one month notice due to : i The non- satisfactory performance. ii Breech of contract of any of the terms & conditions of the agreement on assigning the contract or any part thereof or benefit or interest therein or hereunder by the contractor to any third party for subletting whole or part of the contract to any third party. (c) On the contractor being declared as insolvent by the court of law. 44. During the period for termination of contract in the situation contemplated above, the contractor shall keep discharging his duties as before till the expiry of notice period. It shall be the duty of the contractor to remove all the persons deployed by him on termination of the contract on any ground whatsoever and to ensure that no person creates any disruption/ hindrance/ problem of any nature to PMB /A&N Administration.
