CASE OFFICER Ms Astrid Jahn REFUSED for the reason: 1. The development by virtue of the appearance, style, plot size to building ratio, height and massing of the proposed new dwellings would contrast badly with the nearby Listed buildings (namely Wealden and Elizabethan Cottage ), in addition, and as a consequence of these factors also adversely affect the rural setting and character of, the nearby Listed buildings. The proposal therefore fails to make a positive contribution to sustaining or enhancing the significance of the heritage asset and therefore results in substantial harm to the setting of these Listed buildings. The proposal is contrary to Policy E9 of the Test Valley Borough Revised Local Plan (2016), the National Planning Policy Framework, and the Michelmersh and Timsbury Village Design Statement SPD. Reason: To comply with the provision of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans. Site/Block Plan Drg No. SIMO003/3 Extension Elevations and Floor Plans Drg No. SIMO001 Proposed Elevations and Floor Plans Drg No. SIMO002/3 Reason: For the avoidance of doubt and in the interests of proper planning. 3. The external materials to be used in the construction of all external surfaces of the development hereby permitted shall match in type, colour and texture those used in the existing building. Reason: To ensure a satisfactory visual relationship of the new development with the existing in accordance with Test Valley Borough Revised Local Plan (2016) Policy E1. 4. No development (including site clearance and any other preparatory works) shall take place until a scheme detailing how the hedging along the western boundary to be retained is to be protected has been submitted to and approved in writing by the Local Planning Authority. Such a scheme shall include a plan showing the location and specification of any protective fencing, ground protection or other precautionary measures as informed by British Standard 5837:2012. Such protection measures shall be installed prior to any other site operations and at least 2 working days notice shall be given to the Local Planning Authority. 93

5 The protection installed in discharge of this condition shall be retained and maintained for the full duration of works or until such time as agreed in writing with the Local Planning Authority. No activities whatsoever shall take place within the protected areas without the prior written agreement of the Local Planning Authority. Reason: To ensure the enhancement of the development by the retention of existing natural features during the construction phase in accordance with Test Valley Borough Local Plan policy DES08. Notes to applicant: 1. In reaching this decision Test Valley Borough Council (TVBC) has had regard to paragraphs 186 and 187 of the National Planning Policy Framework and takes a positive and proactive approach to development proposals focused on solutions. TVBC work with applicants and their agents in a positive and proactive manner offering a pre-application advice service and updating applicants/agents of issues that may arise in dealing with the application and where possible suggesting solutions. 2. Bats and their roosts receive strict legal protection under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2010 (as amended). All work must stop immediately if bats, or evidence of bat presence (e.g. droppings, bat carcasses or insect remains), are encountered at any point during this development. 6 3. The existing hedgerows and vegetation marked X - X on plan number TVBC16/01043/FULLS Plan 1 shall be retained. Any plants which die within a five year period shall be replaced unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure maintenance of an appropriate boundary treatment to protect the character and appearance of the area in accordance with Test Valley Borough Revised Local Plan 2016 policies E1 and E2. 4. The site outlined in red on plan number 3 (Location Plan) shall only be used as a garden in relation to the dwelling currently known as The New House and for no other purpose whatsoever. Reason: In order that the Local Planning Authority can exercise control in the locality in the interest of the local amenities in accordance with Test Valley Borough Revised Local Plan 2016 policies E1, E2 and LHW4. Notes to applicant: 1. The development hereby permitted shall be carried out and completed strictly in accordance with the submitted plans, specifications and written particulars for which permission is hereby granted or which are subsequently submitted to, and approved in writing by, the Local Planning Authority and in compliance with any conditions imposed by the Local Planning Authority. 2. In reaching this decision Test Valley Borough Council (TVBC) has had regard to paragraphs 186 and 187 of the National Planning Policy Framework and takes a positive and proactive approach to development proposals focused on solutions. TVBC work with applicants and their agents in a positive and proactive manner offering a pre-application advice service and updating applicants/agents of issues that may arise in dealing with the application and where possible suggesting solutions. 3. Birds nests, when occupied or being built, receive legal protection under the Wildlife and Countryside Act 1981 (as amended). It is highly advisable to undertake clearance of potential bird nesting habitat (such as hedges, scrub, trees, suitable outbuildings etc) outside the bird nesting season, which is generally seen as extending from March to the end of August, although may extend longer depending on local conditions. If there is absolutely no alternative to doing the work during this period then a thorough, careful and quiet examination of the affected area must be carried out before clearance starts. If occupied nests are found then work must stop in that area, a suitable (approximately 5m) stand-off maintained, and clearance can only recommence once the nest becomes occupied of its own accord. 95

The render, brickwork and slate roof tiles to be used in the construction of all external surfaces of the development hereby permitted shall match in type, colour and texture those used in the existing building. The window will be Kloeber aluminium timber & grey (7016). Reason: To ensure a satisfactory visual relationship of the new development with the existing in accordance with Test Valley Borough Local Plan 2016 policy E1. 4. The development shall not be occupied until space has been laid out and provided for the parking and manoeuvring of vehicles to enable them to enter and leave the site in a forward gear in accordance with the approved plan and this space shall thereafter be reserved for such purposes at all times. Reason: In the interests of highway safety in accordance with Test Valley Borough Revised Local Plan (2016) Policy T1. Notes to applicant: 1.
