LN5 9EY Part I - Particulars of Application Date received Application Number 18/10/2016 S/215/01572/16 Particulars and location of the development PROPOSAL: LOCATION: Outline erection for 150 dwellings (with the means of access to be considered) to include the demolition of the existing bungalows at 99 and 101 Witham Road in accordance with amended plan received by the Local Planning Authority on the 15th September, 18th and 26th October and 6th November LAND TO THE REAR OF WITHAM ROAD, WOODHALL SPA, LINCOLNSHIRE. LN10 6RB Part II - Particulars of decision In pursuance of its powers under the Town and Country Planning Act 1990, the East Lindsey District Council grants outline permission for the carrying out of the development referred to in Part I hereof in accordance with the application and plans submitted subject to the following conditions: 1. Application for approval of all reserved matters must be made not later than the expiration of three years beginning with the date of this permission and the development must be begun no later than: The expiration of two years from the final approval of all reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. Reason: In order to comply with the requirements of Section 51 of the Planning and Compulsory Purchase Act The following matters are reserved for subsequent approval by the Local Planning Authority and no development within any phase to which these matters relate shall be carried out on that phase until these matters have been approved, viz:

2 i) detailed drawings of the estate layout to a scale of not less than 1:500 and including road and plot layouts; ii) detailed drawings to a scale of not less than 1:100 showing the layout, scale and appearance of each building, including a schedule of the materials to be used for external walls and roofs; and iii) details of landscaping, tree planting and areas of public open space. Reason: The application was submitted in outline only and the above details are required to enable the Local Planning Authority to assess the detailed scale, appearance and layout of the development as well as ensure that appropriate access and services are provided to serve the development. This condition is imposed in accordance with Policy H12 of the East Lindsey Local Plan 3. The development hereby permitted shall be carried out in accordance with the following approved plans: RDS 11213/09D Received by the LPA on 26/10/2016. RDS 11213/08H Received by the LPA on 26/10/2016. RDS 11213/10B Received by the LPA on 26/10/2016. Reason: In order to ensure the approved plans are clearly identified in the interests of clarity and local amenity. 4. The details required by condition 2 must be based upon the design principles and parameters established in the Design, Access and Justification Statement, the sketch masterplan (RDS11213/04G and RDS11213/03J), the Drainage Statement version 2 dated 7 November 2016 and the recommendations of the Ecological Appraisal dated May The details must also incorporate dwellings of no more than two storey height, with bungalows shown backing onto those dwellings fronting St. Peter's Drive. Reason: No such details have yet been submitted and to ensure a satisfactory standard of built development. This condition has been imposed in line with Policies A4, A5, H12, ENV3 and TR3 in the East Lindsey Local Plan 5. If the development is to be developed in a phased manner then details of the proposed phasing must be submitted to and approved in writing by the Local Planning Authority before any part of the development is commenced on site. Phase one must include the site access, any site contouring for that phase and the buffer planting along the site boundaries. The development must then be completed in accordance with the approved phasing unless otherwise agreed in writing with the Local Planning Authority. Reason: No such details have yet been submitted and to ensure a satisfactory standard of built development. This condition has been imposed in line with Policies A4, A5, H12, ENV3 and TR3 in the East Lindsey Local Plan

No development shall begin on site until details of a surface water drainage scheme based on sustainable urban drainage principles, an assessment of the hydrological and hydrogeological context of the development has been submitted to and approved in writing by the Local Planning Authority. The scheme shall: a) Provide details of how run-off will be safely conveyed and attenuated during storms up to and including the 1 in 100 year critical storm event, with an allowance for climate change, from all hard surfaced areas within the development into the existing local drainage infrastructure and watercourse system without exceeding the run-off rate for the undeveloped site; b) Provide attenuation details and discharge rates which shall be restricted to 1.4 litres per second; c) Provide details of the timetable for and any phasing of implementation for the drainage scheme; and d) Provide details of how the scheme shall be maintained and managed over the lifetime of the development, including any arrangements for adoption by any public body or Statutory Undertaker and any other arrangements required to secure the operation of the drainage system throughout its lifetime. The development shall be carried out in accordance with the approved drainage scheme and no dwelling shall be occupied until the approved scheme has been completed or provided on the site in accordance with the approved phasing. The approved scheme shall be retained and maintained in full in accordance with the approved details. Reason: In the interests of the provision of an acceptable surface water drainage scheme and the prevention of flooding both on and off-site. This condition is imposed in line with Policy ENV3 in the East Lindsey Local Plan 7. No development shall begin on site until a foul water drainage strategy has been submitted to and approved in writing by the Local Planning Authority and off-site sewage and potable water works have been agreed with Anglian Water. No dwelling shall be occupied until these works have been completed and it is connected to them unless otherwise agreed in writing by the Local Planning Authority. Reason: In order to ensure a satisfactory standard of development in the interests of the prevention of flooding and pollution in accordance with Policies H12 and ENV3 in the East Lindsey Local Plan 8. Notwithstanding condition 5 above, no development shall begin on site until an Estate Street Phasing and Completion Plan (ESPC Plan) has been submitted to and approved in writing by the Local Planning Authority. The ESPC Plan must set out the development phases, the standards that estate streets serving each phase of the development will be completed to and details of their future maintenance.

4 Reason: To ensure the development is built and maintained to an acceptable standard in the interests of highway safety and residential and visual amenity in line with Policies A4, A5, H12 and TR3 in the East Lindsey Local Plan 9. No development in any phase shall commence on site until construction details (including engineering, lighting and drainage) of the streets within that phase have been submitted to and approved in writing by the Local Planning Authority. The development must then be carried out in complete accordance with the approved details, unless otherwise agreed in writing with the Local Planning Authority. Reason: No such details have yet been submitted and in the interests of securing a satisfactory standard of development. This condition is imposed in line with Policies H12 and TR3 in the East Lindsey Local Plan Alteration No development shall begin on site until construction and maintenance details of the proposed off-site cycleway/emergency access (including the means of preventing general vehicular use of the access) and details of the proposed footbridge to Public Footpath 150 along with a timetable for their construction and opening for use have been submitted to and approved in writing by the Local Planning Authority. The accesses shall both be provided on site in accordance with the approved details and timetable and the cycleway/emergency access shall thereafter be maintained in accordance with the approved maintenance scheme. Reason: No such details have yet been submitted and in the interests of accessibility for all in line with Policy TR3 in the East Lindsey Local Plan Alteration 1999 and paragraph 75 in the National Planning Policy Framework. 11. No dwelling shall be occupied within a phase until the estate street/s serving it is/are completed in accordance with the Estate Street Phasing and Completion Plan. Reason: In order to ensure a satisfactory standard of development in the interests of highway safety and residential amenity in line with Policies A4, H12 and TR3 in the East Lindsey Local Plan 12. No development shall begin on site until details for the management and future maintenance of all landscaping, areas of public open space and equipped children's play area have been submitted to and approved in writing by the Local Planning Authority. The development must be implemented, managed and maintained in accordance with the approved details unless otherwise agreed in writing with the Local Planning Authority. Reason: No such details have yet been submitted and in order to ensure a satisfactory standard of development. This condition has been imposed in line with Policies A4, A5 and H12 in the East Lindsey Local Plan Alteration 1999.

5 13. No development in any phase shall take place until a Construction Management Plan for that phase has been submitted to and approved in writing by the Local Planning Authority. The plan must include proposed hours of work, construction traffic routes and contractors parking arrangements. The development must be carried out in complete accordance with the Plan to the satisfaction of the Local Planning Authority. Reason: No such details have yet been submitted and to ensure the development is carried out in an acceptable manner in the interests of residential amenity and highway safety and in order to accord with Policies A4 and TR3 of the East Lindsey Local Plan 14. No development shall begin on site including works to demolish 99 and 101 Witham Road until the additional wildlife surveys identified within the Ecological Appraisal produced by Andrew Chick dated May 2016 have been undertaken and the results and any mitigation measures required have been submitted to and approved in writing by the Local Planning Authority. The development must then proceed in complete accord with the approved mitigation measures unless otherwise agreed in writing by the Local Planning Authority. Reason: No such details have yet been submitted and to ensure the development is carried out in an acceptable manner in the interests of the protection and promotion of biodiversity as required by paragraph 118 of the National Planning Policy Framework. 15. Details of all means of enclosure, including that to be erected alongside 97 and 103 Witham Road, shall be submitted to and approved in writing by the Local Planning Authority before it is erected on site. The means of enclosure must be erected on site before any of the dwellings to which it relates is occupied and it must thereafter be so maintained, with the exception of that to be erected alongside 97 and 103 Witham Road which must be erected before the new access is brought into use. Reason: In the interests of visual and residential amenity. This condition is imposed in line with Policies A4, A5 and H12 in the East Lindsey Local Plan 16. As part of a Reserved Matters application details of the existing and proposed site levels and proposed floor levels of the buildings and hard surfaced areas shall be submitted. Reason: To ensure the Local Planning Authority retains control over the finished site and floor levels of the development in the interest of the overall design of the scheme and to protect the amenities of the occupants of future and adjoining dwellings. This condition is imposed in accordance with Policies A4 and A5 of the East Lindsey Local Plan

If during redevelopment contamination not previously considered is identified, then the Local Planning Authority (LPA) shall be notified immediately and no further work shall be carried out until a method statement detailing a scheme for dealing with the suspect contamination has been submitted to and agreed in writing with the LPA. On completion of the development the LPA shall be notified in writing if no additional contamination was identified during the course of the development and the store hereby permitted shall not be occupied until the LPA has acknowledged receipt of the same. Reason: To ensure all contamination within the site is dealt with. This condition has been imposed in line with paragraph 121 in the National Planning Policy Framework. 18. Before each dwelling is occupied the roads and/or footways providing access to that dwelling, for the whole of its frontage, from an existing public highway, shall be constructed to a specification to enable them to be adopted as Highways Maintainable at the Public Expense, less the carriageway and footway surface courses. The carriageway and footway surface courses shall be completed within three months from the date upon which the erection is commenced of the penultimate dwelling. Reason: To ensure safe access to the site and each dwelling in the interests of residential amenity, convenience and safety in line with Policies A4 and TR3 in the East Lindsey Local Plan 19. Details of a children's equipped play area to be provided within one of the areas of public open space must be submitted to and approved in writing by the Local Planning Authority. The approved facility must be provided in full before the dwellings within the phase in which it is to be sited are occupied. It shall thereafter be so maintained. Reason: No such details have yet been submitted, to achieve a satisfactory standard of development and to accord with Policy H12 in the East Lindsey Local Plan 20. The development hereby approved shall be carried out in complete accordance with the details contained within the Travel Plan produced by BWB Consultancy revision 1 and dated July 2016 unless otherwise agreed in writing with the Local Planning Authority. Reason: To promote travel by means other than the private motor car in accordance with Policy TR3 of the East Lindsey Local Plan

7 21. No development shall begin on site until a written scheme of archaeological monitoring has been submitted to and approved in writing by the Local Planning Authority. The applicant must notify the Local Planning Authority of the intention to commence work at least fourteen days before the start of archaeological work in order to facilitate adequate monitoring arrangements. No variation shall take place without the prior written consent of the Local Planning Authority. Reason: To ensure satisfactory arrangements are made for the recording of possible archaeological remains in accordance with the National Planning Policy Framework and to accord with guidance contained within Policy 27 of the East Midlands Regional Plan A report of the archaeologist s findings shall be submitted to the Local Planning Authority and the Historic Environment Record Officer at Lincolnshire County Council within 3 months of the works hereby given consent being commenced unless otherwise agreed in writing by the Local Planning Authority; and the condition shall not be discharged until the archive of all archaeological work undertaken hitherto has been deposited with the County Museum Service, or another public depository willing to receive it. Reason: In order to ensure that satisfactory arrangements are made for the investigation, retrieval and recording of any possible archaeological remains on the site. This Condition is imposed in accordance with the National Planning Policy Framework (paragraph 141). POSITIVE AND PROACTIVE STATEMENT:- The Local Planning Authority has worked with the applicants and their agent in a positive and proactive manner to seek solutions to issues arising during the consideration of the application and now considers the proposal is acceptable and there is compliance with the relevant Development Plan Policies and also with the National Planning Policy Framework.
