Supre. 534, (App. Div. 2005) per the civil case Docket SSX-L This is also a VERIFIED CERTIFIED AFFIDAVIT with adopted references per R. 1: This is a complaint and greivance and ACTUAL NOTICE of Tort Claim Act Violations of outrage, defamation causing emotional distress do the continue threats to my wife Kathryn Caggiano and myself to intimiate witnesses, retaliate against them and obstruct the administration of law and prevent their apprehension and prosecution for violation of ethics laws, Title 2C criminal codes violations and federal crimes including conspiracy, and 18 USC 134, 241 and 242 including other federal laws using instate mail to threaten and terrorize with additional false willful malicious abuse of process in prosecutions as demonstated by the DISMISSAL WITH PREDUDICE the 13 malicious criminal charges filed against me by Borough of Stanhope officials and employees in Sussex County. The Sussex County Prosecutor David Weaver, a former law partner of William Hinkes, Esq. who did NOT have any contract as by fraud he and Judge Craig U. Dana, JMC by trickery convicted myself and others in the Joint Municipal Court of Green, Fredon, Hampton and Borough of Andover not only on Jan 7, 2009 when I was convicted after Richard A. Stein, Esq. committed willful perjury by stating under oath that the Borough of Stanhope provided copies of all documents I requested previously under the Open Public Record Act. I refer you to the Office of Administrative Law under the GRC Complaint Thomas Caggiano v. Ellen Horak OPRA custodian and Teri Massood Town Administrator and GRC interim order responses by the Borough of Stanhope and the statements in writing and under oath by Teri Massood wherein she admitted she willfully destroyed government records and Ellen Horak wrote and stated that she informed Mrs. Mary Pawar, who had signed letters to the N.J. Attorney General with Kathryn Caggiano and myself with letters from D-24 representative letters also requesting criminal investigations of the Borough of Stanhope, and others. These letters were filed in the Office of Attorney General and are posted on the filed web site links and are adopted as referenced exhibits. All voluntary Police reports made by me documenting the corruption and enterprise of rackettering in the Land Use Board and Town Council meetings filed in the Borough of Stanhope are also adopted as exhibits. All court records in State of New Jersey in Hopatcong, Stillwater, Trenton municipal and superior courts, Township of Green, Borough of Stanhope, Frankfort Township are adopted as exhibits to this Certified

2 Affidavits based upon my personal knowledge including the CAG report of May 5, 2009, and Jun 5, 2010 which is available for download on and was also filed in Netcong Municipal Court and Newton Municipal Court. The later Affidavits filed in these courts is also adopted by reference. The CAG report was released to the public by Inside on the Outside to federal, state, county, municipal officials in various municipalties. 4. The Sussex County Administrator on May 14, 2010 requested an investigation of the Sherrif and State Sussex County Prosecutor of my illegal false imprisonment based upon Judge Dana s illegal violations of court rules as determined by Judge N. Peter Conforti, JSC on Sep 9, 2010 when he vacated all of Judge Craig U. Dana s court orders, vacated all his fines which were returned by the Borough of Stanhope and Township of Green, vacated all probation and noted with the concurrence of the State of New Jersey Attorney General per N.J.S.A.2C:21-24 in the person of Sussex County First Assistant Prosecutor the corrupt Gregg Mueller who is also complicit in the criminal acts of Richard A. Stein, Esq. and Ellen Horak. Also on Sep 10, 2009, the criminal indictment I was dismissed without prejudice. I then entered moving papers and motions for Dismissal of the indictment with Prejudice as noted on the moving papers filed as a public record in Sussex County Superior Court distributed to the public and available as noted on the filed CAG Report of Jun 5, 2010 with the Department of Community Affairs Local Finance Board. I adopt as a reference document the June 24, 2010 letter to me by the Department of Community Affairs Marc Pfeiffer, Chair his letter Subject: Complaint Letters, Multiple Government Agencies, Borough of Stanhope and Gen Cor #5387, 5389, 5401, 5402 ad 5403 which were letters dated May 25, May 26, May 31, Jun 1, Jun 2 and Jun 6, 2010 and the 2,700 documents, drawings, field reports, and things in Sussex County Soil Conservation District Box SH#44, Block Lots 10 and 12 and filings with the Sussex County Board of Chosen Freeholders on Nov 5, 2008 as public documents and thereafter. 4. Violation of the Local Govt Ethics Law, N.J.S.A. 40A: et seq. against Ellen Horak and Richard Stein, Esq were filed with the Local Finance Board as the Borough of Stanhope nor any municipality in Sussex County have a municipal ethics board nor does Sussex County. Perhaps this explains why so many local and county officials have no Ethics and violate the Open Public Meetings Act and requirements of the filing of Annual Reports. 5. Adopted by reference is my letter to the Vicinage Trial Court Administrator Michel J. Arnold as Judge Craig U. Dana, JMC has refused repeated requests for the trial court records in ALL petty disorder cases transferred to his court by Judge Mulhern of the Borough of Stanhope and Netcong Judge John A. Paparazzo who has sent Affidavits of Probable Cause filed in his court after coordination with Vicinage 10 Presiding Judge Frank. J. Zinna on Jun 18, 2010 by sending a hard copy of the CAG Report of Jun 5, 2010 with additional evidence comprising a 200 page Affidavit of Probable Cause with adoption of other audio recordings of Richard A. Stein. Esq lies to the public in the Town Council meeting wherein the Mayor of Stanhope and its Governing Body were requested to have open or closed sessions hearings to remove John Cilo Jr., a bribed, incompetent professional engineer who owned John Cilo Jr. Associates and for perhaps 20 years or more was told the public that he was awarded a valid contract per the Local Public Contracts Law with its required newspaper announcement requiring four elements to be published in the official newspaper to be a valid contract as per N.J. Case Law ALL contracts MUST be in writing and per State law to be a valid contract ALL elements of the State Law on proper notification to the Public MUST be made. The N.J.S.A. 40A: appears to have been violated by Borough of Stanhope officials, several of its employees for decades on a constant recurring pattern of official misconduct and criminal disbursement of federal, state, county and municipal funds not only to John Cilo Jr. Associates but Omland Engineering Associates V.P. Eric Keller and other professionals such as the bribed P. David Zimmerman, PP who was protrayed by the Mayor, Governing Body members, Borough Attorney, Town Administrator, Land Use Board members, Finance Committee members who are Governing Body members per Stanhope s By laws, and Land Use Board Law firm Dolan and Dolan PA and Roger Thomas, Esq. and John Leo III, Esq. 6. The Local Finance Board jurisdiction per N.J.S.A. 40A: as stated in teh Local Government Ethics Law is: The Local Finance Board in the Division of Local Government Services in the Department of Community Affairs SHALL have jurisdiction to govern and guide the conduct of local government officers or employees regarding violations of the provisions of this act who are not otherwise regulated by a county or municipal code ethics of ethics promulgated by a county or municipal ethics board in accordance with the provisions of this act. Local governemnt officers or employees serving a local government agency created by more the one county or municipality and officers or employees of county colleges established pursuant to N.J.S.18A:64A-1 et seq. shall be under the jurisdiction of the board. The board in interpreting and applying the provisions of this act shall recognize that under the PRINCIPLES OF DEMOCRACY, public officers adn employees cannot and should not be expected to be without any personal interest in the decisions and policies of government; that the citizens who are government officers and employees have a righ to private interests of a personal, financial and ecconomic nature; and that STANDARDS OF CONDUCT shall distinguish between those conflicts of interest which are legitimate and unavoidable in a free society and those CONFLICTS OF INTEREST WHICH ARE prejudicial and material are, therefore, CORRUPTIVE OF DEMOCRACY AND FREE SOCIETY.

The Mayor, Governing Body, Town Administrator, CFO, Municipal Treasurer, Land Use Board members, and their Law firms and bribed professional engineers, planners and Chief of Police have in my opinion ALL violated the Local Government Ethics laws for each official therein including municipal clerks with the exception of the excellent fromer Ms. Robin Kline, RMC, MAS who reported criminal conduct to many agencies, who wrote answer under great duress as she was intimidated and threatened by the Mayor, Governing Body members, corrupt town administrator Teri Massood and Laddey, Clark and Ryan s Borough Attorney Richard Stein, Esq. during her entire tenure so that they could in their official capacity have direct financial gain and impaired their objectivity and independent judgement as they acted in a confederation, planned, agreed upon enterprise to defraud the public for their personal gain. That per N.J.S. 40A: b.(3) Open competition was NOT held for a substantial period of time for more then a decade as using the exception in the Local Public Contracts Law the law firms were given without competitve bidding to for their financial gain and independence as John Cilo Jr. Associates was given contracts on an exceptional basis for twenty years for his financial gain did as directed by the Mayor, Governing Body, Planning Board and Land Use Board as he did NOT even have a properly awarded contract nor his employee Scarlett Doyle. The corruption violated the Ethics laws and other criminal laws as criminal claims for financial personal interest were submitted without valid contracts by John Cilo Jr. and Omland Engineering Associates. 8. Futhermore to defraud the Local Finance Board itself in the 2006 Local Government Officer Roster for Stanhope Borough recieved by the Division of Local Government Services on May 25, 2006 the criminal acts are evident as noted below: a. No Financial Disclosure was apparently made as required by Public Law and the Department of Local Government Services did NOTHING to notify the appropriate authorities that required annual reports were NOT provided and in other submittals. The obvious question is when the Borough files a report to the State and it itself states their are violations of State law, where is the Mayor of the Borough of Stanhope that per its By-laws is required to assure compliance with state laws as is the Town Administrator per their Chapter 2 Administration duties? b. The report to the Local Govt Services for years shows John Cilo Jr as Land Use Board engineer, Scarlett Doyle as Town Planner and Eric Keller as Municipal engineer. These official positions were awarded contracts to be in these officlal postions. BUT there are NO contracts awarded to these so called officials for their personal gain with directions from the Mayor, Governing Body members and former Land Use Board as its Governing Body members came before the Land use Board with the Land Use Board Borough Engineer of Land Use Board Board Engineer they created. But per the Map Filing Law and Chap 100 a Borough engineer that has as properly awarded contract per the Department of Community Affairs State s Local Public Contracts Law can ONLY pariticipate and approve plans and drawings and maps. All approved illegally by Borough of Stanhope officials to improve their financial gain, have power by defrauding the Local Government Services Division itself in the Submittal of May 25, OPRA Request: The report provided to me in response to my OPRA request to the Department of Community Affairs I believe shows violations of the individuals noted below to submit the annula Financial Disclosure Statement in Exhibit #1, Stanhope report to the Division of Local Govt Services. a. Please provide a copy of the individual annual financial disclosure report for Brain Murphy Councilman for b. Please provide a copy of the individual annual financial disclosure report for Raymond Wooten Councilman and Musconetcong Sewer Authority member for c. Please provide a copy of the individual annual financial disclosure report for Brain Murphy Councilman and Musconetcong Sewer Authority member for d. Please provide a copy of the individual annual financial disclosure report for James Benson Councilman for e. Please provide a copy of the individual annual financial disclosure report for Ed Frenenski as Fire Chief for 2006 f. Please provide a copy of the individual annual financial disclosure report for Dave Hoyt Land Use Board member and Musconetcong Sewer Authority for g. Please provide a copy of the individual annual financial disclosure report for Joseph Torelli Land Use Board member for h. Please provide a copy of the individual annual financial disclosure report for Paula Zeliff-Murphy Land Use Board member for i. Please provide a copy of the individual annual financial disclosure report for Donald Drake Land Use Board member for j. Please provide a copy of the individual annual financial disclosure report for John Mulhern Municipal Judge for 2006.

4 In addition, the official report appears to be a filing of a false instrument an obvious violation of the Ethics laws to enhance their own gain by power, fraud and trickery upon the public and violation of oath of office requiring removal of all officials engaged in such unethical conduct. k. Please provide a copy of John Cilo Jr., of John Cilo Jr. Associates, individual annual financial disclosure report for Land Use Board engineer for 2006 that was filed AND a copy of his contract for professional services that was awarded per the State s Local Public Contracts Law and copy of newspaper announcement in four areas as ALL requirements of the State s Local Public Contracts Law must be complied to have a valid contract as inferred by the submittal by the Borough of Stanhope that is available to the public. l. Please providea copy of Eric Keller, of Omland Engineering Associates, individual annual financial disclosure report for Borough engineer for 2006 that was filed AND a copy of his contract for professional services that was awarded per the State s Local Public Contracts Law and copy of newspaper announcement in four areas as ALL requirements of the State s Local Public Contracts Law must be complied to have a valid contract as inferred by the submittal by the Borough of Stanhope that is available to the public. m. Please provide a copy of Scarllet Doyle, of Omland Engineering Associates, individual annual financial disclosure report for Borough engineer for 2006 that was filed AND a copy of his contract for professional services that was awarded per the State s Local Public Contracts Law and copy of newspaper announcement in four areas as ALL requirements of the State s Local Public Contracts Law must be complied to have a valid contract as inferred by the submittal by the Borough of Stanhope that is available to the public. n. Please provide a copy of the individual financial report for P. David Zimmerman, the professional planner who prepared the Area in Need of Development Report and was repeatedly given in reportss provided the public for free that he was an official of the Borough of Stanhope. Also provide a copy of P. David Zimmerman, individual annual financial disclosure report for Borough engineer for 2006 that was filed AND a copy of his contract for professional services that was awarded per the State s Local Public Contracts Law and copy of newspaper announcement in four areas as ALL requirements of the State s Local Public Contracts Law must be complied to have a valid contract as inferred by the submittal by the Borough of Stanhope that is available to the public. o. Please provide a copy of the check provided John Cilo Jr., Scarlett Doyle and P. David Zimmerman, Dolan and Dolan PA and Laddey, Clark and Ryan LLC from the escrow account funded by KHovnania Companies for the preparation of an apparently false report done without any contracts awarded to the P. David Zimmerman and without notification that the Borough had reported him as an official of the Borough of Stanhope and NOT being listed on the required Annual Financial reporting list as the above concerns listed above all have violations of the Local Government Ethics Laws for personal gain with violations of N.J.S.A paragraphs e-j on a rampant scale of confederated agreement in pattern that continued in 2007 and as such is a pattern of racketeering and an enterprise of rackeeteering with criminal disburing moneys, incurring obligations and obtaining unlawful benefits for official behavior N.J.S.2C:27-4 and submitting false representations N.J.S.2C:21-34.a that government contracts were awarded in accordance with the Local Public Contracts Law

Provide a copy of the payments by the Borough of Stanhope and its approval records by the Finance commitee to John Cilo Jr., Dolan and Dolan PA, Laddey, Clark and Ryan LLC and P. David Zimmerman to prepare the Area in Need of Development Report and the Revised Master Plan by John Cilo Jr. Associates. q. Provide a copy of the Soil Erostion and Sediment Control Plan that is certified by the State of New Jersey and approved by a municipal engineer per the Map Filing Law and Borough of Stanhope for Block Lot 10 and 12, minor sudivsion within two hundred feet of our property on 10 East Drive on 2 and 6 Oak Drive. r. Provide a copy of the closed session meeting noted in the Aug 1, 2002 new Article by the official newspaper the New Jersey Herald pushed in the CAG Report of Jun 5, 2010 noted below. It is noted the statements made by the Governing Body are false in that the DEED for Block Lot 12 was signed on Jul 12, 2002, D and that per the Chap 100 enforcement thereof is by the Mayor and Town Council The petitioners of Jul 25-26, 2002 were defrauded by the Borough and John Cilo Jr. obtained personal gain as he was represented by the Borough as its Borough Engineer, had no contract awarded per the Local Public Contracts Law and violations of Ethics laws have continued in lies, perjuried statements to the Government Record Council in Statement of Information by the Borough Attorney for personal gain, violation of the Code of Ethics R. 1:14 in a conspiracy benefitting by obtaining salaries, medical benefits, retirement benefits by fraud and acceptance of bribes paid through the Borough of Stanhope of Federal, State, County and Municipal funds which were journal vounched to pay fees to Laddey, Clark and Ryan LLC form other accounts to continue their unethical at breach of duty, outrage, neglience and causing great mental injury to myself, wife, family, neighbors and their financial costs to defend themselves against the unethical conduct done for financial gain and greed by staying in power to defame, slander me and have me willfully and falsely imprisoned using the Police Department to have me handcuffed over 20 times to support either hundreds of ethics violations noted above and in the filed Superior courts by the Netcong municipal Judge Paparazzo. It is also noted the District XA Ethics Committee has commenced an Ethics investigation against the Borough of Stanhope s Borough Attorney Richard A. Stein, Esq. and William Hinkes, Esq whose firms are represented in many municipalities and per R. 5.1 and both law firms and all their partners could NOT have any contract with any State, county, municipal entity or body under State authority.

6 10. I have never been convicted of any criminal offense. The indictment I was dismissed with prejudice that was brought upon malicious complaints by the Borough of Stanhope officials and employees as criminal cercion and witness intimidation. 11. All fines, probation and court orders by Judge Craig U. Dana were vacated on Sep 10, 2010 under my Pro Se Municipal appeal ad and fines were repaid by the Borough of Stanhope court administrator Lupo and Township of Green court administrator via checks made from their respective municipalities. 12. The Borough has continued to threaten my wife and myself by interstate mail to our home address in Northern Las Vegas, Nv and was reported to the FBI duty agent in Newark, NJ on Jun 28, 2010 as terrorism, threatening a witness, and violation of 18 USC 1346 and previous acts reported by the FBI Instructions to the U.S. P.S. Inspection Service ( Case file assigned for mail tampering against Borough of Stanhope Ellen Horak (in conspiracy to prevent detection and aide others i criminal and unethical conduct for personal benefit and defrauding of the federal, state, county and municipal governments and all developers and tax payers in Sussex County and Borough of Stanhope by trickery and obstruction of justice and preparing financial annual reports to the Department of Community Affairs Local Finance Board ) for mail tampering ( and feeral criminal code violation 18 USC 1346). The payment of claims, money laudering to pay bribes by the post office for decades, the use of general vouchers to reallocate funds to prepare false reports to Government enties to enrich themselves by personal gain such as medical benefits, trips, retiremenet pay and other offers of favors by John Cilo Jr. a bribed municipal engineer to approve developmeny by Govering Body members who I witnessed in Land Use Board meeting scream at Dolan and Dolan PA s lawyer as Land Use Board members were complaining of improper land development by Governing Body members without proper approvals by the Land Use Board as the Chairman of the Board had John Cilo Jr. by fraud and unethic conduct with personal benefit for decades of sole source contracts to him which in fact did NOT comply with the Local Public Contracts law as he was paid and with goverment officials directed all developers to change title blocks from municipal engineer to land use board engineer as noted in the fraudulant report to the Department of Local Government itself for personal gain. 13. Attached is Mary Pawar, 12 East Drive letter of Oct 28, 2007 to the dishonorable Judge Neil H. Shuster, P.J.on the malcious false filing by the GRC s lawyers Catherine Starghill, Esq., the GRC in house lawyer Karyn Gordon and their corrupt Division of Law s DAG Debra Allen, Esq as all have violated the rules of ethics for years and rules of professional conduct for personal gain and stature as they have as noted in their Final Decision of Sep 26, 2007 on complaints , 21, 22 and 23 and as noted in my adopted exhibit of my letter of May 26, 2010 to the corrupt Government Record Council for reconsideration in a VERIFIED CERTIFIED AFFIDAVIT conspired to protect themselves, provided deceitful information to prevent prosecution of their protected confederates in the Borough of Stanhope wherein false reports for individual benefit is their driving focus NOT protection of public safety and health.

7 14. This letter and OPRA request are posted as public record as a public duty as stated in the Republics Declaration of Independence and Constitution of New Jersey. 15. A copy of this letter is being sent to the Local Finance Board to supplement the 200 pages of documents already recieved by the Local Finance Board to their letter for additional details and evidence of violations of the Local Ethics 16. As can be understood by the denial of access in the letters from the unethical, corrupt leader Laddey, Clark and Ryan s LLC Borough Attorney Richard A. Stein, Esq. he acting for his confederator the OPRA custodian and those who contribute to the denial of access and those unethical lawyers on the Department of Community Affairs that violate the Code of Ethics being Catherine Starghill, Esq., Karyn Gordon, Esq., Office of Attorney General s Division of Law DAG Debra Allen, Esq. with the Commissioner of the Department of Community Affairs Girfa, Esq. and the New Jersey Attorney General Paul Dow, Esq. and Gov Christie, Esq. have all violated the Rules of Professional Conduct for lawyers as with the Judges and Lawyers on the ACJC they have protected other Superior Court and Municipal Judges and their court administrators who have violated their Code of Ethics to protect their friends and themselves financially by stating in office, recieving medical benefits and retirement benefits while NOT fullfully the Code of Judicial Conduct, the Rules of Professional Conduct or the Code of Ethics for Judicial Employees all for their own personal benefit and not reporting suspected improper unethical conduct of Judges and Lawyers which has allowed the personal benefits of bribery to John Cilo Jr. Associates, Omland Engineering Associates and others to continue as funds are paid by developers who desired to destroy U.S. Minerals and modern manufacturers with HQ in Morris County and Buildings across the county line which COAH false to address in its inaequate methodology as bribery was used to benefit those recieving funds through Stanhope s own escrow accounts as false News bulletins were issued when Teri Massoos the former Town Administrator ran away from the Borough without resigning and false news bulletins were distributed with false statements that she left because of a change in management style which has continued under the new Town Administrator Richard Stewart who has no record of his being selected by any method of competitive placement or any formal evaluation.
