MOTION: Mr. Botknecht made a motion to impose an administrative fine of $500, costs of $ to be paid within 90 days and 2 hours of approved continuing education with an emphasis on Chapter 489, Florida Statutes within one year. 3 Page 3 Mr. Torres was charged with a violation of (1)(c), F.S., by having a certificate or registration to practice contracting revoked, suspended, or otherwise acted against, including the denial of licensure, by the licensing authority of another state, territory or country. A violation of (1)(a), F.S., by violating any provision of Chapter 455 by having a license or the authority to practice the regulated profession revoked. A violation of (1)(a), F.S., violating any provision of Chapter 455 by making deceptive, untrue, or fraudulent representations in or related to the practice of a profession or employing a trick or scheme in or related to the practice of the profession. A violation of (1)(a), F.S., violating any provision of Chapter 455 by attempting to obtain, obtaining, or renewing a license to practice a profession by bribery, by fraudulent misrepresentation, or through an error of the department or board. Mr. Flaherty and Mr. Hoffmann were recused. Mr. Torres agreed to waive his right to attorney s fees. MOTION: Mr. Botknecht made a motion to dismiss this case. SECOND: Ms. Krak. Joseph Dana Williams Innovative Electrical Contractors License #: EC Case #: Hearing with No Issue of Disputed Material Fact Mr. Williams was not present nor represented by counsel. MOTION: Ms. Krak made a motion to adopt the Conclusions of Law and find that the conclusions of law constitute a violation of the practice act as alleged in the Administrative Complaint. MOTION: Mr. Botknecht made a motion to impose an administrative fine of $100 and costs of $ to be paid within 90 days, citing mitigating factors related to Mr. Williams account balance with City Electric Supply Company. License #: ER & ER Case #: Waiver Mr. Birsch was not present nor represented by counsel. Mr. Birsch was charged with a violation of (1)(m)4., F.S., failing within 18 months to pay or comply with a civil judgment obbtained against the contractor or a business qualified by the contractor and relating to the practice of contracting. Mr. Flaherty and Mr. Hoffmann were recused. MOTION: Mr. Botknecht made a motion to adopt the Findings of Fact as stated in the administrative complaint. SECOND: Mr. Smith. MOTION: Mr. Botknecht made a motion to adopt the Conclusions of Law and find that the conclusions of law constitute a violation of the practice act as alleged in the Administrative Complaint. SECOND: Mr. Echarri. MOTION: Mr. Botknecht a motion to suspend Mr. Birsch s license. The suspension shall be stayed for a period of 90 days. In order to avoid having the stay lifted resulting in his license being suspended, Mr. Dominguez must pay the City Electric judgment and the fine of $1,000 and costs of $ Mr. Dominguez s license shall be placed on probation for a period of one (1) year following the termination of suspension. SECOND: Mr. Cannava. Petition for Declaratory Statement, Deborah Loucks, Esq., Assistant Attorney General John (Jay) Cannava Regarding the installation of block footer(s) and the erection of illuminated flagpoles. Mr. Cannava was present and sworn in by the court reporter. Mr. Cannava submitted a Petition for Declaratory Statement asking if the installation of block footer(s) and then erecting a illuminated flagpole (according to plans by a licensed professional engineer that meets the wind load requirements) that includes the shoe for lightning protection included in the scope of work of unlimited electrical contractors? Mr. Cannava requested to grant the withdrawal of this Declaratory Statement.
