3 Electrical Contractors Licensing Board Meeting Minutes November 2012 MOTION: Mr. Chinchor made a motion to suspend the license for 5 years, stay the suspension for the first 3 years, license will be on probation for the 3 years the suspension is stayed, licensee must provide proof of satisfaction of the civil judgment by the end of the 3 years and appear before the board or the suspension will go into effect and impose a fine of $1,000 costs of $ and the Board retains jurisdiction to impose additional restrictions when suspension is lifted. SECOND: Mr. Sandefer. Richard Deese License #: EC1882 & EC Case #: Recused: Tibbs & Thomas Mr. Deese was not present and requested a continuance. MOTION: Mr. Chinchor made a motion to grant the continuance. SECOND: Mr. Smith. MOTION: Mr. Chinchor made a motion to accept the findings of facts and conclusions of law as stated in the administrative complaint as those of the Board. SECOND: Mr. Sandefer. MOTION: Mr. Chinchor made a motion to impose a fine of $11,000, costs of $296.50, restitution of $67,164. SECOND: Mr. Smith. Martin Law License #: ER Case #: Recused: Thomas, Tibbs Mr. Law was not present nor represented by counsel. Mr. Law was charged with violation of (1)(r) F.S., failure to obatain required permit or inspections and (1)(o), F.S. failing to maintain workers compenation. Mr. Medoff was charged with violation of Mr. Swaby was charged with violation of (1)(m)4, F.S., committing financial mismanagement by failing to satisfy a civil judgment.. MOTION: Mr. Chinchor made a motion the respondent was properly served and respondent waived his right to hearing. SECOND: Mr. Sandefer. MOTION: Mr. Sandefer made a motion to accept the findings of facts and conclusions of law as stated in the administrative complaint as those of the Board. SECOND: Mr. Chinchor. MOTION: Mr. Sandefer made a motion to impose a fine of $1,000, costs of $496.81, suspension of license for 4 years, stayed for the first 2 years with probation during the stay. Respondent must appear before the board and show satisfaction of civil judgment before reinstatement of license. SECOND: Mr. Chinchor. Mr. Chinchor asked of the second business applicants collectively as a group: Do you understand that you will be legally responsible for every job undertaken by this business? Do you understand that you will be financially responsible for every job undertaken by this business? Do you understand that you are required to approve the work done on every job undertaken by this business? Do you understand that your license is dependent upon how seriously you take these responsibilities? Each applicant answered affirmatively to each of the preceding questions. PETITIONS FOR VARIANCE AND WAIVER, Deborah Loucks, Esq., Assistant Attorney General John Derrick Waiver of Rule 61G Mr. Derick was present sworn in by the court reporter. MOTION: Mr. Sandefer made a motion to grant a waiver to extend the exam scores for 1 year. SECOND: Mr. Tibbs. MOTION: Mr. Tibbs made a motion to approve the application. SECOND: Mr. Sandefer. James Griffin Application Denial Mr. Griffin was present and sworn in by the court reporter. MOTION: Mr. Bramlett made a motion to uphold the denial. SECOND: Mr. Tibbs. The Board did not vote on the motion. Mr. Griffin requested to withdraw his application. MOTION: Mr. Tibbs made a motion to withdraw the application. SECOND: Mr. Bramlett. Brett Price Application Denial Mr. Price was present and sworn in by the court reporter. MOTION: Mr. Tibbs made a motion to reverse the denial and approve the application for downgrade to Alarm II. SECOND: Mr. Bramlett. MOTION: Mr. Tibbs made a motion tot approve Mr. Price for the Residential Specialty license in addition to the Alarm II license contingent on him submitting a complete application within 6 months. SECOND: Mr. Tibbs. LEGISLATIVE REPORT No report given. RULES REPORT Clarence K. Tibbs Ms. Loucks presented the rules report, she noted Rule 61G6- & 61G6 will be effective on November 21, Ms. Loucks provide the Board with draft language for Rule 61G MOTION: Mr. Tibbs made a motion to approve the rule language and notice the rule for development. SECOND: Mr. Sandefer

FINANCIAL BUDGET LIAISON REPORT Clarence K. Tibbs Ms. Chastain presented the financial repot for the 1 st quarter ending September 30, UNLICENSED ACTIVITY (ULA) REPORT Paul Sandefer No report given. EXAMINATION REPORT Kenneth Hoffmann Alex Bosque with the Bureau of Education and Testing addressed the Board. Mr. Bosque explained how pilot questions are administered as part of the exam and how determination is made regarding time allotted. Mr. Bosque also discussed code changes and updates to the exam. The Board did not recommend any change to the current practice regarding pilot questions. ENDORSEMENT REPORT No changes. RATIFICATION OF APPLICATIONS The lists will be attached to the minutes and are hereby incorporated by reference. (Lists are attached as exhibits A, B & C). MOTION: Mr. Tibbs made a motion to ratify the Continuing Education Committee and Initial Application Review results. SECOND: Mr. Smith. See Exhibits A, B & C. APPROVAL OF MINUTES MOTION: Mr. Sandefer made a motion to approve the minutes from the July 2012 meeting. SECOND: Mr. Tibbs. OLD BUSINESS/ NEW BUSINESS The Board discussed the requirements for Solar Work under the Engineers statute , no motions were made

10 Electrical Contractors Licensing Board Meeting Minutes November 2012 PROSECUTING ATTORNEY S REPORT LeChea Parson, Esq., Assistant General Counsel Ms. Henderson presented the report on Thursday; she directed the Board s attention to the details of the report which was distributed to the members. The report included case information as of November 13, MOTION: Mr. Sandefer made a motion for the Department to continue prosecution of cases that are over a year old. SECOND: Mr. Chinchor. BOARD COUNSEL S REPORT Deborah Loucks, Esq., Assistant Attorney General Ms. Loucks informed the Board that all rule and meeting notices would now be published in the Florida Register (formerly Florida Administrative Weekly) and that publication is the day after submission which will speed up rule promulgation. PROBABLE CAUSE PANEL PUBLIC CASES None. EXECUTIVE DIRECTOR S REPORT Juanita Chastain Ms. Chastain directed the Board s attention to the enforcement report and the proposed meeting dates which were provided for their information.
