MOTION: Mr. Flaherty made a motion to impose suspension of licensure until compliance with the prior final order and costs of $ SECOND: Mr. Chinchor APPLICATION REVIEW Brian Flaherty, Chairman Additional Business Applications See attachment for a list of applicants that were present during this portion of the meeting: The Court Reporter swore in, as a group, the applicants and those persons providing testimony on behalf of the applicant. During the review each applicant and their respective designees were interviewed in turn and answered general questions concerning the business entity they wished to qualify and direct questions concerning their understanding of their responsibilities and obligations as primary qualifying agent. Mr. Smith asked of the second business applicants collectively as a group: Do you understand that you will be legally responsible for every job undertaken by this business? Do you understand that you will be financially responsible for every job undertaken by this business? Do you understand that you are required to approve the work done on every job undertaken by this business? Do you understand that your license is dependent upon how seriously you take these responsibilities? Each applicant answered affirmatively to each of the preceding questions. Petitions for Declaratory Statement, Deborah Loucks, Esq., Assistant Attorney General Petition for Declaratory Statement 3M The petitioner was not present nor represented by counsel. The Petition seeks the Board s opinion in response to the following questions: - 5 -

6 Can the Owner contract with us to provide a turn-key solution including provision of the equipment and hiring of the licensed electrical contractor to install the equipment and once the equipment is installed, do we need a license to service and maintain the equipment? MOTION: Mr. Flaherty made a motion that Petitioner is required to be licensed by the Board in order to hire the electrical contractor to install the equipment. Petitioner cannot contract with the owner and then subcontract the electrical work without a license. In response to the second question, no license is required to perform incidental electrical work, including removal of the wires, when servicing or maintaining the equipment. Any electrical work beyond the removal of wires must be performed by a licensee. SECOND: Mr. Cannava. Petition for Declaratory Statement Black Hawk Protection Services, Inc. The Petition seeks the Board s opinion in response to the following questions: Is an alarm contractor license required to watch and listen (monitoring) to a CCTV audio and video system? And do the functions described in the petition fall within the ambit of Section (2)(a), F.S.? MOTION: Mr. Flaherty made a motion that Petitioner is required to be licensed by the Board in order to provide the watch and listen (monitoring) functions described in the petition. In response to the second question, if Petitioner's employees are performing only monitoring activities (as monitoring is defined in the statute), then Section (2)(a), Florida Statutes, would apply and those employees would not be required to become Burglar Alarm System Agents. SECOND: Mr. Sandefer. Petition for Declaratory Statement G4S Technology, LLC The petitioner was not present nor represented by counsel. The Petition seeks the Board s opinion as to whether underground conduit installation is within the scope of licensure for a Certified Alarm System Contractor I. MOTION: Mr. Chinchor made a motion that the installation of underground conduit that is part of the installation of an alarm system (provided that the wire and voltage do not exceed 98 volts) falls within the scope of an Alarm System Contractor I licensee. SECOND: Mr. Sandefer. Petition for Declaratory Statement Kleinbard Bell Becker, LLP The petitioner was not present nor represented by counsel. The Petition seeks the Board s opinion as to whether the safety-related video-conferencing application for smartphones requires a license

7 MOTION: Mr. Flaherty made a motion that the Board decline to answer Petitioner's question regarding the application of the definitions of "alarm system" and "monitoring" to Petitioner's circumstances because the Board believes that the statutory definitions set forth in Section , Florida Statutes, and any applicable exemptions are clear. SECOND: Mr. McHaffie. Petition for Declaratory Statement National Conductor Constructors The petitioner was not present nor represented by counsel. The Petition seeks the Board s opinion as to what types of licenses would be required for the four divisions listed in the Petition. MOTION: Mr. Chinchor made a motion that a Certified Electrical contractor licensee could perform all of the activities described in each division; that a Registered Electrical contractor licensee would likely be able to perform most, if not all, of the described activities; and that some of the described activities could be performed by an utility line electrical specialty contractor. SECOND: Mr. Flaherty. Petition for Declaratory Statement Vergona Bowersox Electric, Inc. The petitioner was not present nor represented by counsel. The Petition seeks the Board s opinion as to scope of authority of a certified electrical contractor when installing solar photovoltaic systems. MOTION: Mr. Sandefer made a motion that an electrical contractor can: bid and be the primary solar contractor on any solar project; do concrete foundations incidental to the installation of the solar photovoltaic system; and can provide structure, support and penetrations that are incidental to the system installation. However, the electrical contractor may have to subcontract for the non-incidental construction work. SECOND: Mr. Chinchor. 9 MOTION: Mr. Hoffmann made a motion to reverse the denial and approve the application for licensure in an inactive status and require Mr. Patera to appear before the Board to activate the license and submitting a new personal credit report and new personal financial statement showing a positive networth. Robert Sherman Application Denial Mr. Sherman was present and sworn in by the court reporter. MOTION: Mr. Hoffmann made a motion to reverse the denial and approve the application. SECOND: Mr. Flahrty. Anthony Valero Application Denial Mr. Valero was present and sworn in by the court reporter. Robert Smith Mark Uffelman LEGISLATIVE REPORT Mr. Flaherty informed the Board that the bill related to requiring journeymen is back before the legislature this session. RULES REPORT - 9 -

10 Ms. Loucks presented the rules report, she informed the Board that Rule 61G is pending completion of the Statement of Estimated Regulatory Costs. 61G Fees The following fees are prescribed by the Board: (1) No change (2) The initial application fee for licensure by endorsement as a certified unlimited electrical, alarm system or specialty contractor by endorsement or certification of a registered contractor shall be two hundred dollars ($200.00). (3) through (8) No change (9) Delinquent Fee. If licensee becomes delinquent, an applicant must elect for active or inactive status, and a fifty dollar ($50.00) delinquent fee will be charged. (10) through (13) No change (14) The initial application fee for licensure by second entity as certified unlimited electrical contractor or alarm system contractor shall be two hundred fifty dollars ($250.00). (15) Pursuant to Section , F.S., in addition to all other fees collected from each licensee, there shall be a five dollar ($5.00) fee collected at the request of the Department, both upon initial licensure and license renewal for the purpose of combatting unlicensed activity. MOTION: Mr. Chinchor made a motion to notice Rule 61G re: Public Comment for development and approved the language presented with a time frame of 5 minutes. SECOND: Mr. Smith. 61G Public Comment. The Electrical Contractors' Licensing Board invites and encourages all members of the public to provide comment on matters or propositions before the Board or a committee of the Board. The opportunity to provide comment shall be subject to the following: (1) Members of the public will be given an opportunity to provide comment on subject matters before the Board after an agenda item is introduced at a properly noticed board meeting. (2) Members of the public shall be limited five(5)_minutes to provide comment. This time shall not include time spent by the presenter responding to questions posed by Board members, staff or board counsel. The chair of the Board may extend the time to provide comment if time permits. (3) A member of the public shall notify board staff in writing of his or her interest to be heard on a proposition or matter before the Board. The notification shall identify the person or entity,

11 indicate the person or entity's support, opposition, or neutrality, and identify who will speak on behalf of a group or faction of persons consisting of five(5) or more persons. If the person or entity appearing before the Board does not wish to be identified, a pseudonym may be used. Rulemaking Authority: , FS Law Implemented: , FS History-New. MOTION: Mr. Chinchor made a motion there was no adverse financial impact in excess of $200,000 and no Statement of Estimated Regulatory Costs was required. SECOND: Hoffmann FINANCIAL BUDGET LIAISON REPORT David Botknecht Mr. Biggins provided the financial report to the Board for their review. UNLICENSED ACTIVITY (ULA) REPORT Thomas McHaffie & David Botknecht No report. EXAMINATION REPORT Kenneth Hoffmann Alex Bosque and Fanny Fuentes appeared before the Board to discuss the exam. Mr. Bosque advised the Board that consultants in Tallahassee assist with review of the examination. Ms. Fuentes discussed the issue of which version of the National Electrical Code should be used as a reference for the exam. The Board asked that the exam be updated to the most current version of the NEC rather than waiting for the Florida Building Code to be updated. ENDORSEMENT REPORT No changes. RATIFICATION OF APPLICATIONS The lists will be attached to the minutes and are hereby incorporated by reference. MOTION: Mr. Hoffmann made a motion to reconsider the application of Terry Moore. OLD BUSINESS/ NEW BUSINESS Mr. Chinchor stated for the record that the 2 week deadline for applications to be complete and in the Board Office to make the agenda stands and he does not plan to make any exceptions. The Board agreed to move some of its business to Wednesday s starting at 1:00 pm in order to reduce the workload on Thursdays. The Board asked Mr. Biggins to determine what would be best on the Wednesday agenda. The Board discussed the issue of certified licensees and grandfather applicants applying to qualify municipalities and what documentation would be required on the municipality. No final determination was reached,. PROSECUTING ATTORNEY S REPORT Erica White, Esq., Assistant General Counsel Mr. Campbell directed the Board s attention to the details of the report which was distributed to the members.
