1 ORDNANCE NO. 42 AN ORDNANCE OF MARTN COUNTY, FLORDA': AUTHORZNG THE NVESTMENT OF SURPLUS PUBLC FUNDS N SHARES OF NVESTMENT FUNDS CREA*D BY THE FLORDA COUNTES NVESTMENT TRUST: i PROVDNG FOR CONFLCTNG PROVSONS; DRECTNG THAT COPES OF THS ORDNANCE BE 2 FLED WTH DEPARTMENT OF STATE; AND PROVDNG FOR AN EFFECTVE DATE AND CODFCATON. 3 NOW THEREFORE, BE T ORDANED BY THE BOARD OF COU TY 4 COMMSSONERS OF MARTN COUNTY, FLORDA: SECTON. DEFNTONS. Unless context of 6 indicates anor meaning or intent, following words and te ms 7 / as used in this Ordinance shall have following meanings. "Boardun means Board of County om missioners of 9 County. lo "Clerkw shall mean Clerk of Circuit Court for tlhe County, ex-off icio Clerk of Board, or such person as may be 2 duly authorized to act on his or her behalf. ttcountyw means Martin County, a political subdivision of he 3 / 4 State of Florida. "FCT" means Florida Counties nvestment Trust. A wgovernment Fund" means initial nvestment F 7 / established pursuant to Trust Agreement. "nvestment Fundw means a trust fund established pursuant to l8 l9 Trust Agreement to enable public entities to pool ir surp us 20 / funds for joint investment. 2 "Ordinancem means this Ordinance, as same may from time 22 time be amended, modified or supplemented. "Trust Agreement" means Agreement and Declaration of 23 "' 24 Trust, dated as of November, 99, creating and establishing 25 FCT. 26 SECTON 2. 2 (B) Section 25.3, Florida Statutes, provides certain limitations and regulations applicable to investment of surplus public funds where not orwise authorized by law or ordinance. (C) t, is, intent and desire of Boa& to authorize additional investments for surplus public funds in order to seek. a higher rate of return without compromising safety or such furds and to provide by this Ordinance authorization for investment opportunities in addition to those set forth in Section 25.3 () (a) through (f), Florida Statutes 30 secretary (D) The FCT, trustees of which are appointed by Florida Association of Counties, nc. and Florida Association of Court Clerks and County Comptrollers, has been created for purpose of establishing nvestment Funds for pooling surplus funds of participating public entities for joint investment order to seek a higher rate of return without compromising safety of such funds. BECTON 3. AUTHORZATON OF NVEBTMENT. Surplus public funds managed or held by Clerk on behalf of any officer, board, authority or agency of County may be invested in shares of Government Fund or any or nvestment Fund, assets of which are restricted to investment instruments authorized by Section 25.3, Florida Statutes or by ordinance of County. SECTON 4. CONFLCTNG PROVBONS. Special acts of Florida Legislature applicable only to unincorporated areas Martin County, County ordinances and County resolutions, or parts reof, in conflict with this ordinance are hereby superseded this ordinance to extent of such conflict. SECTON 5. FLNG WTH DEPARTMENT OF BTATE.
