Daley Center Room 1001 Chicago, Illinois FAX OFFICE OF THE CLERK OF THE CIRCUIT COURT OF COOK COUNTY FOR IMMEDIATE RELEASE Press Contact: Jalyne Strong (312) The Clerk of the Circuit Court, the State s Attorney, the Public Defender and Other Agencies to Host a Full Service, Community-Based, Adult and Juvenile Expungement Summit at Roberto Clemente Community Academy Chicago (May 6, 2008) - The Honorable Dorothy Brown, Clerk of the Circuit Court of Cook County; the Honorable Richard Devine, State s Attorney of Cook County; the Cook County Public Defender, and an array of governmental, legal, community and religious organizations and agencies, will sponsor an Adult and Juvenile Expungement Summit at Roberto Clemente Community Academy, 1147 N. Western Ave., Chicago, IL, on Saturday, June 7, 2008; registration begins at 8:30 a.m. This full-service, community-based Expungement Summit has been extremely successful for the last three years, attracting 2,500 to 3,000 people per year who sought to improve their ability to obtain employment by having expungeable offenses removed from their criminal histories. Previous summits were held at Austin High School, DuSable High School, and Chicago Vocational Career Academy. At the summit, volunteer attorneys assist participants with the preparation of applications for the filing of petitions that qualify for expungement and sealing. The State s Attorney, Chicago Police Department and Illinois State Police holds information sessions on their expungement petition review process. Sessions will be offered on Criminal and Financial Identity Theft presented by the State Appellate Defender (criminal) and the Illinois Attorney General (financial). Additionally, a new feature this year will be sessions on citizenship presented by Illinois Coalition for Immigration and Refugee Rights; Centro Sin Fronteras; and Rainbow PUSH Latino Chapter. Individuals who do not qualify for expungement may attend a panel discussion conducted by the Illinois Prisoner Review Board to learn about Certificates of Good Conduct and Relief from Disabilities, as well as how to prepare letters for clemency and/or pardons from the governor. Other agencies will provide information on employment, job training, health care, housing, voter registration and other services for ex-offenders. The Illinois Department of Employment Security will hold an information session on job placement for ex-offenders. To have a petition filed on site, the petitioner must bring a rap sheet (criminal history) and filing fees, which may include $60 for the Clerk's Office, $60 for the Illinois State Police, $9 per certified disposition (adult cases) or $4 per certified disposition (juvenile cases). If the case is a Page 1 of 2

2 Class 4 Felony drug case, the petitioner will have to provide the results of a drug test taken within the past 30 days. This is an opportunity for individuals to expunge their court records; a second chance for them to be law-abiding, productive members of society, said Clerk Brown. We are attempting to remove as many impediments as possible for people who are attempting to better themselves and their quality of life. 3 Fact Sheet Expunged Records vs. Sealed Records When a record is expunged, it is physically destroyed by the agency, as if it never existed. When an Illinois State Police record is sealed, it is no longer available to a potential employer or other members of the Public, but can still be seen by law enforcement agencies. When a Clerk s Office record is sealed it can be viewed by a potential employer or members of the public by a judge s order. Adult Expungement and Sealing Why Individuals File for Expungement or Sealing Petitions To obtain an apartment or housing To join the Armed Forces, such as the Army, Navy or Air Force To open any child development center that is facilitated by the State of Illinois Department To obtain employment To attain certification for occupations, such as those in the medical or legal fields To immigrate To adopt For marital reasons Gases That Can Be Expunged Cases in which you were acquitted, released without conviction (including cases in which you were not charged), there was on not guilty finding or no probable cause finding, or nolle prosequi (the state did not go forward with your case). Some cases for which you received misdemeanor supervision. Cases That CANNOT Be Expunged CONVICTION, including: A quilty plea, guilty finding or guilty verdict resulting in a sentence other than probation under the Cannabis, Controlled Substances, Steroid Control or Alcohol and Drug Dependency Acts Probation (except under the Cannabis, Controlled Substances, Steroid Control or Alcohol and Drug Dependency Acts) Cases where the defendant was granted supervision for or was convicted of a sexual offense committed against a minor under 18 years of age Conditional Discharge Time Considered Served D.U.I. Supervision Juvenile Expungement Why Individuals File for Expungement The majority of juvenile arrest records are reported to the Illinois State Police Department and shared with the FBA. Arrest records are accessible to potential employers, the fact of which may hinder an applicant s employment opportunities. Individuals have lost job or face losing their jobs because their arrest or court cases are not expunged. It is easier to apply for school loans and for admission to universities and law schools that require disclosure of an arrest or court case history. Cases That Can Be Expunged All arrests that did not result in court petitions. All juvenile court cases EXCEPT for convictions of First Degree Murder and Criminal Sexual Assault. ** There are fees associated with expungement and sealing. (If whole record qualifies, expungable 5 years after termination of supervision. Sealable 3 years after termination of supervision.) Expungable Cases where a person was given probation for possession of cannabis or controlled substances ( 710 or 1410 probation). (If whole record qualifies, expungable 5 years after termination of probation. Sealable 4 years after termination of probation.) Not Expungable or Sealable All other felony convictions. ( Convictions include guilty plea, guilty finding, guilty verdict, time considered served, payment of a fine, conditional discharge, probation, prison time, or a sentence to time in Cook County Jail.) ADULT MISDEMEANOR Expungable Cases where a person was arrested but not charged, or was acquitted; or the case was dismissed; or the case had a not guilty finding, a no probable cause finding, was stricken off the call with leave to reinstate (SOL), non-suited, or nolle prosequi. Expungable If a person is 17 years of age and was arrested without a petition for delinquency, there was a not delinquent finding, s/he successfully completed supervision for a crime, or there was adjudication of an offense that would be a Class B Misdemeanor, Class C misdemeanor, or petty business offense JUVENILE if committed by an adult, and all juvenile court proceedings against the person have been terminated, whichever is later. Expungable If a person is 21 years of age or older and 5 years have elapsed since all juvenile proceedings against him/her have been terminated, whichever is later (unless adjudication for first-degree murder or a sex offense). Not Expungable Adjudications for first-degree murder or sex offenses.
