Any person proposing to use any municipally owned street right-of-way within the city for any private purpose other than installation of a driveway or driveway culvert as specified in section or related to trees as specified in sections through 25-50, shall first obtain approval from the city director of public works. n the event approval is obtained from the city director of public works, the applicant shall sign a release and waiver of liability regarding such private facility or improvement. Such private facility or improvement shall include, but not be limited to, installation of underground s rinkler s te ing walls f; s i hting system etc ovided, however, that street right-of-way s e used for parking or storage of ve es or equipment; disp ay of mere an ei or er on o any sign. Erection of buildings, balconies, supported canopies, stairways and the like may be permitted upon review and approval by the mayor and board of aldermen. The city, in granting approval to use the right-of-way for any private purpose, does not in any way assume maintenance or upkeep of the facility or improvement, nor will the city be held responsible for any damage which may be inadvertently done to such improvement regardless of the source or cause of such damage. The city may. at any ti.me, direct that such facility or improvement be removed from the right-ofway at the expense of the owner, except in instances whereby a permanent easement bas been granted by the mayor and board of aldermen. Any damage to city facilities (including, but not limited to, damages to sidewalks, streets, curb, underground utilities and storm drains) shall be repaired by the owner and approved by the city director of public works before any private facilities or improvement is occupied.
