1 Competition Terms and Conditions So you think you can punt? (INCLUDING ELIGIBILITY REQUIREMENTS) THESE TERMS CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS, PRIVACY AND PERSONAL INFORMATION. PLEASE READ THESE TERMS CAREFULLY. You must indicate your acceptance of the eligibility requirements below by checking the box signifying your agreement where indicated if you wish to apply to be considered for So You Think You Can Punt? 1. I, the applicant named in this Application Form, agree with Punters Paradise Pty Ltd that in consideration for Punters s labour and expense in making arrangements relating to my participant application for the five week series So you think you can punt! (also referred to as the Program ) and the opportunity provided to me to potentially appear in or in association with the Program, I hereby consent to the filming and recording of such contribution and my involvement in the auditioning process and the Program, on the terms and conditions below: 2. I am at least 24 years of age, and am an Australian citizen or permanent resident and will supply a copy of my birth certificate, passport or such other documentation as Punters may require to confirm such. 3. Neither I nor any member of my immediate family or anyone living in my household are or have been within the last two (2) years an employee, officer, director or agent of any of Punters Paradise Pty Ltd or Ladbrokes. In addition, I acknowledge that Punters reserves the right to render ineligible any person who either of them determines, in their sole discretion, is sufficiently connected with the production, administration or distribution of the Program. 4. If selected as a participant in the Program, I agree to execute all waivers and release agreements required by Producer and Broadcaster and any of their licensees, successors or assigns. 5. I will be available to the production for the approximate dates as follows: Shoot Day 1 - Mon 10th Sep, Field two locations (two of trainer, breeder, jockey, form expert) Shoot Day 2 - Tues 11th Sep, Green screen Shoot Day 3 - Wed 12th Sep, Field two locations (two of trainer, breeder, jockey, form expert) Grand Final - Fri 26th OCT (MV Manikato Stakes, Randwick) 6. I am willing to travel to various locations as part of production of the Program, travel expenses will be covered by Punters.

As part of the Program, I agree to create an account with Ladbrokes Digital Australia Pty Ltd (Ladbrokes) via Ladbrokes.com.au and agree to all Ladbrokes.com.au terms and conditions, available here: 8. I hereby accept that the competition is subject to change and Punters reserves the right to make changes at their discretion. 9. I hereby give the following representations, warranties, acknowledgements, consents and releases: 8.1 I hereby represent, warrant, acknowledge and agree that: (a) I have read and I meet and agree to be bound by the terms and eligibility requirements; (b) I will abide by the rules, regulations, terms and conditions ( Rules ) of the Program and any interview, auditioning process, event, activity, promotion or publicity relating thereto as devised from time to time by Punters and will accept the decision of Punters as final and I hereby acknowledge that the interests of the Program shall override those of any participant; (c) I have completed this application and will complete all forms associated with the Program honestly and accurately and I agree that the answers and information I will supply in such forms and otherwise to the Producer will be in no way misleading. I furthermore acknowledge that the Producer reserves the right exercisable at any time at its sole discretion to disqualify me from the contest or auditioning process should I at any stage supply untruthful, inaccurate or misleading personal details or information, break the Rules or otherwise be in breach of these terms. Accordingly, I understand that if any of the information in this application is found to be false or incomplete, this will be grounds for dismissal or disqualification from the Program if I am selected to participate; (d) Punters has no obligation to select me as a participant for the Program; (e) Even if I am selected as a participant, Punters has no obligation to record my involvement in the Program and has no obligation to broadcast my involvement in it; (f) All decisions by Punters concerning selection of the participants is final and not subject to challenge or appeal; (g) Punters has no obligation to return any materials submitted by me as part of the application whether or not I am selected as a participant; and (h) I have not and will not enter into any commercial or other sponsorship agreement or arrangement with any person, firm or company in respect of my appearance in the Program. (i) I do not have an account with a gambling operator (wagering or otherwise) that is closed, suspended or marked as self-excluded due to a Responsible Gambling or financial concern. 8.2 By submitting my video application and form: (a) I consent to the recording, use and reuse by Punters, and any of their respective licensees, successors, assignees, parents, subsidiaries, or affiliated entities, and each of their respective employees, agents, representative, officers and directors (collectively Releasees ) of my voice, actions, likeness, name, appearance, biographical material, and any information contained in, derived from or obtained in connection with my application

3 to be a participant in the Program or in any materials submitted by me or a third party in connection with my application (which includes, without limitation, any personal information as defined in the Privacy Act 1988 (Cth) or otherwise ( Personal Information )), (collectively Likeness ) as edited, altered, or modified by Punters or by any of the other Releasees, in any and all media now known or hereafter devised, throughout the universe in perpetuity, in or in connection with the Program. (b) I further agree that Punters exclusively owns all right, title, and interest (including, without limitation, all copyrights) in and to any and all recordings made by the Releasees and in and to any and all video that I have provided in connection with my application and any other materials that I have provided or may provide in connection with my application or the Program (collectively Materials ), including, without limitation, the right to edit, alter or modify the Materials and to use all or part of the Materials and my Likeness in any and all media now known or hereafter devised throughout the universe, in perpetuity. (c) Without limiting the foregoing, I hereby assign irrevocably to Punters (including present assignment of future copyright) the entire copyright and all other rights of whatsoever nature in my contributions to the Program, the Likeness and the Materials such that the Producer shall be entitled to use and exploit and license others to use and exploit my contributions to the Program, the Likeness and the Materials by all means and in all media and formats whether now known or hereafter invented throughout the Universe for the full period of copyright including any extensions and renewals thereto and thereafter insofar as is possible in perpetuity. Furthermore, I grant irrevocably all consents and waivers (to the extent permissible at law) necessary to enable Punters (and persons authorised by Punters) to make fullest use of the Program, my contributions to the Program, the Likeness and the Materials without restriction. (d) Without limiting the forgoing, I acknowledge that I recognise the needs of the production, promotion and distribution and hereby irrevocably consent to the Releasees (and persons authorised by the Releasees) editing, producing, amending and adapting the results and proceeds of my contributions to the Program, the Likeness and the Materials ( Works ) or any other act or omission in relation to the Works as the Releasees deem fit in their absolute discretion and whether or not such acts or omissions constitute an infringement of my moral rights as that term is understood pursuant to any provision of law prevailing now or in the future in any part of the world ( Moral Rights ). I acknowledge and agree that the Releasee (and persons authorised by the Releasees) will not be liable to me and that I will have no claim against the Releasees or any other person for any act or omission of the Releasees (and persons authorised by the Releasees) resulting in any prejudicial or derogatory portrayal or representation of me and/or the Works or any other act or omission which might otherwise constitute an infringement of my Moral Rights. In all other respects, I irrevocably waive to the extent permissible by law and agree never to assert any Moral Rights arising out of or in connection with the Works against the Releasees or any other person throughout the universe in perpetuity. I will not institute any action on the ground that any changes, deletions, additions or other use of the Works violates my Moral Rights. (e) Without limiting the forgoing, I agree that the Releasees shall be entitled to:

4 i. Alter, adapt or make additions to or deletions from the Program (and my Likeness thereon) at their discretion; ii. Make and exploit and to authorise the making and exploitation of any recording or fixation of my Likeness separately from or in conjunction with the Program throughout the Universe in perpetuity in all media whether now known or hereafter invented; iii. Dub my voice in any language; and iv. Use my Likeness, the Materials, photographs of me and recordings of interviews with me separately from or in conjunction with the Program in all media and formats throughout the Universe including but not by way of limitation in advertising, publicity, promotions, marketing and exploitation material. For the avoidance of doubt, I irrevocably consent to the Releasees (and persons authorised by the Releasees) transferring Personal Information about me overseas to related body corporates and third parties associated with the Program and to use the Personal Information in accordance with the provisions in this Agreement. (f) I agree that I will not be paid any money for giving the Releasees the rights referred to in this Agreement or for signing this agreement. However, I acknowledge and agree that Punters s labour and expense in making arrangements relating to my participant application for the Program and the opportunity provided to me to potentially appear in or in association with the Program, ( Benefits ) include sufficient and adequate consideration for the use and exploitation of my contributions to the Program, the Likeness and the Materials (including without limitation my appearance in any and all episodes of the Program) by any means and media, anywhere in the Universe and I waive any right and/or entitlement to any equitable relief, remuneration or other payment howsoever arising in connection with such use or exploitation. I further acknowledge and agree that the Benefits also include full and final consideration for my attendance at any and all activities as required by Punters in connection with the Program. I also acknowledge that no repeat fees will be payable to me in respect of any subsequent rebroadcast or retransmission or any other use by the Producer (or any assignees or licensees) of the Program or any part thereof. (g) I release the Releasees (jointly and severally) from any and all liability arising out of the recording or use of my Likeness and/or the Materials and I agree not to make any claim against the Releasees as a result of the recording or use of my Likeness and/or the Materials (including, without limitation, any claim that such defames me or invades any right of privacy and/or publicity). (h) The Releasees (jointly and severally) shall not be liable to me or my legal representative for any loss or damage or injury to me or my property caused by or suffered during or in connection with my taking part in the Program unless (subject to viii above) caused by the negligence of a Releasee and recoverable on that ground from that Releasee following judgment of a competent court of final judgment. (i) I agree not to disclose to any third party (other than my professional advisors) any information relating to the Program or the affairs of Punters (or any assigned company) or Producer, which may come to my knowledge during or in connection with my participation in the Program.

5 (j) I agree that I will not publicise or discuss with any third party without prior written consent from Punters any information relating to the Program, my appearance in the Program, any of the production team or any participants in the Program nor any other information which may come to my attention relating to Promoter or the Producer or otherwise connected to the Program save for such information which is already public knowledge. Should I be contacted by a member of the press at any time I agree to refer them to Punters or such person as Punters may nominate. (k) I agree that I grant the rights hereunder whether or not I am selected to participate in the Program in any manner whatsoever. (l) I will at the request of Punters, do everything necessary, including execute any documents, to give effect to this agreement and the transactions contemplated by it and cause third parties to do the same. (m) I agree that Punters may assign my services and all other rights in my contribution to the Program, the Likeness and the Materials to any subsidiary or associated companies or successors in title and to any other third party. (n) If I have opted-in above as part of this Application, I acknowledge that I have agreed to Punters contacting me about upcoming programs to be produced by Punters and associated casting opportunities. When to enter 1. The competition commences on Tuesday 21 st August 2018 at 9:00am and concludes on Monday 27 th August 2018 at 23:59am AEDT. Entries must be received by Punters Paradise prior to the competition close date and time. 2. The time of entry will in each case be the time it is received by punters.com.au, not at the time of transmission by the entrant. Punters accepts no responsibility for any late, lost or misdirected entries. 3. Punters reserves the right to change competition dates at our discretion. How to enter 1. Entrants may enter the competition by publishing a video of themselves informing us why they think they should feature on the series, this can be anything from cheering on their best win / lamenting their best loss or tipping us into a winner. Entries must be made via the dedicated landing page or via . Entrants must also complete an application form, all required fields must be completed including name, address, phone number, postcode and confirmation that the entrant is 24yrs or over. Information provided on form part of these terms and conditions. In the event of any inconsistency, these Terms and Conditions shall prevail.

6 2. Any entry that is made on behalf of an entrant by a third party will be invalid, unless the entrant requires the assistance of a third party to enter due to a disability. 3. Punters Paradise reserves the right to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. 4. Video applications will be used for promotional purposes by Punters on social media and the co-branded webpage on Punters.com.au. Selection Process 1. Players will be picked on a best fit basis through a selection process conducted by Punters.com.au. Punters decision is final and Punters will not enter into correspondence regarding the competition result or any other decisions Punters makes in connection with the Promotion. 2. Players will be selected based on the following criteria: - Level of Entertainment - The most engaging - Best reflects your personality 3. The selected players will be notified by telephone and within two days of the panel s decision. Selected players will be published on punters.com.au by Wednesday 29 th August Selected players are in for the chance to win prizes. Prizes will be awarded to the participating player only. 5. Should an entrant s contact details change during the promotional period, it is the entrant's responsibility to notify Punters. A request to access or modify any information provided in an entry should be directed to Punters. 6. All selected players are required to open a Ladbrokes account. Prize on offer 1. The winner will receive the following prizes: a) 5% in a Proisir/Gemstone colt in training with Troy and Leon Corstens with fees covered until 1st Jan 2019 (Horse Share Prize); and b) $2,000 AUD cash prize, to be deposited into the winner s Ladbrokes.com.au account (Cash Prize).

7 2. The Horse Share Prize is not transferrable, exchangeable or redeemable for cash. 3. Eligibility to receive the Cash Prize is contingent on the winner verifying their identity with Ladbrokes to Ladbrokes satisfaction within 14 days of being notified that they are a prize winner. 4. The Cash Prize may take up to 14 days to reach the winner s Ladbrokes.com.au account. 5. Should it be identified that the winner has breached the Ladbrokes terms and conditions in any way while participating in the Program, the winner will be deemed ineligible to receive the Cash Prize. 6. If a Prize is unavailable for reasons beyond Punters s control, Punters reserves the right to substitute the prize with a prize of equal or greater monetary value. This right is subject to any applicable legislation, regulations or directions from a regulatory authority. 7. Punters takes no responsibility for the Prizes once they have been transferred to the winner. 8. All taxes (including GST & income tax) which may be payable as a consequence of receiving a Prize are the sole responsibility of thewinner. 9. A winner's use of a Prize is entirely at their own risk. Before a Prize is awarded, a winner may be required to sign an agreement to release Punters from and indemnifying Punters against any liability arising from the winner s acceptance and use of the Prize and the winner s participation in the Competition. INFORMATION AND PRIVACY Punters collects information about you, including for example your name and contact details which you provide when registering or using our services as well as information from data houses, social media services, our affiliates and other entities you deal or interact with for example by using their services. We collect and use that information to provide you with our goods and services, to promote and improve our goods and services, to provide you with targeted advertising based on your online activities, for the purposes described in our Privacy Policy and for any other purposes that we describe at the time of collection. We will disclose your information to our partner Ladbrokes. If you do not provide us with requested information we may not be able to allow your participation in the competition. We may disclose your personal information to authorities if you are a prize winner or otherwise as required by law. Further information about how we handle personal

8 information, how you can complain about a breach of the Australian Privacy Principles, how we will deal with a complaint of that nature, how you can access or seek correction of your personal information and our contact details can be found in our Privacy Policy I have read, understand, and agree to be bound by all of the terms and conditions of this application.
