3 Fulton County Board of Commissioners Request for Proposals Lawn Mowing The Fulton County Board of Commissioners has elected to receive proposals for lawn mowing for various county lots. Proposals must be received in the office of the Clerk of the Board by 4:00 p.m. on Friday, March 21, If interested, specifications and proposal forms can be downloaded from fultoncountyoh.com, or obtained in the office of the Clerk of the Board at 152 S. 4 SPECIFICATIONS FOR THE CONTRACTUAL SERVICE OF PROVIDING LAWN MOWING SERVICES FOR FULTON COUNTY OHIO INSTRUCTIONS I. All proposals must be received by March 21, 2014 at 4:00 p.m. and must be in a sealed envelope, clearly marked 2014 LAWN MOWING PROPOSAL on the outside, along with the name and address of the proposer; II. Each proposal must be submitted on the forms provided and must have any and all blank spaces filled in, in ink; III. Any and all proposals received after 4:00 p.m. on March 21, 2014 will be considered late and will be rejected; IV. The Contracting Authority ( County ) reserves the right to waive any irregularities and the right to reject any and all proposals; V. All affidavits & acknowledgments contained in the proposal and shall be submitted at the time of proposal: Non-Collusion Affidavit, Non-Discrimination Affidavit, No Findings for Recovery Affidavit, Personal Property Taxes Affidavit & OPERS Independent Contractor/Worker Acknowledgment; VI. Prior to entering into contract, the awarded service provider ( Contractor ) must submit a Certificate of Insurance, and proof of coverage by Workers Compensation Insurance; VII. The Contractor shall be employed as an independent contractor and not as an employee of Fulton County, Ohio, for any purpose whatsoever, including civil service laws, to perform the duty of lawn maintenance, as needed for the locations described in Exhibit A attached hereto; VIII. The County will pay the Contractor on a per lot basis for services rendered in accord with the per lot price proposal submitted for each item awarded as full compensation for the actual work performed; IX. The Contractor shall furnish all labor, material, tools and equipment to perform and complete the lawn maintenance as described herein; X. All documents contained herein shall be considered part of the awarded contract; XI. The Contractor shall complete all work and services, as described herein on a weekly basis, unless otherwise instructed by a County Representative. Any additional services will require prior authorization; XII. The awarded contract shall be in effect from April 15, 2014 through October 15, 2014, unless otherwise amended by formal proceedings of the Fulton County Board of Commissioners; XIII. A Mandatory Pre-Proposal meeting will be held on March 14, 2014 at 10:00 a.m. to provide further details regarding the lots described in Exhibit A. The meeting will be held in the 2 nd Floor Conference Room of the Fulton County Administration Building at 152 S. Fulton Street, Wauseon, Ohio

5 DESCRIPTION OF CONTRACTUAL SERVICES Section I. SCOPE OF WORK. The Contractor shall furnish all labor, material, tools and equipment to perform and complete the lawn maintenance authorized by this Agreement. The locations subject to this agreement in Exhibit A, as part of this proposal, shall include the mowing of and trimming around all landscaping and signs; keeping all sidewalks and roads free of all lawn clippings; and bagging all lawn clippings when clippings are visible, or as otherwise instructed by a representative of the Contracting Authority. Section II. WORK COMPLETION. The Contractor shall complete all work and services, as described in the proposal, on a weekly basis, unless otherwise instructed by a representative of the Contracting Authority. Section III. SCHEDULE OF PAYMENTS. The Contractor shall submit an invoice to the Fulton County Board of Commissioners on a monthly basis, 152 S. Fulton Street, Suite 270, Wauseon, Ohio Payment to the Contractor shall payable upon receipt, subject to review and acceptance by the Contracting Authority. Section IV. REVIEWS AND ACCEPTANCES. All work and services performed by the Contractor under this agreement shall be subject to review and acceptance by the county. Section VII. INSURANCE. During the term of any agreement awarded herein, Contractor shall maintain liability insurance in minimum amount of at least $1,000, Prior to beginning of said work, Contractor shall present the County with a Certificate of Insurance as proof of a minimum of $1,000, of liability insurance in force. Said insurance shall name the Fulton County Board of Commissioners and indemnify and hold the County harmless for any and all liability, obligations, losses, claims and damages, and without limitation, counsel fees and expenses, penalties and interest, arising out of or relating to said work. In addition, the Contractor shall maintain, as required by law, an adequate Certificate of Workers Compensation and shall be submitted to the Contracting Authority prior to the beginning of the performance of any work, subject to this agreement. 5
