Power Corporation Ltd. Budaun. With reference to your invitation tender spn no 01/EDCB/ for carrying out the work for Operation work of Various 33/11 KV S/s in Electricity Distribution Division-Ist, Budaun round the clock Duty of 8 Hrs ITI (Electrician Trade) operation operator in also look after the switchyard/control room and to maintain its record as detailed in technical specification in favor of EDC, Budaun as per shift supply schedule. I/ We hereby offer to the MVVNL, the rates for the items mentioned in the schedule of prices and delivery annexed on such portion thereof as you determine in strictly accordance with the annexed conditions of contract Form A specification and schedule of rates to the satisfaction of the purchaser or in default thereof to forfeit and to pay MVVNL a sum or money as mentioned in the said conditions. The rates quoted are inclusive pro-rata in full satisfaction of all claims. I/We agree to abide by this tender for the period of 12 month from the date fixed for receiving the tenders. Part- I- The bidder shall submit the following document in sealed envelop with part 1:- i- Required Earnest money in shape of FDR/CDR/DD/TDR in favor of Superintending Engineer, Electricity Distribution Circle, Budaun. The earnest money in shape of cheque shall not be accepted and the tender will be liable to be rejected. ii- Proof of having supplied skilled/unskilled labourers to govt. department. Offers of only those bidders will be consider who have supplied at least 15 Skilled and un-skilled labourers in any of the Central/State govt. department and their registration with labor commissioner. Preference shall be given to the contractor who has supplied skilled/unskilled labuor in UPPCL for operation of 33/11 KV and above sub-stations. iii- Proof of having registration with EPF & Insurance of Skilled and un-skilled labourers. Conditional Part-I shall not be accepted & will be rejected out right. Part I should be complete in all respect or part two will not be opened. B. Part-II- Part II will be submitted is sealed envelop which will consist rates only. SPECIAL TERMS & CONDITIONS 1. The contractor shall follow terms and conditions as per Chairman, UPPCL letter no- 189/PSCH/2007 date and any other conditions as directed by UPPCL/MVVNL/Govt. of UP. 2. The contactor will engage one qualified ITI (Electrician Trade) labourer having sufficient experience in each shift for operation of S/s equipments/cleaning of switch yard/control room and to maintain its records as detailed in technical specification. 3. The labourer engaged by the contractor shall follow instructions of the concern EE/SDO/JE in respect of proper operation & maintenance of Sub-stations, maintenance of records, registers etc. 4. The contractor shall get withself registered with Labour commissioner in accordance with form-05 within 15 days of issue of letter of intent necessarily. Name and address of all engaged labourer will be mentioned in registration 5. Contractor will deduct EPF deduction from the salary of labourer and will deposit such deduction in the office of EPF commissioner monthly. Photocopy of receipt of such deposits shall be submitted by contractor in the department. 6. All charges/compensation on account of damage, loss, theft or accident to be paid as per factory act shall be born by the contractor and he shall be solely responsible for making payments to claimants. For meeting such eventuality, Contractor will provide sufficient insurance cover to its employees. MVVNL is no way shall be responsible for any compensation in case of accident. 7. The contractor will furnish to the department written certificate of all skilled/un-skilled labourers employed by him stating that the labourer so engaged neither will claim service in the MVVNL/UPPCL nor will file any case for appointment in service in MVVNL/UPPCL in any court. : : 2 : : Contd...page 2

7 8. The contractor will ensure payment of minimum wages to labour as fixed by DM/Labour department and will follow the orders of minimum wages issued by DM/Labour department. 9. The contractor will submit age proof certificate of each employee provide by him. Age of labour engaged by the contractor should be years. 10. The contractor will submit character certificate and medical certificate in respect of each Employee provide by him and he will be responsible for any mischief committed by any of his labour. 11. The engagement of out side agency for above work will be done for 12 months only and can be extended upto Six month. 12. All the terms & conditions of the labour Act will be adhered to strictly by the contractor. 13. The wages of skilled/un-skilled labour will be paid by the contractor in the first week of every month in the presence of Sub-Divisional officer concerned, who will certify that the payment of wages has been made by the contractor, In case the contractor fails to make the payment of wages to his labour in time, payment will be made to the employee of contractor by the corporation by enchasing the earnest money/security deposit of the contractor. 14. No experience certificate will be issued by any officer of the UPPCL/MVVNL to any employee of the contractor. 15. No contractor shall be eligible to enter into contract with the MVVNL unless he has obtained license from labour commissioner under the contract labour (Regulation and abolition) Act 1970 and as amended from time to time. 16. It shall be sole responsibility of the contractor to ensure compliance of all labour, industrial and other enactments, rules and orders in force regarding conditions of labour safety of goods, safety and security of people and property etc. 17. The contractor shall ensure that workmen engaged by him possess identity card, entry pass duly signed by the authority designated by Engineer of contract. 18. The contractor shall be responsible for the execution of contract (work) in accordance with the terms and conditions of form A prescribed by the UPPCL. 19. The contractor shall arrange proper tools, plants equipments, workman etc. necessary for the work at his cost. 20. The contractor shall be required to satisfy the Engineer of Contract/Director Electricity Safety in respect of arrangements by him for safety and security of tools, equipments and staff etc arrange by him. He shall follow forthwith the instructions issued in these matters by the Engineer of Contract/Director Electricity Safety. 21. The contractor shall be obliged to discharge his liabilities under the contract most diligently and effectively. In case he fails, the MVVNL shall be free to take decision in this regard including assigning the task to some other person/agency. The contactor shall be responsible to bear the consequence of the same including any financial liability. 22. The MVVNL shall have the right to enquire the contractor to make good free of cost any damage to the equipment/property of MVVNL while carrying our the job. If the contractor fails to do the needful the MVVNL shall be at liberty to recover the cost of damage/loss in the manner deemed fit. 23. No claim shall be entertained for the labours rendered idle due to stoppage of suspension of work or delay in payment for any reason whatsoever. Contd...page 3 : : 3 : :

In case of any dispute arising out between the parties concerned Chief Engineer (D), Bareilly Zone, Bareilly shall be the sole arbitrator and his decision shall be final and binding on both parties. 25. The contactor will have to provide the certificate of ITI electrician trade holder of the workmen to be engaged for the work duly attested before execution of agreement to the Executive Engineer of the concerned division. 26. Apart from above, the contractor shall also be required to get registered with the concerning authorities for central excise duty and service tax in respect of his aforesaid labour. 27. The payment of Ex-gratia will be also made to his labour by the contractor, if it is found payable as per Labour act rules. 28. The skilled and Un-skilled labour being engaged by the contractor shall, in no case, be entitled for regular service of the corporation. 29. The wages of labour will be paid by the contractor to his labour as per minimum wage act by account payee cheques. 30. The contractor will register himself with EPF commissioner and such registration will be valid atleast for the agreement period. In case he fails to register with EPF Commissioner, his contract is liable to be cancelled without any notice. 31. The log sheets and other requisite registers and stationary as well as other material/spares required for attending maintenance/breakdowns shall be supplied by the department and the account of their consumption shall be given by the contractor to the engineer incharge of the Division. 32. A security equivalent to 10% of the total tender value wil be furnished by the successful contractor in shape of Bank guarantee duly pledged in favour of Superintending Engineer, Electricity Distribution Circle, Bareilly before execution of agreement. The security deposit shall be released after proper completion of work-agreement and on the recommendation of Executive Engineer concerned. 33. Income tax/other deductions as per UPPCL/MVVNL rules shall be deducted from the contractor s bills as per Central/State government rates prevailing in the department. 34. No compensation for idle labour shall be payable to the contractor in any circumstances. The compensation owing to accident/incident during execution of work shall be paid by the contractor at his own without any reference to UPPCL/MVVNL and conditional obligation for such compensation shall be sole responsibility of the contractor, The damage, If any, caused to the department/work/t&p by the contractor himself or his staff shall be recovered in full from the pending bill(s)/liability of the contractor. 35. The Superintending Engineer, Electricity Distribution Circle, Budaun will be the principal employer of the contract and the concerned Executive Engineer shall function as Engineer-Incharge of the contract. The work shall be got carried out as per rules by the contractor in strict supervision and to entire satisfaction of Engineer-Incharge of the Division. 36. The dispute arising, if any, taken into court, shall be within the jurisdiction of Bareilly. 37. Service Tax or any other tax, if applicable, shall be paid extra as per rules. 38. Other things being equal, preference will be given to Co-operative formed by employees of UPSEB in deciding the contract. 39. The quantity of labour may increase or decrease by 50%.
