2 REFORMS to TEMPORARY FOREIGN WORKER PROGRAM Now 2 streams: Temporary Foreign Worker Program International Mobility Program EXISTED; changes Academics and Staff who require a Labour Market Impact Assessment to obtain a work permit Academics and Staff who qualify for work permit under existing exemptions - e.g. NAFTA International Visitors who need an employer specific work permit NEW

3 International Mobility Program Who Does this Impact? Academic Exchanges: Visiting Professors/Researchers, Guest Lecturers, Research Award Recipients; Foreign Medical Residents and Medical Research Fellows; Post-doctoral fellows Foreign workers entering under trade agreements (NAFTA); International Experience Canada exemptions: Visiting Co-op Students and Interns. New Requirements Employer must pay $230 fee for each work permit, including renewals Employer must submit CIC Offer of Employment form, signed by Dean Must pay fee and upload Offer to CIC database before new hire/visitor applies for Work Permit or the application will be denied.

Foreign nationals exempt from the requirement for a work permit e.g. Guest Speakers Examiners and Evaluators Self-funded Researchers Candidates for Employment Business Visitors Non-trade agreements e.g. Fullbright Program (Canada-US) Work related to a research program e.g. Canada Research Chair and Canada Excellence Research Chair holders Open Work Permits Foreign national pays new $100 fee on open work permits, in addition to the $155 work permit processing fee e.g. post-graduation work permit applicants spouses of highly-skilled temporary foreign workers and international students certain International Experience Canada program participants certain foreign nationals who are already in Canada waiting for the finalization of their application for permanent residence

5 WHO DOES WHAT? What is your role to support hiring/inviting foreign national? 1. UCalgary Host (PI,Department Head, etc., ) contacts Advisor to invite a foreign visitor 2. Advisor assists the UCalgary Host complete the International Visitor Category Assessment and uploads it to SharePoint(Talent Management/Immigration Services/CIC IMP Documents) 3. Immigration Services assesses form, identifies appropriate visitor category and asks Advisor to complete the appropriate letter of invitation 4. Advisor obtains information from Risk Management, if the foreign visitor will conduct research involving animals and/or humans, finalizes letter of invitation and uploads to SharePoint 5. Advisor completes the Employer Compliance Fee Payment form, if required, uploads to SharePoint 6. Immigration Services pays the employer compliance fee online, completes the Offer of Employment form (IMM 5802) and uploads to SharePoint.

6 WHO DOES WHAT? What is your role to support hiring/inviting foreign national? 7. Immigration Services obtains authorization from Dean and submits Offer of Employment form (IMM 5802) to CIC and sends invitation letter and IMM 5802 form to foreign visitor 8. After arrival, Advisor collects a copy of the foreign visitor s work permit and uploads to SharePoint 9. Immigration Services verifies work permit and updates the tracking system 10. UCalgary Host informs Advisor of any changes to the terms and conditions of the foreign visitor s appointment (e.g., duties, payments, job title, etc.) 11. Advisor consults with Immigration Services prior to the implementation of any changes and advises the Host of any further action (i.e., reporting to or approval by CIC).

7 WHY IS THIS IMPORTANT? Employer inspection and compliance regime is being put in place by CIC If inspection finds employer non-compliant, the employer could face an administrative monetary penalty, a ban from hiring foreign workers, and in serious cases, a criminal investigation and prosecution.
