1 Terms of Reference Border Migration Management Assessment (BMMA) Consultancy: Rapid Border and Migration Management Assessment (BMMA) at Mwami/Mchinji Border Control Post (BCP) and updated Assessment (BMMA) at Chirundu One Stop Border Post (OSBP) Title: Border Migration Management Assessment Consultant Duration: Total 40 working days over a maximum of three months Location: The majority of the consultancy will be carried out remotely with field work in Zambia (Lusaka, as well as Chirundu and Mwami borders); Malawi (Lilongwe and Mchinji border); and, Zimbabwe (Harare and Chirundu border) Start date: 9th July BACKGROUND The International Organization for Migration (IOM) is seeking the services of a consultant to carry out a Border and Migration Management Assessment, focusing on the Chirundu One Stop border Post (OSBP) between Zambia and Zimbabwe and the Mwami/ Mchinji border post between Zambia and Malawi. The consultant will work under the overall supervision of the IOM Zambia Chief of Mission, and in close coordination with the Chiefs or Mission/ Head of Office in Malawi and Zimbabwe, the Senior Regional Thematic Specialist on Immigration and Border Management (IBM), based in Pretoria, and IBM focal points in the respective countries. With the support of the IOM International Development Fund, and in collaboration with the Common Market for Eastern and Southern Africa (COMESA), IOM is implementing a project entitled Promoting a Regional Corridor Approach to Coordinated/Integrated Border Management in Eastern and Southern Africa. The objective of the project is to increase the capacity of Governments for coordinated/integrated border management within a regional corridor approach. The project will be implemented in conjunction with Ministries of Home Affairs, Trade and Customs in three target countries in the COMESA region Malawi, Zambia and Zimbabwe. The project will place emphasis on two particular borders - Chirundu One Stop Border Post (OSBP) and Mwami/ Mchinji. While Chriundu is an already functioning OSBP in the region, the

2 Mwami/Mchinji border is in the process of transforming into an OSBP. Mwami/Mchinji is also a priority border within the region, as part of the Beira Corridor, it lies between Zambia and Malawi. No formal border management and migration assessment has been undertaken at this border by IOM, however it is recognised that there are a number of challenges including the lack of a Border Management Information System on the Malawian side. Chirundu is the first OSBP in the continent and an important Border Control Point (BCP) within the North-South Corridor. Assessments have been taken place at Chirundu OSBP, including a BMMA undertaken by IOM. However, an update to the existing BMMA is required to better understand the requirements of Chirundu as an OSBP from a trade and human mobility perspective. 2. PURPOSE The rapid Border and Migration Management Assessment (BMMA) will include focus on the two aforementioned borders principally Mwami/Mchinji. A full assessment will be undertaken at Mwami/ Mchinji, while for Chirundu OSBP the consultant will update the existing assessment. For Chirundu the analysis will serve to assess the requirements the full effective functioning of the One Stop Border Post (OSBP), facilitated by greater cross-border cooperation. While for Mwami/Mchinji the rapid BMMA will also serve as a basis for the future establishment of the OSBP and can feed into ongoing African Development Bank (AfDB) feasibility studies for the OSBP infrastructure at this BCP, as well as other relevant initiatives. For Mwami/Mchinji the rapid assessment will complement a separate specific needs assessment, which will assess the technical requirements to install the IOM supported Border Management Information System (BMIS) known as the Migration Information and Data Analysis System (MIDAS) in future at Mchinji on the Malawian side. The findings of the separate MIDAS assessment will feed into the rapid BMMA and in particular will inform other IT recommendations for Mchinji, including as it relates to the Zambia BMIS and other relevant institutional systems at the Mchinji border. 3. SCOPE The broad objective of a rapid BMMA to provide a comprehensive analysis of the major elements of national migration control system as relevant to BCP functioning including legislation, policy, procedures, passport/travel documents, visa issuance, entry/exit controls, monitoring and

3 reporting. For Mwami/Mchinji the analysis will serve to assess the requirements for a future functioning One Stop Border Post (OSBP), facilitated by greater cross-border cooperation. While at Chirundu OSBP the analysis will serve to strengthen operations, and coordination thereof, at the border including to facilitate the movement of informal small-scale cross-border traders. Distinct to other BMMA that IOM undertakes, this rapid BMMA will also take into consideration how to improve border management effectiveness through addressing human mobility concerns in the context of small trade and trade facilitation. Moreover, this rapid BMMA will complement a regional research study (a separate component within the IDF project) that will be undertaken (prior to the BMMA) and will analyse the interrelationship between trade facilitation and human mobility within a transport corridor approach. The BMMA will draw from existing analysis available regarding cross-border human mobility, relevant policy, administrative and operational structures at the Mwami/Mchinji and Chirundu broders, including the relevant joint committees established within the framework of coordination and OSBP planning. The rapid BMMA will take place over a period of three (3) months, including the production of a final report that will be shared with Immigration and other relevant counterparts in Zambia and Malawi. In particular the rapid BMMA will include: 1. An analysis of the administrative requirements at both Mwami/Mchinji including budget, human resource and training needs, as well as an updated analysis for Chirundu OSBP; 2. A review of the policy and legal frameworks that are relevant from an immigration perspective at Mwami/Mchinji, and an updated review for Chirundu OSBP. This will include procedures as well as relevant bilateral cooperation arrangements and international legal standards and requirements. 3. A review of the operational procedures relevant to Mwami/Mchinji including, but not restricted to, - entry/exit requirements, measures to assist and refer vulnerable groups, measures to facilitate the mobility of small cross border traders and trade facilitation. Emphasis will also be placed on coordination mechanisms (intra, inter-agency and crossborder) as well as infrastructure and equipment needs and requirements in preparation for the OSBP.

4 4. A detailed review of the ITC and information management systems at Mwami/Mchinji and updated review of the situation at Chirundu OSBP; 5. Action oriented and BCP relevant recommendations that will improve the function of the BCP and prepare for future OSBP operations at Mwami/Mchinji and will consolidate the functioning of Chirundu OSBP; 4. METHODOLOGY. The BMMA will include a relevant literature review, as well as a site visits to each of the BCP that will include consultations with key border management stakeholders and front-line officers at Mwami/ Mchinji and Chirundu OSBP. The consultancy will take place over a period of 40 days (optimally within a 3-month period) including both field visits and remote desk work. 5. Qualifications required for the job The successful consultant should have the following qualifications and experience: a. Advanced university degree in International Relations, public management or a related field. b. Extensive knowledge of immigration and border security and management, trade facilitation and customs, or other relevant areas; c. Minimum of 10 years of relevant professional experience working for Government or an Intergovernmental Organization in a related area of immigration and border management d. Proven previous working experience consisting of substantial involvement in assessments, evaluations, and/or reviews in related areas; e. Working experience with senior officials within government, inter-governmental, and non-governmental organizations; f. Full computer literacy, including familiarity with research and basic statistical tools. g. Excellent written and spoken English. Knowledge of local languages an advantage; h. Demonstrated ability to work in a multicultural environment and establish harmonious and effective relationships. 6. DELIVERABLES An inception report, including methodology and desk review

5 A draft rapid BMMA report with particular emphasis on needs and requirements of Mwami/Mchinji as a future OSBP and Chirundu as an existing OSBP. A final report, which integrates feedback from all concerned stakeholders. 7.
