1 EMBASSY OF THE REPUBLIC OF KENYA Riyadh, Kingdom of Saudi Arabia APPLICATION FOR WORK PERMITS Subject to the exemptions mentioned below, an immigration permit is required by all persons, other than Kenya citizens wishing to enter Kenya. EXEMPTIONS All persons who are entitled to privileges and immunities under the Privileges and Immunities Act (Cap. 179) and who are covered under section 4(3) (a) to (g) of the Immigration Act (Cap. 172) Laws of Kenya. The Immigration Department issues the following types of permits: Class A Issued to persons offered specific employment by specific employer and who satisfy an immigration officer that they are qualified for those particular positions. A fee of Kshs 25,000/- is charged per year. Class B Issued to persons offered specific employment by the Government of Kenya or any other authority under the control of the Government. This class of Permit has since been changed through a legal notice to be treated as class A. The Permit is issued gratis (no fee charged). Class C Persons who are offered specific employment under an approved technical aid Scheme under the United Nations Organization or some other approved Agency. The Permit is issued gratis (no fee charged). Class D A person being the holder of a dependant s passes who is offered specific employment by specific employer. A fee of Kshs. 25,000/- is charged per year. 1

2 Class E Issued to members of missionary societies approved by the Kenya Government. A fee of Kshs 2,000/- is charged per year. Class F Issued to persons engaged in business of Agriculture or Animal Husbandry. A fee of Kshs. 30,000/- is charged per year. Class G Persons engaged in prospecting for minerals in Kenya. A fee of Kshs. 30,000/- is charged per year. Class H Persons in specific trade, business or profession in Kenya. A fee of Kshs 30,000/- is charged per year. Class I Persons engaged in specific manufacture in Kenya. A fee of Kshs. 30,000/- is charged per year. Class J Issued to members of a prescribed profession and are in possession of prescribed qualifications. A Fee of Kshs. 30,000/- is charged per year. Class K Issued to persons who: - (a) is not less than 21 years. (b) Has an assured income of an amount that is prescribed. A fee of 5,000/ is charged per year. Class L Issued to persons who are not in employment whether paid or unpaid and who under the repealed Acts was issued with a resident's certificate or who has held an entry permit for a continuous period of not less than ten years. A fee of Kshs. 5,000/- is charged per year. Class M Issued to refugees recognized by the Government of Kenya. The permit is issued gratis (no fee charged) In order to encourage, promote and retain investment in Kenya, the Department is in the process of recommending for the introduction of a new class of entry permit for permanent residence. NOTE: The following are the Additional Requirements for Class F, G, I and J: 2

3 1. One should obtain or is assured to obtain the necessary licenses and registrations. 2. One has sufficient capital or resources for investment. Application Requirements for Permits 1. CLASSES A AND D Application form (Form 3) duly filled. An application letter from the employer. Copies of the certificates - both academic and professional/copy of C.V. A cutting of advertisement from local press. Form 22 duly filled. Two passport size photographs. Application form (Form 3) duly filled. An application letter from the employer. A cutting of advertisement from the employer. Form 22 duly filled. NOTE: The vacant job must be advertised in local press to attract qualified and experienced Kenyans, and only if a Kenyan is not available should a non-kenyan be offered. Applications from employers under other Government Ministries, Departments or Agencies (e.g.) Education, Non-Governmental Organization Council, Tourism etc must clear with that Ministry first and furnish the clearance before their applications are considered. 2. CLASS E - NEW A copy of certificate of registration. Copies of certificate both for educational and professional qualifications. An application letter from the society or organization (employer). An application letter from the employer. NOTE: Class 'E' permits are only issued to registered societies - any other application whether salaried or unsalaried should be either class A or D. 3. CLASS 'H' NEW 3

4 An application letter from the applicant. Documentary proof of capital to be invested/already invested. Registration certificate of the company. Personal and company's pin numbers if the business is running. Passport copies. An application letter from the applicant. Copies of the current license and certificate of registration - if any change has occurred. A copy of certified audited accounts for the previous two years. 4. CLASS J NEW Applicant form (form 3) duly completed. An application letter from the applicant. Proof of membership to a prescribed profession. Application form duly completed. An applicant letter. A copy of balance sheet of the previous year. Copy of personal pin number. 5. CLASS I NEW A copy of license held. A copy of certificate of Registration for the Company. Proof of funds available for the purpose. Copies of passports. Copies of personal and company's pin number. Audited accounts of the previous year. Copies of licence and certificate of company's registration. 4

5 6. CLASS G NEW Copy of the licence held for prospecting. Proof of funds available for the purpose. Copies of passport. 2 photographs. Copies of current licence held for prospecting. Pin number (copy). 7. CLASS F NEW Proof of land acquired legally for the purpose. Proof of capital available for the purpose. Copies of passport. A copy of audited accounts of the previous year. Copy of pin card. 8. CLASS K NEW Application form (form 3) duly completed. Documentary proof of assured annual income that is sufficient to live on. Two passport size photographs. 9. CLASS L NEW 5

6 10. CLASS M NEW Application form (form 3) duly completed. An application letter from the applicant/employer. A recognition letters from UNHCR and Ministry of Home Affair. Application form (form 3) duly completed. An application letter from the applicant/employer. Recognition letters from UNHCR and Ministry of Home Affairs. DURATION OF APPLICATIONS 1. A New application for an entry permit takes two (2) months to process. 2. Renewal for an entry permit takes one (1) month to process. 3. Application for renewal of entry permit should be done three months prior to expiry date. 6
