1 General TERMS & CONDITIONS These terms and conditions, herewith referred to, are consistent with the laws and standards of the above mentioned countries in which we operate our tour services. The information, descriptions, narrations, accommodation details and security details have been given in good faith. We have taken reasonable care to ensure accuracy. We are not held liable for any errors or omissions resulting from circumstances beyond our control. Reservations & Payments Please note that we are quite flexible on most of these if you let us know of your concern. To confirm your reservation, we need to secure your gorilla permits, habituation permits and chimpanzee permits. And we are required to make full payment for these permits to fully confirm them and so we also request you to make this payment at the time of booking. If the tour you are booking is at least 60 days (or more) away, any deposit that should at minimum be able to cover the cost of the gorillas and chimp s permits is fine. Each gorilla permit is US$600 in Uganda, $1500 in Rwanda; USD1500 for Uganda Gorilla Habituation Experience; USD 220 for Kibale chimp s habituation experience. A Chimpanzee permit is $150 in Uganda and $100 in Rwanda. Because most hotels/ lodges and camps will need payment to confirm bookings, we kindly request you to pay in full before the commencement of your tour/ safari. If you have already paid for the permits, you can pay the balance any time to within 14 days before your tour begins. This is not so strict but of course if we lost your preferred hotel/lodge reservation because of failure to pay in time, because of your failure to remit payment, we won't be held responsible. The standard is we should have your full pay before you start the tour. So you can even pay on the tour start day. Besides, we need money to run your tour. Last minute payments may lead to late starts for the tour especially if you have to withdraw money from an ATM. We advise you not to rely so much on ATMs for payment. Most often the networks fail, cards get rejected, and a search for a working ATM may take hours and this delays your tour so that you could miss out some of the tour activities. That said, most of our clients choose to make one single full payment to reduce on the bank charges and stress of paying installments.

2 Payment Methods Our most preferred payment mode would be by electronic bank transfer (wire) to the bank details we give you when you ask. It takes 3-5 days to receive the funds. Many of our clients also pay us by card securely online or cash. If you are paying by card, we generate a secured link for you to pay. BANK DETAIL AVAILABLE UPON REQUEST Please note that we will not take responsibility for any issues resulting from your payment taking longer than planned. If we receive payment late and miss out on gorilla permits, we will be forced to either request you reschedule your travel program or we send your money back to you. You should take the responsibility to ensure we receive payment in good time to pay for your permits, we take the responsibility to pay for your permits in good time only when we have received the funds, not before. Accommodations We offer a range of accommodations including luxury, mid-range, budget and camping. The accommodations indicated in the itineraries are not conclusive; it is just a proposal subject to your decision. We reserve the right to substitute with the equivalent or a superior one. While you are booking your holiday with us, kindly quote the tour planned date time for arrival and departure, number of people travelling and sleeping arrangements. For your own feeding comfort, please specify your interests like Vegetarian or any feeding allergic cases to make our arrangements with the hotels or lodges your contentment. Children below 12 are not allowed to track chimpanzee and children under 15 are not allowed to trek the gorillas. Gorilla Permits We guarantee availability of gorilla permits after receiving payment or an initial deposit from you. However, we do not guarantee 100% chances of seeing the gorillas. The local conditions determine the presence and availability of the mountain gorillas. We are not liable in case of abrupt closure of the national border for security purposes or closure of the national park in question. In case of a refund of the gorilla permits money, it is subject to a refund by the relevant authority that sale these permits. As soon as we get a refund we are bound to pass it to you. There are 98% chances of viewing the gorillas in the wild in Uganda Rwanda and DRC Congo. We have not had an experience where a client has failed to track gorillas in Virunga ranges Transportation

3 Every effort is made to ensure that vehicles are provided in a roadworthy condition but no liability can be accepted for breakdown, or any damage or delay. Our guides are instructed to follow our code of conduct for Guides (available on request), which you must not ask them to break in any way. In the event that a Guide does not follow the code, please inform the Safari Manager. Company vehicles must only be driven by the company s Guide whose decision on all matters, such as the route taken, is final. You will be liable for any damage caused to a vehicle by any interference by you with the vehicle, including legal and other expenses. Cancellations By pamoja Safaris We seldom cancel bookings by our clients. However, we reserve the right to do so. Any confirmation less than 2 months shall not be cancelled unless unexpected/unusual circumstances (such as war within the country you intend to visit) beyond our control. Where cancellation of your holiday, in case of your failure to pay up or as a result of force majeure, we shall offer you re an alternative vacation with a similar standard with the one you had booked before provided there is one available at the time. In case you have chosen one that is more expensive than your original holiday, you will be asked to pay the difference. However, if it is cheaper, we shall refund you the difference. You are entitled to a full refund except money paid for gorilla permits, which we can later pass to you in case the Uganda Wildlife Authority/ Rwanda Tourism board refunds it. We can not whatsoever bear expenses, costs or losses resulting from your cancellation. A cancellation of a vacation in respect of any person in your party is likely, if, in our opinion or the opinion of any other person in authority, the behavior of the person(s) concerned is believed or suspected to cause trouble, annoyance, or distress to the third party. In such a situation we shall uncompromisingly evict such a visitor from any accommodation and require him/her to quit immediately thus forfeiting any of our services. Such a termination of our services does not warrant any refund or any other remedy on our part. Cancellations by You In case you intend to cancel your holiday with us, you shall have to write to us. Unless we receive a copy of your communication in writing, we can not confirm your cancellation. To avoid losses caused by your cancellation since reselling your holiday may be impossible, cancellation fees, excluding insurance, will be levied per person as follows: Cancellation charge shall be a % age of the total price where applicable. Cancellation Policy

4 Cancellations here below shall be treated against the total cost of the safari booked as follows: days 10% of the safari cost days 50% of safari cost 0-7 days 100% of safari cost Note: Cancellation fees are effective from the date your written notification is received at Gorillas and Wildlife Safaris. Gorilla Permits Cancellation Policy If for any reason you are unable to travel and utilize your gorillas and chimps permits, we usually advise that you try and find alternative dates to reschedule your visit. That way we have a chance to avoid the cancellation charges. For Rwanda gorilla permits, you will not get any refund in case of cancellation. But you can use your permit on another date by paying USD150 for rescheduling. Gorilla permits cannot be transferred to another person. For Uganda Wildlife Authority, permits can be rescheduled at no extra cost only if you have at least 30 days to the travel date. Uganda Wildlife Authority will retain the following percentages on a gorilla permit upon cancellation days to tracking date - no refund days to tracking date 75% (25% refund to client) days to tracking date 50% 91 days and above to tracking date 25% (75% refund to client) Note: The cost of transferring money to you is entirely yours when you cancel your tour and the funds you receive will be less by the bank charges (usually about 20$). Complaints We shall attend to all complaints of any nature either directly from you or indirectly from our tour representative or service supplier. Our motto is: The Client is the king. We shall be in position to respond appropriately to any of your complaint or dissatisfaction as long as we can receive your report not later than 21 days after completion of your holiday. This gives us enough time to investigate your case and respond appropriately. Failure to lodge in your complaint within such a time limit, we shall not be held liable.

5 Force Majeure It is regrettable that we cannot bear liability or compensate where the performance or proper performance of our obligations is hampered or affected by any event which we or our supplier of the service(s) in question could not, even with all due care, foresee or avoid. Events such as war or threat of war, civil strife riots, unexpected government actions including legislations, ordinances and decrees; terrorism, industrial disputes, extreme weather conditions, natural or nuclear disaster, epidemics fire, road closures, pilferage, quarantines, dangers incident to sea, land and air travel, and other similar incidents beyond our control. Some of the services we offer are acquired from independent suppliers who may not be within our control. Services such as hotel accommodations, restaurant services, transportation, medical evacuation services etc. are supplied by other service providers. Thus we are not liable for any death, property damage, loss or personal injury resulting from acts or omissions accruing from such independent suppliers who are not within our control. We reserve the right to make changes in pricing of an itinerary or service in response to economic changes (depreciation or appreciation of the local currency against the Dollar) as the case may be at any time. We also reserve the right to refuse or fail to retain any member or person in a tour team if his / her presence may jeopardize the security or proper enjoyment of a holiday in question and to pass on to the tour members any loss or expenditure resulting from delays or events beyond our control. Some of the activities we offer in addition to the agreed upon itinerary are optional. Some activities carry with them an inherent risk of personal injury. In such circumstances we don t guarantee your personal safety. If you choose to engage in optional activities, you do it at your own risk. We merely Endeavour to minimize the risks involved. Optional activities, we offer include but not limited to: Kayaking, bungee-jumping and white water rafting Mountain climbing adventure Chimpanzee trekking Gorilla trekking Balloon safaris Nature walk Insurance Before undertaking a holiday with us ensure that you have an appropriate insurance for the type of holiday of your choice. Such insurance should comprehensively cover

6 death, medical expenses, personal injury, evacuation in the event of accident or illness or death, and holiday cancellation among others. Adventure safari activities that are highly risky such as gorilla trekking, mountain hiking, chimp trekking, white rafting and bungee jumping should be taken care of. Jurisdiction We are incorporated in Uganda and therefore operates under the Uganda Laws. Liability We shall be liable to compensate you for the loss or damage to luggage or personal possessions (including money) to a maximum of US$30 on condition that the client is fully covered by insurance in respect of such losses at the time of booking and is as a result of any failure to perform or improper performance of the contract by any of our employees, agents, suppliers or sub-contractors (provided they were at the time of executing work with our authority). We will take all due care to prevent your death, injury or illness being caused by the fauna of safari destinations. It is your responsibility to take proper medical precautions. We accept liability in case you or any of your party suffer personal injury, illness, or death, as a result of any failure to perform or improper performance of the contract by any of our employees, agents, suppliers or sub-contractors (provided they were at the time of executing work with our authority) except in the following circumstances: - We shall not be liable where any failure to perform or improper performance was caused by: The unforeseeable acts or omissions of a third party not connected with the provision of the holiday in the contract; An event which we or the supplier of the contracted services could not have anticipated or avoided even with all due care. Any claim must be notified to us in accordance with the complaints procedure set out above. Any person to whom any payment is made must assign to us and /our insurers any rights they may have to follow up any third party in connection with the claim and provide all necessary assistance to us and/ our insurers that be reasonably necessary. Voluntary Execution I/we accept to be duly bound by terms and conditions above. My advancement of a deposit to Pamoja Safaris Ltd demonstrates this acceptance. I certify that I have carefully read and fully understood the contents of the Terms and Conditions, including cancellation and refund policies, limitation of liability, and responsibility

7 borne by tour participants. On the advance of a deposit to Pamoja Safaris Ltd, the depositor, his or her family and/representative agree to be bound by the above Terms and Conditions herein specified. UGANDA TOURIST VISA REQUIREMENTS, MULTIPLE ENTRY VISA, EAST AFRICAN TOURIST VISA, TRANSIT VISA, UGANDA VISA FEES A valid passport (6 months minimum and at least 1 blank page) is mandatory for all visitors to Uganda. Effective July 1, 2016, visas and residency permits will no longer be available at Entebbe Airport upon arrival. Please only apply for your visa online within the last 90 days to enter Uganda. Otherwise, your visa will expire 90 days after issuance and then you will need to apply and pay for another visa. All visa and work permit (E-Visa and E-permits) applications must be completed via the Under the new application process, you must apply online for all immigration services such as visas, permits, and passes at least two weeks prior to travel. Uganda is one of the countries covered by the new East Africa Tourist Visa, and for those also visiting Kenya and Rwanda on the same trip it is a cheaper alternative. The visa costs US$100, is valid for 90 days and is multiple entry it is available upon arrival or from embassies abroad. You are advised to apply through the web portal to avoid any inconveniences and fraudulent characters. Travel visas are issued and paid for directly through this web portal. Please be aware that a visa does not determine how long you may remain in Uganda. The Ugandan immigration officer at the port of entry determines the length of authorized stay, which is generally from two weeks to three months for tourists. Immigration policies are not always consistently applied and may change without notice. Pay close attention to the validity of your visa or special pass to avoid fines or travel interruptions. Ugandan immigration imposes a fine of up to $100 per day for visa overstays and sometimes detains individuals who overstay their visas until the fine is paid. Extensions of duration of stay may be requested at Ugandan immigration headquarters on Jinja Road in Kampala. 3. Uganda Visa Exemptions Nationalities that do not pay for Visa while entering Uganda i.e. nationals of countries that do not pay for Uganda visas COMESA (Angola,Eritrea, Malawi, Madagascar, Seychelles,Swaziland, Zambia, Comoros, Kenya, Mauritius, Zimbabwe) EAC (Tanzania, Rwanda, Kenya, Burundi)

9 OTHERS (Antigua, Barbados, Fiji, Grenada, Lesotho, Sierra Leone, Solomon Islands, The Grenadines, Vanuatu, Cyprus, Bahamas, Belize, Gambia, Jamaica, Malta, Singapore, St. Vincent-Tonga. Any other exemption as may be specified on arrival. 4. Every intending visitor is required to carry a genuine passport/travel document with validity beyond one year. 5. All arriving visitors will be required to fill in arrival declaration cards on arrival and should comply with other immigration formalities including the provision of required biometric information. Arrival/ departure declaration cards are available at the arrival lounge. 6. Immigration authorities at the port of arrival reserve the right of admission. 7. A visitor s pass for a specific duration will be granted by the Immigration authorities on arrival to permit the holder s stay in the country for the period granted in the pass.. 8. Arriving visitors should not carry or convey substances or goods prohibited by customs. (Contact Uganda Revenue Authority for details on prohibited substances) 9 Visitors should not overstay their visitors pass otherwise they will be subjected to a fine of U$ 30 per day and other appropriate legal action including prosecution and deportation. 10. Engagement in employment on basis of visitor s pass is strictly prohibited. Offenders will be prosecuted. 11. Where visitors seek to stay longer than the period granted in the visitor s pass on arrival, extension of the period should be sought from the Immigration Headquarters in Kampala or respective regional offices before expiry of the initial visitor s pass. Save for EAC nationals, extensions sought by other foreign nationals shall not exceed six months in aggregate For more information on immigration issues, please see the Directorate of Citizen and Immigration Control website.

10 RWANDA VISA INFO GENERAL INFORMATION FOR AN APPLICANT SEEKING TO VISIT RWANDA ON A TOURIST VISA Online visa applications will be applied for via the Government Portal, Irembo. Click Here to Apply online TRAVEL DOCUMENT: An applicant should have a valid passport or another acceptable travel document. The document must have a validity of at least 6 months on the day of entry in Rwanda. Foreign Nationals wishing to obtain a Rwandan Visa, submit their applications to Rwandan Diplomatic Missions of their Country of residence for processing. In case where we don t have a Diplomatic Mission/ consulate, foreign nationals request for a visa acceptance letter online, which will be presented on arrival to obtain a visa upon payment of visa fee ($30). In view of bilateral agreements, nationals of the following Countries may visit Rwanda without a visa for a period up to 90 days: Hong Kong, Philippines, Mauritius, Singapore and the Democratic Republic of Congo. EAC Partner states citizens shall be issued with 6 months visitors pass (renewable) upon arrival with no fee. Nationals of Australia, Germany, Israel, New Zealand, Republic of South Africa, Sweden, United Kingdom, and United States of America will be issued with

11 entry visa valid for a period up to 30 days and pay for a visa ($30) upon arrival without prior application. These nationals may also choose to get the visa at Rwanda Diplomatic Missions (except the UN Mission in New York) or online. VISA FEES: These are fees for processing of applications. If applications are refused, or withdrawn by the applicant, refunds of fees will not be made. Transit Visa USD30 Entry Visa USD30 Tourist Visa USD50 Tourist Group (4-10 persons) USD100 East Africa Tourist Visa USD100 Diplomatic / Official Visa Free VALIDITY OF A VISA: The maximum and minimum period of validity of a visa is set out in the Information for Applicants for each visa class. SINGLE OR MULTIPLE ENTRIES: Whether a visa is issued for single or multiple entries is set out in the Information for Applicants for each visa class. FINANCIAL REQUIREMENTS: An applicant must have sufficient funds to cover the costs of their stay in Rwanda. Evidence for such funds may be requested online, at the Rwandan foreign mission or at the entry point. Extension of a Visa for Some Classes: Some visa classes may be extended. Details are set out in the Information for applicants for each class. Extension of a visa should be applied for whilst initial visas remain valid. A grace period of 5 days after a visa has expired is allowed for a person to either depart or renew their visa without a penalty, otherwise the person will be subjected to a penalty and may be refused a visa extension. CHANGE OF STATUS FOR SOME CLASSES:

12 An applicant may apply to the Director General for another class of visa whilst they are in Rwanda and whilst their current visa remains valid. For the group tourist visa change of status is not permitted. Information for applicants for the particular visa class will state if change of status is not allowed. INSTRUCTIONS ON YELLOW FEVER PREVENTION MEASURES While Rwanda is Yellow Fever free, following the current active outbreak of Yellow Fever in Angola and the documenting of imported cases in some countries, the Rwandan Ministry of Health is implementing measures to prevent the import of Yellow Fever cases and therefore protect the health of residents and visitors. The following instructions are delivered to inform public and travelers: 1. To enter in Rwanda, a Yellow Fever vaccination certificate is not required for travelers (Residents/ Non-Residents) coming from Yellow Fever non-endemic countries and without an active transmission outbreak of Yellow Fever. 2. To enter in Rwanda, a valid Yellow Fever vaccination certificate is mandatory for travelers (Residents/ Non-Residents) coming from Yellow Fever endemic countries 1 and countries 2 with active Yellow Fever transmission outbreaks. 3. All residents travelling to Yellow Fever endemic countries 1 should be vaccinated at least 10 days before travelling. 4. For travelers (Resident/ Non-Resident) coming from an active Yellow Fever transmission outbreak country 2 or travelers who have recently visited (within 24 days) an active Yellow Fever transmission outbreak country 2 the following instructions will be applied: Yellow Fever endemic countries 1 : Angola, Argentina, Benin, Bolivia Plurinational, Brazil, Burkina Faso, Burundi, Cameroon, Central African Republic, Chad, Colombia, Congo, Côte d Ivoire, Democratic Republic of the Congo, Ecuador, Equatorial Guinea, Ethiopia, French Guiana, Gabon, Gambia, Ghana, Guinea, Guinea-Bissau, Kenya, Liberia, Mali, Mauritania, Niger, Nigeria, Panama, Paraguay, Peru, Senegal, Sierra Leone, South Sudan, Sudan, Suriname, Togo, Trinidad and Tobago, Uganda, Venezuela Active Yellow Fever transmission outbreak country 2 : Angola

13 INFORMATION FOR EAST AFRICA TOURIST VISA (UGANDA, RWANDA & KENYA ONE VISA) QUALIFIED PERSON: A foreigner who wants to visit simultaneously the Republic of Kenya, Republic of Rwanda and Republic of Uganda for tourism. An East Africa Tourist Visa is multiple entries within the three countries and shall be valid for 90 days. Applications for this visa shall be lodged at any of the diplomatic representation of the Republic of Kenya, Republic of Rwanda and Republic of Uganda, at the Immigration Offices of the respective countries or online where applicable. TRAVEL DOCUMENT: Any genuine acceptable travel document valid not less than 6 months. VISA FEE: 100 USD Free of charge to Foreign residents in the three countries: Kenya, Rwanda and Uganda.

14 VALIDITY OF VISA: 90 days SINGLE OR MULTIPLE ENTRY: Multiple entries within the Republic of Kenya, Republic of Rwanda and Republic of Uganda. VISA EXTENSION: An East Africa Tourist Visa shall not be extended. How to Apply: Applications for this visa shall be lodged at any of the diplomatic representation of the Republic of Kenya, Republic of Rwanda and Republic of Uganda, at the Immigration Offices of the respective countries or online where applicable. Rwanda For those beginning their trip in Rwanda, you can apply through the Rwanda Online Visa Application System Under Type of Visa select East Africa Tourist Visa. Kenya For those beginning their trip in Kenya, you can find information on the visa application process on the consular section of your local Kenya embassy s website Uganda For those beginning their trip in Uganda, you can find information on the visa application process on Uganda Online Visa visas.immigration.go.ug Travel document: Any genuine acceptable travel document valid not less than 6 months. Visa Fees: 100 USD Validity of Visa: 90 days Single or Multiple Entry: Multiple entry The holder of the East Africa Tourist Visa shall enter from the country that issued the visa and move within the two other countries without applying for another visa or paying for another visa fee. The holder shall also be allowed to move out of the Republic of Kenya, Republic of Rwanda and Republic of Uganda; and return without having to pay for another visa. This will only be applicable in the period of 90 days. Visas issued for specific countries can only be used for that particular country Work or No Work: Work is not permitted Visa Extension: An East Africa Tourist Visa shall not be extended. Typical Requirements:

15 1. One clear colored passport size photo with white background recently taken without glasses, caps and scurf; (the photo should be attached to the application form by use of glue stick. Stapling and clipping the photo to the application form is not advisable). 2. A complete filled application form 3. Visa application letter addressed to the issuing authority of the concerned country Online visa application tips: Please be sure that you have all the required information ready to upload on to the websites when prompted. Please ensure that you enter your address correctly as this will be used as the primary sources of contact between immigration department and the applicant. Please note that if you do not get a response from the immigration department within the stated allotted time do contact your travel agent for assistance. Please always check with your countries embassy first to check if you are required to apply for a visa to enter Uganda. Please note that you are still able to apply for a visa on arrival to all the above countries but this option is being phased out over the up coming months. Please make sure you print off your visa, once received so that it can be handed immigration

16 Application for Congo Visa, Congo Tourist Visa Information Institut Congolais pour la Conservation de la Nature (ICCN), the Congolese wildlife authority, has an agreement with Direction Générale de Migration (DGM), the Congolese immigration service, to facilitate obtaining 2-week, single entry tourist visas for people visiting Virunga National Park. The cost of the visa is USD $105. To qualify for a tourist visa, you must first purchase a mountain gorilla trek permit, a Nyiragongo trek permit, or book and pay for accommodation at the Mikeno Lodge. Treks or accommodation are linked with the purchase of a tourist visa through Virunga National Park are non-refundable. For all Gorillas and Wildlife Safaris guests proceeding to the Congo, we will work with ICCN to process the visa to Congo. Once we have your permit booking and or accommodation booking and have received confirmation of your payment, we will also receive an order number. We then proceed to the online visa application with your order number at the top of the form, fill in the remaining fields, and click submit.

17 Although we process your visa for Congo, you will need to process your visa to the countries that you travel through to reach Congo (like Rwanda and Uganda). So, please make sure to secure any other visas that you will need as you make your way to the Democratic Republic of the Congo. Countries such as Rwanda require most nationalities to secure visas in advance of arrival. IMPORTANT NOTES: 1. ) Virunga National Park only acts as a facilitator in the visa process. Full authority rests with the DRC s Department of Immigration (DGM) in Kinshasa. DGM rarely issues actual electronic versions of visa approvals, therefore, every visitor must arrive at the border (Grande Barrière) with a print-out of their trek/accommodation and visa order confirmations. Virunga s tourism team will verify that all paid-in-full applicants are on the list of approved visas at the border in Goma. You do not need an actual copy of your visa if you have your order confirmations in hand when you arrive at the border. 2.) People flying ETHIOPEAN AIRLINES directly into Goma must notify the tourism team two weeks before their departure. Please Vianney Harakandi (vianney@virunga.org) with visit@virunga.org in copy to ensure your visa information has been communicated to Ethiopian Airlines. FAILURE TO DO SO WILL RESULT IN NOT BEING ABLE TO BOARD YOUR FLIGHT. 3.) The Grand Barrière border crossing is open to Virunga visitors from 8:00 am to 7:00 pm daily.
