2 service, HRC defends rights of concrete beneficiaries, whose rights are violated by the state institutions. For the past two years, HRC intensified its activities in the field of strategic litigation. In this regard, particular attention is paid to the access to justice and awareness raising of the women, religions/ethnic minorities in the regions of Georgia. Lawyers in Tbilisi, Shida Kartli (Gori), Kakheti (Gurjaani) and Kvemo Kartli (Rustavi) offices provide citizens with free legal aid and conduct strategic litigation into their cases. Special project for the promotion of prevention of violence against women was implemented in the three regions. INTRODUCTION The projects and activities implemented in 2017 show that Human Rights Center actively reacts on major problems and challenges in the country. As a result of human rights monitoring, the organization, on the one hand, documents the facts of human rights violations, which is finally reflected in HRC annual human rights reports, and on the other hand, through free legal aid In 2016 the International Criminal Court commenced investigation into the crimes committed during 2008 August War. In this process, HRC provides the victims of the war with legal aid and monitors ongoing investigation. HRC is chairing the Georgian Coalition for International Criminal Court. In 2017, International Federation for Human Rights (FIDH) and Human Rights Center organized joint missions in the conflict affected villages in Shida Kartli region and surveyed the needs of the conflict-affected citizens. The recommendations and key findings of the survey report are advocated on national and international levels.

3 HRC is the member of the Coalition for Independent and In 2017, HRC, as experienced observation organization, Transparent Judiciary, which enables the organization to observed municipal elections in Georgia. The monitor ongoing developments in the Georgian judiciary organization continues its years-long experience of system in coordination with partner CSOs. The projects election monitoring and in 2018 the HRC plans to Survey into the new rule of witness interrogation in monitor the presidential elections too. Georgia, Monitoring the Work of the New Department of the Chief Prosecutor s Office and Trial Monitoring for Women aim to evaluate the work of the judiciary system and deliver respective recommendations and advocate the problems. HRC pays particular attention to the analysis of the situation in penitentiary system and defends rights of the convicted people. HRC lawyers are members of the National Preventive Mechanism of the Public Defender s Office and systematically monitor conditions in penitentiary establishments. Upon cooperation memorandum with the PDO, HRC is monitoring the conditions in the penitentiary establishments for female and juvenile prisoners together with the PDO representatives. Besides that, HRC implemented Art- Therapy Project in the penitentiary establishment # 5 for the female prisoners in Rustavi, which aimed to promote rehabilitation/resocialization of female convicts. HRC continues close cooperation with international partners authoritative organizations, coalitions and networks, like: Norwegian Helsinki Committee, International Federation for Human Rights (FIDH), Coalition for the International Criminal Court, Human Rights Houses Network and more. Together with international partners, HRC actively advocates elimination of the key problems in our country. Activities of Human Rights Center are supported by different donor organizations. Increasing trust from the side of the donor organizations encourage us to believe that the organization will further develop and fulfill its future plans. 4 ABOUT HUMAN RIGHTS CENTER NON-GOVERNMENTAL ORGANIZATION THE HUMAN RIGHTS CENTER (HRC) WAS FOUNDED ON DECEMBER 10, 1996 IN TBILISI, GEORGIA. VISION The Human Rights Center believes that everyone is entitled to exercise her/his civil, political, social, economic and cultural rights freely and without any discrimination as guaranteed by national and international law. We consider that protection and promotion of these rights and respect for rule of law are the key preconditions for building sustainable peace and democracy in Georgia. OVERALL OBJECTIVES The HRC aims to increase respect for human rights, fundamental freedoms and facilitate peacebuilding process in Georgia. To achieve this goal it is essential to ensure that authorities respect the rule of law and principles of transparency and separation of powers, to eliminate discrimination at all levels, increase awareness and respect for human rights among the people in Georgia. HUMAN RIGHTS CENTER S PRIORITY AREAS Strengthening the rule of law by: Supporting harmonization of national legislation with international human rights standards and monitoring their implementation; 4

5 Raising public awareness about their rights and available legal remedies/mechanisms for their realisation; Providing free legal aid to individuals and groups to defend their rights and freedoms at national and regional/international levels; Monitoring, documenting and reporting on human rights violations. Supporting Freedom of Expression and Media by: Supporting development of independent media; Promoting creation of environment conducive of free expression; Capacity building of journalists and media representatives; Promotion and development of new media. Promoting Equality and Social Inclusion by Fighting against discrimination; Protecting the rights of minorities and other vulnerable groups; Promoting gender equality and women empowerment. Supporting Transitional Justice by: Documenting and reporting human rights violations committed in relation with armed conflicts; Promoting accountability for human rights violations; Advocating restitution and reparation; Confidence building, reconciliation and peace building. 5

6 Reinforcement of Democratic processes by: Strengthening development of civil society organizations through capacity building and networking; Encouraging involvement of social groups in public activities; Promoting free and fair elections, good governance and transparency. ACTIVITIES: Monitoring and Documenting human rights violations in Georgia; Reporting on human rights situation in Georgia to the EU, Council of Europe, OSCE, UN, ICC and others international bodies on regular basis; Lobbying and Advocacy of legislative and policy reforms before national and international institutions; Litigating cases on human rights violations through Legal Aid Centre free of charge; Public Awareness Raising on human rights situation in Georgia by daily-updatable bi-lingual online magazine and video-portal Networking among human rights organizations on national and regional level. DIFFERENT INITIATIVES The South Caucasus Network of Human Rights Defenders The South Caucasus Network of Human Rights ( Defenders unites 30 human rights NGOs in Armenia, Azerbaijan and Georgia. The Network seeks to facilitate the creation of a safer and enabling 6

7 environment for human rights defenders in the South Caucasus and to strengthen their voices in the region and internationally. The Network offers legal, psychological, medical and financial support to human rights defenders at risk; monitors policy, legal and security environment affecting defenders/ngos and their work as well as human rights and freedoms in general and provides a regional platform for joint lobbying before national and international institutions. Sorry Campaign Sorry Campaign ( was initiated in March The aim of the Sorry Campaign is to change the dynamics and direction of the relationships that have been established between Georgians and Abkhazians during recent years. The Sorry Campaign is not in any way connected with politics; it is a movement that is against war, as the organisation considers that there is no alternative to peaceful dialogue and mutual settlement of the conflict.the Campaign envisages the reestablishment of confidence between Georgian and Abkhazian people and to break through the informational vacuum. They want to encourage people to think about the horrors of war and the mistakes that have been made. The Human Rights House The Human Rights House Tbilisi ( formally accepted by the Human Rights House Network in October 2009 by the international Advisory Board of the Network. By being the member of such a global network, Georgian civil society organizations will be in a position to advocate and lobby with greater degree of impact as well as to exchange knowledge, skills and experience with fellow NGOs from other countries. The House in Tbilisi will serve as a contribution to enhance the respect for human rights in Georgia, support the work of the human rights defenders in the country and be a focal point of human rights organisations in Georgia and the region. 7

8 The Coalition for Trust The Coalition ( was established in June 2015 by a number of representatives of nongovernmental organizations from the South Caucasus and Norway. The coalition resulted from three years of work done in the framework of an EU sponsored program, run by the Norwegian Helsinki Committee in cooperation with Coalition members, with the aim of establishing a coalition for trust. The Coalition has been registered as an international association in September 2015 in Oslo, Norway. It is built on a regional approach, fostering cooperation and partnership. As the members have envisaged it, the Coalition will: Be a strong platform for trust and relations building initiatives and activities by civil society in the region; Be an effective network among regional and relevant international non-governmental organizations; Not involve itself in political decisions nor get involved in political negotiations for resolution of conflicts, but rather facilitate a humanistic approach to rebuilding relations and trust; Seek to work across divisions shaped by historical and political conflicts, and seek to address such divisions with an aim towards peaceful co-existence and peace building. The Casualty Recorders Network In 2009, Oxford Research Group (UK) together with the twenty founding members launched a international practitioner network for casualty recorders(casualty Recorders Network). There are many locally-based organisations operating in zones of current or recent conflict working to collect, record, and ultimately memorialize the casualties of conflict. However, the predominant feature of their work is that each organisation operates in relative isolation, devising solutions in an ad-hoc manner, being largely unaware of the work that is going on elsewhere. 8

9 There has been a clearly expressed need for a platform to allow such organisations to network productively with each other, and address common problems and aspirations. The HRC is one of the founders of the network. The Georgian Coalition for International Criminal Court Human Rights Center is the head of Georgian Coalition for International Criminal Court (GCICC) which aims to protect the interests of victims of crimes within the jurisdiction of ICC, represent their interests both on national as well as on international level, increase public awareness regarding the ICC and promote conflict prevention, peaceful resolution and trust building processes. Following are the member organizations of GCICC: International Center on Conflict and Negotiation, Human Rights Center, Georgian Young Lawyers Association, Human Rights Priority, Union 21 Century, Article 42 of Constitution, Center for Protection of Constitutional Rights, Justice International and Georgian Center for Psychosocial and Medical Rehabilitation of Victims of Torture. HUMAN RIGHTS CENTER IS A MEMBER OF FOLLOWING LOCAL COALITIONS: Eastern Partnership Civil Society Forum Georgian National Platform The National Platform consists of the local NGOs registered in Georgia as well as international NGOs working in partner countries. The functions of the National Platform are: 1) Promoting thematic platforms and flagship initiatives in Georgia 2) Presenting interests of Georgian civil society organizations to Eastern Partnership Civil Society Forum and promoting work of the forum. 9

10 The Coalition for an Independent and Transparent Judiciary Coalition for an Independent and Transparent Judiciary was formed in April Currently it unites 36 member NGOs. The goal of the Coalition is to consolidate the efforts of legal professional associations, legal rights NGOs, business associations, and media into a joint advocacy for an independent, transparent and accountable justice system. The Coalition activities include research and monitoring, development of recommendations and advocacy for judicial reforms, and promotion of public discussions on the problems critical to the justice system. Campaign This Affects You Too Human Rights Center is a member of campaign This Affects You Too. The public campaign This Affects You Too is the initiative of civil society groups. It was launched in 2012, in order to change the election legislation through active citizen participation. The campaign was resumed in 2014, this time to change illicit practices and legislation regarding covert surveillance, and wiretapping, as well as to end prevalent forms of illegal mass surveillance. 12 PROJECTS IMPLEMENTED BY HRC IN 2017 PROMOTE ACCESS TO JUSTICE FOR WOMEN, RELIGIOUS AND ETHNIC MINORITIES IN THE REGIONS OF GEORGIA The project is implemented with financial assistance of the United States Agency for International Development (USAID) in the frame of the East West Management Institute (EWMI) program Promotion Rule of Law in Georgia (PROLoG). Project aims to enhance access of women, religious and ethnic minorities to justice. Project objectives are: promote equal access to justice for women, religious and ethnic minorities; expose cases of strategic litigation and support establishment such judiciary practice which respects fundamental principles of minorities and fair trial; and awareness raising for women, religious and ethnic minorities and informing society about their rights. The project is implemented in Tbilisi, Kvemo Kartli, Kakheti and Shida Kartli regions. The project lasted 18 months April 15, 2017 October 15, Budget: 99,741 USD 12

13 SUPPORT TO THE PREVENTION OF VIOLENCE AGAINST WOMEN IN GEORGIA The project is implemented with financial support of the US Embassy in Georgia under the Democracy Commission Small Grant Program of the Embassy. Within framework of the project, Human Rights Center works with social workers of the shelters, police officers, community leaders, civil activists and victims to exchange information about the obstacles they encounter in their daily work. The purpose of the project is to analyze the miscarriages of the legal mechanisms for the prevention of domestic violence/violence against women/femicide; to work on the creation of more effective mechanisms with participation of key actors of the process; to promote inclusive dialogue about the problems of domestic violence, violence against women and femicide with participation of all state and nonstate actors and propose legislative amendments and new mechanisms to the authority to make the law and the strategy more successful. The project is implemented in three regions Kakheti, Shida kartli, Kvemo Kartli and in Tbilisi. The project lasted 8 months - August 15, April 20, Budget of the project: 18,440 USD 13

14 LEGAL AID AND HUMAN RIGHTS MONITORING The project lasted 12 months from July 1, 2016 to June 30, Project budget: 64,000 EUR. 14 The 12-months project is implemented with financial support of the national endowment for democracy (NED). The project aims to promote the availability of reliable and detailed information about human rights in remote regions of the country; to provide access to human rights and rule of law for the most vulnerable segments of the population. In the frame of the project HRIDC operates legal aid clinics in the Tbilisi head office and in two regional offices in Kakheti and Shida Kartli. The project duration: July 1, 2017 June 30, 2018 The budget of the project: 58,240 USD. MONITORING OF 2016 PARLIAMENTARY ELECTIONS AND ICC INVESTIGATION IN GEORGIA The 12-months project was implemented with financial support of the Norwegian Helsinki Committee/Foreign Ministry of Norway. The project aimed to promote better election environment in Georgia and to promote better defense of rights of victims of 2008 August War. In the frame of the project, Human Rights Center monitored 2016 Parliamentary Elections and also implemented different activities to raise awareness of grass-root population and different professionals (journalists, lawyers) about the ICC investigation into 2008 war.

15 MONITORING OF 2017 LOCAL SELF-GOVERNMENT ELECTIONS IN GEORGIA With financial support of the Open Society Georgia Foundation Human Rights Center monitored the Election Day during the 2017 Municipal Elections in Georgia. The Human Rights Center monitored the local elections in two regions of Georgia: 1. Kakheti region villages of ethnic minorities in Sagarejo, Telavi and Akhmeta municipalities; 2. Shida Kartli region conflict-affected villages in Gori municipality. The project lasted 3 months: September November, Project budget: 9,995 USD SURVEY INTO THE NEW RULE OF WITNESS INTERROGATION IN GEORGIA The project was implemented with financial support of the Open Society Georgia foundation. The project aimed to promote transparent and effective functioning of the new rule of witness interrogation. Human Rights Center studied: how the new rule works in practice; how well the rights of witnesses are respected during interrogation in the magistrate courts; with regard to how many cases the prosecutor s office addressed the magistrate court in relation with witnesses interrogation, including how many cases were 15

16 related with juveniles and what was the basis to appeal to the court; how well the solicitation of the prosecutor s office and the decision of the court are well-grounded; how well the principle of judiciary compatibility is respected during interrogation of witnesses; how the acting rule of witness interrogation guarantees the security of witnesses; how well witnesses are aware of their rights etc. On February 20, 2016 the new rule of witness interrogation went in force, which implies the obligatory interrogation of witness in the magistrate courts. The Coalition for Independent and Transparent Justice stated that the current rule of witness interrogation is against the principles of judicial compatibility and it neglects the role of voluntary interrogation in the criminal law. The principle of compatibility and equality of arms are severely violated when only prosecution side has right to interrogate the witness in the magistrate court. The government adopted the current version of the law on witness interrogation, regardless the critical comments of the NGOs. The project lasted 11 months: 10 August, July, Budget of the project: 29,985 USD. MONITORING THE WORK OF THE NEW DEPARTMENT OF THE CHIEF PROSECUTOR S OFFICE The project aims to monitor the work of the department investigating the offenses committed in the course of legal proceedings in the Chief Prosecutor s Office of Georgia and to promote better work of the new department. The department to investigate the offences committed in the course of legal proceedings were set up in the chief prosecutor s office of 16

17 Georgia based on the February 13, 2015 edict # 62 of the Minister of Justice. During the research, HRIDC team collects public information from the chief prosecutor s office, interviews prosecutors, advocates and judges and monitors the court hearings. The project is implemented with financial support of the Open Society Georgia Foundation. The project lasted 11 months from October 25, 2017 to September 25, Project budget: 29,980 USD COMPLEMENTARY REHABILITATION AND RE-SOCIALIZATION SUPPORT IN THE GEORGIAN PENITENTIARY SYSTEM The project lasted 4 months from December 15, 2017 to April 15, Project budget: 15,000 EUR The four-month project aims to support to rehabilitation and resocialization of the prisoners with disabilities through art-therapy. In the frame of the project disabled prisoners will obtain labor and art skills and also with the assistance of psychologist, they will manage to cope with the stress caused by imprisonment. The project is implemented with financial support Bulgarian Development Aid through the embassy of the republic of Bulgaria in Georgia. 17

18 TRIAL MONITORING FOR WOMEN The project aims to support transparency of trials and raise accountability of the judiciary or prosecution regarding the cases where women are victims (femicide, domestic violence, etc.) or defendants (drug related crimes) as well as hate crimes. The specific goal of the project is to reveal whether the principles of fair trial are ensured at the proceedings, such as principle of adversarial proceeding and equality of arms, right to reasoned decision, right to defense and independence and impartiality of judiciary. The project is implemented with financial support Bulgarian Development Aid through the Embassy of the Republic of Bulgaria in Georgia. The project lasted 6 months from December 15, 2017 to June 15, Project budget: 20,000 EUR MONITORING CONDITIONS OF JUVENILE AND FEMALE PRISONERS IN GEORGIAN PENITENTIARY The project aims to support improvement imprisonment terms for female and juvenile convicts in Georgia. The conditions of the prisoners are studied through monitoring. Apart to that the female and juvenile convicts are provided with free legal aid and representation at courts. The project will raise awareness of local and international stakeholders about the real situation in prisons for juvenile and female convicts. 18

19 The project is implemented with financial support Bulgarian Development Aid through the Embassy of the Republic of Bulgaria in Georgia. The project lasted 6 months from December 15, 2017 to June 15, Project budget: 20,000 EUR CIVIL SOCIETY ENGAGEMENT IN THE ICC GEORGIA INVESTIGATION The project is implemented in partnership with following NGOs - Article 42 of Constitution, Georgian Center for Psychosocial and Medical Rehabilitation of Torture Victims, Georgian Young Lawyers Association, Human Rights Center, and Justice International. Project aims to promote the protection of rights of victims of 2008 August War in front of International Criminal Court (ICC). The project involves raising awareness and providing information to the victims of the 2008 August War regarding the ongoing investigation of ICC into the situation of Georgia, as well as advocating in front of various organs of ICC regarding the issues related to the local context in Georgia. The representatives of the above mentioned organizations will make visits to the Internally Displaced Persons (IDP) settlements within the frameworks of the project for the purposes of providing information and raising awareness, as well as exploring their currents problems and needs in order to further advocate relevant solutions on international and local levels. The project is implemented with financial support of the Open Society Georgia Foundation. The project lasted from November 15, 2017 to February 15, Project budget: 33,151 USD 19

20 KEY ACTIVITIES IN 2017 GEORGIAN COALITION FOR INTERNATIONAL CRIMINAL COURT Georgian Coalition for International Criminal Court (GCICC) resumed its work. Georgian human rights organizations 1 are united in the Georgian Coalition for International Criminal Court. Human Rights Center was elected as a chair organization of the GCICC. One of the significant topics raised at the different forums by the GCICC has been the opening of the local office in Georgia in order to increase public awareness about the investigation and the work of the International Criminal Court (ICC). FIDH-HRIDC JOINT MISSION TO ASSESS IMPACT OF 2008 WAR ON THE VICTIMS OF WAR CRIMES After preliminary missions in 2016 and 2017, FIDH and its Georgian member organisation, the Human Rights Center (HRIDC), undertook a fact-finding mission to Georgia from 26 June to 4 July 2017 in order to assess how the crimes committed during the 2008 war between Georgia and Russia impacted and continue to impact the lives of victims. It is hoped that such assessment of the impact of 2008 crimes on victims may contribute to the ongoing investigation opened in January 2016 by the International Criminal Court (ICC) regarding alleged international crimes committed during the 2008 conflict

21 FIDH and HRIDC mission delegates met with 34 people in 10 villages close to the Administrative Boundary Line (ABL) between Georgia and South Ossetia region and one IDP settlement in Gori district. Victims informed FIDH and HRIDC that the five days of war in 2008 has had an impact perceivable to date. Indeed, victims continue to live in a highly volatile security situation and desperately want justice and reparations for the harm that they suffered during the war and continue to suffer. As a result of the joint mission, FIDH and HRIDC published the report Living on the Edge: Victims Quest for Accountability The Ongoing Impact of the 2008 Russia-Georgia War. The report reflects the problems and challenges faced by the victims of the 2008 August War living in Georgia, including in the borderline villages where their rights to freedom of movement, private life and property are violated on a regular basis and they are experiencing grave socioeconomic consequences of the war. The report was initially presented on February 5, 2018 in Tbilisi and on April 12, 2018, the representatives of International Federation of Human Rights (FIDH) and Human Rights Center held presentation of the joint report in The Hague. 21

22 FREE LEGAL AID From January 1 to December 31, 2017 the lawyers in Tbilisi head office and in three regional offices (Kakheti, Shida Kartli and Kvemo Kartli regions) of the organization issued 4007 free legal consultations to beneficiaries. More precisely: Tbilisi office lawyers issued 2304 free legal consultations to beneficiaries; Kakheti regional office 527 free legal consultations to beneficiaries; Shida Kartli regional office 917 free legal consultations to beneficiaries; Kvemo Kartli regional office 259 free legal consultations to beneficiaries. In 2017, HRC lawyers in all four offices successfully finalized 72 legal cases in the common courts and prosecutor s offices. 22
