If you are a citizen of a non-eu country and would like to work in Estonia, you should apply for a D-visa. Before applying for a D-visa, your employer should register your short-term employment with the Estonian Police and Border Guard Board. The short-term employment registration is given for 365 days during 455 day period. There is no such thing in Estonia as a special work permit. You can work here if your short-term employment is registered by your employer and your stay here is legal (e.g. you have a D-visa) or when you have a valid (temporary) residence permit for work. In most cases you have to apply for the permit in person at an Estonian representation abroad. When your short-term employment has been registered in prior, you can also apply for the permit at the Police and Border Guard Board. 3

In most cases you have to apply for the permit in person at an Estonian representation abroad. There is no such thing in Estonia as a special work permit. The issue of residence permits to the third country nationals is regulated by the Aliens Act. An alien, who is applying for a residence permit, is subjected to the immigration quota of Estonia for aliens, which shall not exceed 0,1% of the Estonian permanent population in one year (in 2019 the population of Estonia is 1,3 million). An alien shall not be subjected to the immigration quota, if he or she is a citizen of the United States of America or Japan As a rule we do not assist in the procedure of obtaining the right of residence. 5

6 There are two main ways to apply for the TRP for employment without the consent of the Estonian Unemployment Insurance Fund but by fulfilling the salary criteria: 1) as an expert, advisor or consultant, on the following condi ons: the applicant has relevant professional qualifica on; the Estonian company (employer) is paying at least the minimum required salary* 2. for performing managerial or supervisory func ons of a company registered in Estonia, on the following condi ons: the company must have been registered in Estonia and conducted actual business ac vi es in Estonia for at least 5 months; the Estonian company (employer) is paying at least the minimum required salary* * Minimum required salary is equal to the recent average yearly wages in Estonia, published by the Sta s cal Office of Estonia, which is currently 1295 EUR gross (published in March 2018). Once your residency permit for employment is granted, you ll receive a temporary residence card within 60 days after submitting the application document. The company must be registered with the Estonian Trade Register. As a Company share holder Inves ng at least EUR of capital in your Estonian company (company's equity capital, subordinated liability and registered fixed assets can be regarded as an investment). A business plan in Estonian or English is required to support the applica on. More than one applicant may invest into the same Estonian company ( EUR each). In case of a sole proprietor, the minimum investment is EUR. As a major investor it requires a direct investment of at least 1 million EUR in an Estonian company or investment fund, that invests mostly into the Estonian economy. 9 When applying as a company shareholder, application must contain the enterprise s business plan and its formation and operating documents. Moreover, if the applicant has a holding in a company, the applicant must have at least 65,000 EUR invested in business in Estonia. Similarly, if the applicant will be the sole proprietor of the enterprise, at least 16,000 EUR is required to be invested into business in Estonia. Once the application is approved, the investor receives the temporary residence permit and can relocate to Estonia to live and work for the enterprise (a spouse and minor children are eligible to accompany the investor). The initial validity period of the temporary residence permits is five years, and the permits may be extended if the enterprise has generated a sales revenue of at least 200,000 EUR each year or if the Estonian monthly social tax that is paid to employees equals five times the Estonian yearly average wage. In short, the residence permit can be obtained if the company has real business ac vi es in Estonia, salaries and taxes are being paid regularly and the applicant has a registered place of residence in the popula on register of Estonia.
