.6 Queenstown Town Centre Zone Rules.6.1 Zone Purpose The Queenstown Town Centre Zone covers the man concentraton of commercal actvty n the Dstrct. The area s bounded by Man Street, Henry Street, Coronaton Drve and Queenstown Bay. The purpose of the zone s to allow for a wde range of actvtes whch wll enhance the town centre whle preservng the mportant physcal and natural character whch gves the town ts outstandng qualtes and mage. The zone rules contan a range of standards to acheve the desred envronmental outcomes relatng to bult form, open space, traffc management, hertage protecton and pedestran amenty..6.2 Dstrct Rules Attenton s drawn to the followng Dstrct Wde Rules whch may apply n addton to any relevant Zone Rules. The matters n respect of whch the Councl has reserved control are lsted wth each Controlled Actvty. Any land use actvty n the Lakevew or Isle Street Sub-zones that would have been a controlled actvty under clauses () or (v) of ths rule except that the buldng proposed contravenes one or more relevant ste standard(s) (requrng restrcted dscretonary consent), shall reman a controlled actvty. Buldngs located n the town centre outsde the specal character area and outsde of the Lakevew sub-zone Desgn, appearance, landscapng sgnage (whch may nclude drectonal street maps), lghtng, materals, colours and contrbuton to the character of the streetscape; and In relaton to the Isle Street sub-zones (West and East), the urban desgn prncples (contaned n the assessment matters at..2(v)); and The provson of pedestran lnks through the Isle Street subzone (West); and - 29

Buldng external appearance Verandas All verandas n respect of desgn, appearance, materals and mpact on and relatonshp to adjonng verandas. Premses Lcensed for the Sale of Lquor Premses lcensed for the sale of lquor under the Sale of Lquor Act 1989, for the consumpton of lquor on the premses between the hours of 11pm and 7am wth respect to the scale of the actvty, car parkng, retenton of amenty, nose and hours of operaton. Ths rule shall not apply to the sale of lquor: To any person who s lvng on the premses To any person who s present on the premses for the purpose of dnng. Premses lcensed for the sale of lquor under the Sale of Lquor Act 1989 wthn the Town Centre Transton sub-zone, for the consumpton of lquor on the premses between the hours of 6 pm and 11 pm wth respect to the scale of ths actvty, car parkng, retenton of amenty, nose and hours of operaton. Ths rule shall not apply to the sale of lquor. (f) The provson of servces. (g) Wth respect to buldngs that provde for resdental actvtes, the extent to whch the desgn provdes for a mxture of unt szes and numbers of bedrooms to promote housng dversty. (h) The extent to whch the desgn and setback of buldngs erected at 34 Brecon Street and/or the Lakevew Campng Ground mtgates any adverse effects on the hertage values of the adjonng Queenstown Cemetery..6.3.2A Restrcted Dscretonary Actvtes Wthn the Lakevew sub-zone: Conventon Centres (ncludng any ancllary retal or ancllary commercal actvtes consented as part of a conventon centre); Vstor Accommodaton (ncludng any ancllary retal or ancllary commercal actvtes consented as part of a vstor accommodaton development). Ths does not apply to 34 Brecon Street (legally descrbed as Lot 1 DP 27703); Commercal recreaton and/or commercal tourst actvty (ncludng any ancllary retal or ancllary commercal actvtes consented as part of commercal recreatonal or commercal tourst actvty) wth a gross floor area of more than 400m 2. Motor vehcle repars Buldngs located wthn the Specal Character Area Buldngs located wthn the Specal Character Area ncludng alteratons to exstng buldngs wth the Councl s dscreton restrcted to the external appearance, materals, sgnage, lghtng, streetscape hertage values and compatblty wth adjonng buldngs. v Conventon Centres (outsde of the Lakevew sub-zone) v Any Actvty whch s not lsted as a Non-Complyng or Prohbted Actvty and comples wth all the Zone Standards but does not comply wth one or more of the Ste Standards shall be a Dscretonary Actvty wth the exercse of the Councl s dscreton beng restrcted to the matter(s) specfed n the standard(s) not compled wth..6.3.4 Non-Complyng Actvtes The followng shall be Non-Complyng Actvtes provded that they are not lsted as a Prohbted Actvty. v Factory Farmng Forestry Actvtes Mnng Actvtes Arports v v v v Surface of Water and Interface Actvtes Wharfs and Jettes wthn the Queenstown Town Centre Waterfront Zone between the Town Per and Queenstown Gardens. Any buldngs located on Wharfs and Jettes wthn the Queenstown Town Centre Waterfront Zone Buldngs or boatng craft wthn the Queenstown Town Centre Waterfront Zone f used for vstor, resdental or overnght accommodaton. Resdental Flat Resdental Flat, except n Town Centre Transton sub-zone and the Isle Street sub-zones (West and East) where resdental flats are permtted. Retal actvtes n the Lakevew sub-zone and the Isle Street sub-zone (West and East) that exceed a maxmum gross floor area of 400m2 per tenancy. Retal actvtes that fall wthn the defnton of ancllary retal actvty wthn the Lakevew sub-zone shall be exempt from ths rule Retal and commercal actvtes wthn the Lakevew sub-zone (except 34 Brecon Street) when exstng or consented retal and commercal actvtes wthn that sub-zone (except 34 Brecon Street) exceed 6,500 m 2. Ancllary retal and ancllary commercal uses are not ncluded n the calculaton of exstng and consented retal and commercal actvtes and are excluded from the applcaton of ths rule. - 33

x Any Actvty whch s not lsted as a Prohbted Actvty and does not comply wth one or more of the relevant Zone Standards..6.3.5 Prohbted Actvtes () The followng shall be Prohbted Actvtes Panelbeatng, spray pantng, motor vehcle dsmantlng, fbreglassng, sheet metal work, bottle or scrap storage, motorbody buldng or fsh or meat processng, or any actvty requrng an Offensve Trade Lcence under the Health Act 1956..6.4 Non-Notfcaton of Applcatons Any applcaton for a resource consent for the followng matters may be consdered wthout the need to obtan the wrtten approval of affected persons and need not be notfed n accordance wth secton 93 of the Resource Management Act 1991, unless the Councl consders specal crcumstances exst n relaton to any such applcaton. () All applcatons for Controlled and Restrcted Dscretonary Actvtes set out n Rule.6.3.2A() and Rule.6.3.2A(). () Applcatons for the exercse of the Councl s dscreton n respect of the followng Ste Standards: Buldng Coverage (wth the excepton of those lots descrbed as Sectons, 11, 17 and 18, Block VIII contaned wthn that land bounded by Hay, Lake, Beach and Man Streets) Hstorc Buldng Incentve Resdental Actvtes.6.5 Standards.6.5.1 Ste Standards Buldng Coverage Specal Character Area Precnct 1: Mnmum buldng coverage - 95%; except where a publc open ar pedestran lnk to an exstng or proposed walkway s provded, the mnmum ste coverage can be reduced by the amount necessary to provde for that lnk. Precnct 2: Maxmum buldng coverage - 70%. Precnct 3: Maxmum buldng coverage - 80%. The Town Centre Transton sub-zone: Maxmum buldng coverage - 70% Town Centre outsde of the Specal Character Area and the Town Centre Transton sub-zone - Maxmum buldng coverage 80% except that on that land bound by Man, Duke and Brecon streets, for every cubc metre of un-utlsed volume wthn the permtted buldng heght envelope, the maxmum allowable coverage shall be ncreased by the equvalent volume. Lakevew sub-zone: Maxmum buldng coverage 80%. (e) Isle Street sub-zone (East): Maxmum buldng coverage 80%. (f) Isle Street sub-zone (West): Maxmum buldng coverage 70%. - 34

.7 Wanaka Town Centre Zone Rules.7.1 Zone Purpose The purpose of ths zone s to recognse and preserve the sgnfcant elements whch contrbute to the character of the Wanaka town centre and to enhance those elements by encouragng the ntensfcaton of actvty wthn the town centre rather than perpheral expanson of the centre. The zone makes provson for a wde range of actvtes necessary to retan the mportance of Wanaka s role as the domnant rural servcng centre n the Upper Clutha. The town centre s generally bounded by Ardmore Street, Brownston Street and Dungarvon Street..7.2 Dstrct Rules Any Actvty whch comples wth all the relevant Ste and Zone Standards and s not lsted as a Controlled, Dscretonary, Non-Complyng or Prohbted Actvty shall be a Permtted Actvty..7.3.2 Controlled Actvtes The followng Actvtes shall be Controlled Actvtes provded that they are not lsted as a Prohbted, Non-Complyng or Dscretonary Actvty and they comply wth all the relevant Ste and Zone Standards. .7.3.3 Dscretonary Actvtes The followng Actvtes shall be Dscretonary Actvtes provded they are not lsted as Prohbted or Non-Complyng Actvty and they comply wth all the relevant Zone Standards. Premses Lcensed for the Sale of Lquor v v The take-off or landng of arcraft other than for emergency rescues or fre-fghtng. Resdental Flat Any Actvty whch s not lsted as a Prohbted Actvty and does not comply wth one or more of the relevant Zone Standards. Premses lcensed for the sale of lquor under the Sale of Lquor Act 1989, for the consumpton of lquor on the premses between the hours of 11pm and 7am wth the Councl s dscreton restrcted to hours of operaton and the effects on resdental zones. Ths rule shall not apply to the sale of lquor: to any person who s lvng on the premses; to any person who s present on the premses for the purpose of dnng. .7.5.1 Ste Standards v Storage Buldng Coverage Maxmum buldng coverage - 80% Setback from Internal Boundares Where the ste adjons a Low Densty Resdental or Hgh Densty Resdental Zone or publc open space the setback shall be 4.5m. For all buldngs wth frontage to Helwck Street, Dunmore Street and Ardmore Street (west of Bullock Creek) storage areas shall be stuated wthn the buldng or accessed from a servce lane at the rear of the property. In all other parts of ths Zone storage areas shall be screened from vew from all publc places and adjonng zones by a sold fence of not less than 2m heght. Retalng v Sunlght and Outlook of Resdental Neghbours v The use of the ground floor frontng onto the street of every buldng frontng Helwck Street shall be lmted to retal actvtes, restaurants, pedestran accessways to other ground floor actvtes and entrances to ndependent busnesses above ground floor. Street Scene Buldngs wthn ths zone shall not project beyond a recesson lne constructed at an angle of 34º nclned towards the ste from ponts 3m above Low Densty Resdental or Hgh Densty Resdental Zone boundares. Except that gable ends may project beyond the recesson lne where the maxmum heght of the gable end s no greater than 2.5m above the recesson lne. Setback of Buldngs v Verandas Buldngs shall be bult up to the street boundary along the full street frontage of the ste except where a pedestran lnk s provded. Nothng n ths rule shall preclude the ncluson of recessed entrances wthn any facade up to a depth of 1.5m and a wdth of 2m. Mnmum Facade Heght The mnmum street facade of all buldngs wthn the zone shall be 3m. Setback of buldngs adjonng open spaces All buldngs adjonng publc open spaces, other than formed roads, shall be set back not less than 4.5m from the ste boundary. Every buldng wth road frontage to Helwck Street, Dunmore Street and Ardmore Street shall, on ts erecton or on beng reconstructed or altered n a way that substantally changes ts external appearance, be provded wth a veranda whch shall be stuated no hgher than 3m above pavement level and shall provde contnuous cover for pedestrans. v Resdental Actvtes All resdental actvtes shall be restrcted to frst floor level or above. Any buldng or part of a buldng used for resdental actvtes shall provde a separate outdoor lvng area for the exclusve use of each separate resdental unt. The nose lmts n shall not apply to constructon sound whch shall be assessed n accordance and comply wth NZS 6803:1999. The nose lmts n shall not apply to sound assocated wth arports or wndfarms. Sound from these sources shall be assessed n accordance and comply wth the relevant New Zealand Standard, ether NZS 6805:1992, or NZS 6808:1998. For the avodance of doubt the reference to arports n ths clause does not nclude helpads other than helpads located wthn any land desgnated for Aerodrome Purposes n ths Plan. The purpose of ths zone s to recognse and conserve the sgnfcant physcal and natural resources whch contrbute to the character of the town centre and enhance these by encouragng compatble land use actvtes and an ntensfcaton of actvty rather than permttng perpheral expanson. In addton, the zone provsons seek to enhance those elements whch gve rse to the partcular sense of place, buldng scale and atmosphere that s characterstc of Arrowtown. The zone makes provson for a wde range of actvtes necessary to retan the Arrowtown s role as a major vstor attracton and as a centre servcng the day to day needs of the resdent populaton.
