Councilmember Hampton arrived at 6:23 p.m. Phillip Sanchez, Pasadena Police Chief, commented on the services provided by Spokeo, Inc., noted that his Department utilized its services on a trial basis, which has expired. However, he stated that his Department is in the process of performing a cost benefit analysis as it relates to the use of Spokeo s law enforcement services. JULY 4, 2017 FIREWORKS OVERVIEW Steve Mermell, City Manager, introduced the agenda item, Wendell Eaton, Fire Battalion Chief, Art Chute, Police Lieutenant, and William Boyer, Public Information Officer, provided a PowerPoint presentation reviewing the agenda item, and responded to questions. The Committee thanked everyone involved in providing enforcement measures to address illegal firework activity in the city and for their community outreach efforts, specifically as it relates to circulating information regarding Pasadena s Zero Tolerance for fireworks, acknowledged the various challenges due to pervasive use of fireworks, and encouraged staff to continue placing the emphasis on education. In response to Councilmember Hampton s expressed concerns, Phillip Sanchez, Pasadena Police Chief, stated that the Police Department will redouble its efforts with the Pasadena Humane Society to circulate information on special pet care. On the order of the Chair, and by consensus of the Committee, the information was received and filed. POLICE STAFFING ANALYSIS Steve Mermell, City Manager, introduced the agenda item and responded to questions. Carlos Livingston and Rebecca Leung, students at the Sol Price School of Public Policy at University of Southern California (USC), provided an overview for the Committee on their work involving a staffing analysis of the Pasadena Police Department, and responded to questions. Dale Gronemeier, Eagle Rock resident, submitted written material and commented on the police staffing analysis, stating that in his opinion the analysis does not answer the question as to the appropriate police staffing level/number for the Pasadena Police Department. Mayor Tornek commented on the International City/County Management Association (ICMA) Rule of 60 Guidelines listed on page 16 of the police staffing analysis report, requested clarification on item number 3, which reads, The Total Service Time how much time officer(s) spent on scene should not exceed a factor of 60, stated the need for clarity on the methodology used to reach the conclusions with regard to shortfalls at certain periods of the day, with the Mayor and the Chair requesting the City Manager to report back to the Committee with follow-up information In response, the City Manager reminded the Committee that the police staffing analysis report is not a totally exhaustive analysis, and noted that staff will work with the students to obtain the requested information and report back to the Committee with the findings. 02 08/16/2017
Following discussion, Councilmember Madison reiterated his concerns involving recruitment and retention of police officers, and urged staff to examine the composition of sworn officers, specifically in terms of tenure/experience when considering police staffing levels. The City Manager spoke regarding the appropriateness to conduct a per capita versus percentage comparison of the City s budget to those of neighboring cities as it relates to costs associated with public safety, with Councilmember Madison disagreeing on the stated need to do a per capita comparison, and noted the importance for staff to provide a full and complete report on the data. Councilmember Hampton asked staff to include the HOPE and K9 teams as part of the staffing level data when the matter is brought back to the Committee for discussion. The Chair stated that the police staffing analysis report is a good start and provides helpful data, but expressed concern with the lack of comprehensive methodology to support several statements and findings outlined in the report. The Chair also requested a further analysis of the police officers various work schedules/shifts (4/10, 3/12, etc.) in terms of coverage. On order of the Chair, and by consensus of the Committee, the information was received and filed. REPORT ON OVERDOSE CASE #16003313 - MARCH 4, 2016, 928 E. COLORADO BOULEVARD Steve Mermell, City Manager, introduced the agenda item, and Phillip Sanchez, Pasadena Police Chief, provided a PowerPoint presentation reviewing the agenda item, and responded to questions. The following individuals provided comments and questions related to the agenda item: Juliana Serrano, Coalition for Increased Civilian Oversight of the Pasadena Police (CICOPP) Kris Ockershauser, Pasadena resident Dale Gronemeier, Eagle Rock resident David LLanes, Pasadena Police Officers Association Joyce Perry, Pasadena resident Following discussion, Councilmembers Madison and Hampton stressed the importance for police officers to timely complete incident reports, with the City Manager reiterating the Police Chief s directive that Pasadena Police Department employees must comply with the City s adopted policy that requires the preparation of incident reports (under certain circumstances) or be subject to discipline. In response to Chair Kennedy, the City Manager commented on information released to the public, with Javan Rad, Chief Assistant City Attorney, clarifying what information can be discussed publicly and noted the importance of being careful not to violate the Police Officer s privacy rights, specifically as it relates to personnel matters. 03 08/16/2017

PUBLIC COMMENT Kris Ockershauser and Michelle White, representing the American Civil Liberties Union of Southern California (ACLU), provided comments and asked a series of questions regarding Spokeo, Incorporated, and submitted questions in writing. In response to the above speakers, the City Manager stated that the Pasadena Police Department is currently considering utilizing Spokeo s technology, and noted that he is not aware of an executed contract between the City and Spokeo, Incorporated. INFORMATION ITEMS Councilmember Hampton arrived at 6:15 p.m. OUTDOOR LIGHTING AND COLOR TEMPERATURE Ara Maloyan, Director of Public Works Department, Ying Ying Goh, Health Officer, and Luis Rocha, Planner, provided a PowerPoint presentation summarizing the agenda item, and responded to questions. In response to Councilmember Madison, Steve Mermell, City Manager noted that the subject report is in response to questions and concerns raised by the Committee at a previous meeting concerning blue-rich lighting. Donald Berry, Pasadena resident, expressed concerns regarding blue-rich lighting and its harmful effects on humans. Following discussion, Mr. Maloyan noted that the City has an unfunded liability, which is to replace the existing high voltage street light system, and stressed the importance to change the above mentioned street lights prior to replacing regular street lights operating above standard. Dr. Goh responded to questions regarding the American Medical Association s (AMA) report on findings as it relates to potential health effects of blue-rich lighting, noted she has reviewed related research on the matter, such as found on the Harvard Medical School s website, and has determined that the City is operating responsibly as it relates to lighting throughout the city. However, she noted there may be individuals with underlying medical conditions that might be affected disproportionately by blue-rich lighting. FIRE STATION FACILITIES CONDITION REPORT Steve Mermell, City Manager, introduced the agenda item, Ara Maloyan, Director of Public Works, and Jon Trautwein, Deputy Fire Chief, provided a PowerPoint presentation reviewing the agenda item, and responded to questions. Councilmember Madison expressed concerns with the lack of information presented on the structural conditions and safety of the fire stations, stressed the need to ensure that our first responders are in a safe environment in the event of a natural disaster, and requested that staff provide the specifics of the six non-conforming fire stations that do not meet the current building code standards. In response to Councilmember Madison, Fire Chief Bertral Washington noted that during the budget process, the Fire Department in collaboration with the Public Works Department, prepared recommendations based on the findings noted in the WLC Architects report, and feedback from the Fire Department s staff. The Mayor agreed with Councilmember Madison, and stated that the forthcoming report should highlight major concerns, life safety issues, and diversity in the workforce. Following discussion, the Chair asked staff to report back to the Committee with the information requested above, with Councilmember Hampton requesting staff to include information on any hygienic matters. The Chair spoke regarding the 2017 California Firefighters Memorial Ceremony, and emphasized the importance of creating a safe environment for our employees. Scott Austin, Pasadena Firefighters Local 809, spoke on two areas of concern: the safety of building structures, and air quality/health safety within fire station facilities. The City Manager thanked Mr. Austin for his comments and acknowledged the need for structural improvements at various public facilities, namely Fire Station facilities, noted the fiscal challenges the City faces in terms of reinvesting in deteriorating infrastructures/aging facilities, and stated that the matter will be discussed as part of the Capital Improvement Budget discussions. Mr. Mermell also noted that he has visited Fire Station No. 38, and as a result, have directed staff to take all appropriate actions to address any health concerns associated with Fire Station No. 38. The Chair asked that the brochure regarding the California Firefighters Memorial Ceremony be made part of the record. GREAT SHAKEOUT AND DISASTER PREPAREDNESS Bryan Frieders, Fire Bureau Chief, provided a PowerPoint presentation on the agenda item and responded to questions. UPDATE ON RECENT CRITICAL INCIDENTS Phillip Sanchez, Chief of Police, provided an oral report on recent critical incidents, which included information on an incident that took place on Summit Avenue on October 5, 2017, where two individuals were wounded. On the order of the Chair, and by consensus of the Committee, the information was received and filed. 2017 MID-YEAR USE OF FORCE OVERVIEW Phillip Sanchez, Chief of Police, provided a PowerPoint presentation summarizing the agenda item, and responded to questions. The Chair applauded the Police Department for the positive preliminary statistical data received covering the first half of the year (2017) as it relates to Use of Force. In response to the Chair, the Chief of Police noted that, in his opinion, it would be premature at this time to say that the statistics for the Use of Force overview and Mid-Year Discipline overview is directly correlated to the use of body worn cameras, and noted that a report is forthcoming on the body worn camera program and its statistics soon. On the order of the Chair, and by consensus of the Committee, the information was received and filed. 2017 MID-YEAR DISCIPLINE OVERVIEW Phillip Sanchez, Chief of Police, provided a PowerPoint presentation summarizing the agenda item, and responded to questions. Councilmember Madison briefly spoke about the numbers of guns recently confiscated, urged staff to use any available resources to address the matter, and suggested that staff consider another gun buyback program. He also expressed concerns with the number of collisions, and asked staff to weigh the factors/causes for the collisions such as fatigue. The Chief responded to questions regarding the number of collisions and some of the factors that cause such collisions, and noted that there is a policy in place that precludes an officer from working more than 18 hours consecutively. Joyce Perry, Pasadena resident, expressed concerns and asked questions regarding the process and procedures for complaints, and stated that she has filed two complaints and have not received a response from the Police Department. 04 10/18/2017
The Chief stated that Lieutenant Sell will follow up with Ms. Perry. The Chair applauded the public speaker, Ms. Perry, for her participation in the community and for her recent graduation from the Citizen s Police Academy. COUNCIL COMMENTS Councilmember Hampton inquired why the Police Department headquarters is not open to the public 24 hours a day, noting that he believes the Los Angeles County Sherriff Stations are open 24 hours, and asked staff to bring forward information on the matter for discussion at a future meeting. The Chair suggested that the Committee consider developing an annual work plan for the Public Safety Committee. The Mayor noted that the Municipal Services Committee prepares a work plan at the beginning of each year outlining future agenda items, which is distributed to the Committee for review/comments, with the Chair agreeing to such a format. Genevieve Clavreul, Pasadena resident, spoke on issues involving safety at the Gold Line Train Station, and expressed concerns with the need for policing services at the Station. Alex Wiggins, Executive Officer, System Security & Law Enforcement for the Los Angeles County Metropolitan Transportation Authority (Metro), spoke briefly regarding the proposed contract and Metro s partnership with law enforcement agencies to provide policing services at the Gold Line Train Station. Following discussion, it was moved by Mayor Tornek, seconded by Councilmember Hampton, to approve staff s recommendation, and forward the item to the full City Council for consideration. INFORMATION ITEM PASADENA POLICE DEPARTMENT LOBBY HOURS POLICE CHIEF PHILLIP SANCHEZ Steve Mermell, City Manager, introduced the agenda item, and Phillip Sanchez, Police Chief, provided an overview of the agenda item as part of a PowerPoint presentation, and responded to questions. Councilmember Hampton reiterated his concerns regarding the Pasadena Police Department s lobby hours, stating that, in his opinion, the doors to the lobby should be open and accessible to the public at all times, specifically for emergency situations, and noted that most Los Angeles County Sheriff Stations are open 24 hours. In response, Mr. Mermell highlighted some concerns as it relates to the Police Department s lobby remaining open 24 hours, but noted that he will ask the Police Chief to consider the matter and check practices of other law enforcement agencies. The Chair agreed on the need for staff to further study the matter and report back to the Committee with information. Use of Force Review Police Department Policy: The use of force by law enforcement personnel is a matter of critical concern, both to the public and to the law enforcement community. Officers are involved on a daily basis in numerous and varied interactions and, when warranted, may use reasonable force in carrying out their duties. Officers must have an understanding of, and true appreciation for, their authority and limitations. This is especially true with respect to overcoming resistance while engaged in the performance of law enforcement duties. The Department recognizes and respects the value of all human life and dignity without prejudice to anyone. Vesting officers with the authority to use reasonable force and to protect the public welfare requires monitoring, evaluation and a careful balancing of all interests. 2
What Constitutes Use of Force? Police Department Force: The application of physical techniques or tactics, chemical agents or weapons to another person.
