Approval of the Work Plan END OF CONSENT CALENDAR The Committee will review the Work Plan recommendation from the May 22, 2017 meeting. Recommendation: Staff recommends the CoHR approve the 2017 Work Plan and forward the CoHR Policies and Procedures and the 2017 Work Plan to the Community and Human Services Commission. 3. ACLU Recommended Policies and Rules for the City of Claremont The Committee will review and discuss the recommended policies and rules, as well as the City of Claremont s New Immigration Hold Policy. Recommendation: Staff recommends the CoHR review and discuss the ACLU Recommended Policies and Rules for the City of Claremont and forward its opinions to the Community and Human Services Commission and the Police Commission. 4. Committee on Human Relations Policies and Procedures Director Turner reported on the following changes to the draft Policies and Procedures. She said the Commission liaison s can provide their expertise and experience, bring the perspective of their commissions to the Committee and bring the Committee s efforts back to their commissions. Liaisons will not be voting members. On Page 2 of Section B., number 2 and 3 revised to read: liaison of the Committee and not member of the Committee. Commission liaison Jed Leano asked if liaisons are not voting members, can liaisons make motions or second motions. Director Turner said no. Committee member Ellen Taylor said liaisons can ask for support and members can make the motion. Commission liaison Edgar W. Reece added that it doesn t limit a liaison to speak or to participate on the Committee. Committee member Rose Ash asked if liaisons are able to assume officer positions. Director Turner said no. Committee member Paul Buch recommended revisions to the language in Sections C, D, and E. The title of Section C., revised to read: MEETING OF OFFICERS The Committee on Human Relations shall: Section D. Item #2, remove the word executive. Consists of the Committee Chair, Vice Chair, with support from the liaison from the Community and Human Services Commission, and the liaison from the Police Commission. Work Plan Discussion Director Turner stated that the Committee will discuss the work plan calendar for the next year. The design of the work plan is intended to be put into quarters. Items put forward in the policies and procedures should be used as a point of reference. Ideas can be things you want to do or support in the local community that is already happening, and work that moves forward the mission and purpose of the Committee. Director Turner said items can be added to the work plan as things are happening in the community. After reviewing the Committee mission statement and purpose from the policies and procedures, the Committee created the following work plan. 8 The next meeting will be held on Monday, June 19 at 6:00 p.m. and will include feedback from the Work Plan Ad Hoc committees, ACLU Recommended Policies and Rules for the City of Claremont, and a Hate Crime and Hate Incident presentation from Police Department Captain Aaron Fate. The Committee will not meet in July or August, but will meet again in the fall on Monday, September 18 at 6:00 p.m. The Committee received and filed the report. The Committee members reported on the following items. Commission liaison Leano said he will immigration clinic information to Anne to to the Committee. Committee member Lauren Roselle asked about the teen group from El Roble Intermediate School and Claremont High School. Director Turner said the Teen Committee is comprised of middle and high school students. The Teen Committee reports to the Community and Human Services Commission. Committee member Buch reported there s a Coalition of Interfaith groups hosting the Muslim community a meal concluding the Ramadan Fast on June 5 at 7:00 p.m. at Temple Beth Israel. The meal will be at 8:15 p.m. A link is provided on the flyer to register. Director Turner will the flyer to the Committee. Commission liaison Reece said he ll report back information to the Police Commission when they meet on June 1. 9 Claremont Committee on Human Relations Agenda Report TO: FROM: COMMITTEE ON HUMAN RELATIONS ANNE K. TURNER, HUMAN SERVICES DIRECTOR DATE: JUNE 19, 2017 SUBJECT: COMMITTEE ON HUMAN RELATIONS 2017 WORK PLAN SUMMARY On January 10, 2017, the Claremont City Council supported the Community and Human Services Commission s recommendation to establish a new Committee on Human Relations (CoHR) committed to vigorous and proactive work, to promote understanding and education with regard to human relations among various segments of the community, and to recommend measures which will serve to improve human relations within the City (Attachment A). The Council instructed the newly formed CoHR to meet for the purpose of developing policies and procedures for the Committee and a work plan for 2017, and to report back on its work plan to the Community and Human Service Commission. At the May 22, 2017 meeting, the CoHR developed a preliminary work plan outlining proposed activity from June 2017 through December 2017 (Attachment B). Also at the meeting, the CoHR approved the policies and procedures for the Committee. The CoHR is ready to provide the Community and Human Services Commission with the CoHR policies and procedures, as well as the work plan. RECOMMENDATION Staff recommends the CoHR approve the 2017 Work Plan and forward the CoHR Policies and Procedures and the 2017 Work Plan to the Community and Human Services Commission. ALTERNATIVE TO RECOMMENDATION Request additional information from staff. FINANCIAL REVIEW The staff cost to prepare this report and administer this program is estimated at $798, and is included in the operating budget of the Human Services Department. ANALYSIS Background The Community and Human Services Commission recommended the City Council establish a new Committee on Human Relations committed to vigorous and proactive work, to promote understanding and education with regard to human relations among various

10 Claremont Committee on Human Relations June, 19, 2017 Page 2 segments of the community, and to recommend measures which will serve to improve human relations within the City. As a part of the establishment of the CoHR, the Committee was asked to report back to the Community and Human Services Commission on its work plan. The CoHR has met several times since the City Council established the Committee on January 10, At the January 30, 2017 meeting, the initial members of the Human Relations Response Team who had been appointed by the City Council to the newly formed CoHR, discussed the work plan for the Committee and how they would grow. At the February 6, 2017 meeting, the CoHR reviewed and approved recruitment and application materials. Staff then released these materials seeking an additional four (4) members for the CoHR. At the April 17, 2017 meeting, applications were reviewed and candidates were recommended for interviews by the Community and Human Services Commission Ad Hoc. Four new members were recommended by the Ad Hoc to the full Community and Human Services Commission at the May 3, 2017 meeting. The Community and Human Services Commission ratified the recommendation of the Ad Hoc to appoint Beatrice Casagran, Fern Jo Kaukonen, Tahil Sharma, and Adrian Stevens. On May 16, 2017, these four new members attended a new member orientation and Brown Act training. On May 22, 2017, the fully appointed CoHR convened to approve the CoHR Policies and Procedures and to begin developing the CoHR 2017 Work Plan. Work Plan The CoHR has been charged to carry out comprehensive and effective human relations work in the community. The Committee is re-establishing a close working partnership with the Los Angeles County Commission on Human Relations and strengthening the relationship with the Claremont Police Department, and the Human Services Department staff members in the execution of its work. TURNER, HUMAN SERVICES DIRECTOR DATE: JUNE 19, 2017 SUBJECT: ACLU RECOMMENDED POLICIES AND RULES FOR THE CITY OF CLAREMONT SUMMARY The American Civil Liberties Union (ACLU) Policies and Rules for the City of Claremont have been provided to the City for consideration by Indivisible Claremont. These rules address the issues of deportation, privacy, redress, and discrimination in regard to the enforcement of immigration policy. The City of Claremont Police Department has developed a new immigration hold policy, which was presented to the Police Commission on June 1, The discussion of immigration policy and enforcement falls under the purview of the Committee on Human Relations as it relates to safeguarding the civil rights, safety, and dignity of all people. RECOMMENDATION Staff recommends the Committee on Human Relations review and discuss the ACLU Recommended Policies and Rules for the City of Claremont and forward its opinions to the Community and Human Services Commission and the Police Commission. ALTERNATIVE TO RECOMMENDATION Request additional information from staff. ANALYSIS Background In March 2017, Indivisible Claremont expressed to the City Manager their desire for the City of Claremont to adopt the ACLU Policies and Rules for the City of Claremont (Attachment A). These rules have four specific categories addressing deportation, privacy, redress when mistakes and abuses occur, and protection from discrimination. While the implementation of these rules would be under purview of the Claremont Police Department, the Committee on Human Relations has been asked to review and discuss the ACLU Policies and Rules for

24 Claremont Committee on Human Relations June, 19, 2017 Page 2 the City of Claremont and forward the information to the Community and Human Services Commission, the Police Commission, and the Claremont City Council. ACLU s Nine Model Policies and Rules were developed to address concerns about the Trump administration s immigration policies. The rules were designed to, defend our friends, families, and neighbors from Trump s mass deportation agenda; protect our friends, families, and neighbors privacy from the Trump administration; help our friends, families, and neighbors get redress when abuses and mistakes occur; help ensure our friends, families, and neighbors are protected from discrimination. The stated objects of the ACLU Policies and Rules for the City of Claremont fall within the purview of the CoHR as per the mission statement. The City of Claremont Committee on Human Relations is dedicated to promoting positive human relations in an increasingly complex and multicultural society. The Committee works to develop programs that address as discrimination, prejudice, and stereotyping based on race, religion, gender, sexual orientation, national origin, age, ability, ethnicity, social class, or any other arbitrary factor, and other divisive attitudes that can lead to inter-cultural tension, hate incidents, hate crimes, and related violence. This item is in the purview of the CoHR and, thus the Community and Human Services Commission, however, the execution of the rules would be the duty of the Claremont Police Department. On June 1, 2017, the Claremont Police Department (CPD) presented to the Police Commission an Immigration Hold policy to be added to the CPD Policy Manual Chapter 7 entitled Jails (Attachment B). The new policy aligns well with the ACLU Policies and Rules. The contents of this new policy are required per Assembly Bill (AB) 2792, also known as the Truth Act. On September 28, 2016, Governor Jerry Brown signed into law Assembly Bill (AB) 2792, known as the Transparent Review of Unjust Transfers and Holds (TRUTH) Act. The Act imposes specific obligations on California law enforcement related to their contacts with the Federal Immigration and Customs Enforcement (ICE) Agency. The TRUTH Act applies to any agency of a city, county, city and county, special district, or other political subdivision of the State that is authorized to enforce criminal statutes, regulations, or local ordinances, or to operate jails or to maintain custody of individuals in jails; or to operate juvenile detention facilities or to maintain custody of individuals in juvenile detention facilities; or to monitor compliance with probation or parole conditions. Current Federal law authorizes ICE to issue an immigration detainer advising a law enforcement agency that ICE seeks custody of an individual presently being held by that agency for the purpose of arresting and deporting the individual. The standard operating procedure of the Police Department has been to not detain a subject for an ICE Detainer alone. They must ALSO have an open charge or warrant issued by a judge. If the individual provides a bail/bond for the open charge/warrant, then they would be released even if we possess an ICE detainer for the subject. This is now included in the new policy along with the requirements of the TRUTH Act.

25 Claremont Committee on Human Relations June, 19, 2017 Page 3 Effective January 1, 2017, the TRUTH Act requires: All law enforcement agencies who receive an ICE detainer, transfer, or notification request, must serve a copy of that request on the individual and inform the individual if the law enforcement agency will comply with the request. If law enforcement provides ICE with notification of an individual s release date and time, the local law enforcement agency also must promptly provide the same notification to the individual and their attorney or designee. A consent form is to be provided to all individuals prior to an ICE interview. If the individual declines to be interviewed, you may not provide ICE with access to the individual. If the individual indicates that he or she is willing to be interviewed only with an attorney present, you may not provide ICE with access to the individual unless the attorney is present. Communications with ICE are subject to the California Public Records Act. The ACLU Policies and Rules call for assurances about Claremont Police Department (CPD) policy and practice. Those assurances are evidenced in the new Immigration Hold policy and in the practice of CPD. The commitment of safeguarding the civil rights, safety, and dignity of all people remains the goal of the City of Claremont.
