Call to Order/ Roll Call Ms. Amanda Skier, Chairperson, called the regular meeting of the Historic Preservation Board to order at 5:02 P.M., and Ms. Laterese Abner, Board Secretary called the roll and it was determined that a quorum was present. II. Approval of Agenda/ Minutes Chairperson Skier noted that there was a modification moving HPB Case No. 17-35 to the beginning of the Agenda. With no additional changes, Ms. Theodora Aspegren made a motion to approve the agenda for June 27, 2017. Mr. William Serrano seconded the motion; the motion was approved 7-0. Ms. Theodora Aspergren made a motion to approve the minutes for May 23, 2017. Mr. Christopher Kammerer seconded the motion; the motion was approved 7-0. III. Report from the Historic Preservation Planner Ms. Friederike Mittner, City Historic Preservation Planner noted that there were 66 Level I applications and three Level II applications along with 14 zoning reviews. At this time there were no general communications to the board except a request for an appeal of a previous case at 280 Edgewood for Window Alterations. The case will go to City Commission on August 14. 1

IV. Remarks by the Chairperson/ Declaration of Ex-Parte Communication Ms. Amanda Skier stated that the matters before the public are quasi-judicial in nature. The decisions of the board are made from competent and substantial evidence that comes before them. For each case, staff will make a presentation and afterwards, the applicant can make a 10 minute presentation for regular cases or take 15 minutes for a proposed demolition. After the applicant, the board will open up the floor for public comment, which is restricted to three minutes per speaker. The applicant may have a short rebuttal after the public speaks. Members of the board need to disclose if they have discussed the cases with anyone prior to tonight s meeting. Ex-Parte Communication Chairperson Skier stated that she had spoken with neighbors surrounding the property for HPB Case No. 16-59B, 224 Belmonte Road. She also met with the applicant for HPB Case No. 16-68B along with visiting the site for 257 Granada Road. In addition, she spoke with Friederike Mittner about the cases for June 27 but noted that she would be able to base her decision on the evidence presented. V. Public Comment No members of the public requested to speak on items not listed on the agenda. A. Swearing in of the Speakers Ms. Sigrid Mariella Vegas-Catinella with the City of West Palm Beach Legal Department swore in all members of the public who wished to speak. New Business Historic Preservation Board Case No. 17-35 Ms. Friederike Mittner presented Historic Preservation Board Case No. 17-35. The applicant, Alfonso Hernandez for Payne Chapel AME Church, Inc. is requesting approval for the following: 1. Individual Landmark Designation Location: 801 9 th Street, in the Historic Northwest District within Commission District No. 3 Commission Paula Ryan. Staff is recommending approval as the site meets HPO criteria for eligibility (Section 94-48(a)(2)): 89 years old. 2

Criteria A Association with events and person that made a significant contribution to the broad pattern of the city s history; Criteria D Embodies the distinctive characteristics of a type, period, or method of construction, namely, the Gothic Revival Style. and SoIS guidelines for retention of historic integrity: #1 A property will be used as it was historically or be given a new use that requires minimal change to its distinctive materials, features, spaces, and spatial relationships. #5 Distinctive materials, features, finishes, and construction techniques or examples of craftsmanship that characterize a property will be preserved. No member of the public spoke on this case. Mr. William Serrano made a motion to recommended approval to City Commission of Historic Preservation Board Case No. 17-35: as a historic landmark under Ordinance No. 4691-17. The board upon hearing and reviewing the report of the Historic Preservation Planner and hearing testimony from the public on such application makes the following findings of fact: 1. The site is a significant resource of architectural importance. It was built in 1928 or more than 89 years ago. 2. The subject building is an extraordinary example of the Gothic Revival style and is reflective of the importance of African-American Churches within the City. 3. The loss of the resource and its connection to the development to the City would be a detrimental loss. Ms. Theodora Aspegren seconded the motion, the motion was approved 7-0. VI. Old/ Continued Cases Historic Preservation Board Case No. 16-59B Ms. Desiree Estabrook presented Historic Preservation Board Case No. 16-59B. The applicant, Charles Reber and Ann Gerow are requesting approval for the following: 3

1. Alterations-windows for already installed horizontal sliders in place of casement windows. Location: 224 Belmonte Road, in the Historic District of El Cid within Commission District No. 3 Commissioner Paula Ryan. Staff is recommending denial as the new windows do not meet the original conditions for approval: 1. Windows shall be clear or low-e glass, not tinted. 2. Replacement windows shall fit into existing openings. 3. Replacement windows shall match the existing divided light configurations (4-light paired casement, 1/1 single-hung, etc.) 4. Colonial-Style shutters will be maintained on the front and side elevations. 5. Restore picture window with sidelights configuration on front elevation, east of the main entry to keep with the original design. (HPB allowed for the conversion of the picture window into a wider casement to match the other window openings. Window opening has since been reduced in width.) Does not meet HPO and SoIS guidelines: #9 New work will be compatible with historic materials, features, size, scale and proportion to protect the integrity of the property and its environment. #10 New additions and adjacent new construction should be undertaken so that, if in the future removed, the essential form and integrity of the historic property is unimpaired. One member of the public spoke on this case. Mr. William Serrano made a motion to deny Historic Preservation Board Case No. 16-59B for alterations. The motion is based upon the testimony presented along with the Staff report that competent, substantial evidence of record has not been submitted that satisfies the standards set forth in the Historic Preservation Ordinance, Section 94-49 of the City s Zoning and Land Development Regulations, the SoIS for Rehabilitation, specifically, Standards #9 and #10. Mr. Daniel Pichney seconded the motion, the motion was approved 6-1 with Mr. Christopher Kammerer dissenting from the vote. 4

Historic Preservation Board Case No. 16-68B Ms. Friederike Mittner presented Historic Preservation Board Case No. 16-68B. The applicant, Sam Fisch is requesting approval for: 1. Alteration windows, replacement instead of repair for front facing windows. Location: 257 Granada Road in the El Cid District within Commission District No. 3 Commissioner Paula Ryan. Staff is recommending denial as it does not meet HPO and SoIS guidelines: #6 Where the severity of deterioration requires replacement of a distinctive feature, the new feature shall match the old in design, color, texture and where possible materials. No members of the public spoke on this case. Mr. William Serrano made a motion to approve Historic Preservation Board Case No. 16-68B. for window replacement in accordance with SoIS #6 and 9, as set forth in Section 94-49 of the City s ZLDRs. The motion is based on the testimony presented along with the Staff report which constitutes competent substantial evidence, with the following conditions: That the approval is limited to replacement of the windows on the top floor, as to the windows on the ground floor; the applicant shall provide Staff with proof that they are not able to be restored. Staff will determine their replacement if sufficient evidence of the inability to restore the windows on the ground floor is provided by the applicant. Ms. Theodora Aspegren seconded the motion, the motion was approved 7-0. VII. New Business Historic Preservation Board Case No. 17-22 Ms. Friederike Mittner presented Historic Preservation Board Case No. 17-22. The applicant, John Foss and Scott Barsin are requesting approval for: 1. Alterations windows, replacing all wood windows with an aluminum product 5

matching the existing lite pattern. Location: 312 Sunset Road, in the El Cid Historic District, Commission District No. 3 Commissioner Paula Ryan. Staff is recommending approval with conditions: 1. All front facing (north elevations) shall be repaired and restored. Partially meets HPO and SoIS guidelines: #6 Where the severity of deterioration requires replacement of a distinctive feature, the new feature shall match the old in design, color, texture and where possible materials. One member of the public spoke on this case. Mr. Christopher Kammerer made a motion to approve Historic Preservation Board Case No. 17-22 for alterations according to Standard #9 along with the SoIS set forth in Section 94-49 of the City s ZLDRs. This motion is based on the testimony submitted along with the application and the Staff report, which constitute competent, substantial evidence. Ms. Theodora Aspergren seconded the motion; the motion was approved 6-1 with Mr. William Serrano dissenting from the vote. Historic Preservation Board Case No. 17-37 Ms. Friederike Mittner presented Historic Preservation Board Case No. 17-37. The applicant, Thomas Kastner on behalf of Sarena Weil is requesting approval of the following: 1. Variance from side setbacks for primary structure Section 94-80b(2). Location: 816 Sunset Road in the Flamingo Park District within Commission District No. 5 Commissioner Shanon Materio. Staff is recommending denial as the request only meets 5 of 10 of the variance standards in the ZLDR section 94-304(d)(6). 6

No members of the public spoke on this case. Ms. Kristin Kellogg made a motion to approve Historic Preservation Board Case No. 17-37 for a variance from section 94-81(b)(2) of the ZLDRs which requires a primary structure to have a minimum of 5 feet from the side property line and 15 feet cumulative in the Historic Single Family High Density as (SF14-C2) Residential zoning district at 816 Sunset Road, to permit a 4.9 foot setback at the east side property line and 9.9 feet cumulative side setbacks if the lot is split. The motion is based upon the testimony presented along with the applications submitted and the Staff report, which constitute competent, substantial evidence. The Historic Preservation Board hereby makes finding of fact that each of the ten criteria in Article II, Section 94-38(d)(6) have been met for the variance; with the condition that the carport must be restored and that the applicant will work with staff. Ms. Theodora Aspegren seconded the motion, the motion passed 7-.0. ADJOURNMENT Ms. Amanda Skier adjourned the meeting at 7:21 p.m. Please be advised that these minutes are not verbatim.
