1 CITY OF SOU MIAMI Environmental Review & Preservation Board Regular Meeting Minutes Tuesday, January 8, 2013 City Commission Chambers 8:30 A.M. City of South Miami Ordinance No requires all lobbyists before engaging in any lobbying activities to register with the City Clerk and pay an annual fee of $500 per Ordinance No This applies to all persons who are retained (whether paid or not) to represent a business entity or organization to influence City action. City action is broadly described to include the ranking and selection of professional consultants, and virtually all-legislative, quasi-judicial and administrative action. I. CALL TO ORDER Action: Mr. Fernandez called the meeting to order at 8:34 A.M. II. PLEDGE OF ALLEGIANCE Action: The Pledge of Allegiance was recited. III. ROLL CALL Action: Roll call was taken. Board members present constituting a quorum: Mr. Fernandez, Ms. McCain, Ms. Schwartz, Mr. Gil, Mr. Montana, and Mr. Corral. Board members absent: None City staff present: Mr. Marcus Lightfoot (Permit Facilitator), Ms. Tiffany Hood (Office Support), Ms. Lourdes Cabrera (Principal Planner). Staff members absent: None IV. ADMINISTRATIVE MATTERS There are none at this time. V. REQUESTS ARE AS FOLLOWS: A) ERPB Page 1 of 7

2 Applicant Present: Kristin Herman-Druck/ Luis Cano Ms. Cabrera read the item to the record and presented it to the Board. Applicant: Gresham Smith & Partners Property Owner: Beatriz Amendola, MD For: Innovative Cancer Institute Location: 5995 SW 71 Street Request: New Construction - Final (Four-Story) The applicant gave an in depth summary of the exploration that was done to comply with the requests of the Board and the Land Development Code. 1. The rooftop screening of the mechanical units-it was stated that they complied. 2. The landscape bulb outs within the right-of-way to match the character on Seventieth Street-it was stated that they did not implement this request, due to budgetary constraints and future parking needs should expansion be explored. Mr. Gil entered the meeting; he was not present when the roll call was taken. 3. The confirmation from the traffic engineer that the main arteries would not be downgraded- it was stated that the traffic study was provided and confirmed by the engineer. 4. The light spillage on the south elevation and the fourth floor parking-it was stated that they have provided three light poles for parking and five wall mounted light fixtures on the fourth floor parking which is the minimum required for parking. 5. To consider adding eyebrows as an architectural feature it was stated that this request was not implemented, due to the design of the building and the possible confliction of any rooftop supports for the window cleaning equipment that would overhang because the eyebrows could be damaged in the process. 6. To consider adding a private garden area with a water feature only accessible from the inside of the building- it was stated that this was not implemented due to the patient carethe owner does not want the patients to go outside. Ms. Schwartz stated that the request was not for the patients but for the caregivers to relax during the time that the patient will be seen by the doctor. She then stated that she feels that with the owner planning future expansion, to please reconsider adding a garden area for caregivers of the patients. Ms. McCain stated that it would be nice to have a garden but we are not on this Board to demand or tell any applicant how to spend their money. Mr. Luis Cano, the applicant responded that the expansion is designed to be on the ground floor, to add a second linear accelerator for cancer treatment which will be located next to the vault that will be built. He also stated that the when the expansion takes place the on-street parking will be utilized to house the accelerator. He then stated that the second reason was a concern of security from vagrants which is an issue that is currently being experienced at the current office at a different location. Mr. Fernandez asked the applicant to look at other options Page 2 of 7

3 to integrate a garden area. Mr. Cano stated that the possibility of a garden was discussed with the owner and for the reasons listed above she is not open to it. Ms. Schwartz commented about the shortage of trees that will be installed. Mr. Corral stated that the landscaping that has been proposed makes sense and because there is a shortage of trees in the proposal the applicant must contribute to the tree fund. Ms. McCain stated that there is a shortage of shade trees in the city and especially downtown to make it conducive to walk or bike. Mr. Montana addressed the concern of the screening for the mechanical equipment, will it mitigate sound. Mr. Cano responded that the seven units are that of residential and not commercial the paneling and the stucco should mitigate the sound. Ms. Schwartz stated her concern of where the loading area will be located. The applicant responded that her supplies would be delivered by a courier, there is not a need for a loading dock; there is a ground clearance of twelve feet in height for trucks. Mr. Fernandez recommended that the applicant explore the possibility of expanding the existing garden area into a larger garden area along the street frontage. Mr. Cano replied that they do not wish to. Mr. Fernandez asked staff to check the Land Development Code (LDC) for any requirements for a loading area. Ms. Cabrera responded that she will check the LDC. Mr. Lightfoot responded that the LDC has no requirements for a loading area in this zoning district. Motion: Mr. Corral motioned for final approval of the application with conditions that a donation is made to the tree trust fund as required by the LDC and an expanded garden area be installed. Mr. Montana seconded the motion. Vote: Approved: 4 Opposed: 2 Ms. McCain: No Mr. Montana: No B) ERPB Applicant Present: Bob Liu Ms. Cabrera read the item to the record and presented it to the Board. Applicant: Carlos Tosca Property Owner: Palmcorp Development Group, LLC For: Davis Gardens, Lot 9 Location: 6723 Magnolia Court Request: New Const. Two-Story - Preliminary Page 3 of 7

4 Mr. Corral asked the applicant about the size of the swell for water retention to prevent water from going into the adjacent property line. The applicant stated that they are not over the threshold and it will maintain the water within the property. Motion: Ms. McCain motioned for final approval. This motion was seconded by Mr. Corral. C) ERPB Applicant Present: Bob Liu Ms. Cabrera read the item to the record and presented it to the Board. Applicant: Carlos Tosca Property Owner: Palmcorp Development Group, LLC For: Davis Gardens, Lot 19 Location: 6715 Poinciana Court Request: New Const. Two-Story- Preliminary Motion: Ms. McCain motioned for final approval with conditions of the removal of the Alexander Palm and the Areca Palm from the strangler fig. This motion was seconded by Mr. Montana. D) ERPB Applicant: Aimee Ortega For: Spice Galore Page 4 of 7

5 Property Owner: Dixie Acquisitions Number 3, LLC Location: 6010 South Dixie Highway Request: Signage Installation Applicant: Aimee Ortega Mr. Lightfoot read the item to the record and presented it to the Board. The Board discussed different options for the signage proposed. Mr. Fernandez recommended that the roof sign located on the front faced be exchanged for a cabinet sign perpendicular to the building within the allowable square footage, the window sign being decreased in size to be in compliance with the LDC and the font will be changed to match the font of the website address which is Arial Black and the rear sign will match the front sign without the phone number. Motion: Mr. Fernandez motioned for deferral of the item to allow for the applicant to comply with the recommendations of the Board. This motion was seconded by Ms. McCain. E) ERPB Applicant: Applicant: Omega Signs For: Isis Wellness Center Property Owner: Bakery Associates, LLC Location: 5701 SW 72 Street Request: Signage Installation Mr. Lightfoot read the item to the record and presented it to the Board. Ms. Schwartz stated that there is signage there already. The applicant stated that the existing signage is temporary which is required by the mall. The applicant stated that they were contracted for the box sign only. Page 5 of 7

6 Motion: Mr. Gil motioned for approval with staff s conditions. This motion was seconded by Ms. Schwartz. VI. Discussion Ms. McCain stated that she feels that there should be changes made to the LDC regarding issues of applicants that complete work without the approval of the Environmental Review and Preservation Board (ERPB). The Board discussed the different items that have come before the Board after the work has been concluded. Ms. McCain then stated that she would like feedback on items that have been brought forth to staff at previous meetings which have been deemed code enforcement violations. 1. The Church on Bird Road 2. Pizza Rustica 3. Biscayne Bank 4. Landscaping- bulb outs in the right-of way, sizes of trees for mitigation 5. Loading area on commercial new construction 6. Small restaurants Mr. Fernandez stated that there are several revisions that need to be made to the LDC. VII. APPROVAL OF MINUTES: A. ERPB Minutes of December 18, 2012 Motion: Mr. Montana motioned for the approval of the minutes. This motion was seconded by Ms. McCain. VI. Next ERPB Meeting: Tuesday January 22, 2013 at 8:30 A.M. 7 Motion: Mr. Montana motioned to approve the scheduled date of January 22, 2013 as the next meeting date due to the holiday the schedules have shifted. This motion was seconded by Mr. Corral. VII. ADJOURNMENT: There being no further business, the meeting was adjourned at approximately 11:28 A.M. An appeal of an ERPB decision or recommendation may be filed at any time before a building permit is issued by filing same with the city clerk upon a form prescribed therefore. Appeals may be taken by the applicant, interested citizens, or the city administration [per (A) of the City s Land Development Code].
