Filing written notice with the Clerk of West Deptford Township on January 7, 2011 Roll Call: Mr. Kilpatrick, Ms. Szymborski, Mr. Garrison, Deputy Mayor Daws and Mayor Docimo were in attendance for this meeting. Open Meeting to the Public: Mayor Docimo opened the meeting to the public. Mrs. Elaine Flannigan asked when the tax bills would be mailed. Mr. Giuliani responded by explaining that the additional aid given to the school board will affect the timing of the mailing of tax bills. Mr. Campo added that a grace period would be given due to the bills going out later than August 1 st. Mr. Ray Chintall asked about the RiverCove Apartments. Mr. Campo explained that the committee is waiting for a recommendation from the planning board before discussing how to proceed on the proposed changes to the current age-restriction. Mr. Daws made a motion to close the meeting to the public and it was seconded by Ms. Szymborski. The motion carried unanimously. BILL LIST WHEREAS, the Township committee of the Township of West Deptford received and reviewed the Bill List as prepared by the Township Treasurer and the Purchasing Officer for the Monthly period ending July 15 th, NOW, THEREFORE, BE IT RESOLVED that said Bill List as prepared by the Township Treasurer and the Purchasing Officer by approved and said Officials are authorized to render payments to each vendor appearing on the attached Bill List. Adopted at a meeting of the Township Committee of the Township of West Deptford on July 14 th, Ms. Szymborski abstained from items pertaining to Wells Fargo Bank and Mr. Kilpatrick abstained from items pertaining to TD Bank because they are employees of these banks. Correspondence: The following items were approved in a motion given by Mr. Daws and seconded by Mr. Garrison. The items were approved by the entire Committee. Mr. Daws made a motion to authorize Payment #1 for Art Anderson, Inc Concession building Structural Floor Repairs in the amount of $54, It was seconded by Mr. Garrison and approved by the entire committee. Mr. Garrison made a motion to authorize Payment #2 (FINAL)for Lexa Concrete, LLC Reconstruction of Center Street, Phase 2 Sidewalk Improvement Project in the amount of $ It was seconded by Mr. Daws and approved by the entire committee. ENGINEER S REPORT TOWNSHIP OF WEST DEPTFORD July 7, MUNICIPAL SEARCHES All Municipal Search Improvement requests are up-to-date. The Engineer received one municipal assessment search this month. 2. RIVERWINDS AT WEST DEPTFORD APPROVALS Waterfront Development Based on the NOV (EA ID# PEA ), the Township must take corrective actions to comply with Special Condition #3 of Transition Area Waiver Averaging Plan # This requires the Township to file deed restrictions for portions of the transition area located on Block 328 Lot 7 (Township owned), 7.04 (Namwest owned) and 7.07 (Township owned Golf Course). We are in the process of filing the deed restrictions with the County Clerk s office. Once we have received copies of the restrictions filed with the County Clerk s Office. We will submit a copy to the NJDEP and to the Township. We continued to provide technical support to the Township s attorneys as part of the Redevelopment Agreement negotiations. No Further Action Letter from NJDEP A new NJDEP case manager has been assigned to RiverWinds. The original Memorandum of Agreement and Remedial Action Work plan will need to be revised for the proposed change in use (residential). The NJDEP has verified that the on-going remedial activities will be under the existing MOA and not the new regulations. The next step will be to present conceptual development plans to NJDEP and modify the Remedial Action Work Plan.
3 Golf Course NFA The NJDEP will issue a No Further Action (NFA) determination for the golf course, once documentation is presented to show compliance with the Remedial Action Work Plan. We have met with NJDEP and agreed upon a soil investigation to document the soil cap depth, which needs to be at least 6 on the fairways and rough and 12 on the tees and greens. On July 22, 2010, we initiated the investigation and completed the field work on August 26, We are prepared to review the results with the Township before discussing the results with NJDEP No Changes. Restaurant NFA We will be performing our field work this month to confirm that the site has been capped in accordance with the NJDEP Remedial Action Work Plan. A letter requesting the NFA with supporting documentation will be issued by the end of July. Township Property NFA Performed field investigation and sampling of soil cap (i.e., low arsenic soil) on June 15 and 16, Collected 34 samples at rate of 2 per acre on untested area of the athletic fields, the recreational field adjacent to the community center, landscaped areas at the community center, areas adjoining the tennis and hockey facilities, the park and amphitheater, and along trails/pathways. Preliminary laboratory results received. Report is in preparation. Club House We have reviewed the golf clubhouse concept plan from McKernan Architects and have requested additional information for comparison to the previously approved overall Site Plan by the NJDEP. We have prepared a schedule of action items relative to this site. We will continue to provide technical documentation and assistance as requested. No Changes. Wetlands Letter of Interpretation (LOI) Portions of the wetland transition area on Lots 7, 7.04 and 7.07 are required to be deed restricted in accordance with the transition area waiver (approved 2001) for the RiverWinds Site. We are in the process of filing the restrictions with the County Clerk s office and will provide a copy of the filed restrictions to the Township upon receipt from the Clerk s office No Change. Concession Building Floor Repairs The contractor completed the demolition of the concrete floor slab and installed the drainage piping to the storm water inlet. The trench was backfilled after the drain was connected to the existing inlet. The area was excavated to grade elevation. The Helical Screw Piles were driven and additional feet were required to achieve the 30 ton capacity required. The contractor then proceeded to place the stone bed, installed the re-bars and poured the new concrete floor. Temperature joints were saw-cut on the concrete floor slab after a 24 hrs. curing process. A concrete haunch was needed to make-up the space between the new concrete floor and the grade beam which was found to be 15 inches lower than the floor elevation. During the installation of the Helical Screw Piles, the drilling machine inadvertently broke an electrical conduit that feed the press box on the grandstands and the irrigation system pumps. The contractor excavated a trench to the existing electrical pull-box to
4 find an alternate conduit to feed the affected systems. T&M prepared a revised drawing to obtain a permit for the electrical work being procured by West Deptford Twp. The electrical repair work is pending. The only work remaining from the contract is the bathroom wall repairs. The contractor submitted the first application for payment and it was recommended favorably. RiverWinds Restaurant NJDEP Notice of Violation A Notice of Violation (NOV EA ID# PEA ) was issued to the restaurant on March 21, 2011 for clearing of trees within the riparian buffer. While the Notice of Violation was issued to the restaurant owners, the clearing was performed on Township property. The riparian buffer is the vegetated area adjacent to the Delaware River and cove. Removal of vegetation is regulated by the NJDEP. Based on the Notice of Violation, the NJDEP is requiring a compensatory planting plan to mitigate for the loss of the trees removed from the riparian buffer in the late winter. The Township has committed to preparing a plan in response to the Notice of Violation for submission to the NJDEP. We have developed a Riparian Area Enhancement Plan for submission to the NJDEP by July 11. Prior to submission to the NJDEP, T&M will provide the plan to the Township for review and comment. 3. PUBLIC WORKS GARAGE HVAC/EMERGENCY GENERATOR The revised preliminary project scope of improvements of probable construction costs was submitted to the Township for review and comment; upon receipt of authorization we will begin the project. No change. 4. RIVERWINDS COMMUNITY CENTER EMERGENCY GENERATOR Quotes were received for the 31 day electrical metering and the recommendation for award was forwarded to the Township on June 29 th for review. A purchase order was issued to the low bidder, and notice to proceed was issued. Following review of the metering data, we will complete the bid documents for advertisement of the project. 5. COMMUNITY CENTER ALTERNATIVE ENERGY SOURCES A viable alternative has been identified to install solar panels to reduce the energy costs associated with the operation of the Community Center. The potential approach is a zero cost alternative to the township. The implementation would be through a public private partnership agreement. The concept plans have been prepared along with the project specifications. On August 1, 2011, the plan will be presented to the Planning Board Work Committee. Advertisement for bids to sell power to the township will begin the week of July 11, ROAD PROGRAM COLUMBIA AVENUE The Certification of project completion from the Townships Chief Financial Officer is completed and submitted to NJDOT No Change. 7. NJDOT TRANSPORTATION ENHANCEMENT PROGRAM Bicycle Route Grant
5 The preliminary plans are complete and have been submitted to the County for review. This project is being completed with a $90, grant. Upon receipt of County comments, we will finalize the documents and submit them to NJDOT for review and approval No Change NJDOT TATUM STREET PROJECT The Certification of project completion from the Townships Chief Financial Officer is completed. The application for payment is completed and was submitted. 9. CENTER STREET (2005 STATE AID PROGRAM) The contractor has submitted their final invoice and Maintenance Bond. The NJDOT SA- 1 change order is approved and the invoice submitted to the Township on July 5, COMMUNITY DEVELOPMENT BLOCK GRANT VIRGINIA AVENUE The CDBG reimbursement application will be submitted by July 11, FY2011 COMMUNITY DEVELOPMENT BLOCK GRANT The Contract Documents for constructing (Plans & Specifications) Curb Access Ramps, curbing and sidewalk repairs on Tatum Street between Dubois Avenue and Red Bank Avenue are 95% complete. Plans are complete and will be submitted to the County for review by July 15, SEWER OPERATIONS Pump Station Reports Riverview Drive Sanitary Sewer A proposal was submitted to the Township on May 17, 2010 to conduct an inspection of the sanitary sewer manholes located in the wooded area adjacent to Riverview Avenue and the Woodbury Creek, which are in need of repair. It is recommended, by T&M, that the investigation be conducted to identify the extent of the repair work before the NJDEP is contacted to discuss the environmental permits that would be required. The project area is situated within 500 feet from a tributary of the Woodbury Creek, which is tidally influenced and would be regulated by the Waterfront Development Law. In addition, based on our review of NJDEP i-mapnj data base information, it appears that freshwater wetlands and freshwater wetland transition areas may also be present within the project area. Our proposal is still pending. No Change. 13. ENERGY CONSERVATION GRANT The executed scopes of work for the 2010 and 2011 EECBG and Direct Install funding rounds were submitted to NJ Clean Energy on March 9 and are currently under review. It is our understanding that NJ Clean Energy will respond to the 2011 application in the near future. The 2010 awards have been made and the township will be receiving $48,000 for improvements to the Municipal Building. The 2010 work consists mostly of lighting and HVAC improvements and will begin in the near future. We will forward a construction schedule to the Township for review as soon as it is received from the contractor,
6 Commercial Carrier No Change. 14. NJDOT LOCAL AID (FY 2011) The plans and specifications for Roadway Improvements of Lewis Terrace and Garrett Avenue are complete and are being reviewed by NJDOT. The project will be advertised for bids the week of July 11, 2011, with a bid opening on July 28, NJDOT LOCAL AID (FY 2011) The plans and specifications for the reconstruction of Pennsylvania, New Jersey and Laurel Avenues are complete. The project will be advertised for bids the week of July 11, 2011, with a bid opening on July 28, Nottingham Estates The contract was awarded to Eco Materials. A preconstruction conference was held on June 21, A notice to proceed was issued effective July 18, Former US Wetlands Property During the NJDEP permitting stages of the wetland mitigation project, US Wetlands was required and has placed a deed restriction on the property due to soil contamination. This restriction will need to be amended to authorize the use of the property for the proposed solar energy project. We have contacted the NJDEP, Site Remediation (Robert Hock), Land Use Regulation (JoDale Legg) and Office of Permit Coordination (Scott Brubaker) to discuss the opportunity to use the property for the proposed project and determine the steps necessary to replace the existing restriction, if necessary, on the property. We have received the information obtained from our file review at the NJDEP to gather information related to the contamination issues are currently reviewing the date, and will use this information to create a new deed restriction. We have contacted the Office of Permit Coordination and await confirmation of a meeting date. The purpose of the meeting will be to discuss the amendment of the deed restriction, applicable NJDEP approvals required for the proposed project, and whether additional actions are necessary on the part of the Township to maintain compliance without standing conditions. Based on our conversation with Site Remediation, a No Further Action letter has not been issued for the property. Outstanding issues which must be addressed to obtain a NFA are the documentation that the engineering control (fence) is in place around the entire property and the installation of signs to warn the public of the potential contamination hazards are required. Once the NFA has been issued, the Township must submit a biannual report to the NJDEP. We anticipate that future activities to develop the site will require a freshwater wetland delineation of the entire site, submission of a Letter of Interpretation application and other Land Use Regulation approvals, and a review by Site Remediation to obtain a modification of the NFA. Mr. Daws made a motion to authorize reimbursements to residents for Miscellaneous Expenses. It was explained that these expenses were related to the recent water problems. Mr. Kilpatrick then seconded Mr. Daws motion and the resolution was approved by the entire committee.
7 RESOLUTION AUTHORIZING REIMBURSEMENTS TO RESIDENTS FOR MISCELLANEOUS EXPENSES Mr. Kilpatrick made a motion for the removal of Water and Sewer charges. His motion was seconded by Mr. Garrison and approved by the entire committee RESOLUTION FOR THE REMOVAL OF WATER AND SEWER CHARGES Ms. Szymborski made a motion to authorize award of a contract between the township of West Deptford and Burlington Engineering Co., for Electrical Metering for Electrical Generator at the RiverWinds Community Center. Her motion was seconded by Mr. Garrison and approved by the entire committee. RESOLUTION OF THE TOWNSHIP OF WEST DEPTFORD AUTHORIZING AWARD OF A CONTRACT BETWEEN THE TOWNSHIP OF WEST DEPTFORD AND BURLINGTON ENGINEERING CO., FOR ELECTRICAL METERING FOR ELECTRICAL GENERATOR AT THE RIVERWINDS COMMUNITY CENTER Mr. Daws made a motion for the cancellation, application and/or refund of Taxes. His motion was seconded by Mr. Garrsion and approved by the entire committee. RESOLUTION FOR THE CANCELLATION, APPLICATION AND/OE REFUND OF TAXES Ms. Szymborski made a motion for the refund of various fees for RiverWinds Community Center. His motion was seconded by Mr. Daws and approved by the entire committee. RESOLUTION FOR THE REFUND OF VARIOUS FEES FOR RIVERWINDS COMMUNITY CENTER Mr. Daws made a motion reappointing James Trautner as Fire Official. It was seconded by Mr. Garrison and approved by the entire committee. RESOLUTION REAPPOINTING JAMES TRAUTNER AS FIRE OFFICIAL Mr. Daws motioned to approve the first reading of the following ordinance. His motion was seconded by Mr. Kilpatrick. The second reading will be on August 11 th. RESOLUTION OF THE TOWNSHIP OF WEST DEPTFORD AUTHORIZING THE TOWNSHIP ADMINISTRATOR TO INTERVEW SEVERAL CANDIDATES FOR THE POSITION OF METER READER, HIRE AND DETERMINE SALARY Mr. Kilpatrick made a motion for a resolution to appoint Mike Douglas as temporary Acting Water/Sewer Operator/Superintendent with a monthly raise in salary to be negotiated by the Administrator while potential candidates are interviewed and a selection is made by the committee.
