1 HAMBURG TOWNSHIP POLICE MONTHLY REPORT March, 2013 COMMUNITY HAPPENINGS Community Involvement: Deputy Chief Dariusz Nisenbaum, Sgt. Gary Harpe and Officer Spencer Flavin represented the police department at recognition event honoring law enforcement, firefighters and EMS personnel at the Cornerstone Presbyterian Church in Brighton on March 3, Chief Richard Duffany attended a luncheon at Cleary University-Howell featuring guest speaker Elizabeth Smart on March 7, Officer Megan Paul participated in a Girl Scout presentation on March 11, Chief Richard Duffany represented the police department at the community liaison meeting held at the Woodland Correctional Facility on March 12, Personnel: POLICE DEPARTMENT OPERATIONS Officer Daniel Bromley successfully completed the second phase of his field training program on March 21, 2013.

His vehicle was impounded and he was transported to US-23 & North Territorial Road where he was turned over to Canton Township officers. 03/04/13 8:39pm A 41-year old male Willis resident was arrested on Shang-Ra-La Drive near Lime Bay Drive on a warrant for Child Neglect out of Pittsfield Township. He was transported to US-23 & North Territorial Road where he was turned over to Pittsfield Township

He was lodged at the Livingston County Jail. 03/22/13 12:20pm A 44-year old female Grand Blanc resident was arrested at M-36 & Lake Crest for Driving While License Suspended. Her vehicle was impounded and she was cited and released. 03/22/13 9:49pm A 31-year old male Township resident was arrested at his home on a Felony warrant for Criminal Sexual Conduct-2 nd Degree out of Hamburg Township. He was lodged at the Livingston County Jail. 03/24/13 12:13am A 26-year old male Pinckney resident was arrested at M-36 near McGregor for Operating While Intoxicated. His vehicle was impounded and he was lodged at the Livingston County Jail. 03/27/13 9:48am A 55-year old male Kalamazoo resident was arrested at M-36 & Merrill Road for a warrant out of Farmington Hills for Driving While License Suspended. His vehicle was impounded and he was transported to I-96 & Kent Lake where he was turned over to Farmington Hills officers.

He was lodged at the Livingston County Jail. 03/29/13 5:19pm A 28-year old male Ypsilanti resident was arrested on Merrick near Farley Road for Fleeing & Eluding, Malicious Destruction of Police Property and Home Invasion. His vehicle was impounded and he was lodged in the Livingston County Jail. Due Partner Agencies State 0 Non Adjudicated Funds State Forfeiture Balance (Adjudicated funds only) 37, General Police information: Marine Patrol: Lakeland Trail Patrol: Police vehicles: Effective September 30, 2012, officers have ceased regular marine patrols of the Chain of Lakes for the season. Officers are patrolling the Lakeland Trail using the department Polaris Ranger Utility vehicle. The new department mountain bike has been outfitted and is in service to assist in patrols. All patrol vehicles are in good working order. The new Unit #3187 was taken to Cruiser s on March 22, 2013 to be outfitted.

Park Coordinator s Report Henneman reviewed Park Coordinator s Report dated February 21, Reported: MNRTF Grant Application update, Public Hearing scheduled for March 5, 2013 at 2:00 p.m., Disc Golf Construction is on schedule, Batting Cage Construction is on schedule. She reported that she had started on a Parks & Recreation Policies and Procedures Manual. 2. Senior/Community Center Report Hoskins reviewed Senior Center Report dated February 26, Reported: Next Senior advisory meeting is 3/13/13 at 10:00 a.m., Hoskins attended the All About Food Conference on February 14, 2013 and gathered on Community Gardening, update on Livingston Leadership Council on Aging meeting, Senior Building Maintenance and reported on upcoming Trips. 3. Correspondence There was no correspondence. 4. Park Use Requests: a. Pinckney Blues Spring 2013, Regular Seasonal Use 3/11/13 to 7/31/13 Motion by Neilson, supported by Hohl, to recommend approval of the Park Use Request from Pinckney Blues Soccer Club application dated 2/1/13 for Regular Seasonal use for the 2013 Spring season, with submissions and limitations as outlined by the Parks and Recreation Coordinator in her memo dated February 11, 2013 as provided in the packet. Dexter Rugby Spring 2013, Regular Seasonal Use March 1, 2013 to May 31, 2013 Motion by Neilson, supported by Koeble, to recommend approval of the Park Use Request from the Dexter Rugby Club application dated 2/22/13 for their Spring 2013 Regular Season, with submissions and limitations as outlined by the Parks and Recreation Coordinator in her memo dated February 22, 2013 as provided in the packet, and to require the applicant provide a $1,000 damage bond. Disc Golf Course Update Neilson advised that the Disc Golf Course construction is on schedule and he is currently working on making benches for the course. The concrete will be poured once the weather breaks. 2. Ice Rink Update There was no update. E. Sponsorships/Volunteerism/Scholarships Not a topic for this meeting. F. Signage and Community Awareness Not a topic for this meeting. G. Parks Master Control Book Henneman reviewed the changes in the Master Control Book which will be forwarded to the Board for their approval. H. Insurance (MMRMA) 8. Box 157 Hamburg, MI (810) March 18, 2013 To: Parks & Recreation Committee From: Deby Henneman, Parks Coordinator Re: Park Coordinator s Report I have completed the initial draft of the Parks & Recreation Policies and Procedures Manual, which has been distributed for comment to the Clerk, Supervisor and Deputy Clerk. It is a comprehensive document that is intended to take the place of some of the smaller procedures that we have implemented such as the Scholarship Procedure, Sports Group Medical Waiver Process, and the Administrative Approval Process. This document describes every aspect of the Parks Department, from processing a Park Use Application to Records Management and thoroughly describes my job function as it relates Parks & Recreation and daily functions of the Department. I anticipate that a draft of this document will be distributed to the Parks & Recreation Committee prior to the next meeting, in order to get edits and recommendation prior to it going to the Township Board for approval. Construction of the Disc Golf Course is on schedule and the volunteers continue to work with our Building and Grounds staff to clear the areas that will delineate the course. When it is warm enough, installation of the concrete pads and baskets will take place, along with placement of benches and trash receptacles. An Eagle Scout did come in last week and ask what we may need done as far as volunteer efforts, and I did mention that we would love a Kiosk sign at the Merrill Trailhead parking area to accommodate score cards and announcements. We anticipate a Grand Opening in late May or early June. Phase 3 (Final Phase) of the Baseball Safety Fencing project will require a joint meeting between the Parks & Recreation Committee, H.E.R.O. and P.H.B.S.A. This meeting will be important to determine what will be necessary to allow for easy access to the ball diamonds for Maintenance and Event purposes, as we will be increasing the Outfield fencing to the required 10 feet. I would like to schedule this meeting as soon as possible, so we are able to develop an RFP for this final phase. We could wait until the weather gets warmer

Hohl noted that he has forwarded the draft to the Planning Commission members for review. Randazzo noted that the DPW staff is planning and preparing for a number of projects to be completed once the weather breaks. The WWTP is running really well and was in compliance for the months of December, January and February, something that did not occur before the improvements, most notably the addition of the boiler. Hohl explained that the sewer extension design is currently in process at OHM and that the Township has requested that the engineer review the possibility of designing this sewer extension as a gravity system that would discharge into a single Duplex pump versus having 10 individual grinder pumps. This would result in a cost savings to the developer as well as to the Township in regards to maintenance of the sewer system. Sodium testing will resume this week and manhole inspections will start after the well washer is installed at the Rustic Pump Station. A trailer has been procured for manhole inspections which will include all necessary items for the job such as a water tank. 2. The plant was in compliance for the month of March. The plant has not been out of compliance for one day due to total inorganic nitrogen or phosphorus since September. 3. The boiler in the WWTP continues to perform well. It has consistently raised the temperature of the sewage by 4 Celsius which in turn aids treatment. The boiler will be turned off for the season after two more weeks of use.

Box 726 Hamburg, MI /15/13 To: Portage-Base Lakes Area Water & Sewer Authority Board From: Tony Randazzo Re: Amendments to the Rules and Regulations There are two amendments to the rules and regulations which we have discussed at previous meetings but have not officially approved. Once approved, they can be sent to the four townships for ratification. The first amendment allows us to suspend the annual escalation for the connection charge which has always been an annual 4% since the inception of the Authority. The rules currently state: A connection charge, levied on a user who proposed to connect to that portion of the public sewer described as Washtenaw County Sewer System No. 12, which for 1991 shall be $8,000 per equivalent residential unit, escalated at four (4) percent per year for each year thereafter. A user that has been specially assessed for capital cost of the original portion of the POTW, including transport and treatment facilities, shall be deemed to have paid the connection charge. These assessments shall be collected by each Township and be remitted to Washtenaw County for purpose of reducing the debt obligation of the Township. Other connection charges shall be collected by the Authority and deposited in the Authority s general fund. (Amended, 1-A, , 1-C, ) An indirect connection charge, levied on a user who proposes to connect to that portion of the public sewer described as Washtenaw County Sewer System No. 12, Addition #1, which for 1997 shall be $2, per equivalent residential unit, escalated at four (4) percent per year for each year thereafter. The indirect connection charges shall be collected by the Authority and deposited in the Authority s general fund. (Add Section , 1-C, )

26 We propose to add the following amendment: Both direct and indirect connection charges annual escalation factor may be suspended for any current fiscal year by the Authority at the time of establishing the Authority s annual budget and fee structure. The second amendment intends to change the way we place delinquent accounts on the tax roll. Currently, any bill more than 90 days delinquent as of August 15 th, is placed on the tax roll. It would be less complicated if we just took any balance as of September 10th and sent that to the tax roll. This still gives customers plenty of time to pay their July bill which is due August 10 th, without worrying that it will go to the their tax bill if it is a few days late. The rules currently state: 17.7 Charges for sewage disposal service furnished to any premises within the Sewer Service District shall be a lien against the premise. Charges delinquent for three (3) months or more as of August 15 of any year shall be certified by the Superintendent, or other employee authorized by the Authority Board, annually, to the proper tax assessing officer of the Township in which the premise lies. The Township Assessing Officer shall enter a lien on the next tax roll against the premises to which the services shall have been rendered, and the charges shall be collected and the lien shall be enforced in the same manner as provided for the collection of taxes assessed upon the Township Roll and the enforcement of the lien for such taxes. Such charges and rates shall be collected or returned in the same manner as other Township taxes are certified, assessed, collected and returned We propose to amend that language as follows: 17.7 Charges for sewage disposal service furnished to any premises within the Sewer Service District shall be a lien against the premise. 27 AMENDMENT TO SEWER USE RULES AND REGULATIONS FOR THE SEWER DISTRICT OF THE PORTAGE-BASE LAKES AREA WATER & SEWER AUTHORITY PORTAGE-BASE LAKES AREA WATER AND SEWER AUTHORITY REGULATION NO. 1-L SEWER AND SEWAGE DISPOSAL RULES AND REGULATIONS Rules and Regulations enacted pursuant to the authority of Act 246 of the Public Acts of 1945, as amended, Act 191 of the Public Acts of 1939, as amended, Act 233 of the Public Acts of 1955, as amended, and Act 368 of the Public Acts of 1978, as amended, by the Portage-Base Lakes Area Water and Sewer Authority and with the concurrence by resolution and ordinance of its constituent municipalities to regulate private and public sewers, sewer connections, industrial waste pretreatment facilities and discharge of industrial waste into the Portage-Base Lakes Water and Sewer Authority publicly operated treatment works and to provide for pollutant limitations, data collection, monitoring and sampling and to preserve, promote and protect the health, safety and general welfare of the persons and property within Dexter, Hamburg, Putnam and Webster Townships; to provide for the enforcement hereof; and to provide penalties and remedies for the violation hereof, and to amend certain provisions regarding the metering of flow and imposition of additional charges. The Portage-Base Lakes Area Water and Sewer Authority with the concurrence of its constituent municipalities the Townships of Dexter, Hamburg, Putnam and Webster, Counties of Livingston and Washtenaw, State of Michigan, ordains: Sec. 1.0 Amendment The Portage-Base Lakes Area Water and Sewer Authority, Rules and Regulations, No. 1., adopted July 31, 1991, as amended, and further amended as follows: Sec. 2.0 Add the following language to Section : Both direct and indirect connection charges annual escalation factor may be suspended for any current fiscal year by the Authority at the time of establishing the Authority s annual budget and fee structure. Motion to approve the purchase of Fire Fighter Structural Firefighting Turn Out Gear at a total cost not to exceed $16,000 from the Turn Out Gear ( ) line item. Budget Impact: The Special Projects line item was budgeted to be used for matching funds for the Assistance to Firefighters Grant. Hamburg Township received notice that due to the federal sequester, HTFD will not be receiving the grant. The money transferred into the Turn Out Gear line item will bring the available funds for the 12/13 budget to $17, This leaves the needed money for equipment maintenance for the remainder of this budget year. This also leaves $7,000 in the Special Projects line item. Information: Turn out gear is the equipment the fire department uses on a daily basis. We budget to replace the gear as needed and recommended by the manufacturer. Turn out gear per The National Fire Protection Agency (NFPA) is to be replaced every 10 years at a minimum if not sooner due to safety issues. The high quality and constant safety inspections are what is keeping our fire fighters safe while operating in dangerous environments. These requested sets of gear are planned replacement sets to keep the fire department NFPA and safety complaint. Each turn out gear manufacture only has one source to purchase their equipment from in the state of Michigan. 1

RAMIFICATIONS Commerce conducted with Wards Hardware is in the area of $10,000 to $12,000 per year. This action by the Board will save Hamburg Township $1000 to $1200 per year.
