1 Snohomish County Council Committee: Planning Analyst: Geoffrey Thomas ECAF: 4774 Date: May 13, 2016 Proposal: Ord Summary Ordinance establishes regulations to authorize rural craft breweries, distilleries, and wineries Background The proposed ordinance would establish regulations to authorize rural craft breweries, distilleries, and wineries in the RB, RI, R-5 and A-10 zoning districts. These uses would be located outside of the urban growth area and would include facilities involved in producing, tasting, and selling beer, spirits, and wine. The use would include any related growing fields. Since being presented to the Planning Committee and an initial public hearing, amendments to the proposed ordinance have been developed. The amendments are summarized in the two matrices that are attached to this briefing. Please note that Amendment 7A has been developed to replace Amendment 7 (correcting for a scrivener s error and to include the Snoqualmie River as part of the eastern border of the described land area). Further, a map has been developed to illustrate the area affected by Amendment 7 and new Amendment 7A. 2 Note: This document consists of two matrices and a map. The first matrix is a summary of amendments. The second matrix, which is on page 3, provides a summary of the difference of those similar amendments 2, 2A, 2B, 2C, and 2D (which will be provided at the hearing). The map is of the area described by Amendment 7 and 7A and is only provided to illustrate the area in those amendments (that is, the map would not be adopted into code). I. Amendment Summary No. Description 1 Definition revision. Clarifies and avoids potential confusion with related growing fields being included in the 4,000 square foot limitation for a Rural Craft Brewery/Distillery/Winery in SCC 30.91R A Definition revision. Revises the definition of Rural Craft Brewery/Distillery/Winery to (1) clarify that growing fields are not considered toward the square-foot limitation and (2) remove the 4,000 square foot limitation from the definition to instead rely on the thresholds proposed in the use matrix in SCC Permitting Process, 5-acre Threshold in R-5. Provides additional criteria for determining whether an Administrative Conditional Use Permit or Conditional Use Permit is required in the R-5 zone, adds a reference note and corrects subsection numbering. Establishes criteria requiring a Conditional Use Permit to authorize the use in the R-5 Zoning District, except that an Administrative Conditional Use Permit may be used to authorize the use when it is under 1,500 square feet and on property exceeding 5 acres. 2A Permitting Process, 5-acre Threshold in R-5 ADDS RD. Similar to Amendment 2. Adds Rural Craft/Brewery/Distillery/Winery as uses allowed in the RD Zoning District; adds a reference note in the R-5 zone requiring compliance with the additional performance standards in SCC ; and establishes additional criteria requiring a Conditional Use Permit to authorize the use in the R-5 Zoning District, except that an Administrative Conditional Use Permit may be used to authorize the use when it is under 1,500 square feet and on property exceeding 5 acres. 3 2B Permitting Process, 100,000 sq ft (R-5) Threshold Prohibits >1,500 sq ft in R-5 ADDS RD. Adds Rural Craft Brewery/Distillery/Winery as a permitted use in the Rural Diversification (RD) Zoning District; Adds a not a reference note in the R-5 zone requiring compliance with the additional performance standards in SCC ; prohibits a Rural Craft Brewery/Distillery/Winery exceeding 1,500 square feet in the R-5 Zoning District; and allows a Rural Craft Brewery/Distillery/Winery in the R-5 Zoning District of under 1,500 square feet with a Conditional Use Permit when located on a parcel measuring at or below 100,000 square feet and with an Administrative Conditional Use Permit when locate don a parcel measuring greater than 100,000 square feet. 2C 2D Permitting Process, No Parcel Size Threshold. Adds a reference note in the R-5 zone requiring compliance with the additional performance standards in SCC Establishes that in R-5 district an Administrative Conditional Use is required for facilities under 1,500 sq ft and a Conditional Use Permit is required for facilities between 1,500 and 4,000 sq ft.
