1 UPPER PROVIDENCE BOARD OF SUPERVISORS MONDAY, OCTOBER 2, :00 P.M. ATTENDANCE: Board of Supervisors: Lisa Mossie, Chairman and Albert Vagnozzi, Supervisor. Staff Present: Timothy J. Tieperman, Township Manager; Bryan Bortnichak, Assistant Township Manager and Mark Toomey, Chief of Police. Consultants Present: Joseph Bresnan, Township Solicitor; William Dingman, Township Engineer; and Geoff Grace, Planning Consultant. PLEDGE OF ALLEGIANCE Chairman Mossie opened the meeting with the Pledge of Allegiance. Chairman Mossie paused for a moment of silence for the victims of Las Vegas. SPECIAL PRESENTATIONS AND CITATIONS (Special citation presentations from Senator John Rafferty, Representative Michael Corr and Montgomery County Emergency Services) Commendation citations were presented to Detective Sergeant Raymond Bechtel, Sergeant Ryan Sheehan and Corporal John Olivieri for their handling of a difficult call in Limerick which involved a hostage situation. On hand to present the awards were Senator Rafferty and Michelle Monzo (Montgomery County Emergency Services). The responding officers were part of the Montgomery County SWAT West Team. Rep. Corr was not able to attend but Senator Rafferty presented a proclamation on his behalf. Senator Rafferty also recognized Upper Providence Little League for their success as Little League State Champions. He presented each member and coaches citations and a championship award from both the House and Senate. He stated it was an honor to present the team with these awards. EXECUTIVE SESSION REPORT: The Board met on September 18 th in Executive Session to discuss pending litigation APPROVAL OF BILL LIST: 1. September 14, 2017 to September 27, 2017: $ 358, Mr. Vagnozzi motioned, seconded by Mrs. Mossie, to approve the bill list from

2 October 2, 2017 BOS Meeting Minutes Page 2 September 14, 2017 to September 27, 2017 in the amount of $358, The motion passed unanimously 2-0. APPROVAL OF MINUTES: 2. September 18, 2017 Meeting Minutes The Board tabled these minutes until the October 2, 2017 meeting, when there will be a full contingency of the Board present. PUBLICCOMMENT: None PUBLIC HEARING: None OLD BUSINESS (ACTION/DISCUSSION ITEMS): 3. Consider adoption of Resolution to approve a preliminary 2-lot minor subdivision plan for the Roop Property, located at the northeast corner of Black Rock Road and Caroline Drive in Upper Providence Township. (Subdivision expires September 30, 2017). Mr. Bresnan and Mr. Bortnichak requested that the Board table action on this item until its October 16, 2017 meeting. The matter was unanimously tabled. 4. Consider adoption of Ordinance 565 to amend the Township Traffic Code to reduce the speed limit from 45 mph to 35 mph on Egypt Road from Collegeville Road to 270 feet east of Willow Drive in Upper Providence Township. Mr. Tieperman confirmed the proper legal advertisement for this Ordinance. Mr. Vagnozzi motioned, seconded by Mrs. Mossie, to adopt Ordinance 565 to amend the Township Traffic Code to reduce the speed limit from 45 mph to 35 mph on Egypt Road form Collegeville Road to 270 feet east of Willow Drive in Upper Providence Township. The motion passed unanimously Consider adoption of Ordinance 566 to extend the brake retarder prohibition zone on Egypt Road from Hollow to Greentree Roads. Mr. Tieperman confirmed the proper legal advertisement of this Ordinance. Mr. Tieperman and Mr. Bresnan clarified that standing committees can have no additional voting members other than the elected officials themselves. He provided an earlier to help clarify the questions that previously arose with standing committees and advisory boards. Mr. Tieperman explained that some of the confusion stemmed from an attempt to include elected Supervisors on the Planning Commission and empower the Commission to serve as a standing committee on planning and zoning-related matters. However, Mr. Bresnan opined that this does not pass legal muster. Board members agreed that the Planning Commission should stay in its current form. Discussion will resume at the next meeting, when there will be a full contingency on the Board. NEW BUSINESS (ACTION/DISCUSSION ITEMS) 7. Presentation from Maille regarding the Township s 2016 Audit. Mr. Ed Furman, senior partner with Maille, LLC, presented a general summary of the 2016 Audit. He said the Township has an excellent balance sheet with a high level of equity and limited debt. He said the audit was clean with no findings and commended Staff for their great cooperation. 8. Consider appointment(s) to Act 209 Impact Fee Advisory Committee. Mrs. Mossie announced that the Board is still accepting letters of interest from Township residents and business owners with a vested interest in Upper Providence Township. She mentioned the Act 209 Impact Fee Advisory Committee requires a minimum of seven members, five of which will be served by the Planning Commission. MANAGER S REPORT: 9. Approve Municibid Sale of Township Vehicles. DEPT. The motion passed unanimously Approve Capacity Rights Agreement 1009 South Lewis Road 1 EDU. Mr. Vagnozzi motioned, seconded by Mrs. Mossie, to approve the Capacity Rights Agreement for 1009 South Lewis Road for 1 EDU. The motion passed unanimously 2-0. CONSULTANT REPORTS: 11. Longford and Black Rock Road Traffic Issue (Township Traffic Engineer) Traffic Engineer Ken O Brien updated the Board on resident concerns expressed from the last Board of Supervisors Meeting over the intersection at Longford and Black Rock Road. He said that he is working closely with Highway Safety Sergeant Robert Solorio who is in dialogue with a local resident to scale back some of the buffer area contributing to some of the site obstructions. The intersection does not meet State warrants for traffic signalization. 12. South Lewis Road Sanitary Sewer Main Extension Project Update. Mr. Dingman gave a brief update on the project. He said the field work is 100% complete, and the anticipated closeout is approximately one month from now. He also updated the Board on the Willowbrooke Sewer project. All contracts have been executed. He said they are now looking to set up a preconstruction meeting possibly next week. 13. Black Rock Park Site Work Project Update. Mr. Dingman gave a brief update on the Black Rock Park Site Work Project. Today marked day forty-nine out of a 210 day contract.. He said the subgrade has been improved and should be paved by the end of the week, along with a significant part of the new parking lot. He said that the cost agreed upon at the last Board of Supervisors Meeting was actually around $10,000 instead of $25,000 because of assistance from Public Works crews. He said the project worked out very well. 14. Pavement Project Updates (Township Engineer) Mr. Dingman gave a brief update on the 2017 Road Project. Project A is 100% complete. Arcola, Troutman, and Cider Mill Roads were milled and will be paved this week. The milling on Greentree Road, the subdivision and the entrance to Little League will be completed this week and paved next week. 15. Phoenixville Region Multimodal Steering Committee Update (Township Planning Consultant) Mr. Geoff Grace gave a brief update on the Phoenixville Region Multimodal Steering Committee. He said it is mostly Chester County officials who are present at these steering committee meetings. He noted that only four of the twenty two issues involve Upper Providence

5 October 2, 2017 BOS Meeting Minutes Page 5 Township. Mr. Grace prioritized them as: 1. Mont Clare Access 2. Trail Linkage at Route Black Rock Road and 2 nd Avenue 4. Route 113 Bridge over the Schuylkill (looking for pedestrian access across the bridge) 5. Starr and Bridge Street intersections (not directly us, but if backed up, the congestion effects our traffic). SOLICITOR S REPORT: None SUPERVISORS COMMENTS: None ADJOURNMENT 16. Adjourn into executive session to discuss personnel matters The Board adjourned into executive session at approximately 8:00 p.m. to discuss personnel issues.
