3 Introduction The William M. McCulloch Papers consist of forty-five cubic feet of materials dating from 1911 to 2009, though the bulk of the collection dates from 1960 to The collection documents the public service career of William M. McCulloch (R-Piqua) as a member of the U.S. House of Representatives for the 4 th Ohio Congressional District. The winner of a special election held in November 1947, McCulloch served 26 years in Congress until his retirement in January Although a few items date from McCulloch s terms in the Ohio General Assembly, the vast majority of the collection consists of the records compiled by the Washington, D.C. office of Congressman McCulloch. Provenance: Ann McCulloch Carver, on behalf of her parents, William M. and Mabel Harris McCulloch, donated the collection to The Ohio State University in December In addition, the Law Library of Ohio Northern University in Ada, Ohio, transferred a large portion of the collection to the Ohio Congressional Archives in March Through this generous transfer Ohio Northern University assured the papers of Congressman McCulloch would be unified, preserved, and made available to researchers at one location. Acknowledgement also goes to the Friends of William M. McCulloch for its assistance in the acquisition of this collection. Established in 2010 to advocate for a statue of Congressman McCulloch in the Statuary Hall of the U.S. Capitol, the group maintains a website at Access: The William M. McCulloch Papers in A careful effort was made during the processing of the collection to preserve whenever possible the original order and filing systems found within each series. Many files, especially within series containing correspondence and legislative records, were maintained originally in oversized file folders. These large files were divided into smaller folders for preservation and descriptive purposes. 3
4 Biographical Sketch William Bill Moore McCulloch was born on November 24, 1901 near Holmesville in Holmes County, Ohio to James H. and Ida M. McCulloch. Raised on his family s farm, McCulloch attended the local public schools, and then graduated from the College of Wooster in nearby Wooster, Ohio. In June 1925, he received a law degree from The Ohio State University College of Law and passed his bar examination in August. After obtaining his license to practice law, McCulloch moved to Jacksonville, Florida, but returned to Piqua, Ohio in 1928 and established a law firm with George Berry. On November 8, 1927, McCulloch married Mabel Harris in Covington, Kentucky. The couple had two daughters, Nancy Jane McCulloch and Ann McCulloch Carver. In 1932, William McCulloch entered the political arena as a member of the Republican Party when he won the first of six subsequent elections to the Ohio House of Representatives. He served as Minority Leader from 1936 through In 1939, he was elected Speaker of the Ohio House. McCulloch served three terms as Speaker, during which time he was instrumental in passing balanced budgets for Ohio at a time when the state still struggled with the effects of the Great Depression. McCulloch left the Ohio General Assembly in December 1943 and enlisted in the U.S. Army during World War II. He served twenty months in the army as a captain in the Military Government Forces in Europe. Returning to his law practice in Piqua following the end of the war, McCulloch joined the 80 th Congress in November 1947 by winning a special election held to fill the vacancy in the 4 th Ohio Congressional District caused by the resignation of Robert F. Jones. Located in west-central Ohio during McCulloch s time in office, the 4 th Ohio Congressional District included the counties of Allen, Hardin, Mercer, Auglaize, Darke, Shelby, Miami, Preble and a part of Montgomery. Predominately rural in nature, the district is noted for containing some of the most fertile soil in the Midwest. The district also was home to many small to midsized businesses and manufacturers, mainly located in the county seat towns of Lima, Piqua, Troy, and Sidney. Beginning in 1948, McCulloch won twelve succeeding elections without serious opposition by candidates from the Democratic Party. Over this twenty-four year time period he averaged 64.3 percent of the votes cast. His largest margin of victory was 70.3 percent in 1962, but it dropped to a low of 55.7 percent in 1964 following his pivotal role in the passage of the Civil Rights Act of McCulloch rebounded by winning 63.6 percent of the vote in 1966 and ran unopposed in Due to ill health, McCulloch declined to run for reelection in 1972 and retired from Congress on January 3, From January 1959 until his retirement, William McCulloch served as the ranking Republican member on the House Judiciary Committee. He also held seats on the Joint Committee on Atomic Energy, the Joint Committee on Immigration and National Policy, and the Select Committee on Small Business. In conjunction with his committee assignments, he was a Congressional member to the Intergovernmental Commission on European Migration, attending many of the commission s meetings in Geneva, Switzerland. 4
5 Although a political conservative who believed in smaller government and continually criticized federal spending programs, William McCulloch s years in Congress are best known for the central role he played in the historic civil rights legislation enacted into law during the 1960s. He firmly supported President Dwight D. Eisenhower s 1957 and 1960 civil rights bills, and from his leadership position on the House Judiciary Committee he introduced his own civil rights bill in January Later that year, in reaction to a series of racial incidents in the South, President John F. Kennedy proposed a wide-ranging civil rights bill designed to end segregation in education, voting, and public accommodations. Faced with stiff opposition from the Democratic South, Kennedy required the support of the Republican Party in order to pass the bill through Congress. Accordingly, the president sent Assistant Attorney General Burke Marshall to meet with William McCulloch to solicit the congressman s support. McCulloch agreed to back the bill in the House Judiciary Committee and later on the House floor under two conditions. First, the bill must be perceived as a strictly bipartisan measure, with both parties claiming equal credit for its passage. Secondly, and most importantly, the Kennedy administration must agree not to drop key provisions in the bill in order to get it passed through the Senate. McCulloch had faced a similar situation with the Civil Rights Acts of 1957 and 1960 when amendments brought forth by Southern Democrats in the Senate significantly weakened this legislation. After President Kennedy agreed to these terms, McCulloch joined with Emanuel Celler (D-NY), the chairman of the House Judiciary Committee, in successfully managing the bill through the House, securing its passage in February Due to President Kennedy s pledge, during the Senate debate on the bill every proposed amendment brought before the Senate had to be first cleared by McCulloch. As a consequence, during the Senate debate McCulloch, even though he was a House member, became known as the Czar of the Senate. The result was a strengthened bill that added a provision prohibiting employment discrimination. Another provision provided the means for the U.S. Attorney General to become involved in discrimination cases filed by individuals. The Senate passed the bill on June 19, When the revised bill returned to the House for a final vote before being sent to President Lyndon B. Johnson, McCulloch received a rare standing ovation and a round of floor speeches in recognition of his leadership. President Johnson publicly recognized McCulloch as "the most important and powerful force" in the enactment of the bill. President Johnson signed the Civil Rights Act of 1964 into law on July 2, 1964, the one-year anniversary of Burke Marshall s initial visit with McCulloch. The following year, William McCulloch was instrumental in the passage of another major piece of civil rights legislation, the Voting Rights Act of McCulloch, who once pointed to this bill as his proudest legislative achievement, successfully defied attempts by President Richard Nixon and Attorney General John Mitchell to significantly weaken the bill when it came up for extension during the 91 st Congress in From his seat on the House Judiciary Committee, William McCulloch also proposed and helped pass major crime bills, including the Electronic Surveillance Control Act of the 1967 and the Omnibus Crime Control and Safe Streets Act of In addition, he took an active interest in 5
6 Electoral College reform, legislative reapportionment, and in legislation aimed to strengthen the federal judiciary. In July 1967, in recognition of McCulloch s expertise in race relations and his commitment to strong anti-crime laws, President Lyndon B. Johnson appointed McCulloch to the National Advisory Commission on Civil Disorders (Kerner Commission). The president charged the 11- member commission with investigating the causes of the race riots afflicting the nation over the previous three years and to provide recommendations to prevent riots in the future. Following the assassinations of Dr. Martin Luther King, Jr. and Robert F. Kennedy in 1968, Johnson again selected McCulloch to serve on the Presidential Commission on the Causes and Prevention of Violence (Eisenhower Commission). Following ratification of the 25 th Amendment to the U.S. Constitution in 1967, which clarifies the succession to the Presidency, McCulloch was one of four members of Congress honored for their work in the amendment s writing and passage. Other significant honors and recognitions William McCulloch received during and after his career in public service include the following. Industrial Union Department of the AFL-CIO Award for approving the most farreaching civil rights legislation of the past 100 years, 1964 American Political Science Association Distinguished Service Award, 1964 Council for United Civil Rights Leadership Award, 1964 Leadership Conference on Civil Rights Award, 1964 State of Ohio Governor s Award, 1971 American Bar Association Special Award for Distinguished Public Service, 1972 Americans for Constitutional Action Distinguished Service Award, 1972 Ohio State University Most Distinguished Alumnus Award, 1972 American Civil Liberties Union Award, 1974 William M. McCulloch died in Washington, DC on February 22, He is buried in Arlington National Cemetery. A constitutional lawyer, the following quote best illustrates William McCulloch s political philosophy. It is an excerpt from his floor statement on October 12, 1971 supporting passage of the Equal Rights Amendment as amended by the House Judiciary Committee. We are a nation of many people and views. In such a nation, the prime purpose of a legislator, from wherever he may come, is to accommodate the interests, desires, wants, and needs of all our citizens. To alienate some in order to satisfy others is not only a disservice to those we alienate, but a violation of the principles of our Republic. Lawmaking is the reconciliation of divergent views. In a democratic society like ours, the purpose of representative government is to soften tension reduce strife while enabling groups and individuals to more nearly obtain the kind of life they wish to live. The function of Congress is not to convert the will of the majority into law, rather its function is to hammer out on the anvil of public debate a compromise between polar positions acceptable to a majority. 6
7 Scope and Contents Notes Series 1: Personal/Political Boxes 1 5 The Personal/Political Series consists of five cubic feet of materials dating from 1933 to 2010, though the bulk of the series dates from 1959 to The series contains the sub-series of biographical, correspondence, invitations, and campaigns. The biographical materials include the biographical sketches used by Congressman McCulloch s office and various newspaper clippings compiled during his time in office. Other files contain a limited number of records from his terms in the Ohio General Assembly and from his military service during World War II. In addition, the sub-series contains documents pertaining to the many awards and honors McCulloch received during his public service career, including the naming of the public square in Piqua in his honor in 2009 and the efforts made during 2010 to place a statue of him in Congress s Statuary Hall. The two and one-half cubic feet of correspondence date from 1931 to Included is a set of files, dating from 1957 to 1973, containing letters written to and from members of Congress on a wide range of topics. Other files contain letters sent to William McCulloch from members of Congress during his illness in 1971 and in reaction to his decision to retire at the end of the 92 nd Congress in January The retirement letters contain a number of moving tributes to McCulloch from members of both political parties in the House and the Senate, as well as tributes from other government officials, organizations, and the media. Another set of files, arranged in alphabetical order, contain letters to and from specific individuals. Most of these individuals were businessmen in the 4 th Ohio Congressional District, but also included are a number of prominent political figures. Box 3 in the series contains a sampling of the thank you letters sent and received by Congressman McCulloch s office from 1961 to The invitations sub-series contains one cubic foot of materials dating from January 1961 through January 1964 and from January 1969 through December The files contain correspondence and related documents pertaining to the meetings and other events Congressman McCulloch attended during these time periods. Due to the lack of daily or monthly scheduling records within the collection, the invitations files offer the only documentation available on McCulloch s day to day activities. The one cubic foot of campaign files date from 1947 to 1972 and offer a of glimpse of William McCulloch s political activates to win election, then continued re-election, to Congress. Included are general correspondence files arranged by Congressional session, along with correspondence and related documents filed by county within the 4 th Ohio Congressional District. Other files pertain to state and national Republican Party organizations. Included within the sub-series is a limited number of brochures, palm cards, and other ephemera from McCulloch s election campaigns. 7
8 Series 2: Legislative Boxes 6 10 The Legislative Series consists of five cubic feet of materials dating from 1947 to 1972, though the bulk of the series dates from 1956 to Arranged in alphabetical order by topic or bill name, the series contains bills, committee prints, amendments, correspondence, reports, and other documents pertaining to William McCulloch s legislative interests as a member of the House Judiciary Committee. Topics of note include the federal judiciary, efforts at legislative reapportionment introduced in 1964, Electoral College reform in 1969, and legislation introduced in 1972 to achieve school desegregation through busing. The series contains multiple files documenting Congressman McCulloch s leadership in the passing of major civil rights legislation during the 1960s. Documents pertaining to the Civil Rights Act of 1964 (H.R. 7152) include bills, correspondence, committee prints, reports, analyses, memoranda, newspaper clippings, press releases, statements and speeches. Other files contain similar documents concerning the Voting Rights Act of 1965 (H.R. 6400) and legislation introduced in the 91 st Congress (H.R. 4249) to extend the act. Additional files pertain to various civil rights bills introduced in 1959, 1960 and 1963, and to the fair housing legislation brought forth as the Civil Rights Act of 1966 (H.R ). William McCulloch s interest in law and order is well documented in the series. Files on crime include the Electronic Surveillance Control Act (H.R ) he sponsored in 1967 and his Omnibus Crime Control and Safe Streets Act of 1968 (H.R. 5037). Additional files containing correspondence, statements and speeches, newspaper clippings, and reports pertain to McCulloch s membership on the Presidential Commission on the Causes and Prevention of Violence (Milton Eisenhower Commission, ). The series includes bound volumes of William McCulloch s statements in the Congressional Record from 1947 to The volumes also contain information on his voting record. Series 3: Media Relations Boxes The Media Relations Series contains one cubic foot of records and nine scrapbooks dating from 1947 to Included in the series is one file of biographical materials consisting of Congressman McCulloch s official biographical sketch, dated November 6, 1972, along with information and correspondence pertaining to the various awards and honors he received during his time in office. A set of files contain correspondence and newspaper clippings to or from the major newspapers published in the 4 th Ohio Congressional District. Generally sorted by Congressional session, this set of files date from 1947 to Another, smaller set of files contain similar correspondence written to or from the district s radio and television stations. Also included in the series is a chronological set of files containing press releases and statements from Congressman McCulloch dating from 1948 to The series contains transcripts or reading copies of a limited number of McCulloch s speeches, most of which pertain to law and order topics. Other files contain a few transcripts of the congressman s Washington Report radio broadcasts, dating from 1961 and

Other clippings pertain to events in the 4 th Ohio Congressional District or to public policy issues of interest to McCulloch. Series 4: District Affairs Boxes The District Affairs Series consists of 24 cubic feet of materials dating from 1950 to 1972, though the bulk of the files date from 1961 to The series contains the sub-series of correspondence, departments and agencies, post offices, and subject files. Please note that researchers must sign a confidentiality agreement prior to use of any records within the District Affairs Series. The correspondence sub-series contains 15.5 cubic feet of materials dating from 1952 to Two and one-half cubic feet of the sub-series consists of a set of carbon copies of the letters sent out by Congressman McCulloch s office for the years and another set of carbon copies dating from Each set of files is arranged in alphabetical order by the surname of the recipient. Another set of files contains a one-half cubic foot sampling of the congratulatory letters sent to constituents from 1961 to The letters are arranged by congressional session into various topical files, such as anniversary, awards, birthday, citizenship, retirement, etc. The correspondence sub-series includes 12.5 cubic feet of letters sent to Congressman McCulloch s office written by constituents offering their opinions and comments on legislative and public policy issues. This issue mail dates from 1961 to 1966 and from 1969 to The files are arranged in alphabetical order per congressional session either by topic or by the congressional committee overseeing a particular topic or issue. For example, letters written in concerning school prayer are held in files under the Judiciary Committee heading, while letters written in concerning civil rights legislation are in files labeled Civil Rights. The issue mail provides excellent documentation on the concerns, aspirations, and sentiments held by voters in the 4 th Ohio Congressional District towards the major public policy issues faced by Congress and the nation during the 1960s and early 1970s. Topics of note include the establishment of Medicare; Supreme Court rulings on school prayer; the enactment of civil rights legislation; federal support for education; gun control; crime and civil unrest; educational desegregation through school busing; family planning and abortion; student demonstrations; pollution and the environmental movement; the Equal Rights Amendment and other women s issues; and the Vietnam War. The departments and agencies sub-series contains 4.5 cubic feet of records dating generally from 1961 to 1972, with a few files dating from the 1950s. Arranged in alphabetical order by departmental, agency, or commission name, the sub-series documents the interaction between Congressman McCulloch s office and various aspects of the federal government on behalf of 9
10 constituents or entities within his district. Files within the sub-series generally contain sent and received correspondence, but may also include memoranda, reports, newsletters, financial records, newspaper clippings, and other types of related documents. Of note within the subseries are extensive files pertaining to the draft status and military service of various individuals from the 4 th Ohio Congressional District during the Vietnam War era. The post office sub-series consists of one cubic foot of records dating from 1951 to Files generally contain sent and received correspondence that document Congressman McCulloch s interaction with the postmasters in various towns and villages located in the 4 th Ohio Congressional District. Much of the correspondence pertains to the functioning of the U.S. Postal Service within the district. The letters also may touch upon local politics within the district, especially in regards to the appointment of postmasters. Files within the subseries are arranged in alphabetical order by post office name. Unfortunately, the records cover only the N to Y range of offices within the district. The subject files sub-series consist of three cubic feet of records dating from 1953 to Arranged in alphabetical order, files within the series pertain to a wide variety of businesses, organizations, institutions, and other entities with the 4 th Ohio Congressional District. Most of the files contain sent and received correspondence, but may also include reports, newspaper clippings, newsletters, memoranda, and related documents. Of note is a small series of files pertaining to the Courthouse Conferences, or open town meetings, Congressman McCulloch held at various locations within his district from 1960 through Another series of files labeled Ohio State Matters contain documents about events or issues pertaining to the State of Ohio in general. Series 5: Audiovisual Materials Boxes The Audiovisual Materials Series contains four cubic feet of items dating from 1911 to 2009, though the bulk of the series dates from 1961 to The series contains the two sub-series of certificates and photographs. The certificates sub-series contains a variety of the awards and honors William McCulloch received both during his lifetime and posthumously. The items range from his 1919 diploma from Wooster High School to the proclamation from the City of Piqua making July 2009 William M. McCulloch Month. Of note are the many recognitions Congressman McCulloch received for his work towards the enactment of civil rights legislation during the 1960s. The photographs sub-series contains a few miscellaneous files containing formal and candid portraits of William McCulloch and his wife, Mabel Harris McCulloch. Other files contain a limited number of photographs from McCulloch s childhood, his military service during World War II, and his election campaigns. 10
11 The bulk of the photographs are sorted into three sets of files encompassing events, VIPs, and visitors. Arranged in alphabetical order by title or subject matter, the event files date from 1941 to Topics include a variety of meetings, appearances, political conventions, campaigns, and travel Congressman McCulloch participated in during this time period. Of note are oversized photographs of McCulloch with President Lyndon B. Johnson taken during signing ceremonies for civil rights and other major legislation during the 1960s. The VIP files date mostly from the 1960s and contain photographs of a wide assortment of politicians on the district, state, and national level, along with some nationally known nonpolitical figures. The files are particularly strong for photographs of the Republican members of the Ohio congressional delegation during this time period. Most of the photographs include Congressman McCulloch posed with a particular individual or group. The files are arranged in alphabetical order by surname. The visitor files dated from 1958 to 1972 and feature Congressman McCulloch with constituents who visited his office in Washington, DC. The photographs include individuals, families, and an assortment of groups. Also included in the photographs sub-series are two photograph albums, dated 1939 and 1941, compiled while William McCulloch was speaker of the Ohio House of Representatives. The albums record trips Ohio politicians and educational leaders took to universities in Illinois, Michigan, and Wisconsin. Series 6: Artifacts Boxes The Artifacts Series contains 14 three-dimensional objects, most of which were presented to William McCulloch during his congressional career. Included are plaques and awards honoring his leadership in the passage of civil rights legislation during the 1960s. Other artifacts commemorate his achievements in general over a lifetime spent in public service. Of note is the award commemorating his posthumous induction into the Ohio Civil Rights Hall of Fame in
