ORDER IN COUNCIL/DÉCRET The Provincial Lands Act [O.C. 847/2006] 14 November 2006 TO THE HONOURABLE THE LIEUTENANT GOVERNOR IN COUNCIL The undersigned has the honour to report that: l Section 3 of The Forest Resources Management Regulations provides, in part, as follows: 3(2) The minister may withdraw land from a provincial forest with the written approval of the Lieutenant Governor in Council. (3) Where land is withdrawn from a provincial forest by the minister: (a) the written approval of the Lieutenant Governor in Council and the reasons for withdrawing the land are to be published in the Gazette; and (b) the areas described in Part III are deemed to be amended accordingly. 2 Section 27 of The Provincial Lands Act provides, in part, as follows: 27(1) Subject to this Act and any applicable regulations, the minister may sell provincial lands on any terms and conditions that: (a) the minister considers appropriate; and (b) are not inconsistent with any terms and conditions that are prescribed in the regulations. 3 Section 4 of The Crown Resource Land Regulations provides, in part, as follows: 4(1) Subject to the approval of the Lieutenant Governor in Council, the minister may sell Crown resource land in accordance with this section if the Crown resource land is not part of a provincial forest. 4 All requirements of The Crown Resource Land Regulations and all other relevant laws, regulations and agreements in force have been fulfilled. 5 It is advisable and in the public interest to withdraw the land identified below from the Northern Provincial Forest, and sell the provincial land for the nominal price of $1.00 to the Northern Hamlet of Michel Village to be used for residential purposes and to complete the necessary documents for title transfer. The undersigned has the honour, therefore, to recommend that Your Honour s Order do issue: (a) pursuant to section 3 of The Forest Resources Management Regulations approving the withdrawal by the Minister of Environment of the land identified below from the Northern Provincial Forest ; and
