2 NOTE: Please note that the following will form part of the Constitution and Bylaws Committee Report. The National President has ruled that the two-thirds majority required in Bylaw 4, sections 17 and 18 is a violation of the PSAC constitution. As a result, they have been amended as follows: Bylaw 4 Sec 17 Local dues When new locals are formed, they may establish dues by a two-thirds majority vote of the members in attendance at a general meeting. Members will be provided a notice of motion 30 days before such meetings. Such dues are collected by the Union of National Employees and paid to the local, provided that the local conforms with all rules in Bylaw 5 and Policy FIN 1. Bylaw 4 Sec 18 A local may amend its dues not more than once a year if authorized by a two-thirds majority of members in attendance at an annual or special meeting. Members will be provided a notice of motion 30 days before such meetings. The local will forward to the Union of National Employees office notice that dues have been changed so that the component can implement the change.

9 AMENDED RESOLUTION CS 1 Membership Suspensions Origin: National Executive Bylaw 7, Section 5 The Committee recommends concurrence in amended resolution CS 1. The Union of National Employees will amend Bylaw 7, Section 5 as follows: Bylaw 7 Sec 5 Membership Suspensions The national executive may recommend to the PSAC Board of Directors the suspension from membership of any individual or group of members for acts detrimental to the Union of National Employees, or for violating any provision of the bylaws of the component, or the PSAC Constitution and regulations., or for any of the reasons listed in Section 4, Subsections a) to m). The local may request the presence of a national executive officer at one of their meetings to explain the cause of the suspension. Any member who has been suspended, and their local, is may submit an appeal to the PSAC National President National Board of Directors under Section 25, Subsection 4 of the PSAC Constitution as per the PSAC Constitution and Regulations. Committee Rationale: This is a language clean up to align UNE Bylaws with the current PSAC practice. It also ensures that the Bylaw is more flexible should the PSAC alter their governance documents. 11 RESOLUTION CS 2 Local s Officers Origin: National Executive Bylaw 3, Section 5 The Committee recommends concurrence in resolution CS 2. The Union of National Employees will amend Bylaw 3, Section 5 as follows: Bylaw 3 Sec 5 Local officers In accordance with its bylaws and the bylaws of the Union of National Employees, Each local will elect at least three executive officers - a president, a vice-president, and a secretary-treasurer to conduct its affairs. Each Local will also elect a health and safety representative. If there are only three executive officers, one will serve as a health and safety representative. A local may divide the secretary-treasurer s responsibilities among two or more executive offices. It may also combine the duties of the health and safety representative with another executive position. As required, it The Local may also establish additional executive positions such as, but not exclusively, chief steward or and human rights representative. Committee Rationale: The previous language was ambiguous and created a situation where a Local could be in conformance and not have a Local President. 12 RESOLUTION CS 3 Eligibility for Election to Local Office Origin: National Executive Bylaw 2, Section 40 The Committee recommends concurrence in resolution CS 3. The Union of National Employees will amend Bylaw 2, Section 40 as follows: Eligibility Members of the national executive are not eligible for election to will not hold local office Committee Rationale: Language clean up to provide greater clarity that a member of the National Executive cannot hold local office. 13 RESOLUTION CS 4 Adopting and Amending Bylaws Origin: National Executive Bylaw 3, Section 16 The Committee recommends concurrence in resolution CS 4. The Union of National Employees will amend Bylaw 3, Sec 16 as follows: Adopting and amending bylaws Locals will adopt bylaws to conduct their business. A local may amend its bylaws once a year and only by a two-thirds majority vote of its membership at the local s annual general meeting, general membership meeting, or a special meeting, provided 30 days notice has been provided to the membership at each instance. All bylaws will be approved by the national president prior to becoming active. Committee Rationale: The change will allow greater flexibility and aligns the Bylaws with the current practice. 14 RESOLUTION CS 5 Resolving Bylaw Disputes Origin: National Executive Bylaw 3, Section 18 The Committee recommends concurrence in resolution CS 5. The Union of National Employees will amend Bylaw 3, Sec 18 as follows: Resolving bylaw disputes In the event of a dispute between the national president and a local over the local s bylaws, either party may refer the matter to the national executive for a decision. If the national executive cannot resolve the matter, the dispute is referred to the national board of directors. The national president provides locals with draft bylaws that locals may use as policies to conduct their business. Committee Rationale: Language provides for an in-house dispute resolution mechanism that is consistent with current practices. The language in the current bylaws preceded the development of the Standard Local Bylaws. Cost of Resolution: No additional cost No dues increase Page 6

15 RESOLUTION CS 6 Local Membership Meetings Origin: National Executive Bylaw 3, Section 22 The Committee recommends concurrence in resolution CS 6. The Union of National Employees will delete Bylaw 3, Sec 22 as follows: Local membership meetings A local may amend its bylaws to include regular monthly meetings and special meetings of its general membership. Committee Rationale: This issue is now addressed in the Standard Local Bylaw. Cost of Resolution: No additional cost No dues increase Page 7

The Union of National Employees will amend Bylaw 3, Sec 23 as follows: Locals annual general meetings Each local will hold a regular annual general meeting to receive and adopt annual reports from its officers, financial statements, local budgets (where applicable) and the minutes of the previous annual general meeting for consideration of business, as required by the local s bylaws. National executive Bylaw 2 Sec 1 Composition The national executive is composed of an elected, the full-time national president, the full-time national executive vice-president, the national vice-president for human rights and a vice-president for each of the following regions: Atlantic Provinces, Quebec, Ontario, Manitoba, Saskatchewan, Alberta and the Northwest Territories and Nunavut, British Columbia and the Yukon Territory, and Outside Canada. There are two vice-presidents for the National Capital Region - one from separate-employer locals and one from Treasury Board locals. Each vice-president is elected by his or her regional caucus. (See Policy RF 1, Regions for a definition of each region.) Committee Rationale: The Component is the second largest in the PSAC family with 22,000 members, 175 locals and 41 collective agreements but still only has one full-time paid national officer. The workload is unrealistic for one person. Other Components have more than one paid official. Page 9

19 RESOLUTION CS 8 (as submitted) Full-Time National Executive Vice-President Origin: Local Bylaw 2, Sections 1 and 18 The Union of National Employees will elect a full time National Executive Vice President, with the salary rate set at 85% of the salary of the National President, or his/her substantive salary; whichever is higher, with residency of the NEVP within commuting distance of the national Capital Region. National executive Bylaw 2 Sec 1 Composition The national executive is composed of an elected, the full-time national president, the full-time national executive vice-president, the national vice-president for human rights and a vice-president for each of the following regions: Atlantic Provinces, Quebec, Ontario, Manitoba, Saskatchewan, Alberta and the Northwest Territories and Nunavut, British Columbia and the Yukon Territory, and Outside Canada. There are two vice-presidents for the National Capital Region - one from separate-employer locals and one from Treasury Board locals. Each vice-president is elected by his or her regional caucus. (See Policy RF 1, Regions for a definition of each region.) Bylaw 2 Sec 18 The national executive vice-president: a) shall reside within commuting distance of the National Capital Region; Because the Union of National employee has the largest and most diverse employer grouping of all the components within the Public Service Alliance of Canada with half of its members attached to employers with national headquarters in the National Capital Region and this would further allow a swift response to issues bearing national labour relations implications; and Page 11

22 RESOLUTION CS 10 (as submitted) Union of National Employees Paid Vice-President Origin: Local Bylaw 2, Section 1 The Union of National Employees will have a paid National Executive Vice-President to assist the National President in the affairs of the union. National executive Bylaw 2 Sec 1 Composition The national executive is composed of an elected, full-time national president, the full-time national executive vice-president, the national vice-president for human rights and a vice-president for each of the following regions: Atlantic Provinces, Quebec, Ontario, Manitoba, Saskatchewan, Alberta and the Northwest Territories and Nunavut, British Columbia and the Yukon Territory, and Outside Canada. There are two vice-presidents for the National Capital Region - one from separate-employer locals and one from Treasury Board locals. Each vice-president is elected by his or her regional caucus. (See Policy RF 1, Regions for a definition of each region.) Because Union of National Employees is a large component with a diverse membership that requires a great deal of attention and cannot be fully handled by the President; Because the Union of National Employees is one of the only components that does not have a paid National Vice-President; and Because the Union of National Employees values providing its members with the best possible service and representation. 23 RESOLUTION CS 11 (as submitted) Full-Time Paid Position - National Executive Vice-President of the Union of National Employees Origin: Mary Anne Walker, ARVP - Ontario Prabir Roy, Local Sue Freeman, Local Jennifer Wagnell, Local Rochelle Rivet, Local Shavane Spencer, Local Bylaw 2, Section 1 The Union of National Employees will amend Bylaw 2, Section 1 to read as follows: Bylaw 2 Sec 1 Composition The national executive is composed of an elected, the full-time national president, the full-time national executive vice-president, the national vice-president for human rights and a vice-president for each of the following regions: Atlantic Provinces, Quebec, Ontario, Manitoba, Saskatchewan, Alberta and the Northwest Territories and Nunavut, British Columbia and the Yukon Territory, and Outside Canada. There are two vice-presidents for the National Capital Region - one from separate-employer locals and one from Treasury Board locals. Each vice-president is elected by his or her regional caucus. (See Policy RF 1, Regions for a definition of each region.) Because the Union of National Employees is the most employer diverse Component within the Public Service Alliance of Canada; Because the position of National Executive Vice-President is necessary to fulfill the form of organization which is Union of National Employees; and Page 15

25 AMENDED RESOLUTION CS 13 Election of Delegates Origin: National Executive Bylaw 6, Section 12 The Committee recommends concurrence in amended resolution CS 13. Moved by: Seconded by: Mylène Séguin Carrie Vasey The Union of National Employees will amend Bylaw 6, Section 12 to read as follows: Bylaw 6 Sec 12 Election of delegates At least four months prior to the opening date of the Union of National Employees National Convention, each local that has met the requirements of Bylaw 3, Sections 5 and 16; Bylaw 3, Section 8; and Bylaw 5, Section 9 will elect from among members at a general meeting an accredited delegate to the convention. The number of delegates per local is based on the number of members in good standing in the local six months prior to the opening date of the convention: a) four to members = one delegate; b) one additional delegate for each members or portion thereof to a maximum of five delegates for any given local Committee Rationale: The current financial situation of the Component dictates that it look at all aspects of its operations to identify areas where savings can be realized. This process still allows locals to be represented at convention while demonstrating financial prudence. Page 17

27 RESOLUTION CS 13 (as submitted) Election of Delegates Origin: National Executive Bylaw 6, Section 12 The Union of National Employees will amend Bylaw 6, Section 12 to read as follows: Bylaw 6 Sec 12 Election of delegates At least four months prior to the opening date of the Union of National Employees National Convention, each local that has met the requirements of Bylaw 3, Sections 5 and 16; Bylaw 3, Section 8; and Bylaw 5, Section 9 will elect from among members at a general meeting an accredited delegate to the convention. The number of delegates per local is based on the number of members in good standing in the local six months prior to the opening date of the convention: a) four to members = one delegate; b) one additional delegate for each members or majority portion thereof to a maximum of five delegates for any given local. The Union of National Employees will amend Bylaw 6, Section 12 to read as follows: Bylaw 6 Sec 12 Election of delegates At least four months prior to the opening date of the Union of National Employees National Convention, each local that has met the requirements of Bylaw 3, Sections 5 and 16; Bylaw 3, Section 8; and Bylaw 5, Section 9 will with the exception of the Local President who is the first delegate, elect from among members at a general meeting an accredited delegate to the convention. The number of delegates per local is based on the number of members in good standing in the local six months prior to the opening date of the convention: a) four to 100 members = one delegate; b) one accredited delegate for each 100 members or portion thereof to a maximum of five delegates for any given local. 29 Committee Rationale: Local Presidents are the leaders in our workplaces who do the day-to-day work and are aware of the issues important to the membership. 30 AMENDED SUPPLEMENTARY RESOLUTION CS 33 National Vice-President for Parks Canada Origin: National Executive Bylaw 2, Section 1 Bylaw 2, Section 2 Bylaw 2, Section 34 The Committee unanimously recommends concurrence in amended supplementary resolution CS 33. The Union of National Employees will amend Bylaw 2, Section 1 to create the position of full time national vice-president for Parks Canada to become part of the Union of National Employees National Executive; The Union of National Employees will also amend Bylaw 2, Section 2 to include the national vice-president for Parks Canada to be elected from among Parks members by all delegates to the UNE 2014 triennial convention; The Union of National Employees will also amend Bylaw 2, Section 34 to include the election of the national vice-president for Parks Canada; The Union of National Employees will also establish an operational budget of $15, for the position to cover the standard costs associated with a position on the national executive, this budget to be absorbed within the already existing national officer s budget line item; and The Union of National Employees will also immediately withdraw these bylaw amendments from the bylaws after the close of the 2017 UNE triennial convention; and The Union of National Employees will also amend Bylaw 2, National executive duties and responsibilities of officers, to include the following duties for the national vice-president for Parks Canada: Page 22

31 The national vice-president for Parks: a) follows and assists the national president in implementing the decisions taken by the national executive; the Triennial Component s and PSAC s conventions; b) at the direction of the national president represents the UNE in relations to Parks Canada Agency at a national level c) attends all meetings of the national executive; d) participates on national executive committees, as required by the national president; e) reports, in writing, on his or her activities at all meetings of the national executive and at the Component Triennial Convention. This report forms part of the minutes of these meetings and will be forwarded to all locals of the Union of National Employees; f) attends all sessions of the Union of National Employees and PSAC conventions; g) represents the component on PSAC committees and in other forums as requested by the national president or the national executive; h) assists, at the direction of the national president or the national executive, regional officers as they carry out their duties; specifically concerning issues involving Parks Canada; i) performs other duties assigned by the national president or the national executive; j) resigns any local office or other component position within one month of being elected as the national vice-president for Parks Canada; k) participates in PSAC activities in his or her region and National at the direction of the national president; l) provides guidance to Parks Canada Locals; m) works cooperatively with the national executive assistant vice-president for the regions, the human rights Page 23

32 representatives and the alternate human rights representatives the human rights committee in assisting them on issues involving Parks Canada; n) attends the regional seminar of the region in which they reside and others as invited by regional vice-presidents; and Note The position will only be filled if the UNE is successful in negotiating with the employer (Parks Canada Agency) the following: a) That the member elected to this office be freed from their regular duties as a Parks Canada Employee and be allowed to fulfil the duties of the office for the triennial cycle of ; b) That the member will continue to receive their salary and paid benefits paid in full by Parks Canada. This includes any increases in salary adjustments of statutory increase and benefits during the triennial cycle periods, under the terms and conditions of employment and collective agreement of Parks Canada; c) Travel costs associated with the position as required by the employer will be paid by Parks Canada; d) These bylaw amendments shall be immediately withdrawn from the bylaws after the close of the 2017 Union of National Employees Triennial Convention. Because Parks Canada is one of the largest employer groups within the Union of National Employees composing 52 locals spread through every province and territory; Because Parks Canada is a complex separate employer with a multitude of classifications and a mixture of seasonal and fulltime members; Because the national president and national executive vice-president have an extremely heavy workload obligation in dealing with the current 60 Page 24

33 employer groups and 41 collective agreements within the Union of National Employees; Because Parks Canada Labour relations occupies a significant amount of time of both the national president and the national executive; Because it would foster a better understanding between the Union of National Employees and Parks Canada and strengthen national labour management relations; Because it would establish a stronger working relationship with the Chief Human resource officer of Parks Canada while representing the interest and rights of the members of the Union of the National Employees; and Because it would ensure that both the Union of the National Employees and Parks Canada have a direct and expedient method of consultation on all labour relations. Committee Rationale: This position will allow the Component to focus on the issues of one of our largest employer groups while sharing the workload of the President. This also represents a small cost to achieve the additional position. Cost of Resolution: This represents a dues rate increase of %. This represents an average dues increase of $0.05 per month per deductee. Page 25

34 SUPPLEMENTARY RESOLUTION CS 33 (as submitted) National Vice-President for Parks Origin: National Executive The Union of National Employees will amend Bylaw 2, Section 1 to create the position of full time National Vice president for Parks to become part of the Union of National Employees National Executive; The Union of National Employees will amend Bylaw 2, Section 2 to include the National Vice-President for Parks to be elected by delegates to the UNE 2014 triennial convention; The Union of National Employees will amend Bylaw 2, Section 34 to include the election of the National Vice-President for Parks; The Union of National Employees will establish an operational budget of $15, for the position to cover the standard costs associated with a position on the national executive, this budget to be absorbed within the already existing national officer s budget line item; and The Union of National Employees will amend Bylaw 2, National executive duties and responsibilities of officers, to include the following duties for the National Vice-President for Parks: The national vice-president for Parks: a) follows and assists the national president in implementing the decisions taken by the national executive; the Triennial Component and PSAC conventions; b) at the direction of the national president represents the UNE in relations to Parks Canada Agency at a national level c) attends all meetings of the national executive; d) participates on national executive committees, as required by the national president; e) reports, in writing, on his or her activities at all meetings of the national executive and at the Component Triennial Convention. This report forms part of the minutes of these meetings and will be forwarded to all locals of the Union of National Employees; Page 26

35 f) attends all sessions of the Union of National Employees and PSAC conventions; g) represents the component on PSAC committees and in other forums as requested by the national president or the national executive; h) assists - at the direction of the national president or the national executive - regional officers as they carry out their duties, specifically concerning issues involving Parks Canada; i) performs other duties assigned by the national president or the national executive; j) resigns any local office or other component position within one month of being elected as the National Vice president Parks; k) participates in PSAC activities in his or her region and National, at the direction of the national President; l) provides guidance to Parks Canada Locals; m) works cooperatively with the National executive. assistant vicepresident for the regions, the human rights representatives and the alternate human rights representatives of the component is assisting them on issues involving Parks Canada; n) attends the regional seminar of the region in which they reside and others as invited by regional Vice presidents Note The position will only be filled if the UNE is successful in negotiating with the employer (Parks Canada Agency) the following: a) That the member elected to this office be freed from their regular duties as a Parks Canada Employee and be allowed to fulfil the duties of the office for the triennial cycle of ; b) That the member will continue to receive their salary and paid benefits paid in full by Parks Canada. This includes any increases in salary adjustments of statutory increase and benefits during the triennial cycle periods, under the terms and conditions of employment and collective agreement of Parks Canada; c) Travel costs associated with the position as required by the employer will be paid by Parks Canada; Page 27

Because Parks Canada is one of the largest employer groups within the Union of National Employees composing 52 locals spread through every province and territory; Because Parks Canada is a complex separate employer with a multitude of classifications and a mixture of seasonal and fulltime members; Because the National President and National Executive Vice President have an extremely heavy workload obligation in dealing with the current 60 employer groups and 41 collective agreements within the Union of National Employees; Because Parks Canada Labour relations occupies a significant amount of time of both the national president and the National Executive; Because it would foster a better understanding between the Union of National Employees and Parks Canada and strengthen national labour management relations; Because it would establish a stronger working relationship with the Chief Human resource officer of Parks Canada while representing the interest and rights of the members of the Union of the National Employees; Because it would ensure that both the Union of the National Employees and Parks Canada have a direct and expedient method of consultation on all labour relations. Bylaw 3 Sec 24 Inactive locals Should a local no longer function for any reason, all documents, property and funds will be returned to the Union of National Employees for care and safekeeping. These assets will be either placed into trust by the national executive until the local is reinstated, or placed in the Union of National Employees general revenue account indefinitely. No local may have its charter amended or revoked, nor will any local be placed under trusteeship without conducting a binding referendum of the local s members. The only exception is when the national executive determines the local has ceased to function or is inactive due to the local s inability to meet the requirements set out in Bylaw 3, Section 16; Bylaw 3, Section 8; and Bylaw 5, Section 6, or when no Page 52

National Executive Bylaw 2 Sec 1 Composition The national executive is composed of an elected, full-time national president, the national executive vice-president, the national vicepresident for human rights, the national health and safety officer and a vice-president for each of the following regions: Atlantic Provinces, Quebec, Ontario, Manitoba, Saskatchewan, Alberta and the Northwest Territories and Nunavut, British Columbia and the Yukon Territory, and Outside Canada. There are two vice-presidents for the National Capital Region - one from separate-employer locals and one from Treasury Board locals. Each vice-president is elected by his or her regional caucus. (See Policy RF 1, Regions for a definition of each region.) Because health and safety affects all workers; and Because the Government has curtailed and eroded workers rights in regards to health and safety, the right to refuse dangerous work and the way it is reported. Decisions for such memberships are made by the national executive. or by a local nomination approved by the national executive. This honour may also be bestowed on former members provided that their membership has not lapsed for more than three years. The Union of National Employees will amend Bylaw 7, Section 1 as follows: Bylaw 7 Sec 1 Discipline by national executive a) The national executive of this component has the authority to discipline - including remove from office - any local officer or national officer, excluding the national president, who contravenes any provision of these bylaws or the PSAC Constitution. b) Any written complaints forwarded to the national executive within 90 calendar days of an alleged offence or within 90 calendar days of someone becoming aware of an alleged offence, will be investigated. The process followed in investigations is governed by the provisions of Policy NEN 5, Investigating complaints and Regulation 19 of the PSAC Constitution. Any written complaints forwarded to the National President or his or her designate within 90 calendar days of an alleged offence may be investigated. The Union of National Employees will amend Bylaw 7, Section 4 as follows: Bylaw 7 Sec 4 Actions that can lead to penalties If an officer commits any of the offenses listed in Subsections a) to m), below, he or she may be penalized under Sections 1 and 2 of this bylaw. The offences are as follows: a) violating any provision of the local bylaws, the bylaws or policies of the Union of National Employees or the PSAC Constitution; b) obtaining membership or soliciting members by misrepresentation; c) instituting, urging or advocating that a member of any local take court action against the Union of National Employees or the Public Service Alliance of Canada or any of their officers or against a local or any of its officers without first exhausting all remedies through appeal within the organization; d) advocating or attempting to bring about the withdrawal or disaffiliation of any member or group of members from the Union of National Employees or any local, other than through the proper component channels as outlined in Policy LOC 1; Page 64

73 e) publishing or circulating among the members false reports or wilful misrepresentations; f) working in the interests of a rival organization; g) slandering, libelling or wilfully wronging an officer or member of the Union of National Employees or of the Public Service Alliance of Canada; h) using abusive language or disturbing the peace of any meeting of the Union of National Employees or its locals; i) fraudulently receiving money due to the Union of National Employees or any of its locals or misappropriating the monies of the component or any of its locals; j) using the name of a local of the Union of National Employees to solicit funds, advertising and the like without the consent of the local concerned or the national executive of the component, whichever applies; k) giving a complete or partial list or any information on the membership of the Union of National Employees or of any local to anyone other than those whose official position entitles them to have such a list; l) deliberately interfering with an official of the Union of National Employees or of the Public Service Alliance of Canada in the discharge of his or her duties; or m) any other conduct prejudicial to the good order and welfare of the Union of National Employees or of the Public Service Alliance of Canada. Because there is a clear need to provide a procedure for disaffiliation and the consequences of violating policies. MEMBERSHIP RIGHTS Every member in good standing as defined in Section 4, Sub-Section (2) is entitled: a) to be represented by the union; b) to be free from any act or omission on the part of the union, or other members, that would discriminate against the member on the basis of age, sex, colour, national or ethnic origin, race, religion, marital status, family status, criminal record, physical or mental disability, sexual orientation, gender identity, language, political belief, social and economic class or employer; c) to be free from harassment by another member, both within the union and in the workplace, on the basis of any of the grounds mentioned in paragraph (b); and d) subject to any qualifications stipulated elsewhere in this Constitution, or in Component, Local or Area Council By-Laws, to vote and/or to be nominated for and hold office in the Union.
