1 VENTURA UNIFIED SCHOOL DISTRICT BOARD OF EDUCATION REGULAR MEETING Minutes Tuesday, November 8, 2016 Call to Order The Board of Education of the met on Tuesday, November 8, 2016 in the City of Ventura, Council Chamber, at 501 Poli Street, Ventura, California. Public Comment on Closed Session Items - None Closed Session It was moved by Mr. Walker, seconded Mrs. Lomax and carried on a roll call vote of 5-0; the Board adjourn to closed session to discuss conference with legal counsel anticipated litigation, public employee discipline/dismissal/release, conference with labor negotiators, pupil matters and public employee appointment.. At 6:00 p.m., President Fitzgerald called the regular meeting to order at which time student Board members Claire Hansen Buena, Kelsie Dugas Ventura and Cianna Calia El Camino read the Vision, Mission and Governing Principals. Report of Action taken in Closed Session No action taken. Good News Student Board members shared information regarding school activities in areas of academics, community service and sports. Dr. Babb, in partnership with CAPS TV presented the Mayor for the Moment video of Armoni Niccoli Loma Vista 5 th grader. Armoni s written essay on Respect provided him the opportunity to be the Mayor for a Moment. Public Comments Deborah Meyer Morris requested time to speak regarding revisions on Uniform Complaint Procedures Board policy and administrative regulations and corrective actions. Dan Nelson thanked the Board of Education for the work they do in support of VUSD students, families and staff. 2 It was moved by Mrs. Haffner, seconded by Mr. Walker and carried on a roll call vote of 5-0; the Board approved the September 13, 2016 minutes as presented. Approval of the Board of Education Meeting Minutes for September 27, 2016 It was moved by Mrs. Golden, seconded by Mrs. Lomax and carried on a roll call vote of 5-0; the Board approved the September 27, 2016 minutes as presented. Report on Board Appointed Committees Mr. Walker reported out on his attendance at the District English Learner Advisory Committee. Mrs. Lomax reported out on her attendance at the Ventura County Office of Education VC Innovative Grant meeting. Mrs. Fitzgerald reported out on her attendance at the Parcel Tax Oversight committee meeting. CONFERENCE AGENDA Superintendent s Recommendation for Appointment of Director of Transportation It was moved by Mrs. Lomax, seconded by Mrs. Haffner and carried on a roll call vote of 5-0; the Board approved the superintendent s recommendation to appointment of Ms. Wendy Stevens as the director of transportation. Presentation and Approval of Resolution #16-27 re Classified School Employee Teacher Credentialing Program (Action Requested) It was moved by Mrs. Haffner, seconded by Mr. Walker to approve VUSD resolution #16-27 in support of the creation of a Ventura county classified school employee teacher credentialing program consortium to provide countywide program to train classified personnel to become fully qualified and credentialed teachers to alleviate teacher vacancies in. Presentation of Ventura County Office of Education Williams Report for the School Year California Education Code Section 1240 requires the county superintendent, or his or her designee, to visit schools in the county ranked in deciles 1 to 3 of the 2012 Academic Performance Index and report the findings in area of: Sufficient Textbooks and Instructional Materials Assess the Condition of School Facilities Annual Review of Teacher assignments and Vacancies Annual review of prior fiscal year audit reports to identify any audit findings relating to Williams issues and determine how those findings will be corrected Annual review of School Accountability Report Cards For the School Year, Ventura County Office of Education visited the following Ventura Unified Schools: Blanche Reynolds, E.P. Foster, Montalvo, ATLAS, Sheridan Way and Will Rogers Elementary Schools and were found compliant in all five areas. Local Education Agency (LEA) Plan Addendum through The No Child Left Behind (NCLB) Act of 2001 mandated that each Local Education Agency develop an LEA Plan as a requirement for receiving federal and state consolidated application funds. The Board approved Ventura Unified School District s initial LEA Plan in May The plan was revised in 2010, and annual updates on the LEA Plan Strategies and Actions provided to the Board. NCLB has been reauthorized and the new Every Student Succeeds Act will be implemented fully in is a transition year, and Ventura Unified School District must submit an addendum to our LEA Plan to reflect the Common Core standards. The LEA addendum was previously provided to the Board and will be brought back for approval at the December 13, 2016 Board of Education meeting. 2

3 Administrative Recommendation to Waive Education Code 51241(c) It is recommended that the Governing Board waive the physical education requirement for Student # s and who have not passed the Fitness Test (FITNESSGRAM ) in grade ten or subsequent grades. Education Code 51241(c) allows the governing Board of a school district to grant a permanent exemption from courses in physical education if the student (1) is 16 years of age or older and has been enrolled in the tenth grade for one academic year or longer and (2) is not attending fewer total hours of courses and classes if he or she elects not to enroll in a physical education course. This item will be brought back for approval at the December 13, Administrative Recommendation to Waive Board Policy The Governing Board waived Board Policy and approved the issuance of a High School Diploma for Student # s and This item will be brought back for approval at the December 13, Sheridan Way Elementary Ventura Neighborhood for Learning Mural The staff and VNfL parents at Sheridan Way School requested permission to paint a mural supporting outdoor learning and the natural environment. The mural will be 7 feet x 11 feet upon completion and will be painted on the outside wall of room 30, next to an existing mural as an extension of the first mural. This mural will depict gardens of produce in addition to orange and lemon trees. Arin Suarez, local artist on the Ventura Neighborhoods for Learning Advisory Board will be painting the mural. The project has been coordinated with the Facilities Services Department and the funding source is a VEP Smart Grant. This item will be brought back for approval at the next regularly scheduled Board of Education meeting. Montalvo Elementary School Mural Dedicated to the Memory of Diane Knerr The staff and students at Montalvo Elementary School requested permission to paint a mural dedicated to the memory of Diane Knerr, Montalvo School Counselor. The mural will be 9 feet x 31 feet upon completion and will be painted on an outside wall facing west at the end of a classroom building. This mural will depict a beach scene; hope, peace, and love are formed by clouds. The words, Courage, never give up is written in the sand. Diane Knerr s saying, be kind and care for others is in a rainbow. MB Hanrahan, local artist will be drawing and painting this mural. The project has been coordinated with the Facilities Services Department and the funding source will be private funding. This item will be brought back for approval at the next regularly scheduled Board of Education meeting. Portola Elementary School Tile Project The staff, students and parents of Portola Elementary School requested permission to place tiles on an outside wall on the C building behind room 15. Portola students hand painted 6 x 6 tiles. Each tile displays a different piece of artwork with a variety of colors used. Upon completion the tile wall will be 5 feet x 3 feet. The Portola PTO has funded this project and the project has been coordinated with the Facilities Services Department. This item will be brought back for approval at the next regularly scheduled Board of Education meeting. Sunset School Mural and Seals The staff and students at Sunset School requested permission to paint a mural depicting inspirational messages for students; giving back, pride, healthy & Fit, College Higher Education, Good Citizen. The mural will be 8 feet x 12 feet upon completion and will be painted on an outside wall of the library building. Sunset Elementary school is also requesting two seals be painted on an outside wall of the office. The first seal is the Gold Ribbon Schools seal which will be 4 feet in diameter. The second seal is the Title I Academic Achievement Award which will be 33 in diameter. Both seals are issued by the California Department of Education. This item will be brought back for approval at the next regularly scheduled Board of Education meeting. Request for Adoption of Textbook The High Schools requested the adoption of the following textbook. Title: Automotive Service Author: Tim Gilles Publisher: Cengage Learning 3

Presentation and Approval of Proposed Changes, Deletions or Additions to Board Bylaw (BB)9270, related to Conflict of Interest (Action Requested) It was moved by Mr. Walker, seconded by Mrs. Golden and carried on a roll call vote of 5-0; the Board approved Board Bylaw 9270 that adds the designated position Personnel Commission to Bylaw, conflict of interest under the heading designated positions/disclosure categories. ACTION AGENDA Administrative Recommendation for Student Expulsion It was moved by Mrs. Lomax, seconded by Mrs. Haffner and carried on a roll call vote of 5-0; the Board approved the administrative recommendation regarding Student Expulsion # s 17/04 and 17/05 Approval of Proposed Changes, Deletions, or Additions to Current Board Policies (BP), Administrative Regulations (AR) and Exhibits (E) It was moved by Mrs. Haffner, seconded by Mrs. Golden and carried on a roll call vote of 5-0; the Board approved Board policy and administrative regulations as indicated. Policy # BP/AR Uniform Complaint Procedures AR Williams Uniform Complaint Procedures Comments Mandated policy updated to reflect programs that must be investigated in accordance with the Uniform Complaint Procedures (UCP), as listed on the California Department of Education's 2016/17 UCP Checklist. Mandated administrative regulation revised to clarify required annual notification and complaint filing requirements, and to provide for equitable treatment of a respondent to a complaint as required under federal law. Mandated regulation updated to delete the use of Williams Uniform Complaint Procedures for complaints regarding deficiencies in intensive instruction for students who fail to pass the high school exit examination by the end of grade 12, since NEW LAW (AB 97, 2013) eliminated 4

5 categorical funding for that program. CONSENT CALENDAR Exhibits updated to delete, from the sample classroom notice and sample complaint form, material related to the provision of intensive instruction to students who fail to pass the high school exit exam, since NEW LAW (AB 97, 2013) eliminated categorical funding for that program. Overnight, Out of the Tri-County and Ratification Fieldtrips Ventura High School requested permission to send students from their Wind Ensemble Honors/String Orchestra class to travel overnight and out of the state to a National Festival Invitational to be held at College of Dupage in Glen Ellyn, Illinois. The trip will take place on April 20-23, 2017, 70 students and 9 chaperones will attend. Ventura High School requested permission to send students from their Wind Ensemble class to travel overnight and out of the tri-county to a state level festival to be held at San Francisco State University in San Francisco, CA. The trip will take place on April 28-30, Board approved travel for 45 students and 6 chaperones. Lincoln Elementary School requested permission to send students from their 5 th grade class to travel overnight for an Outdoor Education fieldtrip to Catalina Island Marine Institute (CIMI) Toyon Bay, Catalina Island. The trip will take place on March 29-31, The Board approved to send 48 5 th grade students and five chaperones to this fieldtrip. Transportation to the Long Beach Harbor will be provided by District bus and transportation to Catalina Island will be provided by Catalina Classic Cruises. Montalvo Elementary School requested permission to send students from their 5 th grade class to travel to Rancho Alegre in Santa Barbara County for an outdoor education fieldtrip January 31 February 3, Board approved request to send 73 5 th grade students and two chaperones to this fieldtrip. Once the students arrive at Rancho Alegre the student to chaperone ratio will be 1 to 10. Buena High School requested permission to send students from their Marching Band to travel out of the tricounty to the marching band championships to be held at Ramona High School in Riverside, CA, Riverside County. The trip will take place on November 19, Board approved request to send 82 students and 12 chaperones to this fieldtrip.. 2. Request for Disposal of Obsolete Books The Board approved the disposal of obsolete/unusable materials from Buena High School. 3. Ventura Adult and Continuing Education s Course Approvals and Program Fees The Board of Education approved the modification to the Ventura Adult and Continuing Education Course Approvals and Program Fees to include the Food Service and Hospitality. 4. Winter Recess Leave for Classified Employees The Board of Education approved classified employees to take leave without pay during the Winter Recess, but not lose pay for the holidays (December 22, 23, 26, 30, and January 1) due to the fact they are not in paid status the day before or the day after a holiday. This has the potential of cost savings to the District (through unpaid leave time, possible closing of offices and/or sites, etc.) and does not deprive the employee of credit for the holidays New Dawn Counseling & Consulting, Inc. Memorandum of Understanding (MOU) The District entered into an agreement with New Dawn Counseling & Consulting, Inc. for coordination and facilitation of youth and families mental health services, and parenting classes. The term of the agreement is effective July 1, 2016 through June 30, Ventura Indian Education Consortium Agreements The Board ratified agreements with Hueneme Elementary, Moorpark Unified, and Ojai Unified School Districts, as part of the Ventura County Indian Education Consortium, during the August 9, 2016 meeting. The following school districts have also entered into agreements for inter-agency services. The agreements are effective July 1, 2016 to June 30, School District Conejo Unified School District Fillmore Unified School District Oxnard School District Oxnard High School District Rio School District Simi Valley School District 18. Ventura County Community College District Second Amendment to Lease Agreement The District extended the lease agreement with Ventura County Community College District through April 30, 2017, at which time they are scheduled to vacate the premises leased at the Trudy Tuttle Arriaga Education Service Center. 19. Ratification of Change Order #1, C11-17 Will Rogers Modular and Site Improvements 8

9 The change order to EJS Construction, Inc. consists of the following: 1. Provide bolts and washers for shade shelter $ Cut ceiling tiles and install at perimeter and ceiling devices $ Install quick coupler at new shade shelter area $1, Remove existing wire mold and replace with new and new wire. Patch and $3, paint old wire mold areas. Total for Change Order #1 $5, The Board ratified change order #1 in the amount of $5, for Will Rogers Modular and Site Improvements, for a total contract of $280, for Contract #C Ratification of Change Order #1, C12-17 Ventura Charter Portables and Site Improvements The change order to EJS Construction, Inc. consists of the following: 1. Provide 18 x 18 catch basin for site drainage $ Cut ceiling tiles and install at perimeter and ceiling devices in (2) new classrooms $ Install new ADA curb ramp at sidewalk and crosswalk striping. Existing curb $3, ramp and stall no longer meet ADA requirements 4. Change conduit connection between the new portable classrooms per DSA $4, requirement Total for Change Order #1 $9, The Board ratified change order #1 in the amount of $9, for Ventura Charter Portables and Site Improvements, for a total contract of $284, for Contract #C Ratification of Change Order #1, C13-17 Will Rogers Fire Hydrant The change order to J & H Engineering General Contractors, Inc. consists of the following: 1. Provide and install chain link enclosure and gate around new backflow $6, maintenance area 2. Notice of Completion for C12-17 Ventura Charter Portables and Site Improvements This contract was awarded to EJS Construction, Inc. in the amount of $275, Change orders have increased this amount to $284, This contract has been completed, inspected and found satisfactory.
