Duckers, City Attorney CERTIFICATE OF APPRECIATION Mayor McTaggart awarded the City of Bonner Springs, Kansas, Fire Department with a Certificate of Appreciation for its mutual aid of service to the residents of Edwardsville, KS through its lending of Fire Pumper 2510 to the Edwardsville Fire Department. AMENDMENT TO AGENDA ORDER Councilmember Adams motion to amend the agenda by moving item number six (6) the Executive Session, as to item (2) (a) for twenty (20) minute session. Councilmember Crider seconded. APPROVE MINUTES OF JANUARY 27, 2014 Councilmember Gillam motioned to approve the minutes. Councilmember Mellott seconded. Council Meeting February 10, 2014 Page 1

2 STATEMENT OF BILLS - $79, Councilmember Crider motioned to approve payment of bills. Councilmember Gillam seconded. EXECUTIVE SESSION Mayor McTaggart stated that the chair will entertain a motion to recess into Executive Session for twenty (20) minutes, with the open meeting to reconvene at 7:25pm. Councilmember Adams moved the motion. Councilmember Crider seconded. Mr. Michael Webb, City Manager, Mr. David K. Duckers, City Attorney, and Robert J. Wonnell, Special Counsel, also were present in the Executive Session. RECONVENE TO REGULAR SESSION Councilmember Crider motioned to reconvene to regular session at 7:27 p.m. Councilmember Adams seconded. REQUESTS OR COMMENTS FROM THE PUBLIC Mr. Heinz Rodgers, 650 Edwardsville Drive, Edwardsville, KS, commended the public works department and DirtWorks on the snow removal, the City staff on the new ambulances for Edwardsville, the city services, and the outstanding job of the fire department and thanked them. Mr. Bob Wing, 7540 Leavenworth Road, Kansas City, KS, Business Manager for the International Association of Firefighters Local 64, reported on the in-disputed times for the automatic mutual aid the city recently initiated. He also expressed his opinion that resources are being taken from the fire department and given to the police department, and he discussed the Unified Government of Wyandotte County along with the IFF local 64 agreed to undertake a comprehensive fire/ems service analysis through a joint union management process. Mr. Mark Bishop, Kansas Avenue, Edwardsville, KS, expressed his concern that more progress is being in the police department than in the fire department. The fire fighters have done a great job with the tools they have been provided, but the decision on Council Meeting February 10, 2014 Page 2

3 a new apparatus needs to be made so that the lives of the city fire fighters, the employees, the people that work in the city and the citizens are not in jeopardy. Mr. John Simma, Kansas Avenue, Edwardsville, KS, expressed his concern for himself, his family, the citizens and the city s firefighters, as the fire department is understaffed, equipment not being maintained properly, and response times has been compromised. He also expressed his concern as a tax payer, about the cost of using the Bonner Springs rig and personnel. He commented that the city s fire fighters are qualified and capable of doing their job. However, they are not being provided with the resources they need to do so. Mr. Tripper Sadler, Richland Avenue, Edwardsville, KS, stated that the City of Edwardsville is not following the NFPA standard guidelines and he doesn t feel that the safety for his family is being considered. Mr. Ed Lynn, 1614 S. 105 th Court, Edwardsville, KS, expressed his concerns as a taxpayer that the police department has received new vehicles and equipment, while the city s fire truck is in the shop, that the city is using a Bonner Springs fire truck, and that citizen s tax dollars are being used to pay for two of the highest paid personnel that do not live in Edwardsville or in Wyandotte County. He also commended the Edwardsville fire fighters on doing great job. Mr. Doug Spangler, 212 N. 4 th Street, Edwardsville, KS, expressed his concern about the safety liability issues of borrowing a rig and having a driver from Bonner Springs, as the driver may not be familiar with the streets system. Mr. Luther Pickell, 3152 N. 107 th Kansas City, KS, expressed his concern, as he heard on the news that the city had no operating fire apparatus. As a non-resident of Edwardsville, he hopes and prays that the city will look into it; and also see why one department receives more than stuff than the other department. Chris Handlin, 1900 S. 102 nd, Edwardsville, KS, expressed that the same amount of safety that you would expect to be given to you, should be provided to our citizens, families, neighborhoods, and to the city. Jackie Brant, 1449 S. 98 th Street Edwardsville, KS, expressed her concerns about the loss of the fire department, as she stated that several years ago she lost her home in a fire and it was the Edwardsville and KCK fire departments that came to assist her. 4 CONSIDER RECOMMENDATION OF APPROVAL FROM THE PLANNING COMMISSION REGARDING FINAL PLAT (REPLAT) AND ACCEPTANCE FOR EASEMENTS/RIGHT-OF-WAY (CRESTWOOD SUBDIVISION LOTS 5, 6, AND 7; CASE # RPT) Mr. Dave Knopick, City Planner, provided a brief explanation of the Final Plat (replat) and acceptance of easements /rights-of-ways (Crestwood Subdivision Lots 5,6 and 7) approved by the Planning Commission with three (3) conditions. Mr. Knopick also explained the original name (Lake Forest Road) was changed to Orchard Street sometime in the past. Councilmember Gillam motioned to approve the recommendation from the Planning Commission regarding final plat (replat) and acceptance for easements/right-of-way (Crestwood Subdivision lots 5, 6, and 7; Case # RPT) with conditions per the staff report. Councilmember Adams seconded. Mr. Knopick stated that in the future, the Council will see more of these types of cases due to old platted property lines. CONSIDER APPOINTMENT OF SPECIAL TASK FORCE TO EVALUATE SALES TAX ELECTION Mr. Michael Webb, City Manager, provided a brief explanation of the background of the recommendation from the Council s direction for the formation of a special task force to consider calling a special sales tax election. Mr. Webb explained the potential questions the task force to consider, including the purpose (ex. for public safety), the amount of the tax the type of election, when, and the number of members to serve on the task force, who consist of a mix of different representation of home and business owners. After a brief discussion, Councilmember Mellott motioned to form a special task force to evaluate sales tax for the City. Councilmember Adams seconded. Mayor McTaggart requested a roll call vote. The motion passed with four (4) in favor. Councilmember Shriver voted against. CONSIDER ANY NECESSARY ACTION FROM THE EXECUTIVE SESSION No action taken. Council Meeting February 10, 2014 Page 4

5 ADVISORY REPORT CITY MANAGER CHIEFS (POLICE & FIRE) PUBLIC WORKS Mayor McTaggart commented that there have been lots of nice calls and compliments on the snow removal in the city, all the work is appreciated, and also thanked DirtWorks on their hard work. CITY ATTORNEY COUNCIL AND MAYOR COMMENTS Councilmember Adams commented on the roads in the city were some of the best to drive on during the snow storm and also thanked all the parties involved in the removal of the snow. Councilmember Gillam commented he had also had driven around other counties and neighborhoods roads during the snow storm, and that the Edwardsville residential streets were well taken care of and appreciates the effort. Councilmember Shriver commented that last week the city council was notified by s on the different updates on the weather and the works of the public works department by the City Manager and Chief of Police. However, there was not any communication reported or provided on the issues regarding the fire department s rigs being down and that the city went without any vehicle for a small amount of time. She commented that she was surprised by the news report aired and received phone calls and questions, but did not have any updates from anybody and believes this was poor management. Councilmember Shriver commented that recently while at her folk s home that her father had been very ill. 911 had to be called and the KCK Fire Department (several fire fighters Council Meeting February 10, 2014 Page 5

6 & paramedics) arrived and saved her father s life and that is exactly what she wants in Edwardsville. Councilmember Shriver expressed her concern about a previous question she asked during the discussion of the future set up of the Edwardsville Fire Department/EMS service and the response. Councilmember Shriver requested that the City of Edwardsville look into the county wide fire services and also requesting that members of the city council sit in on the meetings. Mayor McTaggart commented that because there is lawsuit filed by IAFF 64 and an injunction by a Judge, we are prohibited from making any comments.
