1 PAGE NO. 1 IN COMPLIANCE WITH CHAPTER 231 OF PUBLIC LAW OF 1975, NOTICE OF THIS MEETING WAS GIVEN BY WAY OF ANNUAL NOTICE FILED WITH THE BOROUGH CLERK, THE HOME NEWS TRIBUNE, THE SENTINEL AND POSTED ON THE BULLETIN BOARD IN THE BOROUGH OF SOUTH RIVER MUNICIPAL BUILDING A Regular Meeting of the Mayor and Council of the Borough of South River, in the County of Middlesex and the State of New Jersey was held January 9, 2017 and was called to order by Mayor Krenzel at 7:45 PM in the Council Chamber of the Criminal Justice Building at 61 Main Street in South River, New Jersey with the following Councilmembers in attendance: Councilmembers Alai, Gurchensky, Jones, Meira, Sapata, Haussermann Also attending this meeting were Frederick Carr, Borough Administrator and James Nolan, Borough Attorney. ORDINANCES FIRST READING BY TITLE ONLY ORD ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK FOR CALENDAR YEAR 2017 Councilman Haussermann moved that the Council pass the said Ordinance on its First Reading by Title Only and that the Clerk be authorized to publish same as is required by Law with the Second Reading and Public Hearing to be held at a meeting on January 23, 2017 the Council Chambers of the Criminal Justice Building at 61 Main Street in South River, New Jersey. Councilman Jones seconded the motion. YEAS: NAYS: Alai, Gurchensky, Jones, Meira, Sapata, Haussermann None PUBLIC COMMENTS (agenda items only) No comments were made. Councilman Haussermann moved that the public portion be closed. Councilman Gurchensky seconded the motion. So carried.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of South River in the County of Middlesex, State of New Jersey, that Travis Taylor be

Krenzel, Mayor RES: JANUARY 9, 2017 GRANTING RENEWAL TO PLENARY LICENSES IN THE BOROUGH OF SOUTH RIVER FOR THE PERIOD JULY 1, 2016 TO JUNE 30, 2017 WHEREAS, application for renewal of Plenary License has been filed with the Division of Alcoholic Beverage Control Commission through its Online Licensing System for the period of July 1, 2016 until June 30, 2017; and WHEREAS, all requirements have been complied with and the Borough Council has determined that no protests have been filed against the granting of the said renewal application for such plenary

WHEREAS, the New Jersey Division of Alcoholic Beverage Control has granted permission for the renewal of said license, pursuant to N.J.S.A. 33: NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by the Borough Council of the Borough of South River in the County of Middlesex, New Jersey, that approval is hereby granted to said application, subject to the Rules and Regulations of the Alcoholic Beverage Control Commission and Code of the Borough of South River; and BE IT FURTHER RESOLVED that the certified copies of this resolution be filed with the Division of Alcoholic Beverage Control Commission, the applicant for their record purposes, the Beverage Tax Bureau, and the Chief of Police of the Borough. PLENARY RETAIL CONSUMPTION LICENSE: STATE/LOCAL NUMBERS: HOLDER TRADE NAME C-15 Michael J. Barry (Pocket) P. O. Box 26 Normandy Beach, NJ RES: JANUARY 9, 2017 WHEREAS, several municipal employees, have requested that they be allowed to carry over unused vacation time into the next calendar (2017) year; and WHEREAS, Chapter 68 of the Code of the Borough of South River permits the Governing Body to grant requests based on exceptional unforeseen circumstances which prevents the usage in the current year; and WHEREAS, after careful deliberation, the Governing Body has agreed that employment circumstances did prevent the use of said vacation time.
10 PAGE NO. 10 NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of South River that said employees are granted permission to carry-over their unused 2016 vacation time to the following year of 2017 with the condition that said vacation time be used by March 31, Name Glenn Lauritsen Amount to be Carried Over 1 day RES: JANUARY 9, 2017 WHEREAS, the State of New Jersey implemented the New Jersey Local Unit Pay- to- Play Law under P.L. 2004, Chapter 19 (as amended by P.L. 2005, c.51) N.J.S.A. 19:44A-20.4 et seq.; and WHEREAS, said Statute affects all Municipalities and Counties, and their agencies that enter into contracts with a value over $17, and further requires that all such contracts with a value over $17, (aggregation rules apply) be awarded pursuant to a Fair and Open or a Non-fair and Open process, both of which are defined by law; and WHEREAS, the Borough of South River has determined to solicit proposals of qualifications for professional services under a Fair and Open Process ; and WHEREAS, the Borough of South River shall also establish criteria for its proposal/qualification evaluation in considering a fair and open contract award. NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by the Mayor and Borough Council of the Borough of South River that the Borough of South River shall proceed
11 PAGE NO. 11 with a notice for solicitation of proposals and qualifications for professional services under a Fair and Open Process for the positions of: Public Defender IT Specialist BE IT FURTHER RESOLVED that each of the proposals that are submitted will be evaluated by the Mayor and Borough Council of the Borough of South River by determining those deemed to be the most advantageous and beneficial to the Borough of South River including the following criteria: a) Experience and reputation in the field; b) Knowledge of the Borough of South River and the subject matter to be addressed under the proposed contract as well as familiarity with the Borough of South River and its procedures as well as its ongoing matters; c) Availability to accommodate any required meetings of the agency; d) Such other factors, if demonstrated, to be in the best interest of the Borough of South River BE IT FURTHER RESOLVED that the Borough Clerk shall utilize the attached Public Notice and have the same placed on the Borough website or such other location as determined by the Mayor and Council to be appropriate permitting receipt of proposals and qualifications for a period of not less than 10 days. BE IT FURTHER RESOLVED, that upon receipt of said proposals and qualifications by the Borough Administrator the same shall be reviewed for compliance with the criteria aforesaid and provided to the Borough Clerk for the appropriate appointments to be made by the Mayor with the advice and consent of the Borough Council pursuant to statute. Alai s prior vote. Discussion: Clm. Sapata stated he does not understand what the confusion was on 1/1/17; a motion was made to appoint Tara Auciello as Prosecutor and Clm. Alai voted yes. Clm. Alai stated it was a mistake on his part, first time sitting on dais, will never happen again, he realized it as soon as he did it. stated all are entitled to a mistake, Clm. Alai made it clear at meeting that he wanted to rectify vote. Clm. Sapata stated it was brought to our attention at end of meeting on 1/1/17. Roll Call Vote (to withdraw Clm. Councilman Gurchensky seconded the motion. Discussion: stated he is a good friend of Tara Auciello; there is a language barrier; important to have a bilingual prosecutor; will vote no. Mayor Krenzel noted that Ms. Auciello speaks some Spanish. Clm. Sapata stated Ms. Auciello has served the borough well.
