1 D R A F T REGULAR MEETING OF THE MARIN COUNTY BOARD OF SUPERVISORS HELD TUESDAY, JULY 22, 2003, AT 10:10 A.M. PRESENT: SUPERVISORS Susan L. Adams, Harold C. Brown, Jr., Steve Kinsey, Cynthia L. Murray, Annette Rose, President 1. BOARD OF SUPERVISORS' MATTERS In Memoriam [Memoriam] At the request of Supervisor Adams, M/s Adams-Kinsey, to determine that the need to take action arose subsequent to the agenda being posted. M/s Adams-Kinsey, to adjourn the meeting in memory of Dr. Rafael G. Dufficy, Jr., a fourth generation San Rafael resident, and a long time Marin physician. At the request of Supervisor Adams, M/s Adams-Murray, to determine that the need to take action arose subsequent to the agenda being posted. M/s Adams-Murray, to adjourn the meeting in memory of Lester Roth, a long time bank personnel administrator, and a member of the Marin County Personnel Commission. Association of Bay Area Governments ("ABAG") [Agencies: ABAG] Supervisor Adams reported that the ABAG Regional Planning Committee will soon begin to work on the California Department of Housing and Community Development ("HCD") housing elements, and further reported that the public can now register at for the new lease-purchase home ownership program. CSAC Health Care Principles [Agencies: CSAC] Supervisor Adams stated that she attended a meeting of the California State Association of Counties ("CSAC") working group regarding healthcare expansions and noted that a final revised draft of healthcare principles was approved. In Memoriam [Memoriam] At the request of Supervisor Brown, M/s Brown-Kinsey, to determine that the need to take action arose subsequent to the agenda being posted. M/s Brown-Kinsey, to adjourn the meeting in memory of Marc Oldham, a long time San Anselmo resident and activist. USA Patriot Act [Bills/Legislation] Supervisor Kinsey stated that the Justice Department has completed an internal review of FBI activities since the passage of the USA Patriot Act, and stated that the Justice Department found numerous violations of civil liberties which the agency will soon make public. 2 Mary Ann Gallardo's Retirement [Administrator] Supervisor Rose announced the retirement of Mary Ann Gallardo and thanked Ms. Gallardo for her 37 years of service to the citizens of Marin County. Ms. Gallardo thanked the Board and staff for their support. 2. ADMINISTRATOR'S REPORT 3. OPEN TIME The Administrator offered no report at this time. No member of the public addressed the Board at this time. 4. CONSENT CALENDAR A ("Consent Calendar A" reflects those agenda items that have prior policy approval from the Board and do not exceed $500,000 in cost.) At Supervisor Rose's request, Item CA-1b was pulled from Consent Calendar A for consideration separately following Consent Calendar A. M/s Murray-Adams, to approve: CA-1. Board of Supervisors: [Commendations] a. Request from Supervisor Murray to adopt a resolution honoring the Archdiocese of San Francisco on the occasion of their 150 th Anniversary. b. This item was pulled from the Consent Agenda and heard after Consent Calendar A. CA-2. Community Development Agency: [CDBG] a. Request to authorize President to execute HOME Investment Partnerships Program agreement with Citizens Housing Corporation, in the amount of $325,000, for the development of the Fireside Housing. b. Authorize President to (i) execute Release of Assignment of Proceeds and Lien for the Community Development Block Grant ("CDBG") funding provided in 1982 to the Marin Senior Coordinating Council, Inc. to purchase the Whistlestop North Senior Center; and (ii) authorize staff to execute any related documents in conjunction with the recovery of CDBG funds in relation to the sale of the Whistlestop North property. CA-3. County Clerk: [Elections] Request to adopt the following two resolutions appointing nominees to terms on the Retirement Board of Marin County Employees - Retirement Association, pursuant to Government Code section 31523: (a) Resolution No directing the Clerk to cast a unanimous ballot for Joseph A. Coffrini, Eighth Member-Retired ; and (b) Resolution No directing the Clerk to cast a unanimous ballot for Allen A. Haim, Alternate Member-Retired. CA-4. Health and Human Services: [Employment and Training] Authorize President to execute the Low Income Flexible Transportation ("LIFT") grant funding agreement, in the amount of $211,218, with the Metropolitan Transportation Commission ("MTC") to fund transportation services prioritized in the Board-approved Marin County Welfare to Work Transportation Plan (2002). Human Resources: Authorize President to execute First Addendum to agreement with Burke, Williams & Sorensen, increasing original agreement amount from $15,000 to $30,000, for a special investigation. Public Works: a. Request to accept the report of the award of contract for the Emergency Operations Center ("EOC")/Communications Center Office Remodel Project made by the Public Works Director on July 3, 2003, to Nema Construction in the total amount of $176,000. (Project No. C443 Office Walls) [Project No. C443 Office Walls] b. Authorize President to (i) execute Notice of Completion for the Novato Library circulation desk remodel and book return project; (ii) approve final payment in the amount of $9,329.84; (iii) approve release of retention in the amount of $20, days after Board action to Rose Construction. (Project No. L101) [Project No. L101] c. Request to waive the formal bidding procedure and approve sole source purchase from Cogent Systems, Inc. South Pasadena, CA, for ten Livescan workstations and the extended annual maintenance option, in the total amount of $293,865, for use by the Marin County Sheriff's Department related to the Cogent Automated Palm & Fingerprint Identification System ("APFIS"). d. Request to waive the formal bidding procedure and approve sole source purchase from Silverado Avionics of Napa, CA for the purchase of a Modular Intelligent Interconnect System, in the total amount of $42,433.50, for use by the Marin County Office of Emergency Services. REQUEST FROM SUPERVISOR ROSE TO ADOPT A RESOLUTION COMMENDING WALT BILOFSKY UPON HIS RECOGNITION BY THE BAY AREA AIR QUALITY MANAGEMENT DISTRICT ("BAAQMD") AS A CLEAN AIR CHAMPION [Commendations] M/s Kinsey-Murray, on behalf of Supervisor Rose, to adopt resolution honoring Walt Bilofsky upon his recognition as a Bay Area 2003 Clean Air Champion. Supervisor Rose read and presented the resolution to Mr. Bilofsky, and thanked him for his dedication and hard work specifically in the area of smoke-free environments and anti-smoking legislation. Mr. Bilofsky expressed gratitude to the Board members. 5. PRESENTATION BY THE COUNTY ADMINISTRATOR OF THE "ANNUAL REPORT: LIVING WAGE ORDINANCE" [Administrator] By letter dated July 22, 2003, County Administrator Mark Riesenfeld submitted his report and recommendations on the above-captioned matter. Mr. Riesenfeld introduced Administrative Analyst Dan Eilerman who briefly summarized the initial Annual Report on the Living Wage Ordinance ("LWO") stating that the ordinance was incorporated into the County's standard contract agreement and that the County Administrator has acted as an advisor to department staff and to contracting vendors over the past year. Mr. Eilerman reported that the largest group of employees impacted by the LWO was the In-Home Supportive Services ("IHSS") home care provider group and further reported that the Department of Health and Human Services should be commended given the number of contracts processed and the span of the department's contracted services. Supervisor Kinsey thanked staff stating that this report relates the value of a Living Wage Mr. Riesenfeld stated that the LWO report will be modified with information regarding the Marin County Library contract stating that: a) The new classification of Library Branch Aide I and II and Library Tech Aides I and II wage increases cost the Library approximately $75,000 annually; and b) Janitorial contracts for the branch libraries may increase by $25,000 annually when renewed. M/s Kinsey-Murray, to accept the Living Wage Ordinance Annual Report as modified. 6. REQUEST FROM THE DIRECTOR OF HEALTH AND HUMAN SERVICES TO AUTHORIZE PRESIDENT TO EXECUTE AN AGREEMENT WITH MARIN GENERAL HOSPITAL FOR AN OB/GYN HOSPITALIST PROGRAM; AND ADOPT RESOLUTION AUTHORIZING PROVISION OF MEDICAL MALPRACTICE INSURANCE COVERAGE FOR THE PROGRAM [Hospitals] By letter dated July 22, 2003, Health and Human Services Director Larry Meredith submitted his report and recommendations on the above-captioned item. Dr. Meredith briefly summarized the success of the OB/GYN Hospitalist program in Marin County, thanked staff, and introduced Dr. Robert McGinnis from Marin General Hospital who expressed how important the OB/GYN Hospitalist program quality of care has been to the hospital and residents of Marin County. Thereafter, M/s Murray-Adams, to: a.) b.) Authorize the President to execute a FY contract agreement with Marin General Hospital for the OB/GYN Hospitalist program; and Adopt Resolution No authorizing provision of medical malpractice insurance coverage for the OB/GYN Hospitalist Program. 7. REQUEST FROM THE COMMUNITY DEVELOPMENT AGENCY TO AUTHORIZE THE PRESIDENT TO EXECUTE HOME INVESTMENT PARTNERSHIPS PROGRAM AGREEMENT WITH THE MARIN CONTINUUM OF HOUSING AND SERVICES FOR PHASE II OF THE HAMILTON TRANSITIONAL HOUSING [Community Development Block Grant] Pursuant to recommendation of Community Development Coordinator Roy Bateman in his letter dated July 22, 2003, M/s Murray-Brown, to authorize the President to execute a HOME Investment Partnerships Program agreement with the Marin Continuum of Housing and Services, in the amount of $1,375,000, for Phase II of the Hamilton Transitional Housing at the former Hamilton Army Air Field, Novato, California (Accounts 1998/1999/2000/2001/ ). 8. APPOINTMENTS Marin Women's Commission M/s Adams-Murray, to appoint Janet McAllister to the vacancy representing District 3 due to the resignation of Dale Wheeler. Marin County BOS Minutes 4 7/22/2003
5 The Board recessed at 10:41 a.m. to meet as the Rush Creek Landscape and Lighting District Board of Directors, and the Marin County Redevelopment Agency Board of Commissioners and reconvened as the Board of Supervisors at 10:46 a.m. All Supervisors were present. The Board recessed at 10:47 a.m. to meet in closed session. 11. CLOSED SESSION [Parks] The Board met in closed session at 11:45 a.m. to continue discussion regarding appointed Department Head evaluation (Director of Parks, Open Space and Cultural Services) pursuant to Government Code Section The Board recessed at 1:30 p.m. and reconvened in open session at 1:40 p.m. All Supervisors were present. The President reported that the Board met in closed session and advised that there was no announcement at this time. RE: ADJOURN TO BUDGET HEARINGS The meeting was adjourned at 1:41 p.m. to the budget hearings, in memory of Dr. Rafael G. Dufficy, Jr., Lester Roth, and Marc Oldham.
