5 CITY COUNCIL WORKSHOP March 5, :00 P.M. MINUTES Location: Bonney Lake Justice & Municipal Center, 9002 Main Street East, Bonney Lake, Washington. I. CALL TO ORDER: Mayor Neil Johnson Jr., called the workshop to order at 6:00 p.m. II. ROLL CALL: Administrative Services Director/City Clerk Harwood Edvalson called the roll. In addition to Mayor Johnson, Jr., elected officials attending were Deputy Mayor Randy McKibbin, Councilmember Terry Carter, Councilmember Justin Evans, Councilmember James Rackley, Councilmember Michelle Surdez, Councilmember Dan Swatman, and Councilmember Tom Watson. Staff members in attendance were City Administrator John Vodopich, Administrative Services Director/City Clerk Harwood Edvalson, Police Chief Bryan Jeter, Chief Financial Officer Cherie Gibson, Planning & Building Supervisor Jason Sullivan, Facilities & Special Project Manager Gary Leaf, Deputy City Clerk Sadie Schaneman, and City Attorney Kathleen Haggard. III. AGENDA ITEMS: A. Agenda Modifications: A new agenda item, which was forwarded from Administrative Services Director/City Clerk Edvalson, was presented to the City Council to add to the agenda. Councilmember Watson moved to add AB19-52 to the Agenda. Councilmember Rackley seconded the motion. Motion to add AB19-52 to the Agenda approved 7-0. B. Council Open Discussion: Advertising With Rocks. Councilmember Watson presented to Council a business card that was wrapped in a bag with a rock that is being thrown thru out the City for advertising. He asked that they be contacted and asked to stop due to them being left everywhere and causing trash. Lions4Kids. Councilmember Watson informed Council that there have been several theft attempts at the Lions4Kids House. They have installed cameras and hoping to help prevent more attempts Myers Rd. Councilmember Watson brought to Council s attention the debris in the yard at 7603 Myers Road. He is asking that something be done. Planning & Building Supervisor Sullivan let Council know that a request for action has never been filled out and that code enforcement will look into the problem. Agenda Packet P.5 of 25
6 Kanany Property. Councilmember Watson asked for an update on the Kanany property. There have been complaints placed that the owner is still letting people live on the property after going to court over this exact issue. Planning & Building Supervisor Sullivan explained that code enforcement has investigated the properties but there is no evidence of a separate address for mail or cooking facilities. Community Summit Dinner. Councilmember Watson reminded Council about the Community Summit dinner on March 19, 2019 and there is still time to sign up and attend. There will be great speaker and acknowledgements. Councilmember Swatman agreed that the dinner will be fantastic and the topics are really good this year. Public Safety Committee. Councilmember Swatman would like the Public Safety Committee to look into any future ideas for the 410 East and Myer Road. Intersection to help with safety. Tree Dedication. Councilmember Evans attended the Tree Dedication for Officer Larsen on March 3, He thanked the Chief and everyone else that put the memorial together. C. Review Of Council Minutes: February 19, 2019 City Council Workshop and February 26, 2019 City Council Meeting. Councilmember Watson said that he reviewed the minutes of February 19, 2019 City Council Workshop and February 26, 2019 City Council Meeting and had no corrections. The draft minutes were forwarded to the March 12, 2019 Meeting for approval. D. Discussion: AB19-19 Ordinance D19-04 Introduction To And Use Of Form Based Codes (WPLUP Project Phase III). Planning & Building Supervisor Sullivan reviewed with Council AB19-19 Ordinance D19-04 Introduction To And Use Of Form Based Codes (WPLUP Project Phase III). He went over the different codes and what they reference to within the city. Planning has been working with Planning Commission and Design Commission since August Councilmembers asked questions and discussed concerns about changing the code for zoning. Panning & Building Supervisor Sullivan answered all concerns and presented the other Council Workshop dates for the rest of the code updates with the final code adoption being presented on June 25, E. 7 February 13, He explained that all the bids came in over the estimated cost and the City would like to find ways to cut costs that will bring in new bids closer to the estimated cost. C. Agenda Modifications: None. D. Announcements, Appointments and Presentations: None. II. PUBLIC HEARINGS, CITIZEN COMMENTS & CORRESPONDENCE: A. Citizen Comments: Bonnie Hargate, representing the Ridge at Lake Tapps Homeowner s Association (HOA), asked the City Council for clarification regarding an HOA s permission to contract for snow removal from the City streets within their HOA neighborhoods. She said it was quite some time before the City crews were able to plow their streets after the last major snow event and residents desired quicker relief. Mayor Johnson said he will discuss it with staff and respond to Ms. Hargate. Lauren Murphy, the senior librarian representing the Bonney Lake Library, spoke about the library district s public reading program for the year. She also announced the library started a book club on the last Thursday of the month at 5 p.m. and invited participants to read the scheduled book and join in the discussions. Agenda Packet P.9 of 25
10 Correspondence: None. III. COUNCIL COMMITTEE REPORTS: A. Finance Committee: Deputy Mayor McKibbin reported the Committee met earlier in the afternoon. He said they received an update on Personnel actions, reviewed their Committee notes from their last meeting and approved some accounts receivable write-offs. B. Community Development Committee: Councilmember Swatman said the CDC met on March 5 th and moved forward most of the items on their agenda to this evenings Council meeting on the Consent Agenda. He said one exception Resolution 2727 which appears under the Full Council section of tonight s Council agenda to allow for review and possible comment by the full Council. He said the Committee also received a report on right-of-way procedures and the point when it would be appropriate to involve the City Council in those considerations. C. Public Safety Committee: Councilmember Evans said the Committee met today at 3:30 p.m. He said the Committee discussed a proposed domestic violence program through the Court. He reported the Committee received an update from East Pierce Fire & Rescue who will be hiring 6 additional firefighters in June. The Bonney Lake Police Department said they have a new officer starting on March 16 th with another officer anticipated to start in June. He said other discussion included flashing speed limit and cross walk signs, pan handling and boating noise. He noted the Committee also forwarded items to the Consent Agenda on this evening s Council meeting. D. Other Reports: None. IV. CONSENT AGENDA: A. 13 City of Bonney Lake, Washington City Council Agenda Bill (AB) Department/Staff Contact: Executive / John Vodopich Agenda Item Type: Public Hearing Meeting/Workshop Date: 26 March 2019 Ordinance/Resolution Number: 2734 Agenda Bill Number: AB19-56 Sponsor: Agenda Subject: Declaring Surplus Properties and Authorizing Sale of Properties Full Title/Motion: A Resolution Of The City Council Of The City Of Bonney Lake, Pierce County, Washington, Declaring Surplus Property And Authorizing The Sale Of Such Property In Accordance With Bonney Lake Municipal Code Section Administrative Recommendation: Approve Background Summary: The City acquired the Reed Farm, Smith, and Compass Pointe properties using utility funds. The Reed Farm was acquired in April 2010 (Resolution 2026) as a potential source of water rights for $1,060,000 utilizing Water SDC funds. Exploratory investigations did not result in sufficient quantities of water to warrant pursuing a water right on the property. The Compass Pointe property was acquired in November 2013 (Resolution 2349) in order to further implement the development of a new Public Works Center for $1,000,000 using, in part utility funds. The adjoining Smith property was acquired in April 2016 (Resolution 2521) to acquire additional land for the new Public Works Center for $460,000 utilizing water funds. The City has now chosen the Peaking Storage tank site off of 96th as the location for the new Public Works Center and these properties are no longer needed for that use. When land acquired for public utility purposes is deemed surplus to the City s needs and is not required for providing continued public utility service, the City Council may by resolution and after a public hearing cause such land to be sold. The resolution shall state the fair market value or consideration to be paid and such other terms and conditions for such disposition as the Council deems to be in the best public interest (BLMC D.). The total combined acquisition cost of these properties was $2,520,000 and the combined assessed valuation of these properties is $3,309,500. 15 RESOLUTION NO A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BONNEY LAKE, PIERCE COUNTY, WASHINGTON, DECLARING SURPLUS PROPERTY AND AUTHORIZING THE SALE OF SUCH PROPERTY IN ACCORDANCE WITH BONNEY LAKE MUNICIPAL CODE SECTION and WHEREAS, the Reed Farm was acquired as a source of a potential water right; WHEREAS, the Smith and Compass Pointe properties were acquired for development of a new Public Works Center; and WHEREAS, the Reed Farm, Smith, and Compass Pointe properties as described on Exhibit A attached hereto have been determined to be surplus to the ongoing needs of the City; and WHEREAS, as required by RCW and BLMC D, a duly noticed public hearing on the proposed surplus and disposal of the properties was held on March 26, NOW THEREFORE, the City Council of the City of Bonney Lake, Washington, do hereby resolve that: 1. The described properties listed in Exhibit A, attached hereto and incorporated herein as if fully set forth, are hereby declared surplus to the City s continuing needs and are not required for public service; and 2. The Mayor is authorized to obtain market value appraisals of the properties, to advertise the properties for sale, and to receive offers of purchase, which shall be brought before the Council for consideration. WHEREAS, Officer James Larsen not only served the Bonney Lake community for many years as a Law Enforcement Officer, he also made significant contributions to the City s parks system through construction of several ancillary park features; and WHEREAS, Officer Larsen tragically passed away in March of 2018; and WHEREAS, The City Council is charged with naming parks and recreation facilities after receiving a written recommendation from the Bonney Lake parks board (BLMC ); and WHEREAS, The City Council received a written recommendation on March 5, 2019 from the Parks Commission to name the stage at Allan Yorke Park the Officer James Larsen Stage.
