3 EXHIBIT NO. 1 CHAPTER Beekeeping as Accessory Use in all Zoning Districts A. The keeping of honeybees; of the species Apis mellifera, only, and associated beehives, shall be an accessory use to any principal permitted use in any zoning district, provided a beekeeping permit is obtained from the City of Hamilton Planning Department and the bees and beehives are maintained as set forth herein. Beekeeping permits will be subject to approval only after a 45 day waiting period to allow for notification of all property owners and tenants within 100-ft of the property on which the bees will be kept. Any property owner or tenant notified who can provide documentation from an allergist for a serious medical reaction to honeybee stings may file an objection to the issuance of a permit, with the City of Hamilton Planning Department within 30 days the date on the notification letter. The Planning Director or his/her appointee shall review any objections and determine if it constitutes a legitimate reason for refusal and render an appropriate decision. Appeals to decisions of the Planning Department regarding the approval or denial of a beekeeping permit will be heard by the City of Hamilton Board of Zoning Appeals (BZA) after the appropriate appeal and fees are submitted. B. In addition to the requirements herein, each beehive shall be registered and maintained as required with the Ohio State Department of Agriculture, as set forth in the Ohio Revised Code Chapter 909: Apiaries. C. Beehive to land ratio: No beehive shall be kept on any property less than 2,500 square feet in area. One (1) beehive may be maintained on a lot of 2,500 sq-ft and one additional beehive for every additional 2,000 sq-ft of lot area to a maximum of five (5) beehives per property. D. Location and setbacks: No beehive shall be kept closer than ten (10) feet to any lot line. No beehive shall be placed within twenty (20) feet of any public sidewalk, alley or roadway. Rooftop beehives shall be set back six (6) feet from the edge of a roof. E. Signage: A minimum of one (1) sign minimum size of 1 sq. ft., but no larger than 4-sqft., shall be placed near the gate in any fence enclosing the area where the beehives will be placed or, if no fence, in a prominent location where it will be seen by anyone entering the property. F. Fences: A "flyway barrier", extending at least two feet above the beehive entrance shall be placed along the side of the beehive that contains the entrance to the beehive, and shall be located within six (6) feet of the beehive and shall extend at least two (2) feet on either side of the beehive. No such flyway barrier shall be required if the lot area where the beehives are located is enclosed by a solid fence at least six (6) feet in height. G. Maintenance: Colonies shall be maintained in movable frame beehives with adequate space maintained in the beehives to prevent overcrowding and swarming. If beehives are not maintained in good repair and in accordance with the plans submitted and approved per the beekeeping permit will result in the revocation of said permit without remuneration or refund of permitting fees. H. Prohibitions: No Africanized bees may be kept in the City of Hamilton. I. Fees: There shall be a fee of $20.00 submitted with any beekeeping permit application. If, at any time after the initial permit is issued, additional beehives are added to the property a new application and fee will be required.

If a beehive or beehives are relocated to another property within the City of Hamilton, a new permit is required for the new property. K. Plans required with application for beekeeping permit: Site plan of the subject property to include the following information: North orientation arrow and drawing scale information Property/lot lines and dimensions drawn to scale Street locations and names All building, fencing, locations including setback dimensions to all property lines Location and number of beehives and water source (if applicable) and the distance they are located from property lines and buildings on adjoining properties. Description, photos or other material showing type and dimensions of beehives, and any flyway barrier. Proof of current registration with the State of Ohio Agricultural District.

AN ORDINANCE AMENDING THE SECTION OF THE CODIFIED ORDINANCES OF THE CITY OF HAMILTON, OHIO, RELATIVE TO INSECT AND RODENT HARBORAGE OUTSIDE AND REPEALING SAID EXISTING CODIFIED ORDINANCE SECTION THEREOF. WHEREAS, should City council amend the zoning ordinance to allow Apiaries as an accessory structure, the City of Hamilton Health Department recommends that Section be amended to create a specific exemption for bees; and WHEREAS, the result of this change will reflect similar terminology between the City of Hamilton s Health and Zoning chapters; and WHEREAS, the City of Hamilton planning department will be responsible to ensure compliance with this new zoning chapter; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Hamilton, Ohio: SECTION I: That the section of the Chapter 1700 of the City of Hamilton s codified ordinance be amended to be read as set forth Exhibits No 1 attached hereto, incorporated herein by reference and made a part hereof. SECTION II: This ordinance shall take effect and be in full force from and after the earliest period allowed by law after its passage. 7 CHAPTER 157 Hamilton Youth Commission Purpose Establishment Appointment Term Duties Meetings PURPOSE. The Hamilton Youth Commission shall provide a responsive and proactive voice for the youth of the community, and further grant to them the opportunity to secure and maintain a formal role in planning the future of the City by participating in the decision-making process for the growth and development of the community on those issues of importance to them and impacting upon their lives. (Ord Passed ) ESTABLISHMENT. There is hereby created and established the Hamilton Youth Commission which shall serve in an advisory capacity to Council, the City Manager, and the Administration. The Youth Commission shall be composed of sixteen (16) nine members, each of whom shall be a resident of Hamilton and shall be either a sophomore, junior or senior attending either a high school within the corporate limits of the City or outside the corporate limits of the City. The members of the Youth Commission shall designate, by simple majority vote, a Chair and Vice-Chair for the Commission. (Ord Passed XX-XX-XX.) APPOINTMENT. (a) The City Manager, the Board of Education of the Hamilton City School District, and every member of Council shall each appoint one two (2) members to the Youth Commission. In the event any member of Council resigns or is replaced during his/her elected term of office, his/her Commission appointee shall remain a member of the Commission for the duration of the term for which he/she was originally appointed. Each student to be considered for appointment must be preparing to enter his/her sophomore, junior, or senior year in high school. Effort will be made to have adequate representation from various neighborhoods in the City and different racial, social, economic and demographic groups. Except for the original appointments to the Youth Commission and thereafter, each student to be considered for appointment must be preparing to enter his/her junior year in high school. (b) Applications for membership on the Commission shall be announced, advertised and available in the same manner as those for all City boards, committees, and commissions. City Council Members and the City Manager may remove their Commission appointees. The initial appointments to the Youth Commission for the year 1999 shall be made as follows: (1) The Mayor, Vice-Mayor, City Manager and the Board of Education of the Hamilton City School District shall each appoint a member to the Youth Commission who is entering his/her junior year and who shall serve a term of two years; and

8 (2) Each of the remaining five members of Council shall appoint a member to the Youth Commission who is entering his/her senior year in high school and who shall serve a term of one year. (c) All subsequent appointments to the Youth Commission shall be made as follows: (1) In the odd-numbered years, the Mayor, Vice-Mayor, City Manager and the Board of Education of the Hamilton City School District shall each appoint a member to the Youth Commission who is entering his/her junior year and who shall serve a term of two years; and (2) In the even-numbered years each of the remaining five members of Council shall appoint a member to the Youth Commission who is entering his/her junior year in high school and who shall serve a term of two years. Each member of the Youth Commission shall serve without compensation for a term of two one years, with each term commencing on the first day of June oand terminating on the thirtyfirst day of May the following year.f first year of their term and terminating on the thirty-first day of May of the second year of their term. Members are eligible to serve up to three terms, but must reapply and be selected each year. For those members of the Youth Commission serving as the initial appointees and appointed by the five members of Council as set forth in Section (b)(2), their term shall end May 31, (Ord Passed XX-XX-XX ) DUTIES. (a) The Youth Commission shall review issues and plan initiatives of interest to the youth of the City and which impact upon their lives, shall make recommendations to Council and the Administration on such issues, and shall bring forth any suggestions for the implementation of programs, procedures, or activities to assist the Commission in addressing and resolving such issues. (b) The City Manager shall designate one or more individuals an individual to serve as the municipal administrative representative within the Administration who shall advise and facilitate the Youth Commission in carrying out its duties and responsibilities as set forth herein (hereafter Advisor(s) ).. All other directors, chiefs, and administration shall render any assistance and cooperation, or provide any information requested by the Youth Commission which can be made readily available to it, in order to facilitate the accomplishment of its duties. The City Administration and City Council shall recommend to the Commission for its review and recommendations any item it may deem to be of interest to the youth of the community. (Ord Passed XX-XX-XX.) Passed ) MEETINGS. The Commission shall determine the time and place of its meetings but shall in any event meet at least four (4) times per year. The meetings will be open to the public in accordance with

9 Section of the Ohio Revised Code and Section 3.03 of the City of Hamilton Charter. Additional meetings may be called by the Commission Chair as deemed necessary with at least twenty-four (24) hours prior notice thereof given to all members of the Commission and to the public. The Commission shall make its own rules and regulations related to the operation of the Commission and keep minutes of its meetings. A majority of the members shall be a quorum for the transaction of business. Decisions of the Commission shall be made by a majority vote of those members present. Any member of the Commission failing to attend three (3) consecutive meetings, or four (4) meetings within one year, without excuse acceptable to and approved by the Commission Advisor(s), shall be removed as a member of the Commission. The Youth Commission shall meet on the first Wednesday of each month at a time and place as may be established by the Rules of the Youth Commission. Additional meetings may be called by the Commission Chair as deemed necessary with at least twenty-four (24) hours prior notice thereof given to all members of the Commission and to the public. All meetings shall be open to the public and shall comply with open meeting requirements. The Commission shall also adopt rules for the conduct of its meetings and the cancellation of its meetings. A simple majority of members of the Commission shall constitute a quorum. Any actions or recommendations of the Commission must be approved by a simple majority of those present. Any member of the Commission failing to attend three (3) consecutive meetings, or four (4) meetings within one year, without excuse acceptable to and approved by the Commission, shall be removed as a member of the Commission.
