1 TOWNSHIP OF DENNIS DENNISVILLE, NJ SEPTEMBER 12, :30 P.M. (PREVAILING TIME) TWP. COMMITTEE REGULAR MEETING The Mayor opened the meeting in compliance with the Open Public Meetings Act requirements. The Mayor requested that the roll call and flag salute be carried over from the Work Session Meeting (Salimbene, Tozer, Fry-DeRose and Matalucci present, Smith was absent). The Mayor asked if there were any comments on the consent agenda. Carol Donovan of Academy Lane in Ocean View, questioned the placement of a tower at the golf course on Kings Highway. Committeeman Tozer indicated that he believes that it is an application going before the Land Use Board and commented on the tower. The Township Solicitor commented on differences between the tower which is for cell service and the nodes which would be for Wi-Fi. There was a general discussion of the tower helping with the communications issue. There being no further comment, the Mayor asked for a motion adopting the consent agenda, motion was made by Salimbene, seconded by Tozer, with 4 ayes and 1 absent (Smith), that the consent agenda be adopted. The following resolution numbers thru were a part of the Consent Agenda: RESOLUTION NO RESOLUTION AUTHORIZING THE LEAVE OF ABSENCE FOR A PUBLIC WORKS EMPLOYEE WHEREAS, the Clerk has received a request from a Township Employee for a leave of absence; and WHEREAS, Randy A. Grant, Sr. has requested a leave of absence for a medical condition ; and WHEREAS, said leave would be effective on or about 08/23/2017 and would end on October 23, 2017 with Mr. Grant returning to work on October 24, 2017; and WHEREAS, the leave of absence shall run concurrent with a leave under the provisions of the Family Leave Act for the balance of eligible time with the remainder being that of general leave of absence. NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Dennis, County of Cape May, State of New Jersey, that a leave of absence be granted for Randy A. Grant, Sr. effective on or about August 23, 2017 through October 23, BE IT FURTHER RESOLVED, that a leave under the Family Leave Act will be granted for a portion of the leave not to exceed the Federal and State provisions of the Act. BE IT FURTHER RESOLVED, that the Clerk is hereby authorized and directed to file the necessary paperwork with the N.J. Civil Service Commission.

2 RESOLUTION NO RESOLUTION AUTHORIZING THE EXECUTION OF A PROMISE OF INDEMNIFICATION WITH THE COUNTY OF CAPE MAY FOR THE TEMPORARY PLACEMENT OF HOLIDAY WREATHS ABOVE PETERSBURG ROAD AND MAIN STREET IN DENNISVILLE WHEREAS, the Township has requested that the County of Cape May permit temporary placement of holiday wreaths on utility poles above portions of County Route 610 (Petersburg Road and Main Street) in Dennisville; and WHEREAS, the Holiday Wreath Project would last approximately November 17, 2017 thru January 12, 2018; and WHEREAS, the Township has been notified by the County Engineer that the County requires the Township to execute a Promise of Indemnification in order to process our request. NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Dennis, County of Cape May, State of New Jersey, that the Mayor and Clerk are hereby authorized and directed to execute the Promise of Indemnification so that the County of Cape May can approve the temporary placement of Holiday Wreaths above a portion of County Route 610 (Petersburg Road and Main Street) in Dennisville. BE IT FURTHER RESOLVED, that a certified copy of this resolution shall accompany the executed Promise of Indemnification to the County Engineer s Office. RESOLUTION NO RESOLUTION AWARDING THE BID FOR THE BICYCLE PATH AND PARKING AREA PROJECT WHEREAS, Lindemon Contracting, LLC, of Cape May Court House, NJ. Submitted the lowest bid for Constructing Bicycle Path and Parking Area adjacent to the Dennisville Recreation Complex on September 7, 2017, and whose low bid amounted to $185,829.25, and WHEREAS, the Township Engineer has reviewed the bids and recommends the award to said low bidder, and WHEREAS, the Dennis Township Committee desires to proceed with the project and award a contract for said work. NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Dennis that the contract for Constructing Bicycle Path and Parking Area adjacent to the Dennisville Recreation Complex is awarded to Lindemon Contracting, LLC. for the bid amount of $185, BE IT FURTHER RESOLVED, that the Presiding Officer is directed to sign and the Clerk is directed to attest to said contract on behalf of the Township of Dennis. BE IT FURTHER RESOLVED, the Clerk is in receipt of the Certificate of Availability of Funds for this award from the Chief Financial Officer.

3 RESOLUTION NO.: A RESOLUTION OF THE TOWNSHIP OF DENNIS, COUNTY OF CAPE MAY AND STATE OF NEW JERSEY AWARDING A PROFESSIONAL SERVICE CONTRACT TO JOHN C. GIBSON, P.E. FOR THE ENGINEERING SERVICES ASSOCIATED WITH THE RECONSTRUCTION OF WESCOTT ROAD IN DENNIS TOWNSHIP, CAPE MAY COUNTY, NEW JERSEY. WHEREAS, John C. Gibson, P.E. is the Engineer for the Township of Dennis; and WHEREAS, the Township Committee believes it is in the best interests of the municipality to reconstruct Wescott Road in Dennis Township; and WHEREAS, John C. Gibson, P.E. has submitted a proposal, a copy of which is attached hereto as Exhibit A, in an amount not to exceed $32, NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Dennis, in the County of Cape May and State of New Jersey, that a Contract be and the same is hereby awarded to John C. Gibson, P.E. as a Professional Services Contract, in an amount not to exceed $32,000.00, for the reconstruction of Wescott Road in Dennis Township, New Jersey. BE IT FURTHER RESOLVED that the Municipal Clerk be and is hereby authorized and directed to publish in the official newspaper of the Township a copy of this Resolution. The following Ordinance No was introduced for first reading as part of the Consent Agenda: TOWNSHIP OF DENNIS, NEW JERSEY ORDINANCE NO ORDINANCE OF THE TOWNSHIP OF DENNIS, COUNTY OF CAPE MAY, NEW JERSEY CANCELING CERTAIN FUNDED APPROPRIATION BALANCES HERETOFORE PROVIDED FOR CAPITAL IMPROVEMENTS AND REAPPROPRIATING SUCH FUNDED APPROPRIATION BALANCES FOR OTHER CAPITAL PROJECTS BACKGROUND WHEREAS, the Township of Dennis, County of Cape May, New Jersey ("Township"), duly and finally adopted Bond Ordinances and (collectively, the "Bond Ordinances"); and WHEREAS, the Township, having decided to pursue improvements other than those originally authorized in the Bond Ordinances, has a remaining balance in total of $50,000.00;

4 WHEREAS, the Township is desirous of canceling and reappropriating certain funded balances to provide supplemental funding for the rehabilitation and/or replacement of the roof at both the Township Municipal Building and Senior Center. NOW, THEREFORE, BE IT ORDAINED BY THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF DENNIS, COUNTY OF CAPE MAY, NEW JERSEY (NOT LESS THAN TWO-THIRDS OF ALL THE MEMBERS THEREOF AFFIRMATIVELY CONCURRING), PURSUANT TO THE PROVISIONS OF THE LOCAL BOND LAW, CHAPTER 169 OF THE LAWS OF 1960 OF THE STATE OF NEW JERSEY, AS AMENDED AND SUPPLEMENTED ("LOCAL BOND LAW"), AS FOLLOWS: Section 1. The following appropriations remaining as a balance in the Bond Ordinances heretofore adopted by the Township are hereby cancelled: Ordinance Amount of Funded Appropriation to be Cancelled Amount of Unfunded Appropriation to be Cancelled A , Section 2(a) $10, $0.00 B , TOTAL $50, $0.00 Section 2. The sum of $50,000.00, which represents the funded appropriations cancelled in Section 1 hereof, is hereby reappropriated to provide supplemental funding for the rehabilitation and/or replacement of the roof at both the Township Municipal Building and Senior Center ("Improvements"). Section 3. The period of usefulness of the Improvements referred to in Section 2, within the limitations of the Local Bond Law and according to the reasonable life thereof, is not less than fifteen (15) years. Section 4. The Capital Budget is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency therewith, and the resolution promulgated by the Local Finance Board showing full detail of the amended Capital Budget and Capital Program as approved by the Director of the Division of Local Government Services, is on file with the Township Clerk and available for inspection. Section 5. The Improvements authorized hereby are not current expenses and are general improvements that the Township may lawfully make. No part of the cost of the Improvements authorized hereby has been or shall be specially assessed on any property specially benefited thereby. Section 6. All ordinances, or parts of ordinances, inconsistent herewith are hereby repealed to the extent of such inconsistency. Section 7. after final passage. 5 The foregoing Ordinance was introduced at a meeting of the Township Committee of the Township of Dennis on September 12, Publication will be held on September 15, 2017 and a Public Hearing will be held at a meeting of the said Township Committee to be held on September 26, 2017 at 6:30 p.m. in the Municipal Building located at 571 Petersburg Road in Dennisville. 7 Tax Collector s Report July, 2017 Construction Official s Report August, 2017 Chief Finance Officer s Report July, 2017 Engineer s Report 09/12/2017 The Mayor asked if there were any comments from the public this evening, let the record reflect that there were none. The Mayor asked for comments from the Township Committee. Committeewoman Salimbene gave an update on the County Bike Path. She indicated that the Municipal Alliance is having their next meeting on 9/21. Committeewoman Salimbene commented on the big tree at the Museum and the need for an arborist. Committeeman Tozer recommended contacting Jack Connolly from the Dennisville Historic Home Owners Association. She updated everyone on the Friends of the Old School House Museum. She shared that the DTEA Pride Committee supplied snacks from the students and staff to our First Responders for recognition. She also commented on the Student Government fundraiser for the Humane Society and thanked everyone for coming. Committeeman Tozer shared that the MUA is having an issue with recyclables being put in plastic bags and advised everyone not to do so. Deputy Mayor Fry-DeRose commented the Christmas Parade coming up on December 7 th and asked for volunteers. Mayor Matalucci thanked Committeewoman Salimbene and the Staff at the School and indicated that his kids are excited to be back. He reminded everyone of the Flu Clinic at the Senior Center scheduled for October 18 th. Motion was made by Tozer, seconded by Salimbene, that the meeting be adjourned.
