1 TOWNSHIP OF DENNIS DENNISVILLE, NJ JULY 24, :00 P.M. (PREVAILING TIME) TWP. COMMITTEE REGULAR MEETING The Mayor opened the meeting in compliance with the Open Public Meetings Act requirements. The Mayor requested that the roll call and flag salute be carried over from the Board of Health Meeting (VanArtsdalen, Elisano, Fry-DeRose and Matalucci present, Turner was absent). The Mayor asked if there were any comments on the consent agenda. There being no comment, the Mayor asked for a motion adopting the consent agenda, motion was made by VanArtsdalen, seconded by Elisano, with 4 ayes and 1 absent (Turner), that the consent agenda be adopted. The following resolution numbers thru were a part of the Consent Agenda: RESOLUTION NO RESOLUTION CERTIFYING REVIEW OF ANNUAL AUDIT WHEREAS, N.J.S.A. 40A:5-4 requires the governing body of every local unit to have made an annual audit of its books, accounts and financial transactions, and WHEREAS, the Annual Report of Audit for the year 2017 has been filed by a Registered Municipal Accountant with the Municipal Clerk pursuant to N.J.S.A. 40A:5-6, and a copy has been received by each member of the governing body; and, WHEREAS, R.S. 52:27BB-34 authorizes the Local Finance Board of the State of New Jersey to prescribe reports pertaining to the local fiscal affairs; and, WHEREAS, the Local Finance Board has promulgated N.J.A.C. 5:30-6.5, a regulation requiring that the governing body of each municipality shall by resolution certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit entitled Comments and Recommendations, and, WHEREAS, the members of the governing body have personally reviewed as a minimum the Annual Report of Audit, and specifically the sections of the Annual Audit entitled Comments and Recommendations, as evidenced by the group affidavit form of the governing body attached hereto; and, WHEREAS, such resolution of certification shall be adopted by the Governing Body no later than forty-five days after the receipt of the annual audit, pursuant to N.J.A.C. 5:30-6.5; and, WHEREAS, all members of the governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board, and WHEREAS, failure to comply with the regulations of the Local Finance Board of the State of New Jersey may subject the members of the local governing body to the penalty provisions of R.S. 52:27BB-52, to wit:

2 R.S. 52:27BB-52: A local officer or member of a local governing body who, after a date fixed for compliance, fails or refuses to obey an order of the director (Director of Local Government Services), under the provisions of this Article, shall be guilty of a misdemeanor and, upon conviction, may be fined not more than one thousand dollars ($1,000.00) or imprisoned for not more than one year, or both, in addition shall forfeit his office. NOW, THEREFORE BE IT RESOLVED, That the Township Committee of the Township of Dennis, hereby states that it has complied with N.J.A.C. 5: and does hereby submit a certified copy of this resolution and the required affidavit to said Board to show evidence of said compliance. Matalucci, Mayor RESOLUTION NO APPOINTING A MUNICIPAL HUMANE LAW ENFORCEMENT OFFICER WHEREAS, the new Animal Cruelty Enforcement Law, P.L c. 331 (the New Law ) was signed into law on January 16, 2018; and WHEREAS, the new Animal Cruelty Enforcement Law revises the enforcement of animal cruelty laws in the State of New Jersey by transferring the power of humane law enforcement from the New Jersey Society for the Prevention of Cruelty to Animals (NJSPCA) and county societies for the prevention of cruelty to animals to a county prosecutor animal cruelty task force in each county, and a municipal humane law enforcement officer in each municipality; and WHEREAS, the new Law requires the governing body of each municipality to appoint at least one municipal humane law enforcement officer, who is responsible for the animal welfare within the jurisdiction of the municipality, and who is to enforce and abide by the animal cruelty laws of the State and the ordinances of the Township; and WHEREAS, the Township Committee deems it prudent to appoint Det. Desirae Kramer #7644 and Det. Ken Drake #7195 with the New Jersey State Police Woodbine Barracks to serve as the primary and secondary Municipal Humane Law Enforcement Officer for the Township of Dennis. NOW, THEREFORE, BE IT RESOLVED, by the governing body of the Township of Dennis, County of Cape May, State of New Jersey, that Det. Desirae Kramer #7644 and Det. Ken Drake #7195 with the New Jersey State Police Woodbine Barracks are hereby appointed to the position of primary and secondary Municipal Humane Law Enforcement Officer for the Township of Dennis. Matalucci, Mayor RESOLUTION NO RESOLUTION AMENDING THE TERM OF THE PART-TIME TAX COLLECTOR WHEREAS, Resolution No appointed the part-time Tax Collector for an unexpired term ending 12/31/2018 due to the retirement effective 05/31/2018 of the tenured Tax Collector; and WHEREAS, the retiring Tax Collector had tenure which requires the appointment for a full four (4) year term and not an unexpired term.

3 NOW THEREFORE BE RESOLVED, by the Township Committee of the Township of Dennis, that this governing body does hereby appoint Lisa Garrison as the part-time Tax Collector for the term of four (4) years effective 06/01/2018 and said appointment will be for a maximum of 8 hours per week at the rate of $35.00 per hour. ATTEST ATTEST RESOLUTION NO RESOLUTION HIRING A FULL-TIME ASSISTANT CHIEF FINANCE OFFICER WHEREAS, the Chief Finance Officer is retiring effective 08/01/2018; and WHEREAS, the Township Committee believes it best to bring a replacement in prior to the retirement to starting learning the working of the office; and WHEREAS, the statutes allow for only one Chief Finance Officer at a time thereby necessitating the Township to hire the replacement as an Assistant Chief Finance Officer; and WHEREAS, the Administrator has received applications and conducted interviews and made his recommendation to the Committee. NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Dennis, that this governing body does hereby hire Jessica M. Bishop of 29 Pine Tavern Road, Elmer, NJ as the full-time Assistant Chief Finance Officer effective 07/25/2018 at the rate of $34.88 per hour. The Mayor asked for a motion authorizing the payment of the bills, providing that proper vouchers have been filed and that funds are available. Motion made by Fry-DeRose, seconded by VanArtsdalen, all in favor and the motion carried, that the following Administrative Reports were adopted: Engineer s Report 07/24/2018 The Mayor asked if there were any comments from the public this evening. Let the record reflect that there were no comments from the public. The Mayor asked for comments from the Township Committee.

5 Committeeman VanArtsdalen indicated that August 7 th is our National Night Out starting at 6:30 p.m. with free pretzels for the first 500 and other food available for purchase, live music and fireworks at dusk. Committeeman Elisano indicated that he had no comment at this time. Deputy Mayor Fry-DeRose indicated that she had no comment at this time. Mayor Matalucci commented on efforts to obtain upgraded communication equipment for the Fire Companies such as 700 megahertz radios to improve communication in the more rural areas. He indicated that a company will be supplying some radios for a test period to see if they improve the issues. Mayor Matalucci and OEM Coordinator, John Berg, commented on the radios and stated that they will be dual band. Township Administrator, Pat Moran, clarified the hiring of the full-time Assistant CFO. He stated that she did receive a Rice Notice and commented on the transition Motion was made by Elisano, seconded by Fry-DeRose, that the meeting be adjourned. All in favor and the motion carried.
