9 3.2 Conflicts with other Committees Title Procedure n Pol. Group Control of the 2015/0269 (COD) acquisition and Main: IMCO possession of weapons (Firearms) Directive (PT/PC) State of Play With a letter of the LIBE committee requested its association to the report under Rule 54, claiming in general responsibility on illicit trafficking in firearms and combatting terrorism. The letter is not making reference to concrete provisions of the Commission's proposal. Directive on the approximations of the laws, regulations and administrative provisions of the Member States as regards the accessibility requirements for products and services (TSN/BH) Contract rules for the supply of digital content and contract rules for online and other distance sales of goods (MD/BL) 2015/0278 (COD) Main: IMCO 2015/0287 (COD) Main: IMCO/JURI (rule 55) 2015/0288 (COD) Main: IMCO The Chair discussed the matter with the LIBE Chair on Tuesday 15 December, discussions between the two secretariats continued and IMCO secretariat sent a proposal on 14 January. LIBE replied with a counter-proposal for an agreement to which the IMCO Chair reacted and an agreement was reached on the basis of Rule 54. Following the referral of the proposal to IMCO, on January 18, EMPL requested the joint committee procedure (Rule 55) with IMCO. Furthermore, TRAN and PETI asked for association under Rule 54. An agreement has been reached with PETI on the basis of 53 (simple opinion). Letters have been sent to the CCC regarding the requests from TRAN and EMPL. CoP decision expected by 14 April or 4 May. The two files have been referred to IMCO on 21 January On 24 February a meeting of the IMCO/JURI chairs called by the CCC Chair delivered a negotiated outcome allocating the proposal to IMCO as lead in the sales of goods file with JURI associated under Rule 54 (shared competences) for the entire proposal, and, as for to the digital content file, to grant IMCO and JURI joint PV\ doc 9/22 PE v02-00

10 responsibility under Rule 55 on an equal footing. On 1 March, the majority of IMCO Political Groups endorsed this negotiated outcome which was agreed by JURI on 2 March and validated by the CoP meeting on 14 April. Portability of online content services in the internal market (DA/BL) Regulation on the approval and market surveillance of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles (CM/TSN) COM(2015) /284 (COD) Main: JURI 2016/0014 (COD) Main: IMCO Together with the digital content (2015/287(COD)) and online sale of goods (2015/288(COD)) files, this file was referred to IMCO on 21 January. On 24 February a meeting of the IMCO/JURI Chairs called by the CCC Chair delivered a negotiated outcome allocating the proposal to JURI as lead with IMCO associated under Rule 54 (shared competences) for the entire proposal. On 1 March, the majority of IMCO Political Groups favoured this negotiated outcome which was agreed by JURI on 2 March. On 28 January, CULT requested to be associated under Rule 54 on the entire proposal. Following IMCO's refusal, on 23 March, JURI proposed to restrict its association with share competence only on Art. 2(e) and Art. 4 both as far as the Audio-Visual Media Directive is concerned. The CCC on 12 April will examine if an agreement has been reached and the overall package is to be validated by the CoP meeting on 14 April. Following the referral to IMCO, VI and TRAN have asked for association under rule 54, with both exclusive and shared competence. Letters have been sent to the CCC regarding these requests. INTA and IMCO secretariats exchanged proposals on the division of competences endorsed by the INTA and IMCO Chairs and Rapporteurs respectively. 18 8.2 Delegation to Slovakia Coordinators agreed to cancel the IMCO Mission to Slovakia in case there are no additional Members to be announced to the secretariat by Friday 22 April at noon, Coordinators also agreed to discuss future the current model of missions to Presidencies as it was stressed that either there should be a visit to all of them or to none.
