Commissioner Josi asked what the original value ofthe sirens had been. Mr. Manning said $3.5 million. Commissioner Josi then asked what he had paid for them. Mr. Manning said $1.00. ITEM NO.2: PUBLIC COMMENTS - NON-AGENDA ITEMS: Update on Tsunami Sirens: Mr. Manning said he had met with the contractor that day and the equipment that needed to be installed had been purchased. It should be up and running by the time ofthe next test. Tillamook County would be the first jurisdiction in the State to be tsunami ready. Chair Hurliman reviewed the history ofmr. Manning's obtaining the sirens and putting the system together for about $10,000. Commissioner Labhart said Mr. Manning deserved a lot ofcredit and it was commendable ofhim. He asked what had happened recently with the sirens on the Trask River. Mr. Manning said those sirens did not have an automatic shut down, and at the last test, they ran for ten minutes and had to be manually turned off. That problem had now been corrected. ITEM NO.3: OVERVIEVV OF PACIFIC CITYINESTUCCA VALLEY CHAMBER OF COMMERCE ACTIVITIES: Mr. Olson thanked the Commissioners for the opportunity to speak at the meeting. He said the Chamber in Pacific City had been around since the 1950s and the Nestucca Valley Chamber since the 1980s. Both groups had merged two years previously. The recently hired a part-time staffperson to manage the Chamber. Mr. Olson said there was $120 million to $140 million in new money in the area. He reviewed the new housing developments that were under construction or in the planning phase and the new businesses that had started recently. They had worked with Hebo on the water system upgrade. He said the Nestucca School District was going on the ballot in May for a construction bond for a new

He talked about the proposed rest stop 2 and turnouts on Highway Mr. Olson said there would be a Chamber program on tsunamis in the spring and he invited Mr. 5 Manning to participate. The Birding & Blues festival was the coming weekend, and he listed other 6 upcoming events. 7 8 Commissioner Labhart mentioned the booth the group had at the Sportsman's show in Portland. Mr. 9 Olson said their booth was well-positioned and they had handed out a lot ofbrochures. He said the 10 Chamber's meeting were the first Tuesday ofeach month at noon at the Central Building in Pacific 11 City; the program meetings were at 7:00 a.m. at the Hudson House ITEM NO.4: DISCUSSION CONCERNING POSSIBLE APPLICATION FOR A 14 COMMUNITY DEVELOPMENT BLOCK GRANT BY CEDAR CREEK CHILD CARE 15 CENTER: Ms. Emerson said she was one of the founding members of the Center and on the 16 original Board ofdirectors. She reviewed the history ofthe Center and its use ofthe U.S. Forest 17 Service house. She detailed the work that had been done on the Family Foundation property in 18 Hebo. They would like to build a facility that was made to be a day care center, and not have to 19 retrofit Commissioner Josi explained the history ofthe land swap that enabled the Nestucca Valley Family 22 Foundation to get it. He explained what a Community Development Block Grant (CDBG) was and 23 said the only counties and cities could apply for one Ms. Emerson introduced Ms. Skaar as the finance person from CARE and Ms. Elder, who was the 26 Chair ofthe Center's Board Commissioner Labhart said the Board had been briefed at the Monday Staff Meeting by Ms. 29 Goodman on what a CDBG was. He felt there was no better way to spend taxpayers money than to 30 build a daycare center Commissioner Josi said the CDBGs were based on the need ofthe community and the income data. 33 Ms. Emerson said they had done two income surveys and they met the requirement that 51 % oftheir 34 clients were low to moderate income level Commissioner Josi moved to enter into a partnership with the Cedar Creek Child Care Center and 37 apply for a Community Development Block Grant/Commissioner Labhart seconded, passed with 38 three aye votes ITEMNO. 5: CONSIDERATION OF ORDERAPPOINTING THE COUNTY TREASURER 41 AS THE BUDGET OFFICER FOR THE SOLID WASTE SERVICE DISTRICT: 42 Commissioner Josi said State law required that budget officers be appointed for the County and the 43 service districts. He moved to sign the order, Commissioner Labhart seconded, passed with three

3 Wednesday, February 16,2005 Page 3 1 aye votes. 2 3 The Commissioners signed Order #05-18, Solid Waste Service District Order # ITEM NO.6: CONSIDERATION OF ORDER APPOINTING THE DIRECTOR (TROY 6 DOWNING) OF THE 4-H & EXTENSION SERVICE DISTRICT AS THE BUDGET 7 OFFICERFORTHE DISTRICT: Commissioner Labhart moved to sign the order, Commissioner 8 Josi seconded, passed with three aye votes The Commissioners signed Order #05-19, 4-H & Extension Service District Order # ITEM NO. 7: CONSIDERATION OF NOTICE OF INTENT TO AWARD A CONTRACT 13 FOR COMPUTER PURCHASE: Counsel Sargent reviewed the history of the order. 14 Commissioner Labhart asked the Chair iflocal contractors had been contacted, and the Chair said 15 they had been CommissionerJosi movedto signthe order, CommissionerLabhart seconded, passedwiththree aye 18 votes The Commissioners signed Order #05-20, noticing the intent to award a contract to Computer 21 Technology Link ITEM NO. 8: CONSIDERATION OF LETTER TO OREGON'S CONGRESSIONAL 24 DELEGATION IN SUPPORT OF AN ADDITIONAL APPROPRIATION REOUEST FOR 25 FUNDING TO CONNECT THE WATER SYSTEMS OF BAY CITY AND THE CITY OF 26 TILLAMOOK FOR USE IN EMERGENCY SITUATIONS: Mr. Reiersgaard said Tillamook 27 City, Bay City and the Creameryhad beenworking on this. The two cities had adjacent water lines 28 but they were not connected. Joining them would allow for sharing of resources. They had the 29 design ready to go, butthey did not have the money to construct it. The construction cost last year 30 was estimated to be $500,000. The cost was to be split between the two cities, with the Creamery 31 paying for the design Mr. Reiersgaard said they had heard from Rep. Hooley's office that there were funds available for 34 this project, as it was related to disaster preparedness Commissioner Josi was concerned that this was outside ofthe regular process where projects were 37 prioritized annually. He said doing this would undermine the regular process. He suggested 38 contacting Rep. Hooley's office and getting more information and basing the letter on that. This 39 project would not be associated with the regular request for funding Commissioner Labhart asked why the had not come forward before and been part ofthe regular 42 process. Mr. Vining said they were not that far along with the plan at the time. 43

He wanted them 2 to take the correct steps. 3 4 Commissioner Labhart said he supported the project, and he had been in contact with the Tillamook 5 City Manager,Mark Gervasi. Commissioner Labhart expressed his reservation about adding another 6 appropriation request outside ofthe normal process. 7 8 Mr. Reiersgaard said the process was a good system. He suggested they get more information so 9 they could more clearly articulate where the money was coming from and whether they were the 10 same funds. He could then come back to the Board at another meeting Mr. Vining said the combined water systems could supply drinking water to most ofthe County Commissioner Labhart said they were supportive ofthe project but they had to be true to the process ITEM NO.9: BOARD CONCERNS - NON-AGENDA ITEMS & ANNOUNCEMENTS: a. 17 Review of Board of Commissioners' Letter to U.S. Fish & Wildlife regarding Snowy Plover 18 Regulations: Chair Hurliman reviewed the history ofthe issue. Copies ofthe letter were distributed 19 to the audience. He said the Board was working to keep the County beaches open. The letter 20 addressed the concerns the Board had about the proposed regulations Commissioner Labhart reviewed the letter and the four main points. He said the letter had been sent 23 and hopefully they now have some impact Commissioner Josi summarized the Oregon Coastal Zone Management Act, which required 26 consistency with the County's Comprehensive Plan b. Discussion Concerning Scheduling Champion Health Presentation: Chair Hurliman said this 29 was an item that would normally be discussed at a StaffMeeting, but due to conflicting schedules, 30 all three Commissioners would not be at a meeting together until March Commissioner Josi said Champion Health was interested in taking over the Health Department, and 33 they had asked to make a presentation to the Board at a Wednesday meeting. He wanted to have the 34 presentation in the evening so people could more easily attend. The Board could then take the matter 35 under consideration after that Commissioner Labhart said all three Commissioners had met individually with representatives of 38 Champion Health's Board. He asked them a number ofquestions and they had provided the answers. 39 They would be asking Mr. Levesque to scheduled them. He believed in efficiency, so they should 40 be allowed to present their ideas and make their presentation. He did not know what would happen 41 next. He believed the Board should listen to them Chair Hurliman said he would just as soon not hear the presentation. He had seen a copy ofthe

5 Wednesday, February 16,2005 PageS proposal. He reviewed his reasons why he did not want to schedule the proposal. Commissioner Josi moved to direct staff to schedule a presentation by Champion Health in the evening, beginning at 6:30 p.m., Commissioner Labhart seconded. Commissioner Josi said this was a politically charged issue. The Board was concerned that the services be provided in the best possible way. There were also a number of Tillamook County employees who would be affected by this. Motion passed with two aye votes; Chair Hurliman voted nay. The Chair recessed the meeting at 7:30 p.m. for an Executive Session, pursuant to ORS (1)(h) to discuss possible litigation. At 8:00 p.m. he reconvened the regular meeting. ITEM NO.9: BOARD CONCERNS - NON-AGENDA ITEMS: Commissioner Josi said the Board needed to discuss the armory property project. Several years ago the property had been deeded to CARE with a deadline of completing the project by a certain date, or the property ownership would revertto the County. The deadline had come and gone. He suggested the matter be discussed at the next StaffMeeting when all three Commissioners could be present. ITEM NO. 10: PUBLIC COMMENTS: There were none.
