1 City of Beaver Dam, Wisconsin COMMON COUNCIL PROCEEDINGS MONDAY, AUGUST 20, 2018 The regular meeting of the Common Council was called to order at 8:00 p.m. by Mayor Becky Glewen. Present: Abfall, Anderson, Appenfeldt, Ballweg, Burnett, Doyle, Fischer, Hansen, Henriksen, Loizzo, Morgan, Nelson, Olson, 13. Absent and Excused: Davidson, 1. PLEDGE TO FLAG/SILENT DELIBERATION Sarah Botham, of Botham, Ink., appeared to give a presentation on the branding, and the new logo and tagline, for the City. Ms. Botham reviewed the timeline of getting to the presentation this evening, and the ideas that go into a brand. The City is looking to attract young couples and families, recent graduates, business owners, real estate developers and retirees to make Beaver Dam their home. The logo design was described, as it is the identifier of the brand. She then unveiled the new logo and took questions from the audience and Council. Dona Wininsky, representing the American Lung Association, appeared to discuss amending the City s smoking ordinance in regards to electronic nicotine delivery systems, and distributed information on the same to alderpersons. Because the first reading of Ordinance on tonight s agenda addresses this, her presentation was paused and she was invited back on September 17 when the ordinance gets it second reading and public hearing. Julie Maree and Michelle (inaudible) appeared encouraging the City to support dogs in its parks. Instead of people are traveling outside of Beaver Dam to allow their dogs to socialize with other pets, as well as people which is currently the case, this would bring more people to our parks. The mayor thanked them for appearing and noted that the issue would be brought through the proper channels to ultimately let the Council decide. Mayor Glewen reviewed a lengthy list of announcements: National Night Out was a success and a special thanks to Chuck Stangl for his effort on that event. The Beaver Dam Pepper Festival will be September 8 at Park Village Mall. The Patriot Tour homecoming will also be September 8 at Swan Park, with the parade at noon and the ceremony at 1:00 p.m. Fiesta Beaver Dam will be at Swan Park on September 15 from 11:00 a.m. to 4:00 p.m. and volunteers are still needed. Alliant Energy announced the new Beaver Dam Commerce Park on August 9. Downtown Beaver Dam, Inc., will be meeting with WDEC for strategic planning on August 27. Middle and high school art teachers, along with Wayland art leaders, are meeting to collaborate on an arts district downtown. More information will be forwarded as it is developed. Special thanks to Mary Morgan, Kay Appenfeldt, and Jon Abfall for their hard work at the Dodge County Fair. Right now there is a K-9 Fundraiser in the City, started with a $5,000 donation from Tom and Judy Heffron. Meeting are ongoing with the taxi company, non-profits, and other leaders to discuss the ongoing and increasing needs, and decreasing funding, of transportation. Mayor Glewen attended the WI League of Municipalities Executive conference on Thursday, August 16, where the Dark Store issue continues to be a major topic. Dodge County has received a prevention grant, and thanked Dan Doyle for his work on the committee along with the mayor. Tree and alley work will be starting downtown soon. Jam by the Dam will be Friday, August 24. Spring Brook Farms will be holding a Red Cross Blood Donation Lawn Party on Saturday August 25 from 10:00 a.m. to 3:00 p.m. Rechek s Food Pride will be holding a Blue Zones event on August 29 at 7:00 p.m. to include a grocery giveaway. Henriksen noted that a Protect Waterway Sweep will be held on September 8 at Patrick Parker Conley Park. The mayor then added that an outside group is interested in adopting the river and more details will be announced as they become available. Motion by Morgan, second by Olson, to dispense with the reading and approve the minutes of the August 6, 2018, meeting of the Common Council, and accept them as officially recorded into the records in the City Clerk s office, carried by acclamation. There were no communications this evening. RESOLUTION NO A RESOLUTION APPROVING THE ATTACHED BRANDING DESIGN AND LOGO FOR THE CITY OF BEAVER DAM WHEREAS, the City of Beaver Dam proposes to create a design and logo for the City of Beaver Dam to promote its recreation, healthy living, and sense of community in the City of Beaver Dam; and WHEREAS, funds are available in the 2018 Budget in the Marketing and Tourism Account. NOW, THEREFORE, BE IT RESOLVED that the City of Beaver Dam approves the attached design and logo for the City of Beaver Dam. RESOLUTION NO A RESOLUTION APPROVING AN ENERGY SAVINGS CONTRACT AND LEASE OF PREMISES AGREEMENT BETWEEN THE CITY OF BEAVER DAM AND BEAVER DAM SOLAR, LLC WHEREAS, on May 7, 2018 the Common Council approved resolution adopting the 25x25 State goals for energy independence and becoming an energy independent community and; WHEREAS, the intent of the aforementioned resolution was for the City to implement energy saving projects and invest in renewable energy systems and; WHEREAS, the City is proposing to install solar energy arrays on both City Hall and the Watermark facility and install LED lighting in several City Buildings to help achieve the goals adopted in resolution and; WHEREAS, the attached Energy Savings Contract and Lease of Premise Agreement will allow the City to fund these projects with minimal up-front City investment. NOW THEREFORE BE IT RESOLVED, that the Common Council of the City of Beaver Dam does hereby approve the attached Energy Savings Contract and Lease of Premise Agreement between the City of Beaver Dam and the Beaver Dam Solar, LLC and the appropriate City officials are hereby authorized to execute said agreement on behalf of the City of Beaver Dam. Kurt Reinhold, of Legacy Solar Co-Op, and Doug Stingle, of North Wind Renewable Energy Cooperative, appeared to discuss the contract and lease being acted on, and answered questions from the Council. After continued discussion, the preceding resolution was adopted by the following roll call vote: Ayes: Morgan, Nelson, Olson, Abfall, Appenfeldt, Doyle, Hansen, Henriksen, Loizzo, 10. RESOLUTION NO A RESOLUTION AWARDING THE CONTRACTS FOR THE LIGHTING AND SOLAR PROJECTS AT BEAVER DAM CITY HALL AND THE WATERMARK WHEREAS, the Operations Committee of the Common Council of the City of Beaver Dam, Wisconsin did advertise and receive sealed bids for the captioned contractual service; and WHEREAS, three (3) bids were received and are on file in the City Engineering Department Office; and WHEREAS, three different companies have been awarded the three contracts for LED lighting, the solar portions, and the consultant for the project financing; and WHEREAS, the City of Beaver Dam will pay up front costs of $ paid to the tax financing Limited Liability Company (counterparty to contract). The $ will be paid from the Solar Energy Project Account and the balance will be paid from a combination of Focus on Energy Grant Funds and Private Investment through the Legacy Solar Co-Op. NOW, THEREFORE, BE IT RESOLVED that the contract for LED lighting is awarded to E3 LIGHTING, the contract for the solar portions is awarded to NORTH WIND RENEWABLE ENERGY COOPERATIVE, and the consultant for project financing is awarded to, LEGACY SOLAR CO-OP, pursuant to the attached proposals. RESOLUTION NO COMMON COUNCIL RESOLUTION APPROVING CREATION OF TAX INCREMENTAL FINANCE DISTRICT NO. 8 CITY OF BEAVER DAM, WISCONSIN WHEREAS, the City of Beaver Dam desires to promote development, job growth, infrastructure improvements, and broaden the property tax base in the designated area of Tax Incremental Finance District No. 8; and
3 WHEREAS, pursuant to sec , Wisconsin Statutes, the Plan Commission, City of Beaver Dam, Dodge County, Wisconsin has held a public hearing on the proposed Project Plan and Tax Incremental Finance District No. 8 (herein "Project Plan" and District ) on July 25 th, 2018 after notice as required by law; and WHEREAS, prior to publication of notice of said public hearing, a copy of the notice was sent by first class mail to the chief executive officer or administrator of the Beaver Dam School District, Moraine Park Technical College, and Dodge County; and WHEREAS, after the public hearing was held the Plan Commission recommended adoption of the Project Plan by resolution, subject to the approval of the Common Council; and WHEREAS, the Project Plan, which is attached to this Resolution and incorporated herein by reference, meets all of the following requirements of sec , Wisconsin Statutes, to wit: A. Includes a statement listing the kind, number and location of all proposed public works and improvements within such District; and B. Contains an economic feasibility study; and C. Contains a detailed list of estimated project costs; and D. Contains a description of the methods of financing, all estimated project costs, and the time when such costs or monetary obligations related thereto are to be incurred; and E. Includes maps showing boundary of the District, existing land use, zoning, future land use, and proposed improvements of real property in such District; and F. Includes proposed changes, if any, in zoning ordinances, master plan, map, building codes, and City ordinances; and G. Contains a list of estimated non-project costs; and H. Contains a statement of the proposed method for the relocation, if any, of persons to be displaced by District projects; and I. Contains a statement indicating how creation of the District promotes the development of the City; and J. Includes an opinion of the City Attorney advising that the Project Plan is complete and complies with sec , Wisconsin Statutes. WHEREAS, the Common Council makes the following findings: 1. The name of the District shall be Tax Increment Finance District #8, City of Beaver Dam, a mixed-use district; and 2. The boundaries of the District are described in the attached Project Plan that is incorporated by reference, and such boundaries are contiguous and of sufficient definiteness to identify with ordinary and reasonable certainty the territory included therein. Boundaries include only those whole units of property that are assessed for general tax purposes. The boundaries of the District do not include annexed territory that was not within the boundaries of the City within the last three years; and 3. The boundaries of the District will overlap a portion of existing Tax Increment Finance District #4, City of Beaver Dam; and 4. The creation date of the District for purposes of determining the expenditure and termination periods shall be the date upon which the City Council approves a resolution adopting the Project Plan. For purposes of allocating tax increment the creation date shall be January 1, 2018; and 5. Not less than 50% of the real property in the District is suitable for mixed-use development, as defined under State Statute (2)(cm); and 6. Newly platted residential development, as defined under Wis. Stat , will not exceed 35% of the real property area in the District; and 7. The City will only allow tax increment revenue to be spent on newly platted residential development in the District if one of the following three applies: Density of the residential housing is at least three (3) units per acre, or Residential housing is located in a conservation subdivision, as defined in sec (1)(a), Wis. Stats., or Residential housing is located in a traditional neighborhood development, as defined in sec (1)(c), Wis. Stats. 8. The estimated percentage of territory within the District that will be devoted to retail business at the end of the maximum expenditure period is estimated to be 50 percent of the area of the District; and 9. The improvement of such area is likely to enhance significantly the value of substantially all other real property in the District; and 10. The project costs directly serve to promote orderly development consistent with the purposes for which the District is created; and 11. The equalized value of the taxable property of the District plus the aggregate value increment of all existing districts within the City does not exceed 12% of the total value of equalized taxable property within the City; and 12. The Project Plan for the District is feasible; and 13. Improvements to the District are likely to encourage and promote conformity with the City s planning policies and procedures; and 14. The development described in the Project Plan would not occur, or would occur to a lesser extent, without the creation of TID #8. NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Beaver Dam, Dodge County, Wisconsin hereby approves and adopts the Project Plan for Tax Incremental Finance District No. 8 and creates Tax Incremental Finance District No. 8, said Project Plan being attached and incorporated by reference. BE IT FURTHER RESOLVED, that the Common Council does recommend the Project Plan for adoption by the Joint Review Board for the City of Beaver Dam, Dodge County, Wisconsin. Presented by the Plan Commission Per Plan Commission Resolution Dated July 25, 2018 Andrew Bremer of MSA appeared with an overview of the TIF. The preceding resolution was adopted by the following roll call vote: Ayes: Olson, Abfall, Appenfeldt, Ballweg, Burnett, Doyle, Fischer, Hansen, Henriksen, Loizzo, Morgan, Nelson, 12. RESOLUTION NO A RESOLUTION ENDORSING THE BLUE ZONE PROJECT PRACTICES IN THE CITY OF BEAVER DAM WHEREAS, the City of Beaver Dam ( City ) recognizes the need for its citizens to live in a community that is safe, livable, walkable, bikeable, environmentally independent, and health conscious; and
4 WHEREAS, for the City to achieve a Blue Zone Community Designation a community must implement two Core Best Practices in Transportation, two core Best Practices in Land Use, five best practices from the Core Best Practices Menu or Additional Best Practices Menu, and must complete a marque project which creates a visible change to the built environment (see Core Best Practice Menus attached hereto); and WHEREAS, with regard to the two required Core Best Practices in Transportation: 1. The City adopts and implements a Complete Streets Policy and Trained Key Players. 2. The City adopts and implements an Active Transportation Plan. 3. The City will adopt and implement a Safe Routes to School Master Plan. WHEREAS, with regard to the two Core Best Practices in Land Use: 1. The City will implement a Parking Master Plan to Better Manage Parking. 2. The City adopts and implements a Parks, Open Space, Outdoor Recreation Plan and Natural Systems Plan. WHEREAS, with regard to the five Additional Best Practices from the Core Best Practices Menu: 1. The City will implement a Safety Education Campaign for All Road Users. 2. The City has a Joint-Use-of-Facilities Agreement. 3. The City has a Land Use Vacancy Strategy. 4. The City will implement a Treescape Master Plan. 5. The City will implement a Bicycle Master Plan. 6. The City will implement a Beverage and Food Vending Machine Standards Policy. 7. The City will amend its ordinances to prohibit electronic nicotine delivery systems (ENDS) in all taverns and restaurants. WHEREAS, the City will adopt and implement, as its Built Enviromment Marquee, the Downtown Project implementing vibrant plantings, trees, building rehabilitation, etc. NOW, THEREFORE, BE IT RESOLVED that the City of Beaver Dam has complied with or is in the process of complying with all of the required Blue Zone Project initiatives making the City of Beaver Dam a Blue Zone. RESOLUTION NO A RESOLUTION AWARDING THE CONTRACTS FOR 2018 NON-COMPLIANCE SIDEWALK RECONSTRUCTION WHEREAS, the Operations Committee of the Common Council of the City of Beaver Dam, Wisconsin did advertise and receive sealed bids for the captioned contractual service; and WHEREAS, two (2) bids were received for sidewalk reconstruction and one (1) bid was received for sidewalk grinding. Said bids were received and are on file in the City Engineering Department Office. NOW, THEREFORE, BE IT RESOLVED that the contract for said 2018 Non-Compliance Sidewalk Reconstruction be and are hereby awarded to the low bidder for the sidewalk reconstruction and the only bidder for the sidewalk grinding as follows: Sidewalk Reconstruction Sidewalk Grinding RENNHACK CONSTRUCTION CO., INC. Reeseville, Wisconsin Pursuant to the bid amount. SAFE STEP, LLC Hortonville, Wisconsin Pursuant to the bid amount. Funds for both projects are available in the Street Repair Account. RESOLUTION NO A RESOLUTION AMENDING THE CITY S DEBT POLICY WHEREAS, the Common Council adopted a City Debt policy on May 3, 2010; and WHEREAS, the Administrative Committee has reviewed the debt policy and is recommending that the following amendments be made to the debt policy: 1. Add the following definition: ERP Percentage The most current General Fund budget percentage increase as allowed under the State Expenditure Restraint Program. 2. Add the following language to the end of section 1 under credit Objectives and Debt Limitations: The CIP borrowing limit shall be adjusted annually by the ERP Percentage.
5 NOW THEREFORE BE IT RESOLVED, that the Common Council of the City of Beaver Dam does hereby approve the afore mentioned amendments to the City s Debt Policy and; BE IT FURTHER RESOLVED, that the CIP borrowing limit for the year 2019 shall be set at $2.0 million and adjusted in future years in accordance with the amended City Debt Policy. Motion by Fischer, second by Ballweg, to amend Resolution to read the borrowing limit to be $1.6 million and the 2017 ERP for the 2018 budget to be approximately $1.65 million, carried by acclamation with 7 Ayes and 6 Noes.
