1 Minutes of a meeting of the Plaquemines Parish Council, as the Sole Governing Authority of the Plaquemines Port, Harbor & Terminal District, held in the Plaquemines Parish Temporary Court Building, 450 F. Edward Hebert Blvd., Belle Chasse, Louisiana, on Thursday, June 11, 2015, at 1:00 p.m., pursuant to notice to all members with a quorum present as follows: PRESENT: Council Member Benedict Rousselle-Chairman Council Member John L. Barthelemy, Jr. Council Member W. Beau Black Council Member Kirk M. There being no Executive Session, Council Member Rousselle moved to Agenda Item 3, Status Report by the Executive Port Director. Without objection, so ordered. General Sanders stated there was no legislation for introduction and other than the Port staff visiting the new Port Building, there was nothing to report. Council Member Rousselle added that negotiations were still on-going pursuant to Non-Disclosure Agreements and he believes good news is coming soon. There being no Bids and Advertisements, no Introductions, no legislation to be voted on and no New Business, Council Member Rousselle moved to Agenda Item 8, Approval of Minutes. Without objection, so ordered. 2 Minutes of a meeting of the Plaquemines Parish Council held in the Plaquemines Parish Temporary Court Building, 450 F. Edward Hebert Blvd., Belle Chasse, Louisiana, on Thursday, June 11, 2015, at 1:07 p.m., pursuant to notice to all members with a quorum present as follows: PRESENT: Council Member Benedict Rousselle-Chairman Council Member John L. Barthelemy, Jr. Council Member W. Beau Black Council Member Kirk M. Lepine Council Member Irvin Juneau Council Member Charlie Burt Council Member Audrey Trufant-Salvant Council Member Jeff Edgecombe Council Member Nicole Williams Kim M. Toups Secretary The Prayer and Pledge of Allegiance were dispensed with. The Parish President was in attendance, along with Mr. Edward P. Theriot, Director of Administration, Mr. Stanley Wallace, Director of Operations, and Rev. Michael Jiles, Director of Public Service. There being no Proclamations, Council Member Rousselle moved to Agenda Item 1c, Status Report by the Parish President. Without objection, so ordered. The President had the directors report on the status of review of fees in their departments. Director of Administration, Mr. Ed Theriot, reported the Legal Department has submitted an ordinance to institute fees for use of Parish Fairgrounds and the pavilion to the Council for review. Also, Legal is now working on the ferry and Health Department fees. Mr. Stanley Wallace, the Director of Operations, reported 247 certified letters have been sent out to people who rent boat slips and to date $17, in past due rental fees has been collected. Rev. Jiles, Director of Public Service gave an update on the Plaquemines Pride which has been at Bollinger since November Currently he is trying to schedule a Coast Guard inspection for either Monday, June 15 or Tuesday, June 16, 2015, and hopefully by June 19 th or the week of June 22, 2015, the ferry will be back in service. President Cormier stated he is hoping to obtain sponsorship from a large company, such as BP, to build and maintain a bridge over the Mississippi River in Plaquemines Parish. He believes this would benefit the both Plaquemines and St. Bernard, as well as, the entire state. A new bridge would alleviate traffic on the Crescent City Connection and provide an additional evacuation route for Plaquemines. If anyone has suggestions regarding this matter the President would be happy to hear them. Council Member Rousselle thanked the Administration for reviewing fees charged by various departments. President Cormier informed the public that, hopefully, by the end of the day money would be allocated by the Legislature to Commissioner Strain for citrus tree spraying in Plaquemines Parish. There being no Bids and Advertisements, Council Member Rousselle moved to Agenda Item 3, Beer and Liquor Licenses. Without objection, so ordered. R E S O L U T I O N NO On motion of Council Member Williams, seconded by Council Member Edgecombe, and on roll call all members present and voting Yes, the following Resolution was adopted: BE IT RESOLVED BY THE PLAQUEMINES PARISH COUNCIL THAT the following applications for permit to engage in the sale of liquor and/or beer only in the Parish of Plaquemines for the year 2015 is hereby approved: Cypress Cove Grill, LLC., Cypress Grill, LLC, 226 Cypress Cove Road, Venice, LA 70091, Class A-Retail Outlet, Class A-Retail Liquor.

3 BE IT FURTHER RESOLVED BY THE PLAQUEMINES PARISH COUNCIL THAT a special event permit is hereby issued to the Buras Volunteer Fire Department for a fireworks show scheduled for July 4, 2015, from noon until 9 p.m. at Fort Jackson. BE IT FURTHER RESOLVED BY THE PLAQUEMINES PARISH COUNCIL THAT that certified copies of this Resolution be forwarded to Sheriff Lonnie J. Greco, Sr., and the Plaquemines Parish Health Department as notice of approval of application for permit. Council Member Rousselle moved to Agenda Item 4, Building Permits. Without objection, so ordered. R E S O L U T I O N NO On motion of Council Member Rousselle, seconded by Council Member Burt, and on roll call all members present and voting AYes@ the following Resolution was adopted: BE IT RESOLVED BY THE PLAQUEMINES PARISH COUNCIL THAT the following applications for construction permits in the Parish of Plaquemines are hereby approved: Eustis Engineering, Application No , dated May 11, 2015, to install seven soil borings, 2500 Block of Engineers Road; Restoration Systems, LLC, Application No , dated May 29, 2015, to dredge the Mississippi River and lay a dredge discharge pipe on the river batture and construct a mitigation bank wetland for the Jesuit Bend Marsh Creation Project, Jesuit Bend. Wyman Construction Company, Application No , dated June 1, 2015, to install a boathouse, Hummingbird Lane, Myrtle Grove Lot 329. Council Member Rousselle asked for deferrals and withdrawals. There were no deferrals; however Agenda Items 6c, A Resolution authorizing the Parish President, or his designee, to terminate the Cooperative Endeavor Agreement between the Plaquemines Parish Law Enforcement District and Plaquemines Parish Government and Item 6d, An Ordinance to amend the 2015 Public Health Fund, Manpower Structure and Operating Expenditure Budget, Health Department, personal services line items; and otherwise to provide with respect thereto were deferred by Council Member Burt. Council Member Rousselle moved to Agenda Item 5, Introduction of Ordinances and Resolutions. Without objection, so ordered. 1. An Ordinance to amend the General Fund, 2015 Operating Expenditure Budget, Buildings Department, Davant Percy Griffin Center and the Five Year Capital Improvements Plan, Signs- East Bank Project and Improvements-Braithwaite Auditorium Project; and otherwise to provide with respect thereto. COUNCIL MEMBER ROUSSELLE 12. An Ordinance approving a plan of re-subdivision of the property Versaland Properties LLC, Belle Chasse, Plaquemines Parish, Louisiana, as shown on the plan of re-subdivision Tract BR-9 into BR-9A and BR-9B, by Tildon J. Dufrene, Jr. registered land surveyor, dated November 11, 2014, the owner having fulfilled the requirements of the Subdivision and Re-Subdivision Ordinance of the Parish of Plaquemines without cost to the Plaquemines Parish Government or the Parish of Plaquemines; and otherwise to provide with respect thereto. COUNCIL MEMBER ROUSSELLE 13. An Ordinance to amend the 2015 Waterworks and Sewerage Fund, Manpower Structure, Waterworks-Billings/Collections Department; and otherwise to provide with respect thereto. A Resolution authorizing the Parish President to accept donations to offset the cost to Plaquemines Parish Government of relocating a certain structure to Grand Bayou for use as a temporary community center; and to otherwise provide with respect thereto. An Ordinance by the Plaquemines Parish Council, as and on behalf of the West Bank Levee District, to appropriate new Perpetual Flood Protection Levee Floodwall and Drainage Ditch Easements in certain portions of lands in Plaquemines Parish, Louisiana to construct the New Orleans to Venice NOV-NF-W-06b.1, Woodpark Floodwalls, Plaquemines Parish, Louisiana for levee, drainage, flood and hurricane protection purposes; and otherwise to provide with respect thereto. 6 ORDINANCE NO The following Ordinance was offered by Council Member Burt who moved its adoption: An Ordinance to amend the Public Health Fund, 2015 Operating Expenditure Budget, Health General Department; and otherwise to provide with respect thereto. WHEREAS, after a review of the 2015 operating budget, it has been determined that there is a need for aerial spraying for citrus farmers in Plaquemines Parish, and WHEREAS, amending the Public Health Fund, 2015 Operating Expenditure Budget, Health General Department by appropriating $40,000 to line Professional Services Aerial Spraying from the General Fund Unreserved/Undesignated Fund Balance is requested; WHEREAS, once funding is received from the state in the amount of $160,000, said funding of $40,000 will be refunded back to the General Fund Unreserved/Undesignated Fund Balance; BE IT ORDAINED BY THE PLAQUEMINES PARISH COUNCIL THAT: SECTION 1 The Public Health Fund, 2015 Operating Expenditure Budget, Health General Department is amended by appropriating $40,000 from the General Fund Unreserved/Undesignated Fund Balance as follows: Fund: 004 Public Health Fund Dept/Div: Health General Object Description Inc/Dec Amendment Prof Services Aerial Spraying Inc $40,000 SECTION 2 The remaining said funds of $120,000 will be dedicated strictly for the aerial spray program. SECTION 3 The Secretary of this Council is hereby authorized and directed to immediately certify and release this Ordinance and that Parish employees and officials are authorized to carry out the purposes of this Ordinance, both without further reading and approval by the Plaquemines Parish Council. WHEREUPON, in open session the above Ordinance was read and considered section by section and as a whole. Council Member Edgecombe seconded the motion to adopt the Ordinance. The foregoing Ordinance having been submitted to a vote, the vote resulted as follows: YEAS: Council Members John L. Barthelemy, Jr., W. 7 Council Member Rousselle reverted back to Agenda Item 6a(1): ORDINANCE NO On motion of Council Member Lepine the following Ordinance was moved for adoption: An Ordinance approving a plan of re-subdivision of the property of David Illg and D&D Illg, LLC., Plaquemines Parish, Louisiana, as shown on Map of Resubdivision, Lots 17A and 18D into Lots 17A-1 and 18D-1, Belle Chasse Section D, by Hugh Mc Curdy, III, P.L.S., dated January 21, 2015, the owners having fulfilled all the Requirements of the Subdivision and Re-subdivision Ordinance of the Parish of Plaquemines without cost to the Plaquemines Parish Government or the Parish of Plaquemines; and otherwise to provide with respect thereto. WHEREAS, David Illg and D&D Illg, LLC., as owners of property situated in the Parish of Plaquemines, State of Louisiana, as shown on Map of Re-subdivision, Lots 17A and 18D into Lot Lots 17A-1 and 18D-1, Belle Chasse Section D, by Hugh McCurdy, III, P.L.S., dated January 21, 2015, a copy whereof is annexed hereto and made part hereof; and WHEREAS, David Illg and D&D Illg, LLC., as owners of said property have proposed the resubdivision of the said property into tracts 17A-1 and 18D-1 as more fully shown on said map; and WHEREAS, David Illg and D& D Illg, LLC., as owners of said property have proposed to return lot 18 D-1, to its original state in The Woodlands subdivision created by Ordinance No dated August 12, 1993 and map is registered in COB 814, Folio 834 in Plaquemines Parish. Meeting the requirement of Ordinance No , adopted April 9, 1998 and Ordinance No.142 revised through No , dated February 12, 2004 meeting the squared footage of lot requirements; and WHEREAS, all streets, utilities, drainage structures and other improvements shown on the aforementioned map of survey are in place; and WHEREAS, the owner/developer understands that he and subsequent owners of the property is responsible for the cost, installation, maintenance or improvements of the sewerage and water infrastructure to connect to the public utilities shown on the aforementioned map; and WHEREAS, the owner/developer understands that he and subsequent owners of the property will be responsible for the maintenance of future and all existing non-dedicated streets, roads, right of ways, utilities, drainage and structures and other improvements shown on the aforementioned plan and plat of survey are in place; and WHEREAS, the Plaquemines Parish Government accepts no responsibility or liability for the construction, maintenance or improvements of any future or now existing non-dedicated streets, roads, right of ways, utilities, drainage structure and other improvements that may be shown on the aforementioned plan and plat of survey; and WHEREAS, the owner/developer and subsequent owners of the property shall be responsible for the construction and maintenance of future and all existing non-dedicated streets, roads, rights of ways, utilities, drainage structures and other improvements that may be shown on the aforementioned plan and plat of survey; BE IT ORDAINED BY THE PLAQUEMINES PARISH COUNCIL THAT: SECTION 1 The aforesaid Map of Re-subdivision, Lots 17A and 18D into Lots 17A-1 and 18D-1, Belle Chasse Section D, by Hugh McCurdy, III, P.L.S., dated January 21, 2015, a copy of whereof is annexed hereto and made a part hereof, be approved, and that the approval of the Parish President, Directors and all appropriate Parish department heads of the aforesaid map of survey ratified.

8 SECTION 2 The Parish President be and is hereby authorized to appear before a Notary Public, and execute the approved aforesaid plan or re-subdivision of owner as depicted on plan and plat of survey by Hugh Mc Curdy, III, P.L.S. January 21, 2015 for the Parish of Plaquemines and the Plaquemines Parish Government, and to execute any and all acts and documents necessary and proper in the premises to give full force and effect to the aforesaid Ordinance. SECTION 3 The Plaquemines Parish Government accepts no responsibility or liability for construction, maintenance or improvements of any future or now existing non-dedicated streets, roads, right of ways, utilities, drainage structures and other improvements that may or may not be shown on the aforementioned plan and plat of survey or later developed. SECTION 4 The Secretary of this Council is hereby authorized and directed to immediately certify and release this Ordinance and that Parish employees and officials are authorized to carry out the purposes of this Ordinance, both without further reading and approval by the Plaquemines Parish Council. WHEREUPON, in open session the above Ordinance was read and considered section by section and as a whole. Council Member Juneau seconded the motion to adopt the Ordinance. The foregoing Ordinance having been submitted to a vote, the vote resulted as follows: YEAS: Council Members John L. Barthelemy, Jr., W. NAYS: None ABSENT: Council Member Charlie Burt PRESENT BUT NOT VOTING: None And the Ordinance was adopted on this the 11 th day of June, ORDINANCE NO The following Ordinance was offered by Council Member Williams who moved its adoption: An Ordinance to amend Chapter 15, Section 15-4 Speed Limits to include provisions to change the speed limit on Paul Morgan Road, Boothville Louisiana; to install the appropriate speed limit signs; to establish a penalty for the violation thereof; and otherwise to provide with respect thereto. WHEREAS, after receiving requests from Boothville residents, it is the desire of this Council to lower the speed limit on Paul Morgan Road; BE IT ORDAINED BY THE PLAQUEMINES PARISH COUNCIL THAT: SECTION 1 It hereby amends Chapter 15, Section 15-4 Speed Limits to include the following: The speed limit on Paul Morgan Road, Boothville, Louisiana, is hereby changed to 25 MPH for all motorized vehicular traffic.

9 SECTION 2 Any person found in violation of the provisions of this subsection by a court of competent jurisdiction shall be fined not more than one hundred ($100.00) dollars. SECTION 3 It hereby authorizes the Parish President to direct the Sign Department to have the necessary speed limit signs installed. SECTION 4 The Secretary of this Council is hereby authorized and directed to immediately certify and release this Ordinance and that Parish employees and officials are authorized to carry out the purposes of this Ordinance, both without further reading and approval by the Plaquemines Parish Council. WHEREUPON, in open session the above Ordinance was read and considered section by section and as a whole. Council Member Edgecombe seconded the motion to adopt the Ordinance. The foregoing Ordinance having been submitted to a vote, the vote resulted as follows: YEAS: Council Members John L. Barthelemy, Jr., W. Division, Buras, Louisiana by Dufrene Surveying and Engineering, Inc., dated March 25, 2015, the owner having fulfilled all of the requirements of the Subdivision and Re-subdivision Ordinance of the Parish of Plaquemines without cost to the Plaquemines Parish Government or the Parish of Plaquemines; and otherwise to provide with respect thereto. 11 ORDINANCE NO The following Ordinance was offered by Council Member Rousselle who moved its adoption: An Ordinance to amend, and as amended readopt Chapter 1, Article III, Section 2-30 of the Code of Ordinances relative to creating policy for employment for all Plaquemines Parish Government s Parish Attorneys; and otherwise to provide respect thereto. WHEREAS, in an effort to maintain standards of employment of Parish Attorneys for the Plaquemines Parish Government, the Council wishes to set forth the following guidelines; BE IT ORDAINED BY THE PLAQUEMINES PARISH COUNCIL THAT: SECTION 1 Chapter 1, Article III, Section 2-30 of the Plaquemines Parish Code of Ordinance is amended to read as follows: A. All Parish Attorneys, including the Parish Attorney as appointed as per Section 5.02 of the Parish Charter and the Assistant Parish Attorneys, shall be employed on a full-time basis as of July 1, B. Each Parish Attorney during the time of his employment shall not provide legal services for any other employee of the Parish, for any business owned by any other employee of the Parish or for any person or entity which has or is seeking to obtain a contractual relationship with Plaquemines Parish or with any of its agencies, divisions or special districts, unless said legal services are provided solely within the course and scope of the attorney s duties and responsibilities as an employee of the Plaquemines Parish Legal Department. C. Each Parish Attorney during the term of such employment shall not enter into any contractual relationship with any other employee of the Parish, with any business owned by any other employee of the Parish or with any person or entity which has or is seeking to obtain a contractual relationship with Plaquemines Parish or with any of its agencies, divisions or special districts, unless such contractual relationship is solely within the course and scope of the attorney s duties and responsibilities as an employee of the Plaquemines Parish Legal Department. D. Any Parish Attorney, as of the effective date of this ordinance, who is not in compliance with the terms of this Ordinance shall have thirty days from the effective date of this ordinance to either sever any contractual relationships which would cause the attorney to be in noncompliance with said section, or to resign his or her position with the Plaquemines Parish Legal Department. E. Each Parish Attorney shall devote his full time to the service of the Parish of Plaquemines and shall perform no legal services other than as legal counsel to the Council, the President, and all parish departments, offices, agencies, and special districts and those legal duties as may be assigned to him by administrative regulations adopted pursuant to the Plaquemines Parish Charter. F. No attorney shall be approved by the Council to serve as a Parish Attorney unless and until said attorney first executes and submits to the Council an affidavit attesting and swearing that he will fully comply with the provisions of Subsection A herein during his tenure and employment as a Parish Attorney. G. Any person who is found by the Council after due process and an opportunity is given to present evidence in his defense to be in violation of the provisions of this Ordinance shall be terminated from his or her position as a Parish Attorney.
