1 City of Utica Regular Council Meeting The City Council meeting was called to order by Mayor Dionne at 7:01 p.m. Members present: Sikora, Terenzi, Sylvester, Dionne Absent: Osladil, Cuddington, Czapski Executive Session Motion by Terenzi, seconded by Sikora, to recess to executive session to discuss litigation and union contract matters. Voting by roll, all ayes, motion The City Council meeting was reconvened by Mayor Dionne, Phil Randazzo led the pledge of allegiance at 7:31 p.m. Minutes of 7/11/17 Motion by Sikora, seconded by Terenzi, to approve the minutes of Voting all ayes, motion Public Comments for Items Listed on the Agenda None. Mayor Dionne requested to move the DDA and Utica High School Parade requests to the beginning of the meeting. Motion by Terenzi, seconded by Sikora, to move the two items. Voting all ayes, motion Utica High School Homecoming Parade Request Charlie DiLorenzo, Reagan Richardson, Makayla Gilbert and Isabella Durst, students, were present to request the road closure of Auburn and Cass for the annual Homecoming parade at 4:00 p.m. on Friday 10/13/17. Motion by Dionne, seconded by Sikora, to approve the road closure of Auburn and Cass for the homecoming parade 10/13/17. Voting all ayes, motion Downtown Development Authority Nick Morang, and Linda Davis Kirksey, informed all that fencing on the packing plant property is in disrepair, ownership to be determined as to who is responsible. The Riverwalk of 2018 is scheduled for June 21-24, the DDA has authorized $1500 in expenditures for the Car show of 8/12/17. They are investigating having a 501C3 formed for grant purposes etc. The Zombie festival is scheduled for October 7, Public Hearing 7:48 p.m. St. Lawrence Temporary Use/ Tent Request Motion by Sikora, seconded by Terenzi, to open the public hearing at 7:48 p.m. Voting all ayes, motion Sam Serra, chairman, was present to request tents, signage and use for the Annual St. Lawrence Applefest of Sept. 8,9, 10, All set-up events

As there were no other comments from the public, motion by Terenzi, seconded by Sylvester, to close the public hearing at 8:00 p.m. Voting all ayes, motion Motion by Dionne, seconded by Terenzi, to approve the tents, use and signage for the St. Lawrence Applefest, Sept. 8,9,10, Voting by roll, all ayes, motion Unfinished Business None. Consent Business Clinton River Canoe & Kayak Rental Contract Renewal Motion by Sikora, seconded by Terenzi, to table this item as the contract was not ready. Voting all ayes, motion Correspondence Motion by Terenzi, seconded by Sylvester, to receive and file the correspondence from: Utica Center for Mathematics, Science & Technology Internship Thank You, David Buck Veterans Memorial Thank You, MML Annual Meeting Notice, Sterling Heights Macomb Interceptor Lawsuit update. Voting all ayes, motion New Business Department Reports Mayor Dionne Mayor Dionne informed all that we have a new code enforcement officer, Jerry Hicks, and blight clean-up is being enforced. He also gave a thank you to Nancy Carter and Faith Terenzi for all their work on the Old Mill Arts & Craft/ Antique Festival, it was a great success. The Food Truck Rally of July 15 was very successful with over 2,000 people in attendance. Resolution Supporting Repeal of MI Fireworks Safety Act Motion by Sikora, seconded by Sylvester, to approve the Resolution supporting repeal of the MI Fireworks Safety Act, as presented. Voting all ayes, motion Food Truck Rally September 16 Mayor Dionne requested permission to hold another Food Truck Rally on September 16, with a maximum of 8 trucks from 5:00 pm to 10:00 pm. utilizing the Library parking lot and the Jaqueline K. Noonan Riverwalk Park. Councilman Sikora asked if the event impeded the Downtown at all, no. Councilman Sylvester asked if there were any alcohol problems, no the area is fenced. Motion by Terenzi, seconded by Sylvester, to approve the request for a Food Rally on Sept. 16. Voting all ayes, motion Council Reports Councilman Sikora reported the Movie in the Park was great, very family orientated. Councilwoman Terenzi thanked the Old Mill Arts & Craft vendors for their participation. Councilman Sylvester updated all on the Save MI Cities event in October.

3 Page 3 of 5 Assessing- Nancy Strehl, Assessor Eastside Outdoor LLC MTT # & Motion by Sikora, seconded by Terenzi, to approve the settlement with Eastside Outdoor MTT # & , as discussed in executive session. Voting all ayes, motion Building- Jerry Hicks Property Maintenance Code 2015 Update Request Motion by Sikora, seconded by Dionne, to update the Property Maintenance Code to the 2015 version, per the Building Inspector s request. Voting all ayes, motion Fire- Kevin Wilseck, Chief Ambulance Purchase Request Kevin Wilseck, Chief, explained his request to purchase a used ambulance form Grosse Pointe Woods, at a cost of $35,000. Bill Lang, engineer & himself inspected the ambulance. Motion by Sikora, seconded by Sylvester, to approve the purchase of a used ambulance from Grosse Pointe Woods at a cost of $35,000. Voting by roll, all ayes, motion Chief Wilseck informed all that the golf cart has been outfitted with the following donations: USA Tire- new tires, Meade Lexus- funds for a new battery, Redline Concepts -body paint, thank you to all. Police- Sean Coady, Chief Dispatcher Vacancy & Request to Hire Sean Coady explained the need to hire a part time and one full time dispatcher with the upcoming retirement of Maureen Niedieck. Motion by Sikora, seconded by Dionne, to approve the hiring of dispatcher personal, as presented. Voting by roll, all ayes, motion DPW- Bill Lang, Superintendent Bill Lang, Superintendent explained that the work on Van Dyke has been completed, Auburn Road work will begin shortly (one lane closure), repairs to Senior Housing sidewalks are underway and the Clinton River grant clean-up is in process. DeputyTreasurer- Rita Malkoun BS&A Internet Services Renewal Motion by Terenzi, seconded by Sylvester, to approve the renewal of internet services with BS&A Software, at a cost of $4, Voting by roll, all ayes, motion Administration- Beth Ricketts, City Clerk Verizon Access Transmission Services Metro Act Permit Request Motion by Sikora, seconded by Terenzi, to approve the Verizon Access Transmission Services Metro Act Permit request, as reviewed by City attorneys. Voting by roll, all ayes, motion

4 Page 4 of 5 ROW Permit Request Beth Ricketts, City Clerk, explained the application for a ROW permit to install cell phone antennas in the City. The contract has been reviewed by the City attorney for Metro Act permit, he recommends approval. Bill Lang, Superintendent stated the company originally submitted the request with no funds to the City. Motion by Sikora, seconded by Terenzi, to approve the ROW Permit application, with a $1,000 per year fee, as presented. Voting by roll, all ayes, motion Library- Marsha Doege, Director Parks and Recreation Commission All are invited to attend the Annual Car Show this Saturday, 8/12/17 in downtown Utica. Historic District Commission City Attorney- Linda McGrail Belau Vapor Shop Ordinance #167 Linda McGrail Belau, City Attorney, explained the necessity to adopt a vapor shop ordinance to protect the health and safety of those under eighteen (18) years of age which prevents the purchase/ possession of tobacco and vapor products. Motion by Sikora, seconded by Terenzi, to approve the adoption of the Vapor Shop Ordinance #167, as presented and recommended by Mayor Dionne. Voting by roll, all ayes, motion Memorandum POLC Motion by Sikora, seconded by Terenzi, to approve the memorandum of understanding with the POLC union, regarding the purchase of service credits, as discussed in executive session. Voting by roll, all ayes, motion Planning Commission Senior Housing Steering Committee Valero Van Dyke Conditional Use Amendment Anthony Hermiz, owner, was present to request a change to his special conditional use, to allow for a pylon sign instead of the existing monument sign. Discussion was held on the height of the pylon sign with regards to trucks. Motion by Sikora, seconded by Dionne, to table this item. Voting all ayes, motion Trinity Lutheran Church Tents/ Road Closure Request Jeff Pioch, operations manager, was present to request the closure of Deshon Street, n. of Hall Rd. and s. of Summers, be temporarily closed, permission to park cars along

5 Page 5 of 5 Deshon, Summers, Platt and McClelland and install four temporary tents on Sunday Spt. 10, Motion by Dionne, seconded by Terenzi, to approve the requests for Trinity s Family Fun Festival of Sept. 10, 2017, as presented. Voting by roll, all ayes, motion Bills Payable Motion by Sikora, seconded by Terenzi, to approve the payment of all bills as presented. Voting by roll, all ayes, motion Communication from the Public Phil Randazzo, Shelby Township Veteran s co-ordinator, was present to give a thank you for moving the Veteran s Memorial to the Jacquelin K. Noonan Memorial Park. He asked to rename the park in respect to soldiers who lost their lives to the Veteran s Memorial Park Utica. Mayor Dionne responded council would think about the request. Councilman Sikora stated it would be an honor to rename the park with no disrespect to Jacqueline. Noonan. He believes greater respect should be given to service men who are gone and requested this be placed on the next council agenda. Mayor Dionne stated there is an area around the Memorial to add brick pavers and would like to honor all those who have served the community. Bill Lang spoke on updating names on the Memorial.
