1 TOWNSHIP OF DENVILLE MUNICIPAL COUNCIL REGULAR MEETING October 17, 2017 The Meeting was called to order at 7:30 P.M. by Council President Golinski. The Salute to the Flag was recited, followed by an Invocation by Councilman Gabel. Municipal Clerk Kathryn Bowditch-Leon read the Notice of Compliance with the Open Public Meetings Act and noted that this is a non-smoking facility. The Clerk requested that all electronics be silenced at this time. ROLL CALL: Present: Gabel, Witte, Kuser, Lyden, Fitzpatrick, Murphy, President Golinski Absent: None ALSO IN ATTENDANCE: Thomas W. Andes, Mayor; Steven Ward, Administrator; John Jansen, Township Attorney; Nick Panetta, Recreation Director; Chief Wagner and Members of Denville Township Police Department PRESENTATIONS/CEREMONIAL MATTERS Chief Wagner stated he would like to welcome two new Police Officers and a Class Ill Special Police Officer to the Denville Police Department. He briefly discussed the role of Special Police Officers and provided an overview of the efforts made to be able to have a Special Police Officer in the Denville schools. ADMINISTRATION OF THE OATH OF OFFICE TO SHAWN YEAGER, POLICE OFFICER; ANTHONY CASTELLANI, POLICE OFFICER; AND ORLANDO SOTO, CLASS Ill SPECIAL POLICE OFFICER Chief Wagner stated that with the hiring of the two new police officers, the Department is now back to a full complement of 32 officers. Chief Wagner then provided a brief resume and personal background information on each of the new officers, which is included at the end of these minutes. Officer Yeager was joined by his mother, Cindy; his father, Scott; and his girlfriend, Kayla Lucia. Municipal Clerk Bowditch-Leon then administered the Oath of Office to Officer Yeager. Officer Castellani was joined by his mother, Carolynn; his sister, Alexis; his aunt, Susan; and his uncle, Tom. Municipal Clerk Bowditch-Leon then administered the Oath of Office to Officer Castellani. Special Officer Soto was joined by his wife, Sandy; his brother, Jose Soto; his sister, Aracely Castillanos; his brother-in-law, City of Orange Police Sergeant John Lopez; his brother-in-law, Marcos Yepes; and his daughter, Carissa. Municipal Clerk Bowditch-Leon then administered the Oath of Office to Special Officer Soto. President Golinski thanked the members of the Denville Police Department for continuing to protect the community. Chief Wagner then thanked the officers' families who were present at the meeting. INTRODUCTION OF RECREATION DIRECTOR NICK PANETTA Administrator Ward introduced the Township's new Recreation Director, Nicholas H. Panetta. Mr. Ward shared that over 30 applicants applied for the position, which was narrowed down to 5 final applicants. He stated that he, the Mayor, and the Recreation Committee unanimously felt that Mr. Panetta was best-suited to take the Recreation Department to the next level and build on what Don Bogardus had done. Mr. Ward announced that Nick is a resident of Morris County and graduated from Kean University with a Bachelor of Arts in Recreation Administration with a focus on Community Recreation. He provided an overview of Mr. Panetta's professional experience and outlined some of his plans, one of which involves the automation of the registration process for various programs offered by the Recreation Department. pg. 1

2 LlAISON REPORTS Councilman Murphy stated the Business Improvement District (BID) Committee met with the Executive Director to finalize their calendar for He announced that some of the proposed events for next year include a Lunar New Year celebration in February, a "Decorate the Bear" competition, and another Restaurant Week. The next BID Committee which time they will hold an election for next year's officers. Mr. Murphy announced that the Green Sustainability meeting will be held at Town Hall on Tuesday, October 24th at 7:30 PM, at MAYOR'S REPORT Mayor Andes referenced Resolution R , Resolution Rejecting Bids for the Muriel Hepner Park Pedestrian Bridge Replacement and Granting Permission to Re-Bid, and explained that the bids came in much higher than anticipated and the Township will re-bid the project once it has been redesigned. ADMINISTRATOR'S REPORT Administrator Ward advised that administrative budget hearings will take place during the week of November 61h. He then explained that there are four ordinances pertaining to collective bargaining agreements and salaries on tonight's agenda for introduction. CORRESPONDENCE All correspondence has been copied and distributed to the Council. Committee achieved Silver Status with 380 points and they will be awarded the Silver Certificate on November 14th at the New Jersey League of Municipalities convention. (NJLM) He commended Don Tidey and Township employees for their help in attaining this achievement. Mr. Murphy said that Green Sustainability presentations. continues to work with the Denville Library on energy audits and He also noted that he attended the Morris Park Alliance ceremony where Mayor Andes was honored with the Outstanding Public Official Award. Councilman Fitzpatrick announced that Project Playground 2.0's Zombie SK will be held at Gardner Field on Sunday, October 22nd at 1:30 PM. Councilwoman Lyden had nothing to report. Councilman Gabel commented that he attended the Beautification the annual plants out and plant bulbs for next year. Committee meeting and helped them pull He then stated that he attended the Planning Board meeting last week and noted that the Environmental Commission will meet later this month. Councilwoman Witte reported that: the weekly Farmers Market will continue on Sundays from 8:00 AM to 1:00 PM; Pink Witches Night will be held on Thursday October 19th; and the Holiday Parade will be held on November 26th. She mentioned that she attended the Senior Social this past Sunday, which was Halloween themed, and that Smash Burger is a new sponsor for the Senior Socials. She added that the next Senior Social will be held on November 191h. Ms. Witte noted the Board of Education will meet next Monday, October 23rd at Town Hall. Councilman Kuser said that he met with the Denville Historical Society and they are reviewing architectural plans to restore the Two-Room Schoolhouse to its original condition. President Golinski announced that the Denville Fire Department has elected Rich Yobs as the new Fire Chief and he will take office on January 1, NOTICE OF ADJOURNMENT - Person to Person Transfer of Liquor License has been adjourned to the November 21, 2017 Municipal Council Meeting. President Golinski asked if anyone from the public would like to make any comment regarding the transfer. No one responded. OPEN PUBLIC PORTION Mallary Steinfeld (147 Casterline Road} commented that she heard that the comments of Council members at the October 3rd Council meeting left the community with an optimistic feeling of hope. She asked that the pg.2

3 Township work with residents to form a joint housing commission or authority in order find solutions to satisfy the affordable housing obligation without the involvement of developers. Ms. Steinfeld explained that it was her belief that if the Township planned to build only the Township's affordable housing obligation, impact on the environment, taxes, schools and other infrastructure would be less. Peter Agostini (28 Cambridge Avenue) read into the record an chain between Irving Cohen (19 Copeland Road) and Administrator Ward, which discussed the formation of a Citizens' Advisory Council, a copy of which is attached to the end of these minutes. CLOSE PUBLIC PORTION Mr. Agostini expressed his opinion that citizens are not being heard and asked if the Council would meet with them to discuss potential solutions to the difficult affordable housing problem. Alex Raybould (145 Casterline Road) reiterated the sentiments expressed by Ms. Steinfeld and Mr. Agostini and added that they are trying to open a line of communication between Denville's citizens and the Council. Mr. Raybould suggested that the demographer's report from the Denville Board of Education be submitted to the Court as he believed that the study may serve as a useful tool in the event that an appeal of the decision is filed. Mayor Andes stated that he has consulted with Township Planning Board Attorney Edward Buzak, who strongly advised against the formation of a citizen subcommittee at this time and confirmed that, by doing so, the Township's attorney-client privilege could be at risk. Mayor Andes restated that the Township will continue to look "outside the box" for affordable housing solutions while continuing the fight to reduce the number of new housing units as much as possible. President Golinski expressed agreement with Mayor Andes's comments and stated that he is open to listening to new ideas but believes too many people involved could be problematic. Councilman Fitzpatrick shared his opinion that if a developer is denied something during negotiations, the developer may challenge the denial's legality and the Township could then potentially lose its immunity. Mayor Andes confirmed that all suggestions made have been taken into consideration and that the Township may consider a subcommittee at a later time. Councilman Fitzpatrick asked if Administration could ask Mr. Buzak about the appeal process. then the Councilman Murphy echoed Councilman Fitzpatrick's thoughts and said that he appreciates all the ideas that have been presented by residents. He then explained how Morris Plains satisfied their affordable housing obligation by constructing a 5-story structure on Route 53, which he believes cost over 12 million dollars to construct and was bonded by the municipality. He also stated that he will make himself available to come to meetings and discuss this matter. Councilman Kuser restated that he would be happy to meet with residents about this situation to discuss different ideas. President Golinski stated that he too is open to meeting with residents to discuss affordable housing in Denville, including the idea of housing for individuals with special needs, but he feels strongly that the affordable housing must be integrated throughout Denville and not be constructed as an affordable housing "project". pg.3

4 Councilman Kuser confirmed that if and when the matter comes before the Council for a vote, adequate notice will be provided to the public. Township Attorney Jansen indicated that he spoke with Gail Fraser, Esq., the attorney for Morris Plains, who confirmed that the Morris Plains affordable housing on Route 53 cost approximately Councilman Fitzpatrick expressed his frustration with the Morris Plains dilemma, noting that it could affect the quality of life of Denville residents. Councilman Kuser asked if the Township has already utilized all funding for the legal and administrative associated with affordable housing. Administrator Ward stated that Resolution R , A Resolution Authorizing the Transfer of Funds from the Affordable Housing Trust Fund to the Denville General Trust Fund for COAH Related Administrative Costs, is on this evening's agenda. Mr. Ward then explained that according to regulations, only 20% of the affordable housing trust fund can be used for administrative costs and this transfer will bring the Township to the current maximum. He explained that after this money has been spent, the Township will have to look at alternatives to fund the expenses associated with the declaratory judgment action, such as through general taxation next year. MATTERS OF OLD AND/OR NEW BUSINESS None ORDINANCES FOR ADOPTION An Ordinance Appropriating an Additional $105,000 for Renovations to the Denville Municipal Building with Said Funding Being Provided by the Denville Township Board of Education Be Read by Title on Second Reading and a Hearing Held Thereon: MOTION TO READ BY TITLE: MOVED BY MEMBER MURPHY, SECONDED BY MEMBER GABEL MURPHY, GABEL, WITTE, KUSER, LYDEN, FITZPATRICK, PRESIDENT GOLINSKI OPEN PUBLIC HEARING No one wished to be heard. He further explained that Morris Plains lost their immunity and is facing two builder's remedy lawsuits, adding that one proposal they have received is to construct 800 units across from the Pfizer facility. He added that this resolution is for the cancellation of the ordinance obligation associated with this. Discussion ensued on the effect of the cancellation of capital appropriations. It was noted that, in this case, it is a bookkeeping matter. 10 Officer Shawn Yeager, age 22, was born in Toms River NJ where he has lived his entire life. After graduation from High School, Shawn attended Ocean County College, where he received an Associate's Degree in Criminal Justice. Around the same time, Shawn was hired in the summer of 2015 as a Class I Special Police Officer in Seaside Park, NJ. The next summer, Shawn served as a Class II Special Police Officer and then, in October 2016, he was hired by the Pemberton Police Department as a Police Officer where he served he began in Denville 'this past September. Shawn attended the Ocean County Police Academy for his Special Police and Police Officer Certifications. Shawn just recently moved to Roselle NJ. With Shawn tonight are his mother, Cindy; Dad, Scott; and his Girlfriend Kayla Lucia Officer Anthony Castellani, age 25, was born in Morristown and grew up in Washington Township in Morris County. Anthony attended and graduated from West Morris Central High School. He then attended Montclair State University and graduated with a Bachelor's Degree in Exercise Physiology. He then worked in a few different Fitness locations utilizing his experience and education before attending the Ocean County Police Academy between December and May of He then began working as a Class II Special Police Officer in Point Pleasant Borough this past summer where he was working until he began his position here in Denville in September. Anthony moved to Brick NJ when he began working down the shore and recently moved to Randolph. With Anthony tonight are his Mother, Carolynn; Sister, Alexis; Aunt Susan and Uncle Tom.

11 Orlando Soto is being sworn in as our first Class 111 Special Police Officer. Orlando's responsibilities will be to conduct school security at all three of the Denville Schools. The creation of this position and hiring of Orlando is a result of years of cooperation between the Denville School District and the Police Department. Orlando retired as a Lieutenant with the Orange, NJ police department after 25 years. He commanded the Community Services bureau and supervised the cities two SRO's. Orlando lives in Hanover Deacon at the Abundant Life Worship Center in Whippany.
