1 GLOUCESTER TOWNSHIP COUNCIL MEETING DECEMBER 14, 2015 MUNICIPAL BUILDING, CHEWS LANDING NEW JERSEY Pledge Allegiance to the Flag Pastor David McMurray of the First Baptist Church of Blackwood gave the invocation. Statement: Mr. Bianchini read a statement setting forth the time, date and place of this meeting, that it was properly advertised, posted and filed in the Office of the Township Clerk pursuant to the Open Public Meetings Act. Mr. Mercado Mr. Bianchini Mr. Lechner, Comm. Dev. abs. Deputy Chief Harkins, Police Mr. Bianchini stated that there has been an add on to the agenda this evening. He stated that it is in yellow on the board and had been put on the website. PUBLIC PORTION: Mr. Bianchini opened the public portion. Peter Heinbaugh of Morningstar Court asked about Ordinance 19 and Ordinance 20. Mr. Lechner summarized these two ordinances. He stated that Ordinance 19 is for the redevelopment plan along Blackwood-Clementon Road, from Little Gloucester Road to College Drive. He stated that it is an overlay type zone to allow developers to have bonuses so that they would improve the area. He stated that the plan was done by T & M Associates. Mr. Lechner stated that Ordinance 20 is an ordinance to amend the zoning map to show some of the re-zonings and corrections. Mr. Heinbaugh also asked about the abatement and would it go beyond the 5 years. Ray Polidoro of Erial spoke about the Owens Corning ordinance and what will it cost the township in acquisition or costs to be incurred for a solar program. It was stated that the township is paying $1.00 for the land and will then be using a Power Purchase Agreement and the lease is 15 years and the township could extend it for another 5 years. Mr. Polidoro asked if there is any type of maintenance or guarantee on the panels. Mr. Carlamere stated that the township is not obligated to purchase the panels at the end of the term and that there would be a maintenance agreement with the private contractor. Mr. Polidoro also asked about the change in the Hawkers and Peddlers license. Joanne Carr of Timberbirch asked about the Owens Corning property and why we are are purchasing it now. Mr. Bianchini stated that the township wanted to make sure environmentally that everything was completed. He stated that the township received a No Further Action letter from the DEP. There being no further comment, the public portion was closed. ORDINANCES: FIRST READING O ORDINANCE AMENDING CHAPTER 47 SEC A,B &C OF THE CODE OF THE TOWNSHIP OF GLOUCESTER ENTITLED PETS, AND ANIMAL ABUSE BY ADDING SUBSECTION D REGULATING THE SALE OF DOGS AND CATS FROM PET SHOPS WHEREAS, in the best interest of the residents of Township of Gloucester and other citizens who may purchase dogs and cats, and in the interest of promoting community awareness, certain amendments to the current ordinance regulating Pets Shops located within the Township of Gloucester are required, and
3 WHEREAS, a significant number of puppies and kittens sold at pet shops come from large scale commercial breeding facilities where the health and welfare of the animals are not regularly provided for ("puppy mills" and "kitten mills," respectively). According to The Humane Society of the United States, it is estimated that 10,000 puppy mills produce more than 2,400,000 puppies a year in the United States and that most pet shop dogs and cats come from puppy mills and kitten mills, and WHEREAS, the documented abuses endemic to puppy and kitten mills include overbreeding, inbreeding, minimal to non-existent veterinary care; lack of adequate and nutritious food, water and shelter, lack of socialization, lack of adequate space and lack of adequate exercise, and WHEREAS, the inhumane conditions in puppy and kitten mill facilities lead to health and behavioral issues in the animals bred in those facilities, which many consumers are unaware of when purchasing animals from pet shops due to both a lack of education on the issue and misleading tactics of pet health and behavioral issues in some cases, These health and behavioral issues, which may not present themselves until some time after the purchase of the animals, can impose exorbitant financial and emotional costs on consumers, and WHEREAS, current Federal and State regulations do not adequately address the sale of puppy and kitten mill dogs and cats in pet shops, and WHEREAS, restricting the retail sale of puppies and kittens to only those that are sourced from shelters or rescue organizations is likely to decrease the demand for puppies and kittens bred in puppy and kitten mills and is likely to increase demand for animals from animal shelters and rescue organizations, and WHEREAS, according to the New Jersey Department of Health 2014 Animal Intake and Disposition Survey, due in large part to pet overpopulation, more than 20,000 dogs and cats are euthanized in New Jersey animal shelters annually, including nearly 1,500 in the County of Camden. Restricting the retail sale of puppies and kittens to only those that are sourced from animal shelters and rescue organizations will likely reduce pet overpopulation and thus the burden on such agencies and financial costs on local taxpayers, and WHEREAS, across the country, thousands of independent pet shops as well as large chains operate profitably with a business model focused on the sale of pet services and supplies and not on the sale of dogs and cats. Many of these shops collaborate with local animal shelters and rescue organizations to offer space and support for showcasing adoptable homeless pets on their premises; and WHEREAS, this Ordinance will not affect a consumer's ability to obtain a dog or cat of his or her choice directly from a breed-specific rescue organization or a shelter, or from a hobby breeder where the consumer can see directly the conditions in which the dogs or cats are bred, or can confer directly with the hobby breeder concerning those conditions; and WHEREAS, the Township Council of the Township of Gloucester believes it is in the best interest of the Township to adopt reasonable regulations to reduce costs to the Township and its residents, protect the citizens of Gloucester Township who may purchase cats or dogs from a pet shop or other business establishment, help prevent inhumane breeding conditions, promote community awareness of animal welfare, and foster a more humane environment in the Township. NOW THEREFORE BE IT RESOLVED that Chapter 47 entitle Pets and Animal Abuse be amended as follows; SECTION 1. That Section 47-1 Definitions and Word Usage subsection A be and is hereby amended as follows: ANIMAL CARE FACILITY - Animal care facility means an animal control center or animal shelter, maintained by or under contract with any state, county, or municipality, whose mission and practice is, in whole, or significant part, the rescue and placement of animals in permanent homes or rescue organizations. ANIMAL RESCUE ORGANIZATION - Animal rescue organization means any not-for-profit organization which has tax-exempt status under Section 501 (c) (3) of the United States Internal Revenue Code, whose mission and practice is, in whole or in significant part, the rescue and placement of animals in permanent homes. OFFER FOR SALE - Offer for sale means to sell, offer for sale or adoption, advertise for the sale of, barter, auction, give away or otherwise dispose of a dog or cat. PET SHOP - Pet shop means a retail establishment where dogs and cats are kept in any room or group of rooms, cage or exhibition pen and are sold, exchanged, bartered or offered for sale as
4 pet animals to the general public at retail. Pet shops are prohibited in all residential zones. Such definition shall not include an animal care facility or animal rescue organization, as defined. SECTION 2. That Section Licensing requirements for kennels and pet shops be amended to include the following: D. Regulations: 1. A pet shop may offer for sale only those dogs and cats that the pet shop has obtained from or displays in cooperation with: a. An animal care facility; or b. An animal rescue organization 2. A pet shop shall not offer for sale a dog or cat that is younger than eight weeks old. SECTION 3. All ordinances and provisions thereof inconsistent with the provisions of this Ordinance shall be and are hereby repealed to the extent of such inconsistency. SECTION 4. If any section, subsection or part, clause or phrase of this Ordinance shall be declared invalid by judgment of any court of competent jurisdiction, such section, subsection, part, clause or phrase shall be deemed to be severable from the remainder of the ordinance. SECTION 5. This Ordinance shall take effect immediately after final passage and publication as required by law. Roll call vote: All in favor. O ORDINANCE AMENDING CHAPTER 58 OF THE CODE OF THE TOWNSHIP OF GLOUCESTER ENTITLED, HAWKERS, PEDDLERS. CANVASSARS AND SOLICITORS ORDINANCE BE IT ORDAINED by the Township Council of the Township of Gloucester, County of Camden, State of New Jersey that Chapter 58 of the Code of the Township of Gloucester be and is hereby amended as follows: SECTION 1. That Article I, Canvassers and Solicitors be amended as follows: Definitions When used in this ordinance, the following words or terms shall have the meanings indicated: HIS - Includes "her" or "its." PERSON - Includes any individual, partnership, partner, corporation or corporations. SOLICITOR or CANVASSER - Includes any person, whether or not a resident of the Township of Gloucester, who goes from house to house, from place to place, whether on foot or by conveyance of any kind, nature or sort, soliciting, taking or attempting to take orders for the sale of services, goods, wares, merchandise, food or drink or any products thereof or property of any kind or nature whatsoever, for future performance or delivery, whether or not such individual has, carries or exposes for sale a sample of the subject of such order and whether or not he is collecting advance payments on such sales or orders Investigation and issuance. A. Upon receipt of such application, the original thereof shall be referred immediately by the Township Clerk to the Chief of Police of the Township, who shall cause to be made such investigation as he deems necessary for the protection of the public welfare. Upon receipt of all completed applications, the Chief of Police shall conduct or cause to be conducted such investigation as he deems necessary to determine the truth and
5 accuracy of the information contained in the application, and the applicant's compliance with this Chapter including the criminal record of the applicant and all employees. The applicant must be fingerprinted by the Department of Police or its authorized vendor. The applicant and all employees are subject to a background check by Township's police department or its authorized vendor. The applicant may be refused if such investigation reveals the following: 1. Conviction of any crime or misdemeanor involving arson, aggravated assault; breaking and entering; bribery and corruption; burglary; embezzlement, conspiracy, conversion and misappropriation of funds; extortion; larceny; loan sharking; possession or use of a controlled dangerous substance; and other crimes against the person or crimes involving moral turpitude.; in the last 10 years, or a disorderly persons conviction over the last 3 years. B. Remains unchanged C. Eliminate entire section. SECTION 2. That Article II, Hawkers, Peddlers and Vendors be amended as follows: Definitions. When used in this ordinance, the following terms shall have the meanings indicated: HAWKER, PEDDLER and VENDOR - Includes any person, whether or not a resident of the Township of Gloucester, traveling about the Township of Gloucester either on foot, by vehicle or by any other manner, means or method, who shall go from place to place or street to street conveying or transporting goods, products, wares, merchandise, food or drink or any product thereof, offering or exposing the same for sale or making sales and delivering articles to purchasers. HIS - Includes "her" or "its." ITINERANT AND TRANSIENT MERCHANTS AND PEDDLERS - Included in the definition of "hawker, peddler, and vendor" as above set forth. PERSON - Includes any individual, partnership, partner, corporation or corporations. VENDING UNIT- shall be a cart, truck or other mode of transporting food, goods or wares for the purpose of hawking, peddling & vending Investigation and issuance. A. B. Remains the same. C. Eliminate entire section Regulations. A. Prohibition of Fixed Location Sales 2. A hawker, peddler and vendor shall not sell or offer for sale to the general public any food, goods, wares or merchandise from a fixed location. Hawkers, peddlers and vendors are obligated to move about, going place to place to sell foods, goods, wares and merchandise.

A peddler sells or offers for sale from a fixed location if such peddler remains at a fixed location for a period of time of 20 minutes or longer, unless extended as provided below or for special events. SECTION 3. All ordinances and provisions thereof inconsistent with the provisions of this Ordinance shall be and are hereby repealed to the extent of such inconsistency. SECTION 4. If any section, subsection or part, clause or phrase of this Ordinance shall be declared invalid by judgment of any court of competent jurisdiction, such section, subsection, part, clause or phrase shall be deemed to be severable from the remainder of the ordinance. SECTION 5. This Ordinance shall take effect immediately after final passage and publication as required by law. O ORDINANCE OF THE TOWNSHIP OF GLOUCESTER, COUNTY OF CAMDEN AND STATE OF NEW JERSEY ADOPTING THE BLACKWOOD CLEMENTON ROAD REDEVELOPMENT PLAN IN ACCORDANCE WITH N.J.S.A. 40A:12A-l ET SEQ., LOCAL REDEVELOPMENT AND HOUSING LAW WHEREAS, the Township Council of the Township of Gloucester, County of Camden, State of New Jersey, previously designated the entirety of Gloucester Township as an area in need of rehabilitation by Ordinance O adopted November 13, 1989 authorizing the Township of Gloucester to use all those powers provided by the Legislature for use in a rehabilitation area; and WHEREAS, the Blackwood Clementon Road Redevelopment Plan Area ( Redevelopment Plan Area ) is comprised of several parcels along Blackwood Clementon Road as depicted in Exhibit No. 1 and is generally consistent with the HC Highway Commercial Zoning District (HC District ) and bounded on the North by the boundary line between the HC District and APT Apartment District on the south by Plaza Drive on the west by Little Gloucester Road and on the east by the boundary line between the HC District and the R-1 Residential District; and WHEREAS, the Township Council of the Township of Gloucester finds that the public health, safety, morals, and welfare of the community shall be promoted by the adoption of the redevelopment plan titled Blackwood Clementon Road Redevelopment Plan, ( Redevelopment Plan ) as prepared by T & M Associates dated August 2015; and WHEREAS, the Township Council of the Township of Gloucester has reviewed the Redevelopment Plan and believes the Redevelopment Plan will facilitate economic growth and development in the Redevelopment Plan Area; and WHEREAS, the Planning Board of the Township of Gloucester has adopted a Master Plan and Reexamination Report providing for the appropriate use and development of lands in the Township in a manner that will promote the public health, safety, morals, and general welfare and the Township Council has determined that the Redevelopment Plan Area is an area in need of rehabilitation in accordance with the Redevelopment Plan; and WHEREAS, the Township Council does hereby make the following findings for adoption of the Redevelopment Plan pursuant to N.J.S.A. 40A:12A-7, Adoption of Redevelopment Plan:
7 A) The Township Council of the Township of Gloucester designated the entirety of Gloucester Township as an area in need of rehabilitation by Ordinance O adopted November 13, 1989 in accordance with P.L. 1977, c. 12, supplementing Chapter 4 of the Title 54 of the revised statutes (C 54: et. seq.); and B) The Township Council of the Township of Gloucester is authorized to adopt a redevelopment plan by ordinance for an area in need of rehabilitation in accordance with N.J.S.A 40:12A-7, Adoption of a redevelopment plan; and C) The Planning Board of the Township of Gloucester is required to provide the Township Council a report containing its recommendation concerning the Redevelopment Plan including objectives consistent with the goals for development and redevelopment of the Township as expressed in the Master Plan and Reexamination Report; and D) Township Council does hereby desire to move forward with first reading of this Ordinance subject to review and report by the Planning Board; and E) It is the intent of Township Council to move forward with second reading and final adoption of this Ordinance, in the appropriate manner, and in accordance with Township Council's review of recommendations of the Planning Board. NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Gloucester, County of Camden, State of New Jersey as follows: SECTION 1. The Township Council does hereby adopt the Blackwood Clementon Road Redevelopment Plan, in accordance with N.J.S.A. 40A:12A-7, as the Redevelopment Plan for the Redevelopment Plan Area so designated. SECTION 2. In accordance with N.J.S.A. 40A:12A-7(c), the Zoning Map, as included in Ordinance O-03-03, known as the Land Development Ordinance of the Township of Gloucester, be and hereby is amended to designate the Redevelopment Plan Area as an overlay district titled the BC-RD Blackwood Clementon Road District. SECTION 3. The Township Council is designated as the Redevelopment Entity under the Blackwood Clementon Road Redevelopment Plan, and may proceed with clearance, replanning, development, and redevelopment of the Rehabilitation Area to effectuate the purposes of the Local Redevelopment and Housing Law. SECTION 4. All ordinances and provisions thereof inconsistent with the provisions of this ordinance shall be and are hereby repealed to the extent of such inconsistency. SECTION 5. If any section, subsection or part, clause or phrase of this Ordinance shall be declared invalid by judgment of any court of competent jurisdiction, such section, subsection, part, clause or phrase shall be deemed to be severable from the remainder of the ordinance. SECTION 6. This Ordinance shall take effect immediately after final passage and publication as required by law. BE IT ORDAINED by the Township Council of the Township of Gloucester, County of Camden, State of New Jersey that Ordinance O-03-03, known as the Land Development Ordinance be hereby amended, as follows: SECTION 1. That Article III, Zoning Districts and Zoning Map, Section 302 tilted Zoning Map is hereby amended, as follows: a.) To revise the zoning district boundaries as shown within Section 5.0, 2015 Recommended Changes within a report titled Reexamination Report of the Master Plan of the Township of Gloucester, prepared by Kenneth D. Lechner, PP, AICP, Director, Department of Community Development & Planning dated June 2015; and b.) To revise the redevelopment area boundary for the Glen Oaks Redevelopment Area is hereby amended to correct the boundary to be consistent with Ordinance O adopted June 08, 1997 and Amendment No. 1, Ordinance O adopted May 14, 2001 as shown on Exhibit 1 attached hereto. c.) To delineate the redevelopment area boundary for the College Drive Redevelopment Plan as shown in a report titled the College Drive Redevelopment Plan of the Township of Gloucester, as prepared by Kenneth D. Lechner, PP, AICP dated April 2015, established by Ordinance O adopted April 27, 2015 and as shown in Exhibit 2 attached hereto. d.) To delineate the redevelopment plan overlay district boundary for The Villages of Gloucester Township Redevelopment Plan as shown in a report titled The Villages of Gloucester Township Redevelopment Plan, as prepared by Kenneth D. Lechner, PP, AICP dated June 2015, established by Ordinance O adopted July 27, 2015 and as shown in Exhibit 3 attached hereto. e.) To delineate the redevelopment plan overlay district boundary for the Blackwood Clementon Road Redevelopment Plan as shown in a report titled Blackwood Clementon Road Redevelopment Plan, as prepared by T & M Associates dated August 2015, established by Ordinance O-15- adopted and as shown in Exhibit 4 attached hereto. SECTION 2. That Ordinance O-03-03, Land Development is hereby amended to repeal references to the Blackwood West District (BWD) in the following locations where the only remaining lots in the BWD District as depicted in Section of the 2015 Reexamination Report of the Master Plan referenced in Section 1 herein are to be zoned R-3, Residential: a.) Article III, Zoning Districts and Zoning Map, Section 301, Establishment of Districts is hereby amended to delete Blackwood West and BWD from the zoning district table referenced in Section 301, Establishment of Districts; and, b.) Article IV, Zoning District Regulations, Section 411, Blackwood West District (BWD) is hereby repealed in its entirety and replaced with the word Reserved; and, SECTION 3. That Article IV, Zoning District Regulations, Section 426 Signs is hereby amended as follows: a.) Section 426.V, Signs permitted in the ER, R-1, R-2, R-3 and R-4, BWD Districts: i Delete BWD. ii. Add AND L-RD REDEVELOPMENT ZONE. b.) Section 426.X, Signs permitted in the OR Districts add the following: i. AND BW-RD REDEVELOPEMNT ZONE. c.) Section 426.Y, Signs permitted in the OF and CR Districts add the following: i. AND G-RD AND M-RD REDEVELOPMENT ZONES. d.)
