CATAWBA COUNTY SHERFF'S OFFCE NARCOTCS DVSON, NEWTON, NC " (ft ORDER This matter coming on to be heard and being heard by the undersigned Superior Court Judge at a specia session of Superior Court for Catawba County, heard in Gaston County by consent of a parties on May 3, 208. t appearing to the Court that the nterveners were represented by Forest Ferre and Andrew Howe of Sigmon, Cark, Mackie, Hanvey, & Ferre, PA, and C. Amanda Martin of Stevens, Martin, Vaughn, Tadych, PLLC; the North Caroina Attorney Genera's Office was represented by, Boz Zeinger, and Lesie C. Dismukes; Coy Reid, the eected Sheriff of Catawba County was present and represented by Debra Bechte in his officia capacity and by Lisa Dubbs in his individua capacity. The court having reviewed the motion fied by the interveners, heard arguments of counse for the respective parties and having reviewed a reevant documents and information makes and enters the foowing: FNDNGS OF FACT. Judge Kuehnert entered the origina order seaing the search warrants that are at issue herein after "search warrant" as the affidavits and facts reated to both search warrants are virtuay identica. 2. t is presumed by this Court that Judge Kuehnert was exercising his inherent authority over the matter as a resident Superior Court Judge assigned the district for this rotation where the search warrant was executed and fied when entering the order to sea the warrant. 3. The search warrant was originay signed and issued by the undersigned. 4. Since the issuing of his order seaing the search warrant Judge Kuehnert has recused himsef from further hearings on this matter.

By consent of the parties and at the request of Judge Kuehnert this matter was brought before the undersigned to address the pending issues regarding this investigation and any issues arising from the matter that may be addressed unti such time as charges are brought if charges are to be brought at a. 6. The Sheriff in his individua capacity has standing and has a right to have his persona attorney present at this hearing, as the county attorney for Catawba County wi not be representing the Sheriff after his term expires in December of 208 and this matter is not ikey to be fuy resoved before December The interveners have a sufficient interest in this matter and are aowed to intervene pursuant to Rue 24(b of the North Caroina Rues of Civi Procedure. 8. The origina appication for the search warrant contains investigative sources and methods used by the Catawba County Sheriffs Office and aw enforcement n genera that are not readiy known or avaiabe to the genera pubic. 9. Aowing the sources and methods to be discosed in the context of a search warrant appication and to become a part of the pubic domain woud be highy detrimenta to and negativey impact aw enforcement agencies in the State of North Caroina in their abiity to conduct investigations effectivey. 0. The origina appication for the search warrant contained the address, ocation, and or other descriptions of one or more faciities not widey known to the pubic that are beieved to be used by the Catawba County Sheriffs Office to faciitate it's investigative process, and to conduct covert operations.. Aowing the ocation and description of these faciities to be discosed and to become a part of the pubic domain woud a have a detrimenta impact on the Catawba County Sheriffs Office in its abiity to conduct investigations, woud ikey compromise current pending investigations, and coud cause egitimate safety concerns for the ives and safety of the Catawba County Sheriffs Office deputies, empoyees, and others cooperating with or assisting that agency. 2. The origina appication for the search warrant contained information that woud aow the identity of the confidentia sources of information used in that appication to be discerned reativey easiy by the targets of this investigation thereby potentiay compromising the ongoing investigation in this matter. 3. There exist an administrative order entered by a Senior Resident Superior Court Judge for Catawba County, Timothy Kincaid, who has since retired that requires the seaing of a warrant ony upon Appication of the Attorney Genera's Office or the District Attorneys Office. 2

3 4. t appears cear to this court that Judge Kincaid in entering this administrative order did not intend to remove from the Superior Court its inherent authority to sea warrants, orders, and/or other documents upon it on motion. 5. There is a compeing governmenta interest in not reveaing the sources and methods used by Catawba County Sheriffs Office and other aw-enforcement agencies across the State of North Caroina; in not reveaing the confidentia ocations a faciities used by the Catawba County Sheriffs Office and possiby other aw enforcement agencies in conducting their investigations; and in not reveaing identifying information about confidentia sources used in obtaining information used in compiing the information contained in the search warrant appication. 6. This investigation and the detais thereof, have not been opened to the pubic to this point in the investigation, and the pubic in genera has payed itte or no roe in this investigation to this point 7. This is an ongoing investigation, no charges have been brought as of yet against anyone as a resut of the investigation done thus far, and there is no cear indication to the Court at this time base upon the information provided that charges wi be brought 8. n the discretion of the court a portion of this hearing was cosed to the pubic in order to preserve and protect the ongoing nature of the investigation the sources and methods used by a aw enforcement agencies across the State of North Caroina, ocations of faciities used in investigations that are not widey or readiy known to the pubic, and the identification of sources of information in this investigation. 9. There is a compeing governmenta and pubic interest in not having the aforementioned information discosed to the pubic and paced in the pubic domain at an open session of Court. 20. There are no ess restrictive means of protecting this information, the ongoing investigation, and the compeing governmenta interest than cosing the proceedings as it reates to the detais of the search warrant and the intervener's Motion to have the appication unseaed. 2. A parties and their respective attorneys were aowed to remain in the courtroom during the cosed session as we as the ead investigators from the State Bureau of nvestigation, the current eected Sheriff of Catawba County, and necessary courtroom staff. 22. The affidavits in both search warrants are identica except for the heading therefore in the discretion of the Court on redacted affidavit wi be reeased with the respective inventory for both warrants and the cover pages of each warrant. The east restrictive means in protecting the compeing governmenta interest baanced against the interest of the pubic to have access to the documents and information surrounding this investigation is to reease a redirected version of the search warrant 5. Specificay, Appicant is assigned to the Southern Piedmont District ocated in Harrisburg, N0ih Caroina for the purposes of investigating cases of crimes committed in vioation of North Caroina aws. Appicant has been so empoyed since August 7, Appicant obtained her Basic Law Enforcement Training ceiificate in October 994, upon graduation from the Charotte-Meckenburg Poice Academy. n 995, Appicant went to work for the Union County Sheriff's Office ocated in Momoe, N0ih Caroina where Appicant worked for approximatey eeven years. The ast five and haf years, Appicant was assigned to the Detective Bureau where Appicant conducted and/or assisted with numerous crimina investigations, which incuded but was not imited to, homicides, sexua assauts, arsons, robberies, frauds and break-ins. Appicant has received numerous hours of training throughout her aw enforcement career in regards to conducting successfu crimina investigations. Appicant has obtained her Advanced Law Enforcement Certificate and Genera nstructor Cetificate. At the time th was ocated, pi.ad ended a romantic reationship with Jason Coy Reid, and had begun dating someone new. A week prior to the -... being ocated on. ':ar,. eceived severa text messages from Jason Coy Reid which detaied ocations where. had traveed. The Appicant swears to the foowing facts to estabish probabe cause for the issuance of a search warrant: The information received during the course of this investigation is discussed in this affidavit and is beieved to be true and accurate by ASAC Christy Hearne. conduct a crimina investigation in reference to a ocated and removed from a 203 Kia Optima LX owned by Appicant noted thee was a g ME: md Seria No. with a white adhesive abe that read t -.. Sheriff Carpenter responded to inconton on August 3, 207. Sheriff Carpenter met with who produced the bearing ME: and Seria No. 9 Q for examination and photographs. Sheriff Carpenter shared photos of the tracker with the Appicant via emai on August 3, Copies of two photographs received from Sheriff Carpenter, which dispayed the dentifying information, one with the white adhesive abe and one without the white adhesive abe, are incuded with this search warrant and identified as Attachment V. At the time the - was ocated on Kia Optima, and Jason Coy Reid had not been in a dating reationship for severa months. On August 3, 207, SB Specia Agent K. Wright retrieved the bearing ME: and Seria No. with a white adhesive abe that read fro at ocated at. in Linconton. SA Wright transported the to the Southern Piedmont District Office and paced it into evidence. Appicant contacted at teephone numbe.confimed she had dated Jason Reid, a Sheriffs Deputy at the Catawba County Sheriff's Office, but noted her reationship with Reid ended in March or Apri of 207.._said they, she and Reid, were friends initiay after their break-up, but then Reid started questioning... _ when she began dating. in May 207. noted Jason Reid had texted her accurate ocations where she was during the time she dated. Per the Catawba County Sheriff's Office Organization Chart for Fisca Year 7//207 thru 6/30/208, posted on the Catawba County Sheriffs Office website, Jason Reid was the Captain over Community Reations, Court and Narcotics unti he resigned on February 7, 208. Appicant knows from her training and experience and conversations with other aw enforcement officers, that many aw enforcement agencies utiize... whie conducting crimina investigations. As a resut, numerous aw enforcement agencies purchase and maintain within their equipment ventory for use by officers/investigat9rs. n an effot to track the equipment inventory, which may consist of mutipe units of the same equipnt item, aw enforcement agencies assign equipment items an identifying or unique number.
