STATION. 2MC-PAY & USE-Sulabh-2008/MBY Dated : The Divisional Railway Manager(Coml.), N.W.Railway, Bikaner for and on behalf of the President of India invites open tender in sealed cover from the experience agencies organizations for cleanliness of Pay & use Toilets & Baths at Mandi Dabwali Rly. Station on the trend of Normal Pay & Use system for the period of five years. 1. Reserve Price - Rs. 35,775/- (For 5 years) 2. Earnest Money - Rs.716/-* 3. Dated: Sub: Tender for a license for cleanliness and maintenance of Normal Pay & Use Toilets and Bathrooms of Mandi Dabwali Railway Station. (1) The sealed tenders on the enclosed tender form addressed to the DRM (COMML.) NWR/BKN should be submitted in cover marked TENDER FOR CLEANLINESS AND MAINTENANCE OF NORMAL PAY & USE TOILETS AND BATHROOMS AT MANDI DABWALI RAILWAY STATION and shall be either deposited in tender box, kept in the Sr.DCM NWR/BKN s office up to hrs on or may be sent by registered post well in time so as to be received on the due date before opening of tender. Tenders will be opened just after closing of tender box in the presence of such tenderers. (2) Tender received after the Date and time specified above shall not be accepted. (3) The rates should be filled legibly in ink, in figures as well as in words. Tenders containing any erasures or alteration in the tender documents or any over writing are liable to be declared invalid. (4) Tenderers are requested to deposit a sum of Rs. 716/- as earnest money in mode of demand draft of the same value of scheduled bank pledges in favour of Sr. Divl. Finance Manager. N.W. Railway, Bikaner or Tenderer may deposit Earnest Money in cash with Divl. Cashier N.W. Rly. Bikaner for the fulfillment of the contract Tender submitted without earnest money will be summarily rejected. Earnest Money will be refunded in full without interest to the unsuccessful tenderer. (5) The successful tenderer will have to deposit security i.e. 10% of the value of the contract payable by him for the proper and satisfactory execution and fulfillment of the terms and conditions of agreement. (6) The tenderer shall keep their offers open for a period of 120 day from the date of opening of the tenders, Tenderer cannot withdraw their offer, subject to the period being extended further if necessary by mutual agreement, from time to time. Any contravention of this condition will make the tenderer liable for forfeiture of their earnest money. In the event of tenderer refusing to accept the contract and not turning up after intimation of acceptance of his tender has been given to him, his earnest money shall be forfeited. (7) The tenderer shall not reduce their quoted rates in case the Rly. Administration negotiates for increasing of rates. Such negotiation shall not amount to cancellation or withdrawal of the original offers and the rates originally quoted will be binding on the tenderers. (8) No Railway Passes will be issued to the contractor by the administration.

5 (9) If the tendering party is a partnership firm, an attested copy of the partnership deed must also accompany the tender form. The Railway Administration reserves the rights to call for the original partnership deed for inspection. Tenderer s Signature Contd 2-2- (10) The tendering party must also submit with the tender document any evidence regarding their financial position, provision, experience and ability to execute the contract works. (11) It should be noted if any tender is not accompanied by these documents it is liable to be rejected out rightly. (12) The successful tenderer will have to execute an agreement. He is also liable to pay annual Licence fee to the Railways as quoted in the tender form. The payment of Licence fee will be done on annual basis and to be paid in advance in first quarter of every year of the contract. The cost of stamp duty for the execution of the agreement will be borne by the contractor. (13) The Divl. Railway Manager Reserves right to reject any or all the tenders without assigning any reasons or to accept any of the tenders though may not be necessary the highest. (14) The duration of the contract will be Five years from the date of commencement of the contract. (15) The contractor will charge Rs for the use of Latrine and Rs for the use of bathroom only or both bathroom and latrine. However, no charge shall be levied for urinal, children below 12 years and handicapped person will be free (16) The site of the Lavatory and Bathroom at the station can be seen at any time. 7 NORMAL PAY & USE TOILETS & BATHS: 1 Handing over of site Normal Pay and Use toilets and baths shall be handed over to the service provider for its cleanliness and maintenance. 2 BASIC AMENITIES TO BE ENSURED: a. Urinals. b. Separate toilets for ladies, gents and handicapped persons. c. At least one toilet of European style. d. Adequate number of washbasins with provision of soap solution for hand washing. e. A small bathing unit (Optional). However, no bathing unit on island platform will be permitted. f. Good quality ceramic flooring and dado tiles should be used, preferably of larger size to have fewer joints. g. Should have proper electrical provisions. h. Proper cleaning arrangements should be ensured. i. PVC water storage tank of adequate capacity should be provided. j. Litterbins should be provided. k. The toilet unit is to be operated as a no-smoking zone and proper indication board in this regard should be displayed. l. All water pipes, drainage and waste pipes should be concealed. 3 OPERATION AND MAINTENANCE Provision of litterbins for proper garbage disposal. Adequate no. of safaiwalas to be posted. Employee schedule to be provided. Standard cleaning material and equipments should be used. Ensure proper cleanliness. Ensure safety and security of passengers/ users Routine maintenance including prompt repairs of potholes, cracks, concrete joints, electric fittings, lightings, sanitary fittings and signage. Prevention of any encroachment in/or adjoining the Pay & Use toilet block. It will be the responsibility of the service provider to ensure proper drainage up-to the pitfall and any choking of drainage should be attended to by him promptly. Cleanliness/ hygiene of surroundings of toilets (about 2 meters around) should be ensured by the Service provider. Proper litter/garbage disposal at an authorized garbage dump should be done by the Service provider Cleaning the septic tanks, including safe disposal of their contents and maintenance of sewerage system will be responsibility of the service provider. 8 -2- White washing and painting should also be undertaken as and when required. The staff provided should be literate and courteous towards the users and assist handicapped persons and old aged users. 4 ELECTRICITY AND WATER CHARGES The contractor will be liable to pay for the actual consumption of electric power and water supply. In case flow meter is not provided, the Service provider will have to pay lump sum water charges as decided by the Railways. Connection shall be provided by Railways from the nearest available electric and water point from where Service Provider has to extend connection at his cost. 5 PERIOD The period of Agreement for Normal Pay & Use toilets and Baths will be 05 years. The Service should indemnify the Railways for the damages caused due to non-compliance to any statutory law, bye-law or service conditions 6 LUMP SUM LICENSE FEE The service provider shall pay annual license fee to the Railways as quoted in the financial bid. Reserve price, however, will be fixed by Railways depending upon various parameters, like category of station, location, amenities provided etc. The payment of license fees will be done on annual basis and to be paid in advance in first quarter of every year of the contract. a. SERVICE CHARGE Service Provider can charge the users/ Rs. 2/- for using latrine and Rs. 5/- for using bathroom only or both bathroom and latrine. However, no charge shall be levied for urinals the rates can be reviewed once in three years on mutually agreed terms. The rate list should be displayed at noticeable locations/ entry points to the toilets. Clear sign boards showing that the urinals are free should be displayed. The Service provider should issue a receipt to the user/ passenger for the service provided. 7 TAX LIABILITY The service provider shall be responsible for all the taxes to be paid to the civic agencies for the service rendered by him. There will be no tax liability upon the Railways whatsoever on any account Contd 3.

9 -3-8 TERMINATION OF CONTRACT The Railway can terminate the contract in case of continued non compliance of service conditions by the Service provider with one month s notice. The assets will then be transferred to Railways at the Depreciated Replacement Value, which will be determined by the Railways. The Railways will be free to lease the assets on further contract. 9 PUNITIVE CLAUSE Railways can impose a fine on the service provider if the desired level of cleanliness is not maintained and for lack of proper upkeep, facilities, etc. Fine upto Rs.500/- at a time for unsatisfactory cleanliness and upto Rs.1000/- at a time for lack of proper upkeep, facilities may be imposed. However, in no case the fine should be more than Rs.2000/- at a time. 10 OMPLAINTS & SUGGESTIONS While the service provider is responsible for ensuring a complaint free service, they should also maintain a complaint and suggestion register at the toilet, which should be made available to the users/ passenger. A notice to this effect may be displayed at the entry points to the toilets 11 LOSS AND THEFT OF PROPERTY The Service Provider shall be solely responsible for the upkeep of all the assets created and any loss and damage there of shall be made good by him immediately at his own cost to continue to keep the complex operational and available for use. The Service Provider will be responsible for any loss/ theft of passenger s property kept in the cloak rook of the deluxe toilet. Divl. Railway Manager (Commercial) North Western Railway, Bikaner. 10 TERMS AND CONDITIONS 1. Railway shall provide land (Normal Pay & Use Toilets & baths) to the Service Provider suitable to the latter s requirement in terms of size, location and workability etc. depending upon availability. The title of the land will be with the Railway. 2. The service provider shall ensure that the premises are not used for any purpose other than that for which it is allowed under the Agreement. The premises should not be used for playing games, cards etc., which involves stakes/betting etc. 3. Both the parties shall be at liberty to cancel the agreement at any stage after giving three months notice from either side, if they find that the project/arrangement is not workable according to their aims and objectives. The assets created by the Service Provider shall stand transferred to the Railways in such eventualities. 4. Railway shall have the right to cancel/revoke/ terminate the agreement at any stage in case of breach of any of the stipulated terms and conditions by the Service Provider or if their performance is not found satisfactory. 5. The sites and the works assigned to the Service Provider by the Railways shall not be transferred by the former to any person, Trust, Society or Institution in any manner whatsoever at anytime, whether during or after the termination of the agreement. 6. The Service Provider shall not use or allow any person to use such toilets for residential purpose. 7. Tenderer have to submit documents regarding Financial status, Capability to execute work duly attested by Notary or CA, Past Experience of similar nature of work, duly attested from any gazetted officer or notary and Character certificate, Residential Proof duly verified by the local police authority.
