1 May 5, 2017 Dear Performer Applicant: Thank you for your interest in performing at Bridge Street Town Centre. We welcome local performers to showcase their talent at the Centre. Performers are scheduled to perform after a brief approval and orientation process. Performers must be pre-screened, approved and scheduled. Please read through the process below. Although performers at Bridge Street Town Centre are unpaid, performers are eligible to be hired for special events such as Christmas, Fourth of July and other holidays and special promotions throughout the year. Performers are allowed to receive tips and sell CD s during their performances as outlined in the performance guidelines. 1. Read and sign the Application to include the Performer Profile; Release, Indemnification and Hold-Harmless agreement; Consent form; and Performance guidelines. 2. Submit a sample of the work or art to be performed. The work submitted may include CD demo, photo of set-up, website link, or link to a YouTube video. 3. If approved, be prepared to turn in the signed paperwork prior to the first performance date or you will not be allowed to perform. 2 Guidelines Performing artists are recognized as significant contributors to the atmosphere of the Bridge Street Town Centre. Performers must be approved by the Marketing Department and scheduled prior to their performance. Day of Performance: Check-in with Guest Services no less than 15 minutes before your performance time. Call Guest Services at (256) if you are going to be late or miss your performance. Attendance: Being tardy on two occasions or one absence without 24-hour notice may result in probation of up to 3 months. It is possible to be waitlisted or placed on probationary period based on merchant and patron feedback including loss of performance privileges at Bridge Street Town Centre (BSTC), which BSTC reserves the right to do at any time. Signage: All signage displaying the name of the act must be professionally made or computer generated. They cannot be handwritten. Performers may display signs indicating that recordings are available. These signs must be professionally made or computer generated, may not exceed 12 x 24 and must be displayed with the recordings in an instrument case or other receptacle provided for that purpose by the performer. Merchandise and Tips: Donations for performances may be accepted passively in an instrument case or other receptacle provided for that purpose by the performer. The receptacle may include a professionally made or computer generated sign, which informs the public that such donations are sought. No performer shall actively solicit donations by word of mouth, gesture, mechanical devices or second parties. Performers must be in the act of performing at a designated performer spot while recordings are displayed. Performers are prohibited from displaying or selling recordings of any other artist. Performances are presented at the performer s own risk. Bridge Street Town Centre is not responsible for damage, loss, or theft of equipment, recordings or money collected. Performers must report their tips to Guest Services at end of each performance. Etiquette: Performers shall immediately comply with requests of the Marketing Department and any entity representing Bridge Street Town Centre including Manager on Duty and Security. Performers must remain in the designated performance zone unless told otherwise. Roaming performers such as magicians and artists may not perform in locations that hinder entrance to businesses. Performances must be appropriate for all ages. May be required to perform in 20-minute intervals to allow center guests to disburse for shopping and dining. All performers may take breaks as needed during Centre hours within reason for sets lasting longer than one hour. No performer shall treat any person in a manner that is rough, menacing, vulgar, profane or abusive. Drinking of alcoholic beverages or performing while intoxicated or under the influence of controlled substances is prohibited. Performers are responsible for moderating the volume of their performance to a level appropriate to the surroundings. Performers are responsible for respecting reasonable requests of nearby vendors regarding performance volume and crowd control. Performers are responsible for ensuring that their audience does not block customer traffic, access to retailer entrances or cause a safety hazard.
3 Performers are responsible for respecting spaces provided for performance by keeping them free from unnecessary debris and visual clutter. Unauthorized Activities: Fire is not allowed in Bridge Street Town Centre. That includes, but is not limited to: ground fires, juggling, and fire dancing. Juggling knives, swords, sharp sticks or other objects deemed dangerous are strictly prohibited. All dangerous activity will be stopped. Failure to comply will result in a call to the Huntsville Police Department and removal from the grounds. Attaching any equipment, fliers or other material to trees, shrubs or other landscaping or lampposts is strictly prohibited. Age restrictions: Any performer under the age of 18 must be accompanied by a parent, legal guardian or chaperone during performance. Chaperones include instructors or teachers. 4 CONSENT TO RELEASE FOR STORY, LIKENESS AND VOICE I hereby give permission to IMI Huntsville LLC, Bayer Properties, L.L.C. and its entities (collectively referred to as the organization) to use (including but not limited to taking photographs and audio recordings or videos), without charge and without reservation, all or a portion of my story including my likeness and my voice in promoting these Organizations. I acknowledge that editorial changes may be made as deemed suitable by the organizations. Whether or not these changes are made, I waive any rights of action I have and release the Organizations from any and all claims I have arising from the use, publication and changes in content, including any rights to sue for defamation or violation of rights of privacy of rights of publicity. 5 RELEASE, INDEMNIFICATION AND HOLD HARMLESS AGREEMENT To the maximum extent permitted by law, the undersigned (the Releasing Party ), hereby agrees to release, indemnify, defend and hold harmless Bayer Properties, L.L.C., IMI Huntsville, LLC and their affiliates, and each of their respective owners, officers, managers, members, directors, trustees, employees, shareholders and agents (hereinafter collectively referred to as the Released Parties ) from and against any and all liabilities, claims, losses, damages and expenses, including, but not limited to, attorneys fees, arising out of, or connected with the Releasing Party s acts or omissions, the Releasing Party s use and occupancy of or any participation in events at the development commonly known as Bridge Street Town Centre (the Property ), including, but not limited to, event preparation and set up and take down. The Releasing Party acknowledges and agrees that the Releasing Party has been granted no right to occupy or use any portion of the Property and will immediately leave the Property, upon the request by any representative of Bayer Properties, L.L.C. In addition to the foregoing, to the maximum extent permitted by law, the Releasing Party hereby releases the Released Parties from and against any claim, damage, action, penalty, liability or judgment arising out of any loss, theft, burglary, robbery, damage, fire or other loss caused by casualty, or any other reason, to any of the Releasing Party s possessions or personal property of any kind, including without limitation, equipment, instruments, supplies, prizes, merchandise or exhibits, which are located in the Shopping Center.
