6 CITY OF ORILLIA TO: Council August 14, 2014 FROM: DATE: August 14, 2014 SUBJECT: Department of Development Services ADDENDUM TO Supplementary Report to Planning Report DS Application for a Zoning By-law Amendment Applicant: Jennark Homes (the proponent ) Owner: Plan 1203 Orillia Holdings Inc. Plan 1203, Lots 68, 69, 70, 71, 100, 101, 102, 103, and 104, and Plan 1203, Grants Cove (hereinafter 1038 Mississaga Street West ) FILE NO.: D On August 13 th, 2014, representatives from the proponent (including their environmental consultant) met with City staff and the City s peer review consultant (R.J. Burnside & Associates Limited, R.J. Burnside ). The purpose of that meeting was to discuss the letter from R.J. Burnside dated July 30, 2014, and the corresponding recommendation made by City staff in the Supplementary Report to Planning Report DS-14-10, dated August 6, That meeting concluded with representatives from the proponent, R.J. Burnside, and City staff reaching agreement that the outstanding issues regarding the impacts of the development of 1038 Mississaga Street West (as conceptually proposed by the above captioned application) could be addressed as an integral part of the Site Plan Approval process, which would be required prior to its future development (per Chapter 363 of the City of Orillia Municipal Code). In that regard, R.J. Burnside has provided the City with an additional Technical Memorandum, dated August 13, 2014 (see Schedule A ), that identifies Potential Effects and Recommended Mitigation measures in the proposed development. Accordingly, staff recommends that Council approve Zoning By-law Amendment Application No. D as outlined in Option 2 to the Supplementary Report dated August 6, City staff will ensure that provisions to the effect of the Recommended Mitigation measures are incorporated into a Site Plan Agreement for the future development of the subject properties. 12 Schedule C Zoning By-law Amendment from , as amended (page 1 of 2) BY-LAW NUMBER OF THE CITY OF ORILLIA AMENDMENT NUMBER 144 TO BY-LAW NUMBER , THE ZONING BY-LAW FOR THE CITY OF ORILLIA (PLAN 1203 ORILLIA HOLDINGS INC MISSISSAGA STREET WEST) WHEREAS the Council of The Corporation of the City of Orillia may pass by-laws pursuant to Section 34 of the Planning Act, R.S.O. 1990, as amended; AND WHEREAS the Council of The Corporation of the City of Orillia has received an application to amend the zoning of the lands legally described as Plan 1203, Lots 68, 69, 70, 71, 100, 101, 102, 103, and 104, and Plan 1203, Grants Cove; AND WHEREAS the Council of The Corporation of the City of Orillia deems the said application to be in conformity with the Official Plan of the City of Orillia, as amended, and deems it advisable to amend By-law Number , as amended. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF ORILLIA HEREBY ENACTS AS FOLLOWS: 1. THAT Schedule A to By-law Number , as amended, is hereby further amended by rezoning the lands identified on Schedule A-1 attached from the Second Density Multiple Residential Exception Sixteen (Holding) (RM2-16(H)) Zone and the Environmental Protection Exception Two (EP-2) Zone to the Second Density Residential Exception Twenty Three (R2-23) Zone. 2. THAT the following section is hereby added to Section 10.3 Second Density Residential Exception Zones of By-law Number , as amended: SECOND DENSITY RESIDENTIAL EXCEPTION TWENTY THREE (R2-23) ZONE Notwithstanding Sections and , the lands denoted by the R2-23 symbol on the date of approval of Amendment Number 144 to this by-law shall have: a) A minimum Lot Frontage of 11.3 metres, and b) A minimum Lot Area of sq. m. 3.
